Visibly Shackled: The Supreme Court's Failure To Distinguish Between Convicted And Accused At Sentencing For Capital Crimes, David R. Wallis Apr 2006

Visibly Shackled: The Supreme Court's Failure To Distinguish Between Convicted And Accused At Sentencing For Capital Crimes, David R. Wallis

Missouri Law Review

American courts have long held that the practice of placing a criminal defendant in visible shackles during the guilt phase of trial is inherently prejudicial and have required courts to state with particularity the reason for doing so. However, no bright-line rule establishes the proper procedure or the degree of discretion given to the trial courts when making their determination. As a result, disparity has developed among the courts as to when and under what circumstances a criminal defendant may be shackled. Even greater confusion arises when courts consider the issue of shackling a convicted defendant during sentencing. For instance, …

Designs For Immunity: A Comparison Of The Criminal Prosecution Of United States Presidents & Italian Prime Ministers, Brianne Biggiani Apr 2006

Designs For Immunity: A Comparison Of The Criminal Prosecution Of United States Presidents & Italian Prime Ministers, Brianne Biggiani

Cardozo Journal of International and Comparative Law

The note examines the differing approaches of the United States and Italy in granting criminal prosecution immunity to their leaders, emphasizing the role of institutional strength and historical context. It argues that while the U.S. policy of temporary presidential immunity is justifiable due to its robust checks and balances, Italy's weaker governance structure and history of corruption make similar immunity measures inappropriate. The analysis highlights the importance of tailoring legal frameworks to a nation's specific political and cultural conditions.

Implementing Community Policing Successfully: An Analysis Of The Degree Of Police Engagement With The Philosophy And Practice Of Community Policing, Robert G. Muladore

Dissertations

The police community in the United States began to adopt the philosophy of community policing in the early 1970s as a solution to rising crime rates. Since that time a great many police departments have officially stated that they have embraced and practice this concept. When later studies began to question theeffectiveness of community policing in reducing crime rates, measures such as reduction of citizens' fear of crime and citizen's attitudes toward policebecame the secondary measures of success of this philosophy. Few comprehensive studies have specifically looked at the degree of congruence betweenpolice agency adoption of the community policing philosophy …

Localization In Wireless Sensor Networks, Mark Terwilliger Apr 2006

Localization In Wireless Sensor Networks, Mark Terwilliger

Dissertations

With the proliferation of wireless sensor networks, providing location-aware technology and services to new applications have become important for developers. Localization is the problem of determining the positions of nodes in an ad hoc network. With the constrained resources of network sensors, providing robust localization services remains a fundamental research challenge facing the entire sensor network development community.

The initial localization problem that we addressed was to design and develop a working system that could locate equipment, such as a laptop or video projector. Ferret, the localization system developed, uses two different ranging techniques to help locate an object to …

Bioterrorism: Cases When Public Health Agencies Should Have Sweeping Powers, Judith Watkins Apr 2006

Bioterrorism: Cases When Public Health Agencies Should Have Sweeping Powers, Judith Watkins

Internet Journal of Allied Health Sciences and Practice

The dispersal of anthrax spores in October 2001 showed Americans that they are vulnerable to bioterrorism. The ineffective response to bioterrorism demonstrates that public health agencies do not have plans or training exercises in place to deal with this emerging threat. Although the CDC asked that the Model State Emergency Health Powers Act (MSEHPA or Model Act) be drafted to prepare the states for these emerging risks, critics like George Annas assert that the acts are “blatantly unconstitutional” (MSEHPA,2005,p.1). In this paper, I intend to explore the conflict between individual rights and sweeping powers of public health agencies as described …

A Study On Perceptions Of Civil Engineers Regarding Mandatory Continuing Education, Alee A. Sleymann Apr 2006

A Study On Perceptions Of Civil Engineers Regarding Mandatory Continuing Education, Alee A. Sleymann

Dissertations

This study explored the perceptions of civil engineers regarding continuing professional competency requirements for license renewal. In this study, continuing professional competency is assumed to have a direct relationship to public welfare and safety. The policy of mandatory continuing education was adopted primarily for this reason. Currently, mandatory continuing education is adopted by 29 states as the method of assuring continued professional competency.

