An Empirical Analysis Of County-Level Determinants Of Small Business Growth And Poverty In Appalachia: A Spatial Simultaneous-Equations Approach, Gebremeskel H. Gebremariam, Tesfa Gebremedhin, Peter V. Schaeffer Jan 2006

An Empirical Analysis Of County-Level Determinants Of Small Business Growth And Poverty In Appalachia: A Spatial Simultaneous-Equations Approach, Gebremeskel H. Gebremariam, Tesfa Gebremedhin, Peter V. Schaeffer

Regional Research Institute Working Papers

A spatial simultaneous-equations growth equilibrium model estimated by GS2SLS and GS3SLS estimators is used to determine the interdependence between small business growth and poverty. The parameter estimates are mostly consistent with the theoretical expectations. The coefficients for the endogenous variables of the model are positive and significant indicating strong interdependence (feedback simultaneity) between small business and median household income growth rates. The results also show the presence of spatial autoregressive lag simultaneity and spatial cross-regressive lag simultaneity, with respect to both small business and median household income growth rates, and the existence of spatial correlation in the error terms. Dickerson V. United States: The Case That Disappointed Miranda's Critics - And Then Its Supporters, Yale Kamisar Jan 2006

Dickerson V. United States: The Case That Disappointed Miranda's Critics - And Then Its Supporters, Yale Kamisar

Book Chapters

It is difficult, if not impossible, to discuss Dickerson1 intelligently without discussing Miranda whose constitutional status Dickerson reaffirmed (or, one might say, resuscitated). It is also difficult, if not impossible, to discuss the Dickerson case intelligently without discussing cases the Court has handed down in the five years since Dickerson was decided. The hard truth is that in those five years the reaffirmation of Miranda's constitutional status has become less and less meaningful. In this chapter I focus on the Court's characterization of statements elicited in violation of the Miranda warnings as not actually "coerced" or "compelled" but obtained merely …

Amending Its Anti-Paparazzi Statute: California's Latest Baby Step In Its Attempt To Curb The Aggressive Paparazzi, Lisa Vance Jan 2006

Amending Its Anti-Paparazzi Statute: California's Latest Baby Step In Its Attempt To Curb The Aggressive Paparazzi, Lisa Vance

UC Law SF Communications and Entertainment Journal

The financial rewards of celebrity photos have driven the paparazzi to increasingly dangerous tactics, often endangering celebrities and others in their pursuit of a valuable photo. In response to this danger, California amended its anti-paparazzi statute in 2005. The amended statute provides stiff penalties, including punitive and treble damages, and allows a celebrity to recover these damages for assault. However, assault requires the intent to cause apprehension of imminent contact, and much of the outrageous conduct of the paparazzi does not evidence this sort of intent. If California is serious about curbing improper behavior by the paparazzi, it should penalize …

Faulting San Andreas: The Call To Arms For Sensible Regulation Of Violent Video Games, Jessica Williams Jan 2006

Faulting San Andreas: The Call To Arms For Sensible Regulation Of Violent Video Games, Jessica Williams

UC Law SF Communications and Entertainment Journal

Video game violence has escalated to shocking limits. Murder and sex are glorified in modern games. California Assembly Bill 1179 is the latest attempt to curb the sale of video games encouraging this type of violence. Because it is improbable that current social science research will be able to prove the causal connections necessary to satisfy the Brandenburg standard for regulating free speech, AB 1179 violates the First Amendment rights of California's citizens. In the future, increased parental controls and the Entertainment Software Ratings Board's active role in enforcing compliance with its rating system will be the most effective means …

The Court Of Disbelief: The Constitution's Article Vi Religious Test Prohibition And The Judiciary's Religious Motive Analysis, Francis J. Beckwith Jan 2006

The Court Of Disbelief: The Constitution's Article Vi Religious Test Prohibition And The Judiciary's Religious Motive Analysis, Francis J. Beckwith

UC Law Constitutional Quarterly

In several federal cases concerning whether particular statutes or policies violate the First Amendment's prohibition of religious establishment, both the United States Supreme Court and other federal courts have rejected the constitutionality of these laws and policies on the grounds that they have an exclusively religious purpose. Part of the courts' analyses in some of these cases rely on the apparent religious motives of the statute's or policy's sponsors and/or citizen-supporters as the basis by which the courts infer that the law or policy in question has a religious purpose.

I argue in this paper that this sort of analysis …

Effectiveness Of Asynchronous Reference Services For Distance Learning Students Within Florida's Community College System, Patricia C. Profeta Jan 2006

Effectiveness Of Asynchronous Reference Services For Distance Learning Students Within Florida's Community College System, Patricia C. Profeta

CCAC Theses and Dissertations

The impact of distance learning on higher education and the need to provide equitable library services to students in the digital environment emerged as critical areas during the 1990s. Library services available to distance learning students included digital reference and instructional services, remote access to online research tools, database and research tutorials, interlibrary loan, and document delivery. Digital reference services appeared to be one of the more significant services proffered by academic libraries although these services were developed often without forethought to goals and assessment. The purpose of this study was to examine the adequacy of asynchronous e-mail reference services …
