Ecocritism And The Renaissance: A Study In Shakespeare And More, Melissa Levert Smith Jan 2006

Ecocritism And The Renaissance: A Study In Shakespeare And More, Melissa Levert Smith

Honors Theses

This study draws on ideas from the emerging field of literary criticism known as ecocriticism and extends its basic assumptions back to the Renaissance works of Thomas More and William Shakespeare. The research therefore includes primary Renaissance texts, current ecocritical works, and selections from the twentieth-century criticism from which ecocriticism developed. I investigate in detail More’s Utopia and Shakespeare’s A Midsummer Night’s Dream and King Lear. The study takes into account the disparity between Renaissance attitudes towards the environment and current concerns about pollution and scarcity of resources, but I suggest that the questions asked by ecocritical scholars today, when …

Cotton And Compromise: Charles Pinckney And The Political Unification Of South Carolina 1788-1808, Hunter Glenn Upchurch Jan 2006

Cotton And Compromise: Charles Pinckney And The Political Unification Of South Carolina 1788-1808, Hunter Glenn Upchurch

Honors Theses

This project surveys the life and times of South Carolinian Charles Pinckney after he participated in the Constitutional Convention of 1787. My objective was to discern how Pinckney’s political career both mirrored and contributed to South Carolina’s gradual shift away from Federalism towards Jeffersonian-Republicanism, as the western “Up-Country” region slowly took power from the more traditional, coastal “Low- Country.” To achieve this goal, I examined hundreds of pages of primary sources, including Pinckney’s extant speeches, his published articles or pamphlets, and many of his personal letters. To augment my factual and historiographical knowledge of the early national period of United …

The Market Participant Doctrine And The Clear Statement Rule, David S. Bogen Jan 2006

The Market Participant Doctrine And The Clear Statement Rule, David S. Bogen

Seattle University Law Review

When the state acts as a market regulator, the dormant Commerce Clause invalidates discriminatory regulation without the need for an order against the state. The courts simply refuse to enforce the state law on the ground that it is unconstitutional. When the state acts as a market participant, however, the court would have to direct its order against the state or its officials to negate the discrimination. This produces a direct confrontation with the state, the same kind of confrontation the clear statement rule was designed to avoid. Part II of this article examines the theory of the dormant Commerce …

Harry Potter, Ruby Slippers And Merlin: Telling The Client's Story Using The Characters And Paradigm Of The Archetypal Hero's Journey, Ruth Anne Robbins

Seattle University Law Review

This Article focuses on the relationship of mythology and folklore heroes to everyday lawyering decisions regarding case theory when the audience is a judge or panel of judges rather than a jury. This Article adds to the discourse by beginning a conversation about what might be termed “applied legal storytelling.” The term pertains to ideas of how everyday lawyers can utilize elements of mythology as a persuasive technique in stories told directly to judges--either via bench trials or via legal writing documents such as briefs--on behalf of an individual client in everyday litigation. Parts II and III of this Article …

Net Chicks' And Geekgirls': Remixing Of Frontier And Pioneer Rhetoric, Charlotte Krolokke Jan 2006

Net Chicks' And Geekgirls': Remixing Of Frontier And Pioneer Rhetoric, Charlotte Krolokke

Iowa Journal of Communication

In this article remixing is discussed as a feminist theoretical and rhetorical concept that helps explicate young women's rhetoric about the Internet and situate it in light of early feminist pioneers. Of particular focus is Net Chicks' and Geekgirls' remix of frontier and pioneer rhetoric, which is read in light of the myths surrounding geographical pioneers such as Annie Oakley and "Stagecoach" Mary. While Net Chicks' and Geekgirls' remix, due to its largely colonialist perspective, is problematic, it provides us with a way to reflect on long-forgotten women on the geographical frontier.

Buffy Never Goes In Alone: The Rhetorical Construction Of Feminism In Buffy And The Vampire Slayer's Final Season, Susan M. Payne-Mulliken, Valerie R. Renegar Jan 2006

Buffy Never Goes In Alone: The Rhetorical Construction Of Feminism In Buffy And The Vampire Slayer's Final Season, Susan M. Payne-Mulliken, Valerie R. Renegar

Iowa Journal of Communication

This essay is a rhetorical criticism of the final season of Buffy the Vampire Slayer (BtVS) and examines how metaphor is used to rhetorically construct feminist concepts. The essay specifically analyzes the metaphoric construction of the patriarchy and the feminist concept of sisterhood in the final season of BtVS. A thorough analysis reveals that the above ideas, represented via metaphor, are frequent and crucial components of the final season's plot. By using metaphor as a way to shape reality, BtVS communicates feminist ideals to its audience, thereby contributing to their overall perception of the movement.

