In June of 2005 the federal legislation On the national language was signed into law by Vladimir Putin.1 The bill, revised and renamed several times after its initial introduction in the Duma in 2001, proved to be highly controversial, stimulating lively public debate. The law merits discussion as the first major piece of federation legislation focused on language policy and language planning to appear in the Russian Federation in several years. The first years of the twenty‐first century in Russia saw a considerable rise in the state’s regulation of language. In the words of one of the agents of this regulation, Natalia Liashchenko, a Consultant for the Committee for the Nationalities, “Определенный поворот к проблемам русского языка произошел и в органах государственной власти России.” The engagement of the state by way of regulations in the national discussion of the nature and quality of the Russian language demonstrates ‘the state power turning to language’.

Worlds Together . . . Words Apart: An Assessment Of The Effectiveness Of Arts-Based Curriculum For Second Language Learners, Stephanie Urso Spina

The objective of this study is to assess whether authentic arts-based1 curricula facilitate the acquisition of English as a second language (ESL) without sacrificing proficiency in the first language (Spanish). This question is examined theoretically and empirically. First, the use of an arts-based curriculum is positioned within a Vygotskiian framework of learning as reflected in current research. This overview is organized by two themes: 1) the authenticity of the art experience and 2) the emphasis on social interaction and the cognitive mediation among sign systems. Applicable findings from related literature are reviewed and synthesized within each of these themes. Secondly, …

Interaction Of Native- And Second- Language Vowel System(S) In Early And Late Bilinguals, Wendy Baker, Pavel Trofimovich

The objective of this study was to determine how bilinguals’ age at the time of language acquisition influenced the organization of their phonetic system(s). The productions of six English and five Korean vowels by English and Korean monolinguals were compared to the productions of the same vowels by early and late Korean-English bilinguals varying in amount of exposure to their second language. Results indicated that bilinguals’ age profoundly influenced both the degree and the direction of the interaction between the phonetic systems of their native (L1) and second (L2) languages. In this Article, we suggest that litigation can be analyzed as though it is a competitive research and development project. Developing this analogy, we present a two-stage real option model of the litigation process that involves sequential information revelation and bargaining over the surplus generated by early settlement. Litigants are risk-neutral and have no private information. The model generates results that, we believe, have analytic and normative significance for the economic analysis of litigation

Ms. Mart examines the legal bases of the public's right to access government information, reviews the types of information that have recently been removed from the Internet, and analyzes the rationales given for the removals. She suggests that the concerted use of the Freedom of Information Act by public interest groups and their constituents is a possible method of returning the information to the Internet.

Abstract:

This chapter examines how Raja Rammohan Ray utilized Vedanta philosophy as a strategic response to colonial critiques of Hinduism during the early nineteenth century. Ray emerged as a pivotal figure who navigated between British orientalist discourse and Indian religious reform, employing Advaita Vedanta to counter accusations of idolatry and polytheism leveled against Hindu practices. The analysis demonstrates how Ray's translations of the Upanishads and his promotion of Vedantic monotheism served dual purposes: defending indigenous civilization against missionary attacks while accommodating European notions of rational religion. Ray's approach involved significant textual interventions, including rendering the neuter brahman as masculine "God" …

In March of 2005 I was a cast member in Mad Cow Theatre's production of the Morality drama Everyman. This classic tale on the condition of human dying is regarding as one of the greatest dramas of the Medieval period and is one of the first plays in the English language to be put into print. This thesis is an actor's journey into the history of Medieval theatre, the challenges of producing Everyman for a contemporary audience, and the techniques of acting implemented in the creation of allegorical characters. In one of his first major writings on the United States Supreme Court, Justice John Paul Stevens famously argued that "[t]here is only one Equal Protection Clause." In the ensuing three decades, that quotation has become something of a battle cry for commentators critical of tiered equal protection review, many of whom not only seek to dismantle tiered equal protection scrutiny but also to replace it with an alternative (usually more complicated) doctrinal super-structure. Schooling Miranda: Policing Interrogation In The Twenty-First Century Schoolhouse, Paul Holland

This article directs courts to base their application of Miranda on an explicit and contextually sound consideration of the relationships among students, officers and administrators. This article argues that Miranda applies when a state agent questions a student under circumstances in which it would be reasonable for the student to believe that she is the subject of law enforcement authority, regardless of whether a law enforcement officer conducts the questioning. The determination that Miranda applies is not tantamount to a decision that the student was in custody. It is merely a prelude to the custody inquiry. This article does not …

This article focuses on the use of linguistic expertise by trial courts to aid in fact-finding. It identifies many of the ways the legal system has been enriched by donations from linguistic scholarship. In addition, it discusses the underutilized-at-present use of linguistic knowledge by appellate courts as a tool for crafting and applying doctrinal rules. Whereas courts have adopted economics analysis in determining appropriate legal rules, linguistic science has been neglected. Linguistic predictions are more testable and falsifiable than economic predictions. Linguistic research can be useful—particularly in the areas of comprehensibility of texts and resolving textual ambiguity. Indeed, legislatures and …

"Transition systems pervade much of computer science. This article outlines the beginnings of a general theory of specification languages for transition systems. More specifically, transition systems are generalised to coalgebras. Specification languages together with their proof systems, in the following called (logical or modal) calculi, are presented by the associated classes of algebras (e.g., classical propositional logic by Boolean algebras). Stone duality will be used to relate the logics and their coalgebraic semantics."

This was accomplished by studying the effect that three specific factors have on that decision. This article shows how the enlistment of private monitors can overcome the limits of public enforcers in overseeing gatekeeper compliance with liability-induced duties. Gatekeepers are private actors who possess skills or advantages that allow them to detect and prevent wrongdoing in a more cost-effective way than the state. The problem enforcers face is that the same skills or advantages that equip gatekeepers with the ability to identify wrongdoing often provide them with the means and incentives to subvert their duties and to evade public oversight. Policymakers have largely attempted to remedy this challenge by increasing sanctions against gatekeepers and have …

Should the U.S. constitution afford greater discretion to states than to the federal government in matters affecting religion? In recent years, a number of commentators have been asserting that the Establishment Clause should not apply to the states. Justice Thomas has embraced this view, while offering his own refinements to it. Moreover, the Supreme Court's decision in Locke v. Davey (2004) ruled that a state did not run afoul of the Free Exercise Clause when it refused to subsidize religious studies, in a context in which the Establishment Clause would have permitted the subsidy.

eXtensible Markup Language (XML) structures information in documentary systems ranging from financial reports to medical records and business contracts. XML standards for specific applications are developed spontaneously by self-appointed technologists or entrepreneurs. XML's social and economic stakes are considerable, especially when developed for the private law of contracts. XML can reduce transaction costs but also limit the range of contractual expression and redefine the nature of law practice. So reliance on spontaneous development may be sub-optimal and identification of a more formal public standard setting model necessary.
