Creating And Using Learning Objects In Qualitative Research Education, Ronald J. Chenail, Jennifer L. Spong, Jan Chenail, Michele Liscio, Lenworth G. Mclean, Holly G. Cox, Brenda Shepherd, Nura C. Mowzoon

The Qualitative Report

Based upon the lessons learned and the educational materials generated from a doctoral course on qualitative data analysis, a group of doctoral students, their professor, and a linguistics consultant launched an on- going project to create a series of reusable learning objects designed to help other groups of students and professors learn how to analyze qualitative data. The results of the first six months of this project are shared, as the team describes how they have begun to use instructional design and software applications to create a digital learning environment in the form of a series of activities engineered to …

Conceptual Metaphors As Interpretive Tools In Qualitative Research: A Re-Examination Of College Students’ Diversity Discussions, Bruce Kochis, Diane Gillespie Sep 2006

Conceptual Metaphors As Interpretive Tools In Qualitative Research: A Re-Examination Of College Students’ Diversity Discussions, Bruce Kochis, Diane Gillespie

The Qualitative Report

In this contribution to the growing literature on conceptual metaphor as a fruitful heuristic for qualitative analysis, the authors re-analyzed transcripts of college student discussions of problematic situations involving cultural diversity and interpersonal conflict. The authors show how they identified metaphorical linguistic expressions and from them derived three conceptual metaphors (life is a journey, the problem is a barrier/maze, and the self is divided) that in turn formed patterns or constellations of meanings in students’ problem-solving strategies. As an interpretive tool, conceptual metaphors link certain isolated individual metaphors to these larger patterns of meaning, including ideological frameworks readily available in …

Beliefs About Language Learning Of Foreign Language- Major University Students, Mustapha X. Altan Sep 2006

Beliefs About Language Learning Of Foreign Language- Major University Students, Mustapha X. Altan

Australian Journal of Teacher Education

Beliefs are a central construct in every discipline which deals with human behavior and learning. Teachers’ beliefs influence their consciousness, teaching attitude, teaching methods and teaching policies. Teachers’ beliefs also strongly influence teaching behavior and, finally, learners’ development. The formation of teachers’ educational beliefs in language teaching/learning process will exert an indiscernible effect on forming effective teaching methods and will bring about the improvement of learners’ language learning abilities (Horwitz, 1985). The Beliefs About Language Learning Inventory (BALLI) was administered to a total of 248 foreign language-major university students at five universities. The participants were in the departments of English, …

Cuhk At Imageclef 2005: Cross-Language And Cross Media Image Retrieval, Steven Hoi, Jianke Zhu, Michael R. Lyu

Research Collection School Of Computing and Information Systems

In this paper, we describe our studies of cross-language and cross-media image retrieval at the ImageCLEF 2005. This is the first participation of our CUHK (The Chinese University of Hong Kong) group at ImageCLEF. The task in which we participated is the “bilingual ad hoc retrieval” task. There are three major focuses and contributions in our participation. The first is the empirical evaluation of language models and smoothing strategies for cross-language image retrieval. The second is the evaluation of cross-media image retrieval, i.e., combining text and visual contents for image retrieval. The last is the evaluation of bilingual image retrieval …

Promoting Compliance Of Private Security And Military Companies With International Humanitarian Law, Benjamin Perrin Sep 2006

Promoting Compliance Of Private Security And Military Companies With International Humanitarian Law, Benjamin Perrin

All Faculty Publications

Private security and military companies have become a ubiquitous part of modern armed conflict and post-conflict reconstruction. Their diverse clients include governments in the developed and developing world alike, non-state belligerents, international corporations, non-governmental organizations, the United Nations, and private individuals. The implications of this proliferation of private security and military companies for international humanitarian law and human rights are only beginning to be appreciated, as potential violations and misconduct by their employees have come to light in Iraq and Afghanistan. The author critically examines the theoretical risks posed by private military and security company activity with respect to violations …

Multilingual Phoneme Models For Rapid Speech Processing System Development, Eric G. Hansen Sep 2006

Multilingual Phoneme Models For Rapid Speech Processing System Development, Eric G. Hansen

Theses and Dissertations

Current speech recognition systems tend to be developed only for commercially viable languages. The resources needed for a typical speech recognition system include hundreds of hours of transcribed speech for acoustic models and 10 to 100 million words of text for language models; both of these requirements can be costly in time and money. The goal of this research is to facilitate rapid development of speech systems to new languages by using multilingual phoneme models to alleviate requirements for large amounts of transcribed speech. The Global Phone database, winch contains transcribed speech from 15 languages, is used as source data …

Learning To Writing In Code: The Value Of Using Legal Writing Exercises To Teach Tax Law, Scott A. Schumacher Aug 2006

Learning To Writing In Code: The Value Of Using Legal Writing Exercises To Teach Tax Law, Scott A. Schumacher

ExpressO

Traditionally, law school tax courses have been taught using a mix of problems, class discussion, the Socratic method, and one end-of-term exam. The goal of these courses is to introduce students to key concepts of tax law and to teach them the essential skill of reading and interpreting the Internal Revenue Code and Treasury Regulations. This traditional method of instruction is an efficient and cost-effective way of transmitting a great deal of complex information to a large number of students. It is also a good vehicle to teach the essential skill of reading and interpreting the Code. However, the time …

Swallows As It Might Have Been: Regulations Revising Case Law, Steve R. Johnson Aug 2006