A New Economics Of Trademarks, David W. Barnes Jan 2006

A New Economics Of Trademarks, David W. Barnes

Northwestern Journal of Technology and Intellectual Property

Conventional wisdom holds that trademarks are nothing like other intellectual property. Copyright and patent law are theoretically based in public goods theory and are designed to promote creation and disclosure of original expressions and novel, useful innovations. By contrast, trademarks are private goods and trademark law is designed to promote trade and encourage competition.

This article challenges conventional wisdom by demonstrating that trademarks are a type of public good that contributes to the public stock of useful ideas just as patented and copyrighted works do. This economic perspective suggests, again contrary to conventional trademark theory, that competitive markets fail to …

Surrounding Embryos: Biology, Ideology And Politics, Janet L. Dolgin

Hofstra Law Faculty Scholarship

This article considers several parameters of the late twentieth and early twenty-first-century debate in the U.S. about ethics, politics, science, and ideology (popularly referred to as the "culture wars"). The article focuses, in particular, on shifting understandings of the embryo. The article reviews developments in science (especially the advent of stem-cell research and cloning) that have affected understandings of embryo, the history of debate about abortion in the U.S., and the place of discourse about abortion in a more far-reaching social debate about family, personal relationships, and the scope of personhood in the U.S.

Reforming Rhetoric: Gender Equity, The American Association Of University Women, And The New White, Kim Golombisky Jan 2006

Reforming Rhetoric: Gender Equity, The American Association Of University Women, And The New White, Kim Golombisky

Iowa Journal of Communication

During the 1990s, the American Association of University Women tried to put gender equity back onto a U.S. education agenda that had rolled back equity programming during the 1980s and turned toward standards and testing in the 1990s. Conservatives labeled the AA UW radical feminists and argued black schoolboys represent the greatest at-a-risk student population, a logic that prioritized race over gender and boys over girls. Nonwhite non-Anglo women criticized the AA UW for glossing over differences among girls and women. In its 1998 Gender Gaps, the AA UW wrote a rhetorical alliance with its critics on the right and …

The Intersection Of Race, Gender, And Class In Social Transitions: Caribbean Immigrant Women Negotiating United States Higher Education, Tracy A. Mcfarlane

Dissertations, Theses, and Capstone Projects

The experiences of immigrant women of color within US higher education provide a unique opportunity to understand the complex influences of intersecting identities within changing social contexts. This study was designed to determine how the social categories of gender, class, race, and nationality operate in Caribbean immigrant women's experience of being college students. Focus groups and life story interviews were conducted with 27 English-speaking Caribbean-born women attending CUNY undergraduate colleges. The data yielded four main findings: First, Caribbean gender roles and traditions are not homogenous; hence, there is variation in the ways in which these affect women's experiences in the …

The Future Of Student Grouping Systems In Science 14-16., Stephen Rowcliffe Jan 2006

The Future Of Student Grouping Systems In Science 14-16., Stephen Rowcliffe

School of Law, Humanities and Social Sciences

Ability grouping is a contentious issue in high school science education, and one that divides teachers, parents, and policymakers alike. However, it may be that current grouping systems are founded on ideasthat are failing to provide for the best interests of students at any ability level. This article aims to reviewcurrent practice and its effects on student and teacher outcomes, and suggest a new direction for studentgrouping polices based on the ideal of “science for all” through curriculum reform and choice-basedmodular course systems. The article is based largely on the British education system.

This article will discuss and demonstrate how attorneys can protect and yield better legal outcomes for their clients by collaborating with social service professionals specifically, and by reconsidering their own roles in serving trafficking survivors--not only as legal advocates, but as informal mental health advocates. This article also presents one model of comprehensive service delivery, that of the Coalition to Abolish Slavery ("CAST"), in which legal and social services complement and support each other within one agency to better serve clients.

Profiles Of Pre-Service Teacher Education : An Investigation Into The Nature Of Selected Exemplary Programs In Jamaica And Michigan, Heather Smith-Sherwood

Dissertations

Problem. The education system in this 21st century is faced with numerous challenges that, quite often, leave administrators and classroom teachers bewildered in their quest for effective solutions. In light of these challenges, this study investigated three exemplary pre-service teacher education programs in Jamaica and Michigan in order to provide an account of how these are structured in different contexts of tertiary institutions and, in addition, to identify how these programs ensure that their graduates are prepared to function effectively in today’s schools.

Method. A qualitative case study design was used in this study. Five categories of stakeholders in the …
