The Religious Land Use And Institutionalized Persons Act Of 2000 And Its Effect On Eleventh Circuit Law, Christina Harrison Schnizler Jul 2006

The Religious Land Use And Institutionalized Persons Act Of 2000 And Its Effect On Eleventh Circuit Law, Christina Harrison Schnizler

Mercer Law Review

The Religious Land Use and Institutionalized Persons Act of 2000 ("RLUIPA") was enacted by Congress in response to the Supreme Court overruling the Religious Freedom Restoration Act of 1993 ("RFRA") and as an extension of the Civil Rights of Institutionalized Persons Act. RLUIPA is intended "to protect religious liberty" and prohibits discrimination based on religion in two areas: land use regulations and religious rights for institutionalized persons. Generally, the religious land use provisions prevent state and local governments from creating improper zoning restrictions that unduly prohibit religious organizations from holding meetings, locating in a specific area, or expanding their current …

Pursuing Cost Containment In A Pluralistic Payer Environment: From The Aftermath Of Clinton’S Failure At Health Care Reform To The Balanced Budget Act Of 1997, Rick Mayes, Robert E. Hurley Jul 2006

Pursuing Cost Containment In A Pluralistic Payer Environment: From The Aftermath Of Clinton’S Failure At Health Care Reform To The Balanced Budget Act Of 1997, Rick Mayes, Robert E. Hurley

Political Science Faculty Publications

Following a decade in which Medicare operated as the leading ‘change agent’ within the US health care system, the private sector rose to the fore in the mid 1990s. The failure of President Clinton’s attempt at comprehensive, public sector-led reform left managed care as the solution for cost control. And for a period it worked, largely because managed care organizations were able to both squeeze payments to selective networks of medical providers and significantly reduce inpatient hospital stays. There was a lot of ‘fat’ in the nation’s convoluted health care system that could be (and was) eliminated through competitive negotiations …

Nurse Practitioner Adoption Of Clinical Innovations, Rhoberta Jones Haley Phd Jul 2006

Nurse Practitioner Adoption Of Clinical Innovations, Rhoberta Jones Haley Phd

Dissertations

Adoption of clinical innovations by Nurse Practitioners (NP) is a complex phenomenon, rooted in personal values and influenced by challenges within health care environments. When clinical innovations are adopted or rejected by NPs, this decision has meaning for patients, NPs, health care agencies, and society. The decision controls the opportunity for patients to access a clinical innovation that could reduce morbidity and mortality, save money, and provide satisfaction related to the health care encounter. The purpose of the study was to increase knowledge about NP adoption of clinical innovations, particularly emotionally-laden clinical innovations. The lines of inquiry focused on what …

A Retrospective Evaluation Of The Planetree Patient Centered Model Of Care Program's Impact On Inpatient Quality Outcomes, Susan Stone Phd Jul 2006

A Retrospective Evaluation Of The Planetree Patient Centered Model Of Care Program's Impact On Inpatient Quality Outcomes, Susan Stone Phd

Dissertations

This retrospective quasi experimental study evaluated the effectiveness of Planetree's patient-centered model of care. Donabedian's model linking structure and process to outcome was used to frame this study. The structure variable is the inpatient acute care hospital unit and the process variable consists of the Planetree patient-centered model of care. Outcomes are (1) patient satisfaction, (2) length of stay, (3) readmission, (4) cost per case, and (5) productive nursing hours per patient day. All data for patient satisfaction, length of stay, readmission, cost per case and productive nurse hours per patient day were retrospective, no participant recruitment was needed. Data …

After School Policy In The State Of Michigan, Erica Curry Jul 2006

After School Policy In The State Of Michigan, Erica Curry

SPNA Review

Young people spend just 20 percent of their waking hours in school. Nationwide, 28 million children between the ages of 6 and 17 have parents who work outside the home. These children need care and supervision before and after school, over the summer, and during school breaks. Often, the supply does not meet the demand, and many of the children are not able to get the care and supervision they need. In fact, lack of funding is causing many school-age programs to reduce services or to shut down completely. The lack of care is not without consequences. This paper examines …