Many professionals, however, have not welcomed this mandatory continuing education (MCE) policy. The reason for this opposition is the claimed ineffectiveness of this policy in fostering continued competency. In addition, the regulatory boards and policy advocates have not …

Service With Friends: The Influence Of Peer Interactions And Emotions In Community Service Experiences, Jennifer Jill Kidd Apr 2006

Service With Friends: The Influence Of Peer Interactions And Emotions In Community Service Experiences, Jennifer Jill Kidd

Theses and Dissertations in Urban Services - Urban Education

Community service has increasingly become part of students' educational experience. It is seen both as a stand alone requirement and as a core component integrated into course objectives. Much has been learned about the effects of community service on students, but there remain unanswered questions. This study compares four structures of mandatory community service differing in the amount of peer and faculty interaction. It also examines the influence of students' emotional reactions to community service experiences. The participants for the study are college freshmen enrolled in a required environmental course. Hierarchical regressions are utilized to explore the influences of community …

Minimum Contacts In A Borderless World: Voice Over Internet Protocol And The Coming Implosion Of Personal Jurisdiction Theory, Danielle K. Citron Apr 2006

Minimum Contacts In A Borderless World: Voice Over Internet Protocol And The Coming Implosion Of Personal Jurisdiction Theory, Danielle K. Citron

Faculty Scholarship

Modern personal jurisdiction theory rests on the twin pillars of state sovereignty and due process. A nonresident's "minimum contacts" with a forum state are treated as the equivalent of her territorial presence in the state and hence justify a state's exercise of sovereignty over her. At the same time, the nonresident's "purposeful availment" of opportunities within the state is seen as implying her agreement to that state's jurisdiction in exchange for the protection of its laws. This theory presumes that a nonresident directs voice communications to known places by dialing a telephone number's area code.

Voice over Internet Protocol ("VoIP") …

Patient Safety Law: From Silos To Systems, Jocelyn Downie, William Lahey Prof., Don Ford, Elaine Gibson, Mary Thomson, Tom Ward, Fiona Mcdonald, Alison Shea

Reports & Public Policy Documents

Patient safety has become a significant and pressing policy issue. Around the world, governments, the health care sector and the public are increasingly cognizant of the need to improve the safety of care delivered by their health systems. Pressure for change has been created by highly publicized incidents in a number of countries involving unsafe acts that were significant both in scale and consequence and a number of empirical studies that revealed the high rates of unsafe acts and their consequences. The costs of unsafe health care – both personal and fiscal – to individuals, their families and their communities …

Kav Laoved Worker’S Hotline V. Government Of Israel, Edmond E. Levy, Mishael Cheshin, Aharon Barak Mar 2006

Kav Laoved Worker’S Hotline V. Government Of Israel, Edmond E. Levy, Mishael Cheshin, Aharon Barak

Translated Opinions

Facts: The government of Israel adopted a policy of allowing foreign workers to come to work in Israel. The residence permits given to the foreign workers are conditional upon the foreign workers working for a specific employer (‘the restrictive employment arrangement’). Consequently, if the worker leaves his employer, he automatically becomes an illegal alien, and is liable to be arrested and deported. The petitioners attacked this policy, on the grounds that it violates the dignity and liberty of the foreign workers. It also undermines the bargaining power of the foreign workers in the employment market. The respondents replied that the …

Development Of A Gis Based Infrastructure Replacement Prioritization System; A Case Study, Brian D. Pickard Mar 2006

Development Of A Gis Based Infrastructure Replacement Prioritization System; A Case Study, Brian D. Pickard

USF Tampa Graduate Theses and Dissertations

Maintenance, repair, and replacement of transmission mains and distribution system piping is expected to cost approximately $75 billion over the next two decades to ensure that public water systems are capable of providing the United States with safe drinking water. However, there is a significant gap between the funds available and the projected costs of infrastructure replacement or rehabilitation. Infrastructure Management Systems (IMS) have been developed to assist utilities and decision-makers in determining how to allocate resources for infrastructure. This project utilizes theTampa Water Department (TWD) as a case study to develop a tool for prioritizing infrastructure replacement.

TWD is …
