Demystifying Legal Reasoning: Part Ii, Larry Alexander, Emily Sherwin Jan 2006

Demystifying Legal Reasoning: Part Ii, Larry Alexander, Emily Sherwin

Cornell Law Faculty Publications

"Demystifying Legal Reasoning" defends the proposition that there are no special forms of reasoning peculiar to law. Legal decisionmakers engage in the same modes of reasoning that all actors use in deciding what to do: open-ended moral reasoning, empirical reasoning, and deduction from authoritative rules. Part II (abstracted here) addresses common law reasoning, when prior judicial decisions determine the law. Part III addresses interpretation of texts. We conclude that, in both areas, the popular view that legal decisionmakers practice special forms of reasoning are false.

In Chapter 2, we propose that there are two plausible models of common law reasoning, …

Courage And Knowledge At Protagoras 349e1-351b2, David Wolfsdorf Jan 2006

Courage And Knowledge At Protagoras 349e1-351b2, David Wolfsdorf

The Society for Ancient Greek Philosophy Newsletter

At Protagoras 349E1-350C5 Socrates argues for the identity of courage and knowledge, and at 350C6- 351B2 Protagoras objects to Socrates’ argument. Between 1961 and 1985, a few valuable contributions in English were made to the interpretation of these passages. None, however, is entirely satisfactory. And in the last twenty years, among some cursory treatments in studies not particularly focused on these passages, no notable progress has been made.

The objective of this paper is to present a more satisfactory interpretation of Socrates’ argument and Protagoras’ objection, in particular by engaging with a set of problems with which previous commentators have …

Των Λογων Ο Πρωτος Τε Και Σμικροτατος, Sph. 262c6-7: The First And Littlest Of Sentences, John J. Mulhern Jan 2006

Των Λογων Ο Πρωτος Τε Και Σμικροτατος, Sph. 262c6-7: The First And Littlest Of Sentences, John J. Mulhern

The Society for Ancient Greek Philosophy Newsletter

In this paper I show that the orthodox syntax suggested in Sophistes 262C6-7 and the surrounding text is not adhered to in the dialogues. Within the limited universe of monadic atomic sentence syntax extended with constants for existence and unity, in fact, all but three of the 14 possible irregular forms are used in one or other of the three dialogues instanced here. Self-predication, which, in the mid-twentieth-century, fascinated so many scholars, turns out to be just one among the many varieties of irregular syntax in the dialogues.

The nonadherence of other interlocutors to the Eleatic Stranger’s description of monadic …

Employing Technologies To Engage Students With Diverse Needs In Rural School Communities, Chris Forlin, Graeme Lock Jan 2006

Employing Technologies To Engage Students With Diverse Needs In Rural School Communities, Chris Forlin, Graeme Lock

Australian Journal of Teacher Education

This paper considers the use of information and communication technologies (ICT) to enable students to access the curriculum in inclusive classrooms. The research considers the latest trends regarding promotion of the use of ICT in education in Australia and then considers the outcome from the perspective of one state, that of Western Australia. In particular, the focus is on the use of ICT in remote and rural school communities for supporting inclusive practices. While it seems clear that considerable financial support has been allocated to the enhancement of access to ICT across Australia by various education departments, there are several …

Participant Reactions To Two-Way Immersion (Twi) Programs, Brett Frayseth, Carrie Lewis Miller, James Livermont, Melissa Siebke

IT Solutions Publications

The purpose of this study was to elicit participant reactions to two-way immersion (TWI) programs in the United States of America. A large number of recent studies have focused on instructor views and perspectives of two-way immersion programs, so this study aimed to gain insight from students who are, or who have, participated in TWI programs throughout North America.

One hundred fifty-one TWI schools throughout the United States were contacted and asked to participate in this study. Two similar surveys were developed, one for current TWI students, and another for former TWI students. Students from these two groups were asked …

Agreeing To Disagree: Cultural Relativism And The Difficulty Of Defining Terrorism In A Post-9/11 World, Sami Zeidan

UC Law SF International Law Review

Paradoxically, in a post-9/11 world where there is an unprecedented international joint response to counter-terrorism, there is still no universal, permanent and comprehensive definition of terrorism. This essay exposes the legal and political issues arising from the tension created between the universal agreement to coordinate counter-terrorism efforts on the one hand, and the proliferation of culturally relativistic definitions of terrorism on the other.

France: Banning Legal Pluralism By Passing A Law, Jessica Fourneret Jan 2006

France: Banning Legal Pluralism By Passing A Law, Jessica Fourneret

UC Law SF International Law Review

On March 15, 2004, French president Jacques Chirac enacted a law prohibiting public school students from wearing clothing and insignia that manifests a religious affiliation. The clear aim of the law was to prohibit female Muslim students from wearing headscarves to public schools. Critics of the ban state that wearing the headscarf is a Muslim woman's religious duty, akin to a law she must follow. This article explores the Western system of laws and the conflict between that system and religious belief systems which impose differing sets of laws. The author examines the impossible choice imposed on school-aged children as …

Leaving Home: A Handbook For Teachers To Promote Critical Thinking, Leanne Molly Luehrs

All Graduate Projects

A handbook of instructional strategies connected to a text set theme for fourth grade teachers to promote critical thinking was developed. The handbook is intended for fourth grade teachers interested in promoting critical thinking through the use of children's literature. The text set theme, leaving home, was chosen and children's literature and curriculum was developed around this thematic focus. Library research, books, and the Internet aided in the development of this project. The studies showed the importance of developing critical thinking skills in elementary students. Marxism's ‘Communicative Crisis’? Mapping Debates Over Leninist Print-Media Practices In The 20th Century, Herbert Pimlott Jan 2006

Marxism's ‘Communicative Crisis’? Mapping Debates Over Leninist Print-Media Practices In The 20th Century, Herbert Pimlott

Communication Studies Faculty Publications

Despite the scholarly neglect of Marxism’s ‘communicative crisis’, it was a topic of concern that was addressed, debated and negotiated over by party leaders, intellectuals and activists on a continuous basis throughout the 20th century. These concerns revolved around three areas: first, the primary means of print communication, the party paper; second, the specialization of production, particularly around the role of writers and journalists; and third, the search for a popular rhetoric and writing style, which would appeal to the general public. This paper maps out the ‘communicative crisis’ of Marxism in the 20th century through an examination of key …

In Defense Of The Objective Epistemic Approach To Argumentation, John Biro, Harvey Siegel Jan 2006

In Defense Of The Objective Epistemic Approach To Argumentation, John Biro, Harvey Siegel

Philosophy Articles and Papers

In this paper we defend a particular version of the epistemic approach to argumentation. We advance some general considerations in favor of the approach and then examine the ways in which different versions of it play out with respect to the theory of fallacies, which we see as central to an understanding of argumentation. Epistemic theories divide into objective and subjective versions. We argue in favor of the objective version, showing that it provides a better account than its subjectivist rival of the central fallacy of begging the question. We suggest that the strengths of the objective epistemic theory of …

Train Our Jurors, Jonathan Koehler Jan 2006

Train Our Jurors, Jonathan Koehler

Faculty Working Papers

Lay jurors are often legally and logically unprepared for trial. In response, it is recommended that jurors receive training in how to make better legal decisions. This chapter suggests that jurors should receive comprehensive training in critical legal doctrines and in how to reason with legal evidence. Jurors who cannot be trained to achieve minimal levels of competence (in the law or in basic reasoning) should be excused from jury service. Suggestions are given as to how policy makers and researchers who are interested in jury reform may wish to proceed.
