Who’S In And Who’S Out? Can India’S Answer Help Us Determine Who Qualifies For Affirmative Action? , Sean A. Pager Mar 2006

Who’S In And Who’S Out? Can India’S Answer Help Us Determine Who Qualifies For Affirmative Action? , Sean A. Pager

ExpressO

Who should be the beneficiaries of racially targeted affirmative action? In its Croson decision, the Supreme Court answered part of the “Who Question” when it conditioned affirmative action eligibility on underrepresentation. What the Court did not tell us was underrepresentation of whom? The Court thus instructs us to select beneficiary groups by counting heads, but leaves open which heads get counted where and what categories to use.

By artificially separating what are necessarily related inquiries, the Court left a definitional lacuna that lower courts have struggled to fill. Such definitional issues matter because they often determine who benefits from affirmative …

Paid Family Leave In American Law Schools: Findings And Open Questions, Laura T. Kessler Mar 2006

Paid Family Leave In American Law Schools: Findings And Open Questions, Laura T. Kessler

ExpressO

There exists a substantial literature on the status of women in the legal profession, including studies on women students’ experiences in law schools, gender bias on law school faculties, and family leave policies and practices among legal employers. However, no recent study examines the family leave policies and practices in American law schools. This study seeks to fill that gap. Its findings are threefold. First, almost three quarters of law schools provide wage replacement during a family leave that is more generous than required by federal law. Second, there is a positive relationship between teaching at top-tier and private law …

Commodification And Contract Formation: Placing The Consideration Doctrine On Stronger Foundations, David S. Gamage Mar 2006

Commodification And Contract Formation: Placing The Consideration Doctrine On Stronger Foundations, David S. Gamage

ExpressO

Under the traditional consideration doctrine, a promise is only legally enforceable if it is made in exchange for something of value. This doctrine lies at the heart of contract law, yet it lacks a sound theoretical justification – a fact that has confounded generations of scholars and created a mess of case law.

This paper argues that the failure of traditional justifications for the doctrine comes from two mistaken assumptions. First, previous scholars have assumed that anyone can back a promise with nominal consideration if they wish to do so. We show how social norms against commodification limit the availability …

Digital Storytelling: The Application Of Vichian Theory, Karen Pierotti Mar 2006

Digital Storytelling: The Application Of Vichian Theory, Karen Pierotti

Theses and Dissertations

Storytelling is often looked at as something archaic or something that simpler cultures engage in. However, in our sophisticated and highly technological world storytelling swirls about us though we may not always recognize it. This thesis looks at the phenomenon of digital storytelling that functions to create community on the Internet. In order to ground this phenomenon in theory, I examine the works of Giambattista Vico, the 18th-century Neapolitan philosopher/rhetorician, who lived on the cusp of the Renaissance and the Age of Enlightenment. Furthermore, as a teacher of rhetoric to youth, Vico admonished young people to study the arts of …

The Pocahontas Exception: American Indians And Exceptionalism In Virginia’S Racial Integrity Act Of 1924, Kevin Noble Maillard Mar 2006

The Pocahontas Exception: American Indians And Exceptionalism In Virginia’S Racial Integrity Act Of 1924, Kevin Noble Maillard

ExpressO

Most scholarship on Loving v. Virginia (1967) briefly mentions the “Pocahontas Exception,” a subsection of Virginia’s Racial Integrity Act of 1924 which counted persons of limited American Indian ancestry as white. However, few of these works raise the issue outside of a footnote. This article addresses the treatment of Native American ancestry as a curious exception to the threat of racial impurity. Virginia’s antimiscegenation statute sought to eradicate stealth intrusions of tainted blood into the white race, which proponents believed to be threatened “by the quagmire of mongrelization.” Exempted from this racial policing regime were those influential whites, the “First …

When 2 Or 3 Come Together, Tracey L. Meares Mar 2006

When 2 Or 3 Come Together, Tracey L. Meares

ExpressO

This article investigates policies that are responsive to crime in disadvantaged, urban neighborhoods from a community-based context. The vehicle is an analysis of a community-wide prayer vigil held in Chicago in May of 1997. The vigil resulted from a collaboration between the Chicago Police Department and hundreds of (mostly) African-American churches on Chicago’s West Side. Strikingly, the local police district’s commander facilitated the vigil. We explain the sociological and political significance of this collaboration by drawing upon the “Chicago School” of urban sociology and demonstrating theoretically and empirically the potential for the collaboration, through the integration of key community institutions, …

A Norms Approach To Jury "Nullification", Joseph Sanders Mar 2006

A Norms Approach To Jury "Nullification", Joseph Sanders

ExpressO

The paper synthesizes economic and sociological approaches to norms to explain the circumstance under which juries are most likely to substitute their own rules and criteria for that of the law when deciding a case. It concludes that this type of “nullification” is most likely to occur when substantive societal value norms embedded in scripts are contrary to legal rules.

Summer Programming: What Do Children Say?, Nila Cobb, Stacey Harper, Kerri Mccormick, Kimary Mcneil Mar 2006

Summer Programming: What Do Children Say?, Nila Cobb, Stacey Harper, Kerri Mccormick, Kimary Mcneil

Journal of Youth Development

Studies document that low-income children lose academic skills over the summer. Six years of reading achievement data collected by Energy Express, a nationally recognized summer reading and nutrition program in West Virginia, has established the efficacy of the intervention. The purpose of this study was to examine characteristics of a voluntary summer program that foster participation. Interview data indicates that children attend because they perceive the program as fun; large creative art (for example, full-body portraits, appliance box castles, wall murals) seems particularly important. Energy Express gives children both the fun they want and the enrichment they need in the …
