The War On Terrorism And International Humanitarian Law, Steven R. Ratner Jan 2006

The War On Terrorism And International Humanitarian Law, Steven R. Ratner

Articles

My focus today is on the broad question of the so-called "war on terrorism" and how it fits within the framework of the rules of international humanitarian law. Are these laws applicable? There have been a variety of claims since September 11th that humanitarian law needs some kind of revision. Some making this claim assert that the current legal regime is too generous to terrorists, while others insist that it is too generous to governments. The International Committee of the Red Cross (ICRC) has even convened various groups of experts to discuss this issue and the assumption among many has …

A Cognitive Theory Of Trust, Claire Hill, Erin O'Hara O'Connor Jan 2006

A Cognitive Theory Of Trust, Claire Hill, Erin O'Hara O'Connor

Articles

Interpersonal trust is currently receiving widespread attention in the academy. Many legal scholars incorrectly assume that interpersonal trust is an unmitigated good (or bad) and that legal policy should therefore be crafted to maximize (or minimize) trust. A more nuanced understanding of trust indicates instead that it should be promoted or discouraged, depending on the context. Such an understanding needs to reflect the fact that trust and distrust can, and often do, coexist. In most relationships, the parties trust one another with regard to some matters and yet distrust one another with regard to other matters. More specifically, developing a …

Foreclosure Equity Stripping: Legal Theories And Strategies To Attack A Growing Problem, Prentiss Cox Jan 2006

Foreclosure Equity Stripping: Legal Theories And Strategies To Attack A Growing Problem, Prentiss Cox

Articles

Foreclosure equity stripping is the classic case of kicking someone who is down. The person perpetrating the equity strip-let's call this person the "acquirer"- targets homeowners who are in foreclosure and have equity remaining in the property. Promising to "save" the home for the desperate homeowner, the acquirer offers refinancing or other assistance to "stop the foreclosure." For too many foreclosed homeowners, these promises end when the acquirer or the acquirer's confederates gain title to the property and take the homeowner's equity.

Trade And Tensions, Daniel J. Gifford Jan 2006

Trade And Tensions, Daniel J. Gifford

Articles

International disputes and tensions arise in situations where one nation is seeking its own economic betterment in ways that diminish the economic welfare of other nations. Prior to World War II, most nations deployed systems of tariffs and import quotas in unveiled attempts to protect their domestic in- dustries. Today, trading tensions are often generated by a range of government activities that limit imports or subsidize exports; yet the governments that impose these measures often rationalize them as policy measures that have no protectionist or other trading objective. The earlier trading model was a mer- cantilist one. Economic welfare was …

Electrical Pulse Formation During High Temperature Reaction Between Ni And Al, Mona Setoodeh, Karen S. Martirosyan, Dan Luss Jan 2006

Electrical Pulse Formation During High Temperature Reaction Between Ni And Al, Mona Setoodeh, Karen S. Martirosyan, Dan Luss

Physics & Astronomy Faculty Publications

An electric voltage pulse (duration of about 2ms) with an amplitude of up to 0.6V was generated during the reaction between nickel and aluminum powders by a high temperature moving reaction front. The electrical signal formed during the initial stages of the combustion was annihilated before the moving front attained its maximum temperature. The voltage amplitude and combustion temperature depended on the particle size of the reactants as well as the Al to Ni ratio in the reactant mixture, and their largest values were attained for a mixture containing 27–31.5wt% Al. The combustion temperature increased when smaller Al particles were …

The in-plane and out-of-the-plane angular dependences of the resonance field were analyzed within the Landau-Lifshitz-Gilbert approach. The second- and fourth-order magnetic anisotropy energies were derived. The temperature dependence of magnetization and of magnetic anisotropy were studied by superconducting quantum interference device and ferromagnetic resonance.

Phytoremediation Of Nitrate In The Karlsruhe Aquifer, Mchenry County, North Dakota, Laura C. Ackerman Jan 2006

Phytoremediation Of Nitrate In The Karlsruhe Aquifer, Mchenry County, North Dakota, Laura C. Ackerman

Undergraduate Theses and Senior Projects

Nitrate concentrations in the Karlsruhe aquifer (23,070 acres), located in north central McHenry County, North Dakota have been monitored by the North Dakota State Water Commission since 2001. The average nitrate-N concentration in the top ten feet of the aquifer was determined to be about 14.0 mg/L. The objective of this engineering design was to determine the location of shallow areas in the Karlsruhe aquifer where phytoremediation would be most suitable and to evaluate the effect of phytoremediation on attenuating nitrate-N concentrations. The determination of areas in the Karlsruhe aquifer where phytoremediation would be most effective was carried out through …

Faculty and Staff Scholarship

Design Of Optimal Pi Controllers For Doubly Fed Induction Generators Driven By Wind Turbines Using Particle Swarm Optimization, Wei Qiao, Ganesh K. Venayagamoorthy, Ronald G. Harley Jan 2006

