A Price Theory Of Legal Bargaining: An Inquiry Into The Selection Of Settlement And Litigation Under Uncertainty, Robert J. Rhee Mar 2006

A Price Theory Of Legal Bargaining: An Inquiry Into The Selection Of Settlement And Litigation Under Uncertainty, Robert J. Rhee

Faculty Scholarship

Conventional wisdom says that economic surplus is created when the cost of litigation is foregone in favor of settlement, a theory flowing from the Coase Theorem. The cost-benefit analysis weighs settlement against the expected value of litigation net of transaction cost. This calculus yields the normative proposition that settlement is a superior form of dispute resolution and so most trials are considered errors. While simple in concept, the prevailing economic model is flawed. This article is a theoretical inquiry into the selection criteria of settlement and trial. It applies principles of financial economics to construct a pricing theory of legal …

H.L.A. Hart And The Methodology Of Jurisprudence, Ian Farrell Mar 2006

H.L.A. Hart And The Methodology Of Jurisprudence, Ian Farrell

Sturm College of Law: Faculty Scholarship

Nicola Lacey’s biography, A Life of H.L.A. Hart: The Nightmare and the Noble Dream, is a triumph of the highest order. Lacey takes to the role of biographer with aplomb, weaving thoughtful philosophical assessment into an intimate, richly detailed tapestry of Hart’s life and character. Her sympathetic portrait of a man whose unparalleled external success in legal philosophy contrasted sharply with his life-long internal struggle with self-doubt is rewarding reading on several levels, and not just for aficionados of jurisprudence. Hart’s life story is compelling in its own right, and Lacey’s treatment of it holds the additional promise that biographical …

The Time Course Of Variability Effects In The Perception Of Spoken Language: Changes Across The Lifespan, Conor T. Mclennan Mar 2006

The Time Course Of Variability Effects In The Perception Of Spoken Language: Changes Across The Lifespan, Conor T. Mclennan

Psychology Faculty Publications

Although spoken language is communicated via a rapidly varying signal, human listeners recognize spoken words both quickly and accurately. Nonetheless, variability in speech does have implications for both the processes and representations involved in spoken language perception. Moreover, variability effects have been observed across the lifespan, ranging from infants to older adults. Many factors could potentially modulate the degree to which variability affects spoken language perception. In particular, recent findings demonstrate that variability effects follow a time course, manifesting themselves at predictable points during perceptual processing. However, time course investigations are currently limited to young adults. Therefore, the current paper …

The Impact Of Biculturalism On Language And Literacy Development: Teaching Chinese English Language Learners, Barbara C. Palmer, Chia-I Chen, Sara Chang, Judith T. Leclere

Reading Horizons: A Journal of Literacy and Language Arts

According to the 2000 United States Census, Americans age five and older who speak a language other than English at home grew 47 percent over the preceding decade. This group accounts for slightly less than one in five Americans (17.9%). Among the minority languages spoken in the United States, Asian-language speakers, including Chinese and other Asian and Pacific Islander languages, have increased by more than 75 percent. Futher, the proportion of Asian language speakers having difficulty speaking English has almost doubled (Klein, Bugarin, Beitranena, & McArthur, 2004). Today, Chinese students are one of the largest groups of English Language Learners …

Regulation And Freedom In Global Business Education, Stefano Harney, Cliff Oswick

Research Collection Lee Kong Chian School Of Business

Purpose: This paper seeks to confront the orthodoxy of global business education with some insights from postcolonial theory in order to develop a new critical pedagogy adequate for a global sociology of management and accounting. Design/methodology/approach: Reviewing the state of play in postcolonial theory and noting the new politicisation in that field, the paper asks what relevance this politicisation might have for an alternative to orthodox global business education. Findings: The paper finds that the texts available to postcolonial theory present a wealth beyond the regulation of colonial and neo‐colonial regimes and in contrast critical management studies do not have …

Yizkor Books As Holocaust Grey Literature, Gretta E. Siegel, Faith Jones Mar 2006

Yizkor Books As Holocaust Grey Literature, Gretta E. Siegel, Faith Jones

Library Faculty and Staff Publications and Presentations

Yizkor is a Hebrew word meaning 'you will remember', and Yizkor books are books that commemorate the vanished communities destroyed by the Holocaust. As the 60th anniversary of the liberation of the German concentration camps is commemorated this year, it seems fitting, with this conference being held in Europe, to call attention to this unique and interesting body of literature.

Yizkor books present an historic but interesting type of grey literature, with significant modern day interest. While the Yizkor Book had its origins in the 13th century, it reemerged early in the 20th Century as a tool for documenting the …

Engaging Students In The L2 Reading Process, Marcia L. Wilbur Mar 2006

Engaging Students In The L2 Reading Process, Marcia L. Wilbur

Dimensions

This article will consider a necessary departure from more traditional paradigms, where speaking skills are the primary focus and in which reading is viewed as something intermediate or advanced learners do with authentic literature once they have mastered a particular level of grammatical structures. Instead, reading will be considered as an important component of L2 instruction that, when included along side other input modes, can enrich students’ second language acquisition. Concepts and strategies on which to build classroom practices as well as practical suggestions for implementing pre-, during-, and post-reading activities are included. Considerations that place learners at the center …

Talking About Music:Ethnographic Interviews On Traditional Hispanic Songs, Paula Heusinkveld

Dimensions

This article proposes a variety of activities designed to enrich the study of authentic Hispanic music in the foreign language class. As an integral part of any lesson on a culturally authentic song, students interview native speakers, both in and out of class, to learn about the cultural context of various songs. Of special interest are songs that have strong associations with specific cultural practices, such as “Las mañanitas.” In other assignments, students interview native speakers about their musical tastes, seek out songs from native informants, and then share these songs with the class. The cultural information obtained from the …

English Or Spanish?! Language Accommodation In New York City Service Encounters, Laura Callahan Mar 2006

English Or Spanish?! Language Accommodation In New York City Service Encounters, Laura Callahan

Modern Languages & Literature

Speech accommodation theory refers to an individual's adaptation of his or her speech to more closely approximate that of an interlocutor. A change to the interlocutor's language is one of the most obvious and observable forms of accommodation. Language choices are shaped by the linguistic proficiency of both speaker and interlocutor, the ingroup or outgroup status of each, and the situational norms for the setting in which an exchange takes place. Language choices in the workplace are further influenced by company policies and by the asymmetrical power dynamic in worker-customer interactions.

This paper reports on data from service encounters with …

Interracial Marriage In The Shadows Of Jim Crow: Racial Segregation As A System Of Racial And Gender Subordination, Reginald Oh Mar 2006

Interracial Marriage In The Shadows Of Jim Crow: Racial Segregation As A System Of Racial And Gender Subordination, Reginald Oh

Law Faculty Articles and Essays

This Essay works through essentialist language to reveal the multidimensional nature of racial segregation as a system of subordination. Specifically, it examines how racial segregation in public schools and laws prohibiting interracial marriage mutually reinforce racial and gender inequality. Part I discusses Brown and the traditional analysis of that decision as a case dealing with race, racial stigma, and equal educational opportunity. Part II reviews laws prohibiting interracial marriage, the reasoning and purpose behind these laws, and the Loving decision that rendered such laws unconstitutional. Part III then examines racial segregation in public schools as more than just a system …
