Privacy And Access To Public Records In The Information Age, Sol Bermann May 2006

Privacy And Access To Public Records In The Information Age, Sol Bermann

ExpressO

Online public record access brings a wealth of benefits ranging from greater government access and accountability to increased cost-savings and efficiencies. However, due to the presence of highly sensitive, personal data, an increase in public records access also brings potential dangers, including heightened risk of identity theft and frivolous snooping into the affairs of others.

Historically, public records have had some measure of public accessibility in order to empower citizens with the ability to observe the goings-on of government, leading to greater government accountability. Until the rise of the internet, citizens have had their privacy protected through practical obscurity (the …

Physical Abilities Testing: A Review Of Court Cases, 1992-2006, Paula Starling

Masters Theses & Specialist Projects

Selection procedures are designed with the goal to select the most qualified applicant for the job. A variety of selection tests are used in organizations today, including physical ability tests, which are often used in police agencies and fire departments. A total of 22 physical ability testing cases at the Appellate and Supreme Court level were identified to be included as part of a review to examine the outcome of litigation. Of the 22 cases, only 6 cases involved a female plaintiff, while 1 involved a Hispanic plaintiff. There were five race-based claims and nine gender-based claims (three of the …

Harry Potter And The Half-Crazed Bureaucracy, Benjamin H. Barton May 2006

Harry Potter And The Half-Crazed Bureaucracy, Benjamin H. Barton

Scholarly Works

This Essay examines what the Harry Potter series (and particularly the most recent book, The Half-Blood Prince) tells us about government and bureaucracy. There are two short answers. The first is that Rowling presents a government (The Ministry of Magic) that is 100% bureaucracy. There is no discernable executive or legislative branch, and no elections. There is a modified judicial function, but it appears to be completely dominated by the bureaucracy, and certainly does not serve as an independent check on governmental excess.

Second, government is controlled by and for the benefit of the self-interested bureaucrat. The most cold-blooded public …

Passenger Dies When Semi-Truck Trailer Hits Cow In Roadway, Kentucky Injury Prevention And Research Center

Fatality Case Reports--Motor Vehicle

On November 8, 2005, a 26-year-old male laborer who was a passenger in a semi-truck died when the driver swerved to avoid hitting a cow that was standing in the parkway lane. The two employees had been traveling westbound for approximately one hour when the driver noticed a cow in his lane. He swerved to avoid hitting the cow but hit it anyway. The tractor and two trailers jack-knifed, traveled through the median with the cab and trailers flipped onto their right sides, slid across the eastbound lanes, then the cab slammed through the guardrail. Privatizing Transportation Through Public-Private Partnerships: Definitions, Models, And Issues, Juita-Elena Wie Yusuf, Candice Y. Wallace, Merl Hackbart

Kentucky Transportation Center Research Report

There has been greater emphasis in recent times on using public-private partnerships (PPPs or P3s) to provide and deliver transportation infrastructure and services. These public-private partnerships differ from contracting out, being applicable to a broader range of projects and requiring different contract management and accountability. In the transportation arena the focus on public-private partnerships has resulted from both the need for greater reliance on private capital to fund critical infrastructure and services and the need to tap private sector expertise to ensure delivery of high quality infrastructure and services on time and on budget. This report serves as a primer …

A Habitat Suitability Index Model For Black Bear Living Within The Kittatinny Mountain Range In New Jersey, Brett Callanan May 2006

A Habitat Suitability Index Model For Black Bear Living Within The Kittatinny Mountain Range In New Jersey, Brett Callanan

Theses, Dissertations and Culminating Projects

Throughout the past decade, an increase in urbanization and the population of black bear (Ursus americanus) in New Jersey have caused an overlap of bear habitat and areas of residential and commercial development (Eriksen 1999). Consequently, the close proximity of humans to black bear has resulted in a variety of conflicts (Carr and Burguess 2003). Strategies traditionally used to regulate the numbers and interactions with bear, such as capture and relocation, euthanization, and the utilization of game hunts can be limited by their efficiency and predictability of results. New tools are needed to address the issues of habitat loss, bear …

Keeping Communism Down On The Farm: The Brazilian Rural Labor Movement During The Cold War, Cliff Welch May 2006

Keeping Communism Down On The Farm: The Brazilian Rural Labor Movement During The Cold War, Cliff Welch

Peer Reviewed Articles

Drawing on primary and secondary sources, this article discusses the durability of communist ideology in rural Brazil during the second half of the twentieth century. It analyzes the theme in two major periods: the Populist Republic (1945–1964) and the Military Regime (1964–1985). Concluding with a discussion of the first years of the New Republic, it argues that the political mobilization of Brazilian peasants defied the geopolitical logic of the era, which dictated the elimination of communist thought by the conclusion of the cold war.

Harry Potter And The Half-Crazed Bureaucracy, Benjamin H. Barton

Michigan Law Review

What would you think of a government that engaged in this list of tyrannical activities: tortured children for lying; designed its prison specifically to suck all life and hope out of the inmates; placed citizens in that prison without a hearing; ordered the death penalty without a trial; allowed the powerful, rich, or famous to control policy; selectively prosecuted crimes (the powerful. go unpunished and the unpopular face trumped-up charges); conducted criminal trials without defense counsel; used truth serum to force confessions; maintained constant surveillance over all citizens; offered no elections and no democratic lawmaking process; and controlled the press? …

Fattening Food: Should Purveyors Of Fast Food Be Required To Warn? A Call For A New Tort, Charles E. Cantu

Journal of Food Law & Policy

Being overweight continues to be an important issue for many Americans. The latest diet fad is likely to include at least one title on the current bestseller list, and newspapers carry daily articles on the most recent study regarding risks related to obesity. Heeding these concerns, the federal government has added its own impetus by requiring the packaged food industry to list, not only nutritional information, but also calories. Individuals alleging injury and seeking recourse have made an attempt to place fault upon purveyors of fast food. To date, American jurisprudence has not helped. The courts have suggested that, from …

Investigating The Use Of Intelligent Transportation System Applications To Mitigate The Effects Of Terrorism In Marine Transportation, Kenneth Brown May 2006

Investigating The Use Of Intelligent Transportation System Applications To Mitigate The Effects Of Terrorism In Marine Transportation, Kenneth Brown

Theses (Pre-2016)

Contrary to popular belief marine transportation is probably the most vulnerable and the most critical sector of transportation. The Marine Transportation System (MTS) is comprised of ships, tugs, barges, ports, rail and trucking all operating in a highly integrated system. The vulnerability of the MTS to the effects of possible terrorist attacks would not only pose a great threat to the safety of the local community but also our U.S. economy. In other modes of transportation such as surface, air, and mass transit, security and safety issues have been addressed through Technological improvements. Many of these Technological improvements fall under …

Communications, Alexander J. Field May 2006

Communications, Alexander J. Field

Economics

The communications sector of an economy comprises a range of technologies, physical media, and institutions/rules that facilitate the storage of information through means other than a society's oral tradition and the transmission of that information over distances beyond the normal reach of human conversation. This chapter provides data on the historical evolution of a disparate range of industries and institutions contributing to the movement and storage of information in the United States over the past two centuries. These include the U.S. Postal Service, the newspaper industry, book publishing, the telegraph, wired and cellular telephone service, radio and television, and the …