Swallows As It Might Have Been: Regulations Revising Case Law, Steve R. Johnson

Scholarly Publications

This is the second of two reports on the Swallozvs Holding decision. 1 In that case, the Tax Court, over three dissenting opinions, invalidated a timing rule contained in a Treasury regulation under IRC section 882. That timing rule provided that some foreign corporations could not claim otherwise available deductions if their returns for the tax year were filed outside an 18-month grace period. The majority and the dissenters clashed over which line of authority – Chevron 2 or the pre-Chevron tax-specific line of decisions typified by National Muffier3 – provides the governing standard for evaluating the validity of …

Stuck In The Thicket: Struggling With Interpretation And Application Of California's Anti-Gang Step Act, Martin Baker Aug 2006

Stuck In The Thicket: Struggling With Interpretation And Application Of California's Anti-Gang Step Act, Martin Baker

ExpressO

California’s Street Terrorism Enforcement and Prevention Act (Penal Code Sections 186.20 et seq.) was enacted in 1988 in response to a perceived “state of crisis . . . caused by violent street gangs” throughout the state. The “STEP” Act created a distinct crime of active participation in a criminal street gang, as well as providing enhanced penalties for any crime committed with the intent to facilitate criminal gang activity.

Since its enactment, the poorly drafted Act—described by the California Supreme Court as a “thicket of statutory construction”—has produced an array of conflicting and vague appellate opinions. This article examines the …

[Insert Song Lyrics Here]: The Uses And Misuses Of Popular Music Lyrics In Legal Writing, Alex B. Long Aug 2006

[Insert Song Lyrics Here]: The Uses And Misuses Of Popular Music Lyrics In Legal Writing, Alex B. Long

ExpressO

Legal writers frequently utilize the lyrics of popular music artists to help advance a particular theme or argument in legal writing. And if the music we listen to says something about us as individuals, then the music we, the legal profession as a whole, write about may something about who we are as a profession. A study of citations to popular artists in law journals reveals that, not surprisingly, Bob Dylan is the most popular artist in legal scholarship. The list of names of the other artists rounding out the Top Ten essentially reads like a Who’s Who of baby …

Individual Rights And Group Rights In The European Union's Approach To Minority Languages, Robert F. Weber Aug 2006

Individual Rights And Group Rights In The European Union's Approach To Minority Languages, Robert F. Weber

ExpressO

The European Union rights discourse is dominated by talk of individual, and not group, rights. Individual market actors have been the constitutive atoms of European Union law. Within this legal framework, the onus has been on the Member States to protect and contribute to minority language groups. This paper examines some of the ways Member States accommodate and recognize the minority language groups residing within Europe, and subsequently analyzes the compatibility of these measures with the EC Treaty in light of the European Court of Justice's (ECJ) willingness to invoke the Treaty in an increasing array of situations. Specifically, the …

The Story Of Me: The Underprotection Of Autobiographical Speech, Sonja R. West Aug 2006

The Story Of Me: The Underprotection Of Autobiographical Speech, Sonja R. West

ExpressO

This article begins the debate over the constitutional underprotection of autobiographical speech. While receiving significant historical, scientific, religious and philosophical respect for centuries, the time-honored practice of talking about yourself has been ignored by legal scholars. A consequence of this oversight is that current free speech principles protect the autobiographies of the powerful but leave the stories of “ordinary” people vulnerable to challenge. Shifting attitudes about privacy combined with advanced technologies, meanwhile, have led to more people than ever before having both the desire and the means to tell their stories to a widespread audience. This article argues that truthful …

Merits Stripping, Howard M. Wasserman Aug 2006

Merits Stripping, Howard M. Wasserman

ExpressO

As the debate rages about the power and wisdom of Congress to “strip” federal courts of jurisdiction to adjudicate particular controversial federal issues, the discussion either ignores another means of constricting the power and influence of the courts. That is the distinct act of “merits stripping.” Merits stripping eliminates, limits, or diminishes enforceable substantive rights and the merits of claims brought to enforce those rights. Merits strips diminish the amount of real-world actors and conduct subject to legal duties and protected by legal rights. Merits striping limits who can sue whom over what conduct. Merits strips can target statutory or …

Reasonable Burdens: Resolving The Conflict Between Disabled Employees And Their Co-Workers, Nicole Porter Aug 2006

Reasonable Burdens: Resolving The Conflict Between Disabled Employees And Their Co-Workers, Nicole Porter

ExpressO

This Article addresses one of the most difficult issues under the reasonable accommodation provision of the Americans with Disabilities Act (ADA): how to resolve the conflict that arises when accommodating a disabled employee negatively affects or interferes with the rights of other employees. Several scholars and the Supreme Court (in US Airways v. Barnett) have weighed in on this debate but their analyses fall short of the ultimate goal of this Article—to achieve equal opportunity for individuals with disabilities without unnecessarily interfering with the rights of other employees. In order to achieve that goal, this Article proposes a statutory amendment …

The Right To Self-Determination And Statehood: The Case Of Kosovo, Besfort Rrecaj Aug 2006

The Right To Self-Determination And Statehood: The Case Of Kosovo, Besfort Rrecaj

ExpressO

Introduction To explore self-determination is, in the words of Antonio Cassese”, a way of opening a veritable Pandora’s Box.” Indeed, the historical evolution of the concept reveals that it has been subjected to ambiguity, misconception and contradictory application. Over the years, it was redefined and re-applied on the basis of the interests of particular states. More recent events, namely the dissolution of the USSR and Yugoslavia, have given a new perspective to the meaning of self-determination. In this post Cold War era, greater attention is being paid to the enforcement of human rights and with it, a broader understanding of …
