Stitched From The Soul: An Auto/Biographical Inquiry Into One Black Woman Administrator's Voice And Vision, Sonya D. Jefferson Jan 2006

Stitched From The Soul: An Auto/Biographical Inquiry Into One Black Woman Administrator's Voice And Vision, Sonya D. Jefferson

College of Graduate Studies: Theses & Dissertations

Author's abstract: This study is an auto/biographical inquiry into my voice and vision as a Black woman administrator. I explore the lives of four generations of Black women in my family. Each of these women -- Hattie C. Wilcher (my great grandmother), Connie W. Duggan (my mother), Danielle R. Lowe (my daughter), and I -- have studied and/or taught in public schools in the U. S. south. I explore how my family narrative parallels community and historical narratives and contests the meta narrative in existing literature. I explore these narratives through the lenses of Critical Race Theory and Black Feminist …

Utility Of Health Belief Model Constructs In Predicting Dietary Behaviors Among Female University Students: A Pilot Investigation, Vanessa Emily Anderson Jan 2006

Utility Of Health Belief Model Constructs In Predicting Dietary Behaviors Among Female University Students: A Pilot Investigation, Vanessa Emily Anderson

College of Graduate Studies: Theses & Dissertations

This study examined the relationship between Health Belief Model constructs as they related to dietary behaviors in a sample of university women 18-to-25 years of age (n=182). A cross-sectional, non-experimental design was utilized. Independent sample t-tests compared the mean of body mass indices (BMI) to dietary risk and race. Odds ratios amassed relationships between race and healthy food choices. Nearly one-third (32.4%) of participants were either overweight or obese. Black females had significantly higher BMI than white females; however, dietary risk from less-than-adequate fruit and vegetable consumption and consumption of high-fat foods were not related to race. Focus group participants …

Edmund Burke, John Whyte And Themes In Canadian Constitutional Culture, David Schneiderman Jan 2006

Edmund Burke, John Whyte And Themes In Canadian Constitutional Culture, David Schneiderman

Georgetown Law Faculty Publications and Other Works

John Whyte, the author observes, is committed to the idea that there are moral foundations to Canada's constitutional order and that these foundations are derived from liberal principles. This paper compares Whyte's liberal and organicist constitutionalism to that of the eighteenth century British political thinker, Edmund Burke. Three themes are predominant in Whyte's work: those of liberty and security, unity and diversity, and constitutional change. Drawing out these themes in both Whyte's and Burke's constitutional thought, the author argues that Whyte has a sound historical basis for deriving Canadian constitutional practices from liberal principles ordinarily associated with Burke. The author …

Called Up To The Big Leagues: An Examination Of The Factors Affecting The Location Of Minor League Baseball Teams, Michael C. Davis Jan 2006

Called Up To The Big Leagues: An Examination Of The Factors Affecting The Location Of Minor League Baseball Teams, Michael C. Davis

Economics Faculty Research & Creative Works

In this study we analyze the factors that determine whether a particular city has a minor league baseball team and the level at which that team competes. Using the generalized ordered logit model we determine that higher population, personal income, and time from nearest Major League Baseball team all have a positive effect on the city's having a minor league baseball team and having one at a higher level. The finding that personal income has a positive effect on the level of the baseball team, combined with past studies suggesting income does not affect minor league baseball attendance, leads us …

Teaching Bodies: Curriculum And Corporeality, Julie Garlen Maudlin Jan 2006

Teaching Bodies: Curriculum And Corporeality, Julie Garlen Maudlin

College of Graduate Studies: Theses & Dissertations

I began thinking about the topic of this dissertation at first in 2003 when I found myself expecting a third child while teaching full-time and pursuing a doctoral degree, and in earnest later that year at Bergamo, where I began to see a connection between my own interest in desires and bodies as they relate to education and the work of several of my colleagues. I began to think about the role of the body in the curriculum. Every day that we enter the classroom we bring our bodies and our desires along with us. We educate and learn from …

