Misfearing: A Reply, Cass R. Sunstein Jan 2006

Misfearing: A Reply, Cass R. Sunstein

Coase-Sandor Institute for Law & Economics Research Paper Series

Human beings are prone to "misfearing": Sometimes they are fearful in the absence of significant danger, and sometimes they neglect serious risks. Misfearing is a product of bounded rationality, and it produces serious problems for individuals and governments. This essay is a reply to a review of Laws of Fear by Dan M. Kahan, Paul Slovic, Donald Braman, and John Gastil, who contend that "cultural cognition," rather than bounded rationality, explains people's fears. The problem with their argument is that cultural cognition is a product of bounded rationality, not an alternative to it. In particular, cultural differences are largely a …

Hamdi's Habeas Puzzle: Suspension As Authorization?, Trevor W. Morrison Jan 2006

Hamdi's Habeas Puzzle: Suspension As Authorization?, Trevor W. Morrison

Faculty Articles

Although the executive detention of individuals outside the criminal justice system implicates the historical core of the writ of habeas corpus, there persists in this area a remarkable amount of disagreement over the nature of habeas corpus and its place in our constitutional system. This phenomenon is especially evident in Hamdi v. Rumsfeld, the 2003 Supreme Court case involving a challenge to the executive branch's detention, without charge, of a U.S. citizen alleged to be an enemy combatant. The case divided the Court, producing four opinions in all. Two of those opinions - a plurality by Justice O'Connor and a …

Voluntarism And Volunteering, Richard Holtzman Jan 2006

Voluntarism And Volunteering, Richard Holtzman

History and Social Sciences Faculty Journal Articles

To engage in voluntarism, as the term is commonly understood today, is to freely offer support in the service of others. Defining the concept in such general terms, however, ignores a number of important factors, such as the motives leading individuals to choose such action, the means by which the activity occurs, and the broader implications of voluntarism for society. This chapter looks at voluntarism from a historical perspective to demonstrate the numerous and sometimes conflicting ways the concept has been understood. Recognizing voluntarism as a social issue requires examining it in the variety of historical contexts and settings that …

Meditations On Carl Schmitt, Mark Tushnet Jan 2006

Meditations On Carl Schmitt, Mark Tushnet

Georgia Law Review

A spectre is haunting Professor Levinson - the spectre of Carl Schmitt. The German--or should it be Nazi? - constitutional theorist flits in and out of Professor Levinson's discussion. Professor Levinson has done yeoman work in bringing Schmitt's perspective to the attention of constitutional theorists. My comments offer my own reaction to what I take to be Schmitt's points, and in doing so may confirm Professor Levinson's assessment of Schmitt's importance today. I start with the sentence Professor Levinson quotes: "Sovereign is he who decides on the exception. Professor Levinson focuses on the first part of the sentence, because, in …

South Korea's National Security Law: A Tool Of Oppression In An Insecure World, Diane B. Kraft

Law Faculty Scholarly Articles

In September 2004, the ruling party in South Korea, along with two opposition parties, called for the abolishment of the 1948 anti-communist National Security Law. The following month, Amnesty International, a long-time critic of the law, officially called for the law's repeal. The law had been enacted in 1948 in response to threats from communist North Korea, but has long been used by the government to silence legitimate opposition in South Korea. This Comment will examine South Korea's National Security Law as viewed by its domestic supporters and critics, as well as by the international community. Part I will consider …

The Character Of The Minnesota Tort System, Michael K. Steenson Jan 2006

The Character Of The Minnesota Tort System, Michael K. Steenson

Faculty Scholarship

The specific focus of this article is whether the Minnesota tort system is progressive. The answer to that question depends on a number of other questions. First, what are the components of the tort system? Second, what are the primary motivating principles of the system? Third, how is the term “progressive” defined for purposes of evaluating the system, and as applied to the tort system, what conclusions does it yield? Other questions might be whether the tort system in Minnesota is liberal, or conservative, or, perhaps, moderate, with the overriding question of whether those labels make any difference.