Design Of Optimal Pi Controllers For Doubly Fed Induction Generators Driven By Wind Turbines Using Particle Swarm Optimization, Wei Qiao, Ganesh K. Venayagamoorthy, Ronald G. Harley

Electrical and Computer Engineering Faculty Research & Creative Works

When subjected to transient disturbances in the power grid, the variable frequency converter (VFC) is the most sensitive part in the variable-speed wind turbine generator system (WTGS) equipped with a doubly fed induction generator (DFIG). The VFC is normally controlled by a set of PI controllers. Tuning these PI controllers is a tedious work and it is difficult to tune the PI gains optimally due to the nonlinearity and the high complexity of the system. This paper presents an approach to use the particle swarm optimization algorithm to design the optimal PI controllers for the rotor-side converter of the DFIG. …

Experimental Infection Of Fox Squirrels (Sciurus Niger) With West Nile Virus, J. Jeffrey Root, Paul T. Oesterle, Nicole M. Nemeth, Kaci Klenk, Daniel H. Gould, Robert G. Mclean, Larry Clark, Jeffrey S. Hall Jan 2006

Experimental Infection Of Fox Squirrels (Sciurus Niger) With West Nile Virus, J. Jeffrey Root, Paul T. Oesterle, Nicole M. Nemeth, Kaci Klenk, Daniel H. Gould, Robert G. Mclean, Larry Clark, Jeffrey S. Hall

United States Department of Agriculture Wildlife Services: Staff Publications

Tree squirrels (Sciurus spp.) have exhibited high seroprevalence rates, suggesting that they are commonly exposed to West Nile virus (WNV). Many characteristics of WNV infections in tree squirrels, such as the durations and levels of viremia, remain unknown. To better understand WNV infections in fox squirrels (S. niger), we subcutaneously inoculated fourteen fox squirrels with WNV. Peak viremias ranged from 104.00 plaque-forming units (PFU)/mL of serum on day 2 post-infection (DPI) to 104.98 PFU/mL on 3 DPI, although viremias varied between individuals. Oral secretions of some fox squirrels were positive for WNV viral RNA, occasionally …

Economic Development And The Role Of Agricultural Technology, Richard Grabowski, Sharmistha Self Jan 2006

Economic Development And The Role Of Agricultural Technology, Richard Grabowski, Sharmistha Self

Economics Discussion Papers

In earlier debates on economic development, the agricultural sector’s role was somewhat controversial. While dualistic models highlighted the importance of agriculture, the mainstream literature placed a greater emphasis on the creation of a modern industrial sector. Soon agriculture disappeared from the mainstream development literature to re-emerge recently with a variety of multiple-sector growth models emphasizing the key role of agriculture and specifically technology in agriculture. This paper is an empirical cross-country analysis of agricultural technology’s role in economic development. Specifically, the hypothesis being tested is whether improvements in agricultural technology have a significant impact on long-run economic growth. The results …

Agricultural Development, State Effectiveness, And Long-Run Economic Development, Richard Grabowski, Sharmistha Self Jan 2006

Agricultural Development, State Effectiveness, And Long-Run Economic Development, Richard Grabowski, Sharmistha Self

Economics Discussion Papers

This paper begins with the presumption that rapid economic development requires an effective state. An effective state is able to act independently of powerful interest groups with the aim of allocating resources so as to maximize long-term economic growth. It will be argued that such states are more likely to arise in situations within which the state must earn its income. That is, it must construct an institutional apparatus to extract the revenue that it needs and it is dependent upon the bulk of its agricultural producers to produce this revenue. The higher agricultural productivity within a region, the more …

Emission Standard Versus Tax Under Oligopoly: The Role Of Free Entry, Sajal Lahiri, Yoshiyasu Ono Jan 2006

Emission Standard Versus Tax Under Oligopoly: The Role Of Free Entry, Sajal Lahiri, Yoshiyasu Ono

Economics Discussion Papers

We compare the effects of an emission tax, and those of an emission standard, on welfare and pollution levels under oligopolistic market structures. We consider the cases where the number of firms is fixed and where there is free entry and exit of firms. When the number of firms is fixed (i) an emission standard is welfare-superior to a pollution-equivalent emission tax, and (ii) an emission tax is emission-superior to welfare-equivalent emission standard. Under free entry and exit, the results are just the opposite when the inverse demand function is concave.