Contagious Discourse: Germs, Mass Media, And The Shaping Of Reality, Amy Richardson Ballagh Jan 2006

Contagious Discourse: Germs, Mass Media, And The Shaping Of Reality, Amy Richardson Ballagh

College of Graduate Studies: Theses & Dissertations

Over the past two decades, mass media coverage of certain infectious diseases has become more abundant. News reports of many of these contagious illnesses invoke fear in many people, such as Ebola and pandemic influenza; multidrug-resistant strains of infectious diseases, such as tuberculosis; and agents of biological warfare, a concern that is now at the forefront with many Americans due to the most recent act of bioterrorism on American soil following the events of September 11th. This dissertation focuses on the American public's perception of infectious diseases, particularly as portrayed in the cultural science curriculum. I examine the cyclic nature …

Inquiry Into The Writing Pedagogy For Middle School Language Arts, William Love Moore Jan 2006

Inquiry Into The Writing Pedagogy For Middle School Language Arts, William Love Moore

College of Graduate Studies: Theses & Dissertations

This is a narrative inquiry into writing pedagogies of middle school language arts teachers and an administrator. Six teacher participants were interviewed and observed, their lesson plans were analyzed, and their instructional practices and writing philosophies were examined. Overarching research questions were (1) What role does writing pedagogy play in a language arts program? (2) What strategies were used to teach writing? and (3) What types of assessments were utilized? The theoretical framework of my research was based on Dewey's (1897) philosophy of education with roots in hermeneutic phenomenology by van Manen (1990). Methods of inquiry were based on narrative …

Reviving The Nixon Doctrine: Nsa Spying, The Commander-In-Chief, And Excutive Power In The War On Terror, David Cole Jan 2006

Reviving The Nixon Doctrine: Nsa Spying, The Commander-In-Chief, And Excutive Power In The War On Terror, David Cole

Georgetown Law Faculty Publications and Other Works

When the President does it, that means that it is not illegal. So Richard Nixon infamously defended his approval of a plan to engage in warrantless wiretapping of Americans involved in the antiwar movement in the 1970s. For thirty years Nixon's defense has stood as the apogee of presidential arrogance. But of course Nixon was proved wrong. The wiretapping plan was shelved when FBI Director J. Edgar Hoover, of all people, objected to it. Nixon's approval of the program was listed in the articles of impeachment, and ultimately he was forced to resign. Nixon learned the hard way that presidents …

Critical Constitutionalism Now, Louis Michael Seidman Jan 2006

Critical Constitutionalism Now, Louis Michael Seidman

Georgetown Law Faculty Publications and Other Works

The starting point for this essay is the claim that if the texts that critical scholars studied are unstable over time, then this must also be true of the studies themselves. There is no reason to suppose that the critical perspective, uniquely among all possible perspectives, reflects timeless and contextless truth. The question I want to ask, then, is what meaning the critical perspective has for us now in our new and dramatically transformed environment. I proceed in four parts. First, I address the meaning that critical scholars attributed to constitutional law in the late twentieth century. Second, I describe …

Anti-Terrorist Finance In The United Kingdom And United States, Laura K. Donohue Jan 2006

Anti-Terrorist Finance In The United Kingdom And United States, Laura K. Donohue

Georgetown Law Faculty Publications and Other Works

This article adopts a two-tiered approach: it provides a detailed, historical account of anti-terrorist finance initiatives in the United Kingdom and United States—two states driving global norms in this area. It then proceeds to a critique of these laws. The analysis assumes—and accepts—the goals of the two states in adopting these provisions. It questions how well the measures achieve their aim. Specifically, it highlights how the transfer of money laundering tools undermines the effectiveness of the states' counterterrorist efforts—flooding the systems with suspicious activity reports, driving money out of the regulated sector, and using inappropriate metrics to gauge success. This …

Philosophy V. Rhetoric In Legal Education: Understanding The Schism Between Doctrinal And Legal Writing Faculty, Kristen Konrad Robbins-Tiscione Jan 2006

