He Said-She Said: On Credibility And The New Reason, Nancy Rourke
He Said-She Said: On Credibility And The New Reason, Nancy Rourke
ExpressO
The traditional wisdom in the field of evidence holds that, if there is a direct contradiction in the testimony of two witnesses, one of them must be lying. The jury is to discover which version is more credible. The traditional wisdom is wrong. This article uses an actual criminal case to establish that a direct contradiction in testimony can arise from another source - a fundamental difference of conceptual frame. In this case, both witnesses were telling the truth as they knew it, but were talking past one another. Words that were 100% true in the victim's conceptual frame were …

Post-Charley Evaluation Of Undamaged Homes In Punta Gorda Isles, Virgilet Pierrissaint
Post-Charley Evaluation Of Undamaged Homes In Punta Gorda Isles, Virgilet Pierrissaint
USF Tampa Graduate Theses and Dissertations
Hurricane Charley was the third named storm and the second major hurricane of the 2004 Atlantic hurricane season. At that time, it was also the strongest hurricane to strike the US coast since 1992. Charley made landfall on Friday, August 13, 2004 on the barrier islands off Lee County, Florida whence it moved rapidly inland towards Port Charlotte, DeSoto and Hardee counties.
The purpose of this study was to understand the performance of undamaged residential home in Punta Gorda Isles (PGI) in Port Charlotte County that was crossed by Charley’s eye shortly after it made landfall. To achieve this goal, …

Halos, Billboards, And The Taxation Of Charitable Sponsorships, Ethan G. Stone
Halos, Billboards, And The Taxation Of Charitable Sponsorships, Ethan G. Stone
ExpressO
This article reexamines the controversy in the 1990s over the tax treatment of revenues charities earn by selling sponsor acknowledgements. The controversy erupted when the IRS tried to tax Mobil Cotton Bowl and John Hancock Bowl on their sponsorship revenues, claiming that it represented payment for advertising. It ended when Congress amended to tax code to grant sponsorship revenues an effective exemption from tax. Traditionally, this has been understood as a simple and sordid story of raw lobbying power supplanting good tax policy. I argue that the controversy reflects the overriding importance of political symbolism in understanding the charitable tax …

Smith V. City Of Jackson: Age Discrimination Act Authorizes Disparate Impact Claims – But Scope Is Narrow, William B. Holladay
Smith V. City Of Jackson: Age Discrimination Act Authorizes Disparate Impact Claims – But Scope Is Narrow, William B. Holladay
Duke Journal of Constitutional Law & Public Policy Sidebar
When Jackson, Mississippi revised its salary structure for police and public safety officers, it gave proportionately higher increases to officers with less than five years of seniority, who were overwhelmingly under forty years old. Thirty officers over the age of forty sued the city for age discrimination, alleging disparate impact. In a plurality opinion, the Court held that the Age Discrimination in Employment Act authorized claims of disparate impact. When it accepted the employer’s justification for the raise and dismissed the plaintiffs’ claim, however, the Court signaled that in the future, the scope of disparate impact claims would be narrow.

Internalizing European Court Of Human Rights Interpretations: Russia's Courts Of General Jurisdiction And New Directions In Civil Defamation Law, Peter F. Krug
ExpressO
The manuscript examines the steps that Russia's courts of general jurisdiction have taken since 2002 to fashion major changes in Russia's civil defamation law. The critical element in this process has been the courts' internalization of the practice of the European Court of Human Rights in interpreting the freedom of expression provisions in Article 10 of the European Convention on Human Rights, to which Russia acceded in 1998. The internalization movement in the Russian courts began in 2002 in isolated lower court decisions, and culminated in a generally-applicable Decree of the Russian Federation Supreme Court in 2005. The manuscript examines …

Changing Expectations Of Privacy And The Fourth Amendment, Robert Power
Changing Expectations Of Privacy And The Fourth Amendment, Robert Power
ExpressO
Public attitudes about privacy are central to the development of fourth amendment doctrine in two respects. These are the two “reasonableness” requirements, which define the scope of the fourth amendment (it protects only “reasonable” expectations of privacy), and provide the key to determining compliance with its commands (it prohibits “unreasonable” searches and seizures). Both requirements are interpreted in substantial part through evaluation of societal norms about acceptable levels of privacy from governmental intrusions. Caselaw, poll data, newspaper articles, internet sites, and other vehicles for gauging public attitudes after the September 11 attacks indicate that public concerns about terrorism and the …
When All Else Fails: Regulating Risky Products Through Tort Litigation, Wendy E. Wagner
When All Else Fails: Regulating Risky Products Through Tort Litigation, Wendy E. Wagner
ExpressO
It is the prevailing wisdom among both the legal academy and the general public that the regulatory system is better able to ensure the safety of risky products than the tort system. In this article I argue that this is not always the case. Contrary to sharp criticisms of “regulation by litigation” propounded by leading academics such as Richard Epstein, Richard Reich, and Peter Shuck, tort litigation is sometimes the only way to encourage product safety, at least in settings where manufacturers conceal key information needed to evaluate product safety. Without this litigation, we might still be using products that …
