In the medical liability wars, physicians like to think that they are the ones in the trenches. Yet the true soldiers, of course, are the patients. As patients seek to avoid the barrage of malpractice reforms and the spoliation of managed care, one of their key refuges-the fiduciary duty of health care professionals-is being assailed from a number of directions. This Article describes these attacks and suggests how best to thwart them.

Influence And Its Opposite: Presence And Absence In The Work Of Harold Bloom, Joshua Henderson

In the years since he formulated and expanded on it in The Anxiety of Influence (1973), A Map of Misreading (1975), and Kaballah and Criticism (1975), Harold Bloom's theory of the "anxiety of influence" has engendered more ambivalence than serious investigation into his theory and its influences. In part, the ambivalence is due to Bloom's persona, which irritates the academic "left" and "right" alike. Surprisingly, it is not Bloom's defense of canonicity against post-structural Marxism, feminism, and New Historical criticism that generates the most resistance; instead, Bloom's dissenters more often come from the ranks of conservative traditionalists who might be …

Head Start, a federally funded preschool program that provides a diverse array of services to children ages three to five years, strongly emphasizes the importance of parent involvement in its program. The purpose of the present study was to examine Head Start parents' perceptions of the parent involvement component of a regional Head Start program. Specifically, this study assessed barriers to parent involvement with the program, parent participation and satisfaction with the program, and whether or not parents were aware of the various aspects of the Head Start parent involvement component. In order to meet the requirements of the masters of Architecture Terminal Project, I propose to design an equestrian training facility for Cotton Top Farms in St. Joseph, Missouri. The site is located in a rural area three miles outside of St. Joseph, Missouri, on a bluff which overlooks a flood plain. The area has been used for farming for over 150 years. The original farm was a dairy, 40 acres of which has been adapted into Cotton Top Farms, a small family horse farm. The year 2005 witnessed two watershed developments in federal jurisdiction: the U.S. Supreme Court's decision in Exxon Mobil Corp. v. Allapattah Services, Inc. and the enactment of the Class Action Fairness Act (CAFA). Allapantah and CAFA raise the same fundamental question: how should courts interpret a statute whose text would expand federal jurisdiction far beyond what Congress apparently intended? In Allapattah, the Court confronted this question in resolving an aspect of the supplemental jurisdiction statute that had deeply divided both the judiciary and academia. CAFA's expansion of federal jurisdiction over class actions will require courts to struggle with this …

Mycobacterium-Plant Interactions In Bioremediation Of Polycyclic Aromatic Hydrocarbon Compounds, Robert D. Child

Five mycobacterium isolates that degrade polycyclic aromatic hydrocarbons colonize the surface of barley roots from a seed inoculum. Colonization was maintained in the presence of an aggressive root-colonizing pseudomonad. All five of the mycobacterium strains utilized components in root washes for growth but they differed in their potential for biofilm formation. Components in the barley root washes did not impede the mineralization of pyrene. An inexpensive, portable, flexible microcosm chamber system was constructed and implemented in pyrene mineralization experiments. The system facilitated control of sterile conditions, air flow-through, and collection of volatilized radiolabeled compounds. Mineralization rates of pyrene were higher …

PURPOSE OF REVIEW: Communicable diseases were traditionally the major cause of public health concern in Asian countries, most of which were less developed. With industrialization and associated lifestyle changes during the past few decades, however, noncommunicable diseases similar to those that affect Western societies have emerged in Asian countries. The purpose of the review was to examine recent evidence about the burden and factors associated with hypertension and chronic kidney disease (CKD) in Asian countries.RECENT FINDINGS: Hypertension has become one of the leading causes of mortality in Asia. Background: Weight gain in adulthood is common, from modest gains in developing countries to substantial increases in Western societies. Evidence of the importance of energy expenditure in adult weight change has been limited to studies conducted in Pima Indians, in whom resting energy expenditure (REE) was found to be inversely associated with weight gain. Objective: The aim was to determine whether REE was predictive of weight change in lean Nigerian adults. Design: Weight was measured in 744 adults on 2-4 occasions over 5.5 y. The components that define cereal-grain yield potential have not been well defined. The objective of this study was to collect many differing biological measurements from a long-term winter wheat (Triticum aestivum L.) study in an attempt to better define yield potential. Four treatments were sampled that annually received 0, 45, 90, and 135 kg N ha-1 at fixed rates of phosphorus (P) (30 kg ha-1) and potassium (K) (37 kg ha -1). Research suggests that whole grain intake may decrease the risk of heart disease, type II diabetes, hypertension, obesity, and many types of cancer. The overall goal of this work is to increase the health status of an older adult population through comprehensive nutrition risk assessment and exposure to tailored nutrition education interventions. This project involved assisting in baseline and post-intervention assessment of the knowledge, attitude, and intake of whole grain foods within a convenience sample of fifty-eight older adults residing in low-income housing sites across Rhode Island. As early as the 1950’s it was shown that animals as mice, rats, guinea pigs, and monkeys that received one injection of xenogeneic thyroglobulin emulsified in Complete Freund’s Adjuvant (CFA) developed Experimental Autoimmune Thyroiditis (EAT) (Voller et al., 1980). The damage reported was destruction of the thyroid follicles, and infiltration of the thyroid by macrophages, neutrophils, and lymphocytes. An injection of Bordetella pertussis proved to enhance the incidence and severity of EAT in animal models. Bordetella pertussis is no longer manufactured in large quantities, and it is extremely difficult to purchase. Therefore, a different procedure had to be developed that …

A Preliminary Benthic Invertebrate Study Of Jun Jaegyu Volcano : An Undersea Volcano In Antarctic Sound, Antarctica, Gina QuiñOnes

Jun Jaegyu volcano, an Antarctic submarine volcano, was dredged in May 2004 for sediment and marine macroinvertebrates. The objectives of this study were to examine the benthic assemblages and biodiversity present on the newly discovered volcano. The volcano is located on the continental shelf of the northeastern Antarctic Peninsula, where recent changes in surface temperature and ice shelf stability have been observed. This volcano was swath-mapped during cruise 01 -07 of the Research Vessel-Ice Breaker Nathaniel B. Palmer. The volcano was studied using a SCUD video camera and a dredge along the flanks and crest. Results indicate a seafloor surface …