Philosophy V. Rhetoric In Legal Education: Understanding The Schism Between Doctrinal And Legal Writing Faculty, Kristen Konrad Robbins-Tiscione

Georgetown Law Faculty Publications and Other Works

The author argues that although legal writing faculty know that what they teach is absolutely essential to their students' success, yet it continues to be grossly, even embarrassingly, undervalued in legal education. Doctrinal legal faculty perpetuate the view that legal education is a philosophical endeavor that focuses on the truth about the nature of law and, in the twenty-first century, on the law's ability to serve justice in a multicultural America. Because of their political power, however, doctrinal faculty are able to preserve the task of truth finding for themselves. Since the nature of truth is independent of its practical …

Download It While It's Hot: Open Access And Legal Scholarship, Lawrence B. Solum Jan 2006

Download It While It's Hot: Open Access And Legal Scholarship, Lawrence B. Solum

Georgetown Law Faculty Publications and Other Works

This article analyzes the shift of legal scholarship from the old world of law reviews to today's world of peer reviews to tomorrow's world of open access legal blogs. This shift is occurring in three dimensions. First, legal scholarship is moving from the long form (treatises and law review articles) to the short form (very short articles, blog posts, and online collaborations). Second, a regime of exclusive rights is giving way to a regime of open access. Third, intermediaries (law school editorial boards, peer-reviewed journals) are being supplemented by disintermediated forms (papers on the Internet, blogs). Blogs and internet conversations …

Someplace Between Philosophy And Economics: Legitimacy And Good Corporate Lawyering, Donald C. Langevoort Jan 2006

Someplace Between Philosophy And Economics: Legitimacy And Good Corporate Lawyering, Donald C. Langevoort

Georgetown Law Faculty Publications and Other Works

This essay deals with the demands of responsible lawyering when one's client is a corporate or other business entity. I suspect that to most business clients, many of the laws they encounter are mundane and, worse, suspicious in their origins. We would be naive to think that laws always do more good than harm, or even that they are intended to do so. Too often, law in economic and commercial settings is the product of special interest haggling, political grandstanding, or bureaucratic sloth. In its totality, the bulk of commercial and regulatory law probably is mediocre at best. If this …

Unitariness And Myopia: The Executive Branch, Legal Process And Torture, Cornelia T. Pillard Jan 2006

Unitariness And Myopia: The Executive Branch, Legal Process And Torture, Cornelia T. Pillard

Georgetown Law Faculty Publications and Other Works

What promotes legality on the part of government under strain? This Article looks to the role of intra-executive processes in facilitating well-reasoned, legitimate conclusions on questions like the one addressed in this symposium: What are the legal authorities and limits governing coercive interrogation tactics? Admittedly, even the best legal processes are no guarantee of good substantive outcomes. Many critics would disagree with the substance of the executive's August 1, 2002, legal position on coercive interrogation no matter how it was derived. And even were all the best processes faithfully adhered to in developing the government's legal position on torture, it …

When Is Knowing Less Better Than Knowing More? Unpacking The Controversy Over Supreme Court Reference To Non-U.S. Law, Mark V. Tushnet Jan 2006

When Is Knowing Less Better Than Knowing More? Unpacking The Controversy Over Supreme Court Reference To Non-U.S. Law, Mark V. Tushnet

Georgetown Law Faculty Publications and Other Works

My goal in this Essay is simply to lay out the criticisms of the use of non-U.S. law in constitutional interpretation, so as to identify what might be correct (not much, in the end) in those criticisms. I discuss criticisms based on theories of interpretation, on the claim that reference to non-U.S. law is merely decoration playing no role in generating outcomes, on the role the Constitution has in expressing distinctively American values, and on the proposition that judges are unlikely to do a good job in understanding - and therefore in referring to - non-U.S. law. This last "quality-control" …