Identification Of Svc Dynamics Using Wide Area Signals In A Power System, Ganesh K. Venayagamoorthy, Sandhya R. Jetti Jan 2006

Identification Of Svc Dynamics Using Wide Area Signals In A Power System, Ganesh K. Venayagamoorthy, Sandhya R. Jetti

Electrical and Computer Engineering Faculty Research & Creative Works

This paper presents the design of a wide area monitor (WAM) using remote area signals, such as speed deviations of generators in a power network, for identifying online the dynamics of a static var compensator (SVC). The design of the WAM is studied on the 12 bus FACTS benchmark system recently introduced. A predict-correct method is used to enhance the performance of the WAM during online operation. Simulation results are presented to show that WAM can correctly identify the dynamics of SVC in a power system for small and large disturbances. Such WAMs can be applied in the design of …

Free To Be: Supporting Lesbian, Gay, And Bisexual Students On Catholic Campuses, Jessica B. Buckley Jan 2006

Free To Be: Supporting Lesbian, Gay, And Bisexual Students On Catholic Campuses, Jessica B. Buckley

Faculty and Staff Scholarship

There is a long history of tension between the authority of the Vatican and the relative autonomy of Roman Catholic institutions of higher education, particularly in the United States of America. These tensions currently arise on Catholic campuses where student affairs practitioners seek to support lesbian, gay, and bisexual (LGB) students while at the same time operating within Vatican teaching that homosexuality is objectively disordered (Ratzinger, 1986). This paper will review those Catholic teachings on homosexuality and explore policies and practices of student affairs practitioners seeking to serve LGB students at Catholic higher education institutions.

Misperceptions In Intergroup Conflict: Disagreeing About What We Disagree About, John R. Chambers, Robert S. Baron, Mary L. Inman Jan 2006

Misperceptions In Intergroup Conflict: Disagreeing About What We Disagree About, John R. Chambers, Robert S. Baron, Mary L. Inman

Faculty Publications

Two studies examined misperceptions of disagreement in partisan social conflicts, namely, in the debates over abortion (Study 1) and politics (Study 2). We observed that partisans tend to exaggerate differences of opinion with their adversaries. Further, we found that perceptions of disagreement were more pronounced for values that were central to the perceiver's own ideology than for values that were central to the ideology of the perceiver's adversaries. To the extent that partisans assumed disagreement concerning personally important values, they were also inaccurate in perceiving their adversaries' actual opinions. Discussion focuses on the cognitive mechanisms underlying misperceptions of disagreement and …

Training Community-Based Professionals To Implement An Empirically Supported Parenting Program, Robert A. Fox, Kathleen M. Duffy, Kathryn M. Keller Jan 2006

Training Community-Based Professionals To Implement An Empirically Supported Parenting Program, Robert A. Fox, Kathleen M. Duffy, Kathryn M. Keller

College of Education Faculty Research and Publications

Professionals representing 14 community-based organizations were trained at three different sites serving urban and rural families to implement an empirically supported parenting program for families of young children with challenging behaviors. Of the 44 practitioners trained, 23 successfully completed the program, which involved passing a knowledge test and facilitating the entire 10session program with a family. A total of 28, primarily low-income families completed the program. The family outcomes obtained by the facilitators, based on multiple pre-program and post-program measures, were comparable with those reported previously in the literature for facilitators trained in university settings. The challenges inherent in efforts …

The Ongoing Battle Over Weingarten Rights For Nonunion Employees: What Do Terrorism, Corporate Fraud And Workplace Violence Have To Do With It?, Sarah Helene Duggin Jan 2006

The Ongoing Battle Over Weingarten Rights For Nonunion Employees: What Do Terrorism, Corporate Fraud And Workplace Violence Have To Do With It?, Sarah Helene Duggin

Scholarly Articles

Part I of this article offers a brief history of the development of the right of employees to co-worker representation. Part II analyzes the Board's June 2004 decision to withdraw Weingarten rights from non-union employees, and Part III explores key policy factors relevant to recognition of an employee's right to the presence of a co-worker in an investigative interview. Part IV argues that, rather than eliminating Weingarten rights for non-unionized workers, the NLRB should take the next available opportunity to reaffirm and enhance these safeguards.

Roles Of Cyclooxygenase-2 In Microglial Activation And Dopaminergic Cell Death, Rattanavijit Vijitruth Jan 2006

Roles Of Cyclooxygenase-2 In Microglial Activation And Dopaminergic Cell Death, Rattanavijit Vijitruth

University of Kentucky Doctoral Dissertations

Accumulating evidence suggests that inflammation plays an important role in the progression ofParkinson's disease (PD). Among many inflammatory factors found in the PD brain, cyclooxygenase(COX), especially the inducible isoform, COX-2, is believed to be the critical enzyme in theinflammatory response. Induction of COX-2 is also found in an experimental model of PD producedby administration of 1-methy-4-phenyl-1,2,3,6-tetrahydropyridine (MPTP). To investigate whetherinhibition of COX-2 by valdecoxib or deficiency in COX-2 could prevent dopaminergic neuronaltoxicity and locomotor activity impairment, we injected MPTP into valdecoxib-treated C57BL/6N miceand COX-2 deficient mice, respectively. Both automated total distance and vertical activitymeasurements of the open-field test were significantly …
