The Color Of Sexual Harassment And The Public/Private Divide, Janeille Zorina Matthews

UC Law Journal of Race and Economic Justice

This article argues that the conception of sexual harassment as simply a gendered harm is inadequate because sexual harassment is not only about gender but also about race, class, sexual orientation and other realities of existence. Sexual harassment is about power and about keeping particular women out of particular economic spheres. Using the Commonwealth Caribbean as an example, this article concludes that an intersectional understanding of sexual harassment, and a more nuanced understanding of the public/private divide, will lead to better workplace harassment legislation. Historical Perspective On Performance Budgeting: Performance Budgeting In The United States Before 1960, Dan Williams

With the assistance of A. E. Buck, Herbert Hoover coined the term Performance Budget in 1949 to rebrand cost data budgeting. Cost data budgeting originated in 1912 in Richmond County (Staten Island), New York. It is strongly associated with the National Commission on Municipal Standards and the Committee on Uniform Street Sanitation Records, which are both direct derivatives of Clarence Ridley’s original work in making sense of performance measurement under the title Means of Measuring Municipal Government, his 1927 dissertation at Syracuse University. Ridley subsequently led the International City Managers Association for nearly 30 years. He teamed with A. E. …

Creating A Tribal Law Practice Clinic In Kansas: Carving The Peg To Fit The Hole, Aliza Organick

This article will focus on three main challenges in creating a tribal court practice clinic. The first part will address creating a tribal court focus within an existing clinic curriculum. The second part will address the process of designing a curriculum for the TCPC that includes incorporating the basic doctrinal foundations of federal Indian law, as well as the clinical skills necessary to practice in a tribal court setting. The third part will offer some concluding thoughts on my long-term plans and dreams for TCPC.

At the beginning of the 21st century, the face of fatherhood is a dynamic and complex reality. The aim of this study was to explore father's perceptions regarding their own experiences during the transition to fatherhood. More specifically, this study aimed at exploring the adjustment to fatherhood and the resources and support systems that the fathers utilised in managing their adjustment to fatherhood. A qualitative research design, specifically an approach based on grounded theory was employed. Panel Unit Root Tests And Spatial Dependence, Badi H. Baltagi, Georges Bresson, Alain Pirotte

This paper studies the performance of panel unit root tests when spatial effects are present that account for cross-section correlation. Monte Carlo simulations show that there can be considerable size distortions in panel unit root tests when the true specification exhibits spatial error correlation. These tests are applied to a panel data set on net real income from the 1000 largest French communes observed over the period 1985-1998.

Section I of this Note details the history of the juvenile justice system, making specific reference to the various developments in juvenile justice policy, concluding with a discussion of the conflicts involved in juvenile offending. Section II examines ADR techniques that have been used in the juvenile justice field, with some success, as an alternative to further prosecution, incarceration or other punishment, highlighting Victim-Offender Mediation and Family Group Conferencing. Altruism is loosely defined as a desire to help others as well as acts and behaviors towards that end, particularly when no expectation of personal gain or reward exists (Batson, Fultz, Schoenrade & Paduano, 1987). It seems likely that individuals who choose to pursue acareer in counseling might be doing so out of some altruistic interest; in other words a desire to come to the aid of others in distress. Recently, the Boston College Law Review published a symposium issue containing twelve articles on federal income taxation issues pertaining to rates, progressivity, and budget processes. These articles are well written, copiously researched, and representative of contemporary legal scholarship. For the most part, these articles variously support the idea that our federal taxation system is insufficiently progressive. Often this body of work attributes deleterious social effects to insufficient progressivity caused by tax cuts legislated in 2001 and 2003. From the time when Congress passed and the President enacted the Trafficking Victims Protection Act of 2000 ("TVPA"), this innovative law has changed the contours of the U.S. legal landscape.I Given even more teeth by the subsequent passage of the Trafficking Victims Protection Reauthorization Act of 2003 ("TVPRA"), the law provides unprecedented tools for U.S. governmental agencies and non-governmental organizations ("NGOs") to combat trafficking in persons, both within the U.S. and abroad. One strand of home visiting research investigates effi cacy while another investigates under what conditions programs achieve outcomes. The current study follows the latter approach. Using a within-program design in a sample of 11 home-based sites in the Early Head Start Research and Evaluation study, this study found that three components of home visits (quantity of involvement including number of home visits, duration in the program, length of visits and intensity of service; quality of engagement including global ratings of engagement by staff and ratings of engagement during each home visit; and the extent to which home visits were child …

When thinking of law-making, one usually thinks of the activities of Congress or state legislatures. Students of law and government may also think of the rule-making activities of federal or state bureaucracies. More recently, some attention has been paid to the lawmaking power known as prosecutorial discretion (the decision of whether or for what crimes to charge a criminal defendant) or judicial discretion in sentencing. Combining education and fieldwork, I created this multifaceted Capstone Project. I have included a legislative review of ILP and CWS. I conducted surveys of ILP youth and focus groups of social workers in three units of Monterey County DSES. I developed an analysis of the data gathered. With the research gathered primarily and secondarily, I created an ILP Tracking Database for following the outcomes of youth after foster care. These experiences and research also lead to recommendations for keeping up the tracking database and improving ILP training for foster youth.
