The U.S. Tax System In International Perspective, John E. Anderson, Council Of Economic Advisers Aug 2006

The U.S. Tax System In International Perspective, John E. Anderson, Council Of Economic Advisers

Department of Economics: Faculty Publications

All governments face two important decisions. They must choose the scope and scale of public goods and services to provide for their citizens, and they must also decide how to collect the funds to finance those public services. Chapter 5, The U.S. Tax System in International Perspective, examines U.S. choices in the context of other countries. It makes three key points:

• Fundamental choices about tax systems matter because they affect the living standards of citizens.

• The United States has made different choices from other countries. The United States has a relatively low tax burden compared to the rest …

Calling The United States' Bluff: How Sovereign Immunity Undermines The United States' Claim To An Effective Domestic Human Rights System, Denise L. Gilman Aug 2006

Calling The United States' Bluff: How Sovereign Immunity Undermines The United States' Claim To An Effective Domestic Human Rights System, Denise L. Gilman

ExpressO

This article challenges the claims made by the United States that the civil rights system in this country adequately protects human rights, making it unnecessary for the United States to take on additional international human rights commitments. Specifically, the article uses international human rights law and comparative law to analyze the broad sovereign immunity doctrines that protect government actors in the United States from suits for damages even where constitutional violations are in play.

Redefining The Right To Be Let Alone: Privacy Rights And The Constitutionality Of Technical Surveillance Measures In Germany And The United States, Nicole E. Jacoby Aug 2006

Redefining The Right To Be Let Alone: Privacy Rights And The Constitutionality Of Technical Surveillance Measures In Germany And The United States, Nicole E. Jacoby

ExpressO

U.S. and German courts alike long have struggled to find the proper balance between protecting the privacy rights of criminal suspects and granting law enforcement officials the adequate tools to fight crime. The highest courts in each country have produced different paradigms for determining where the public sphere ends and the private sphere begins. In a series of cases, the U.S. Supreme Court has inquired whether a criminal defendant had a reasonable expectation of privacy when the state conducted a warrantless search of the suspect’s person, premises, or belongings. Germany’s Federal Constitutional Court, in contrast, has asked whether an investigative …

Bahamian Cave And Karst Geodatabase, And Gis Analysis Of San Salvador Island, Bahamas, Adam Dennis Walker

Theses and Dissertations

A geodatabase and a data management program have been created to store and manipulate cave and karst feature data from the Bahamas. A geographic information system was used to recognize any spatial patterns in the cave and karst data from San Salvador Island. Elevation data for banana holes, vadose pits and flank margin caves were obtained from a digital elevation model and are consistent with values predicted by the Carbonate Island Karst Model. The slope and aspect of the hill on which a flank margin cave is found showed no relationship to cave sizes and shapes, emphasizing the hypogenic nature …

Thinking Outside The Border: Homeland Security And The Forward Deployment Of The U.S. Border, Gregory W. Bowman Aug 2006

Thinking Outside The Border: Homeland Security And The Forward Deployment Of The U.S. Border, Gregory W. Bowman

ExpressO

Following the September 11, 2001, terrorist attacks, the U.S. government implemented a number of inbound cargo security programs it described as “pushing the border outward” or “expanding [the U.S.] perimeter of security.” Are these statements rhetorical flourish, or do these programs materially affect international cargo trade? This article argues that far from being mundane or rhetorical, these cargo security programs are transforming how U.S. borders operate from both a conceptual and practical perspective. Specifically, by moving certain aspects of border functionality to locations well-removed from the physical U.S. border, these programs make U.S. regulation of inbound trade significantly more extraterritorial. …

The Logistical And Ethical Difficulties Of Informing Juveniles About The Consequences Of Adjudications, Michael Pinard Aug 2006

The Logistical And Ethical Difficulties Of Informing Juveniles About The Consequences Of Adjudications, Michael Pinard

Faculty Scholarship

In this article, Professor Michael Pinard observes that the recent attention devoted to the collateral consequences of criminal convictions has overlooked the ways in which these consequences impact juvenile offenders. The article recognizes the emergent arguments for informing adult defendants of these consequences as part of the guilty plea or sentencing process, and argues that juvenile defendants should also be informed of the collateral consequences that attach to their adjudications. However, the article asserts that there are ethical and logistical questions unique to the juvenile justice process that would pose difficulties in conveying this information to juveniles. These issues (or …

Characteristics Of Marijuana Users Compared To Multiple Drug Users, Swateja Nimkar

Masters Theses & Specialist Projects

This study examines drug use behavior in a self-described sample of users. Comparisons are made between subjects whose only illicit drug use is marijuana and those who use both marijuana and other drugs. Data are from the DRUGNET study (1996, 1998, 1999), a multi-panel study conducted over the internet from 1996 - 1998. This sample was predominately white, male, young, and college educated. The majority of respondents were employed with incomes in the $50,000 - $60,000 (USD) range. A subset of respondents to the DRUGNET survey was selected for this analysis. Washington's Title Match: The Single-Subject And Subject-In-Title Rules Of Article Ii, Section 19 Of The Washington State Constitution, Dustin Buehler Aug 2006

Washington's Title Match: The Single-Subject And Subject-In-Title Rules Of Article Ii, Section 19 Of The Washington State Constitution, Dustin Buehler

Washington Law Review

Article II, section 19 of the Washington State Constitution provides that "[n]o bill shall embrace more than one subject, and that shall be expressed in the title." This provision contains two rules. First, an act violates the single-subject rule if it has a general title and its provisions lack rational unity, or if it has a restrictive title and contains provisions not fairly within the scope of that title. Second, an act violates the subject-in-title rule if the plain language of its title does not indicate the scope and purpose of the bill to an inquiring mind, or if it …

A Comparative Study Of Compliant And Non-Compliant Sexual Offenders In The State Of Tennessee, Nora Eliana Del Cul

Masters Theses and Doctoral Dissertations

Sexual offenders have been identified as a group of criminals who must be monitored even after their release from prison or after completion of parole. This is accomplished by requiring sexual offenders to comply with registration requirements such as checking in with law enforcement agents on a regular basis, providing information on where they are living, working, and going to school, and being placed on a public registry for a period of at least ten years. Some offenders do comply with all of the registration requirements; unfortunately, many do not. The purpose of this research was to try and find …

Sustainable Development Or Just Plain Development? An Analysis Of Sustainability Indicators For Chattanooga, Tennessee, Cheryl Horn Aug 2006

Sustainable Development Or Just Plain Development? An Analysis Of Sustainability Indicators For Chattanooga, Tennessee, Cheryl Horn

Masters Theses and Doctoral Dissertations

The city of Chattanooga, Tennessee, and the surrounding area has undergone a notable transformation in recent decades. Many of these changes have been used to promote the city as an environmentally friendly place to live, and the phrase sustainable development is frequently used to describe local growth and planning. However, no comprehensive analysis has been undertaken to determine whether Chattanooga is truly headed toward becoming a sustainable community in terms of environmental, social, and economic considerations. Based on the concept of sustainable development, as defined by the United Nations and others, and on sustainability studies conducted in four other cities, …