Weak-Form Judicial Review And "Core" Civil Liberties, Mark V. Tushnet Jan 2006

Weak-Form Judicial Review And "Core" Civil Liberties, Mark V. Tushnet

Georgetown Law Faculty Publications and Other Works

In this Essay, I want to unearth some subordinated strands in the Rehnquist Court's free speech jurisprudence. For example, the Rehnquist Court allowed Congress to regulate campaign finance in ways subject to credible First Amendment objections, and to impose obligations on cable television systems that would almost certainly be unconstitutional were they imposed on newspapers. These decisions, I suggest, do not rest simply on the kind of deference to legislative judgment that fits comfortably into a system of strong-form review. Rather, they represent what I call a managerial model of the First Amendment, which accords legislatures a large role in …

My Library: Copyright And The Role Of Institutions In A Peer-To-Peer World, Rebecca Tushnet Jan 2006

My Library: Copyright And The Role Of Institutions In A Peer-To-Peer World, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

Today's technology turns every computer - every hard drive - into a type of library. But the institutions traditionally known as libraries have been given special consideration under copyright law, even as commercial endeavors and filesharing programs have begun to emulate some of their functions. This Article explores how recent technological and legal trends are affecting public and school-affiliated libraries, which have special concerns that are not necessarily captured by an end-consumer-oriented analysis. Despite the promise that technology will empower individuals, we must recognize the crucial structural role of intermediaries that select and distribute copyrighted works. By exploring how traditional …

The National Security Agency's Domestic Spying Program: Framing The Debate, David Cole, Martin S. Lederman Jan 2006

The National Security Agency's Domestic Spying Program: Framing The Debate, David Cole, Martin S. Lederman

Georgetown Law Faculty Publications and Other Works

On Friday, December 16, 2005, the New York Times reported that President George W. Bush had secretly authorized the National Security Agency (NSA) to conduct warrantless surveillance of Americans' telephone and e-mail communications as part of an effort to obtain intelligence about future terrorist activity.' The Times report was based on leaks of classified information, presumably by NSA officials concerned about the legality of the program. The Times reported that at the President's request it had delayed publication of the story for more than a year.

The Indiana Law Journal reprinted four documents that, taken together, set forth the basic …

Design And Implementation Of Preparation Strategies For Massachusetts Comprehensive Assessment System Stakeholders, Judith Josephs Jan 2006

Design And Implementation Of Preparation Strategies For Massachusetts Comprehensive Assessment System Stakeholders, Judith Josephs

Theses and Dissertations

This applied dissertation was designed to provide better access to current preparation strategies for passing the Massachusetts Comprehensive Assessment System (MCAS) test. The test preparation strategies did not meet the needs of the students. The students did not know how to use the computer to study for the test and did not know how to study at home for the test. Teachers also did not know of the availability of electronic information to enrich their lessons and increase the achievement of vocational high school students.

The researcher developed strategies to train students and teachers on Bridges Transitions (1999) testGEAR and …

Abraham Van Buskirk: United Empire Loyalist Opposed To The American War For Independence, Rolf Buschardt Christensen Jan 2006

Abraham Van Buskirk: United Empire Loyalist Opposed To The American War For Independence, Rolf Buschardt Christensen

The Bridge

In 1983 when Canada celebrated the 200th anniversary of the arrival of the Loyalists-the refugees from the American Revolution-the Canadian media reported that among the Loyalists was Abraham Van Buskirk, who was of Danish origin. That's all the media said about him; the point being that not all Loyalists were of English background. Here's his story-and the historical background, which shaped his life.

Picturing Karen Blixen--Artist, Charlatan, Heretic, And Iconoclast: European Storyteller In The American Marketplace, Marianne Stecher-Hansen Jan 2006

Picturing Karen Blixen--Artist, Charlatan, Heretic, And Iconoclast: European Storyteller In The American Marketplace, Marianne Stecher-Hansen

The Bridge

In one of her stories, published in 1942 at a midpoint in her literary career, Karen Blixen addresses the difficult relationship of the artist to the public:

All human relationships have in them something monstrous and cruel. But the relation of the artist to the public is amongst the most monstrous. Yes, it is as terrible as marriage. (Winter's Tales 291)
