A Meaning-Based Instruction To Enhance Literacy Learning In A Dual-Language Kindergarten Classroom, Megan Melissa Fife Mar 2006

A Meaning-Based Instruction To Enhance Literacy Learning In A Dual-Language Kindergarten Classroom, Megan Melissa Fife

Theses and Dissertations

Concerns among educators continue to grow with the increased enrollment of Second Language Learners (SLL) in classrooms throughout the United States. This influx has stressed the boundaries of current methods of literacy instruction, which are not designed to meet the needs of these at-risk students. Literacy instructional methods need to be remediated through early intervention, followed by effective literacy instruction that is designed to meet the specific needs of SLL. Effective literacy instruction overcomes differences in culture and background by using meaning-based instruction coupled with engaging and varied contexts. This study evaluated the effectiveness of incorporating meaning-based instructional activities into …

Reducing Uncertainty In Effects-Based Operations, Wilburn B. Mclamb Mar 2006

Reducing Uncertainty In Effects-Based Operations, Wilburn B. Mclamb

Theses and Dissertations

Known as the fog of war, uncertainty has been prevalent in the conduct of military operations throughout human history. Intelligence collection efforts are tasked to reduce this uncertainty through the collection of information. Utilizing Shannon's entropy as a measure of the expected information gain due to an intelligence collection effort, a methodology is developed to prioritize and allocate intelligence assets in an efficient manner. Incorporated in this methodology are target priority and the requirement to reassess dynamic targets. The application area for the methodology is Effects-Based Operations. A generalized state model is developed to conduct adversary system-of-systems analysis. This model …

The Freedom To Manifest Religious Belief: An Analysis Of The Neccesity Clauses Of The Iccpr And The Echr, Todd Parker

ExpressO

This paper examines Article 18 of the International Covenant on Civil and Political Rights and Article 9 of the European Convention on Human Rights. Both documents affirm freedom of religion as a fundamental human right, yet both recognize the need for restrictions on freedom of religion when “necessary.” The paper discusses the text of Articles 18 and 9, as well as European Court of Human Rights and Human Rights Committee cases interpreting and applying the Articles. The paper then analyzes several current laws restricting religious freedom on necessity grounds as to whether the restrictions are legitimate or illegitimate under the …

Fuck, Christopher M. Fairman Mar 2006

Fuck, Christopher M. Fairman

ExpressO

This Article is as simple and provocative as its title suggests: it explores the legal implications of the word fuck. The intersection of the word fuck and the law is examined in four major areas: First Amendment, broadcast regulation, sexual harassment, and education. The legal implications from the use of fuck vary greatly with the context. To fully understand the legal power of fuck, the nonlegal sources of its power are tapped. Drawing upon the research of etymologists, linguists, lexicographers, psychoanalysts, and other social scientists, the visceral reaction to fuck can be explained by cultural taboo. Fuck is a taboo …

The Expressive Impact Of Patents, Timothy R. Holbrook Mar 2006

The Expressive Impact Of Patents, Timothy R. Holbrook

ExpressO

Patents represent a quid pro quo between the public and the inventor: in exchange for disclosing the invention, the inventor receives the right to exclude others from practicing her invention. They therefore serve as a source technical information. Patents also communicate information to markets and companies that serve to reduce various transaction costs, allowing more efficient transactions and investment. Patents consequently communicate various types of information beyond the technical.

There is no reason, however, that such messages must be limited to the technical or the pecuniary. This Article explores whether patents, like other governmental acts such as legislation, can create …

Galactic Stupidity And The Business Judgment Rule, David Rosenberg Mar 2006

Galactic Stupidity And The Business Judgment Rule, David Rosenberg

ExpressO

The article examines whether the business judgment rule allows courts to review the substantive wisdom of decisions made by corporate directors. Although the conventional view among legal scholars is that the business judgment rule precludes such review, the article concludes that Delaware courts must sometimes examine the substance of directors’ decisions in order to determine whether those directors acted in good faith. Where the evidence shows that a director acted in a rational way (and therefore in good faith) in arriving at a decision, courts will not review the substance of that decision. However, where a director made a decision …

Who Cares What Thomas Jefferson Thought About Patents: Reevaluating The Patent "Privilege" In Historical Context, Adam Mossoff Mar 2006

Who Cares What Thomas Jefferson Thought About Patents: Reevaluating The Patent "Privilege" In Historical Context, Adam Mossoff

ExpressO

The conventional wisdom holds that American patents have always been grants of special monopoly privileges lacking any justification in natural rights philosophy, a belief based in oft-repeated citations to Thomas Jefferson's writings on patents. Using privilege as a fulcrum in its analysis, this Article reveals that the history of early American patent law has been widely misunderstood and misused. In canvassing primary historical sources, including political and legal treatises, Founders' writings, congressional reports, and long-forgotten court decisions, it explains how patent rights were defined and enforced under the social contract doctrine and labor theory of property of natural rights philosophy. …

The Legalization Of Fat: Law, Science, And The Construction Of A Moral Panic, Paul Campos Mar 2006

The Legalization Of Fat: Law, Science, And The Construction Of A Moral Panic, Paul Campos

ExpressO

Over the past decade, American public health authorities have made increasingly alarming claims regarding how obesity is becoming the nation’s leading public health problem. These warnings have inspired a flurry of legislative, administrative, and judicial responses, and calls for further legal intervention are issuing constantly from obesity researchers and public health officials. This article surveys and critiques the sudden wave of attempts to use the American legal system to shrink the nation’s waistline The article demonstrates that the health risks associated with the populace’s fairly modest increasing average weight have been greatly exaggerated; that the causal links, if any, between …

How U.S. Audiences View Korean Films: A Case Study Of Oldboy, Sung Taik Cha

USF Tampa Graduate Theses and Dissertations

Prior studies have shown that the information and cultural product flow is dominantly one direction from large/wealthy markets to smaller markets. Extending this position through the underlying research, it is expected that the audiences in the United States, one of the largest cultural product exporters, may have shaped certain perceptions on the scarcity of Korean films in their domestic film market. By studying the users in an internet film discussion community, this research aims to provide useful ideas about how American audiences perceive Korean films. This qualitative case study conducted a content analysis of the actual postings by the participants …

A Prolegomena To Federal Statutory Interpretation: Identifying The Sources Of Interpretive Problems, James G. Christy Mar 2006

A Prolegomena To Federal Statutory Interpretation: Identifying The Sources Of Interpretive Problems, James G. Christy

ExpressO

This article traces the problems encountered in interpreting statutes to twenty-nine distinct problems encountered in creating statutory rule systems. Specifically, given their purposes and other purposes the law is simultaneously pursuing, statutory rule systems inevitably emerge incomplete in a least sixteen types of ways and containing key words and phrases with meanings that are in part inappropriate in at least thirteen types of ways. Interpreting a statute includes completing its incomplete rule system and modifying the meanings of words and phrases to bring the statute into better allignment with underlying purposes. So understood, the process of interpreting statutes can add …