From Service To Solidarity: Evaluation And Recommendations For International Service Learning, Melissa Baker-Boosamra Jul 2006

From Service To Solidarity: Evaluation And Recommendations For International Service Learning, Melissa Baker-Boosamra

SPNA Review

For service learning pedagogy to live up to its fullest and most authentic potential, educators must address the pitfalls of privilege that often go unexamined in relationships between groups of affluent university students and underprivileged populations that service learning programs traditionally seek to “serve.” In order to address dynamics of power and privilege inherent in any relationship between those who “give service” and those who are “served”, a relationship of honesty, reciprocity and mutuality must be established and promoted between those two groups. This study is an effort to further establish such a relationship by fully involving Salvadoran partners in …

Evaluating Public School Funding In Michigan And The Impact Of Proposal A, Anne-Marie Bessette Jul 2006

Evaluating Public School Funding In Michigan And The Impact Of Proposal A, Anne-Marie Bessette

SPNA Review

“The scope of reductions under consideration by the Grand Rapids Public School Board should be a wake-up call for the entire community. We can no longer expect business as usual—what was once unimaginable now becomes reality.” - Grand Rapids Education Reform Initiative.

While it is a national trend that public schools are struggling financially, each state has a unique situation due to different funding practices. The budget problems are often blamed on poor money management: too many administrators, too high levels of salaries, extra cost in working with unions, excessive benefits. As for Grand Rapids Public Schools, there are four …

Active Hyperemia And Vascular Conductance Differ Between Men And Women For An Isometric Fatiguing Contraction, Sandra K. Hunter, Jennie M. Schletty, Kristine M. Schlachter, Erin E. Griffith, Aaron J. Polichnowski, Alexander V. Ng Jul 2006

Active Hyperemia And Vascular Conductance Differ Between Men And Women For An Isometric Fatiguing Contraction, Sandra K. Hunter, Jennie M. Schletty, Kristine M. Schlachter, Erin E. Griffith, Aaron J. Polichnowski, Alexander V. Ng

Exercise Science Faculty Research and Publications

To understand the role of muscle perfusion in the sex differences of muscle fatigue, we compared the time to task failure, postcontraction (active) hyperemia, and vascular conductance for an isometric fatiguing contraction performed by young men and women with the handgrip muscles at 20% of maximal voluntary contraction (MVC) force. In study 1, the men (n = 16) were stronger than the women (n = 18), and study 2, the men (n = 7) and women (n = 7) were matched for strength. Isometric contractions were sustained during two sessions: 1) until the target …

Complementarity And Custom In Wage Contract Violation, John S. Earle, Klara Sabirianova Peter Jul 2006

Complementarity And Custom In Wage Contract Violation, John S. Earle, Klara Sabirianova Peter

Upjohn Institute Working Papers

We analyze a model of wage delay in which strategic complementarity arises because each employer's costs of violating its contracts decrease with the arrears in its labor market. The model is estimated on panel data for workers and firms in Russia, facilitating identification through fixed effects for employees, employers, and local labor markets, and instrumental variables based on policy interventions. The estimated reaction function displays strongly positive neighborhood effects, and the estimated feedback loops - worker quits, effort, strikes, and legal penalties - imply that costs of wage delays are attenuated by neighborhood arrears. We also study a nonlinear case …

Retiree Health Benefits And Retirement, James Marton, Stephen A. Woodbury Jul 2006

Retiree Health Benefits And Retirement, James Marton, Stephen A. Woodbury

Upjohn Institute Working Papers

Employer-provided health benefit coverage for workers who retire before age 65 has fallen over the last decade. We examine a cohort of male workers from the Health and Retirement Survey to examine questions about the dynamics of retiree health benefits and the relationship between retiree health benefits and retirement behavior, which is important for the debate over increasing health coverage for older Americans without reducing work incentives. On dynamics, we find that between 1992 and 1996, 24 percent of full-time workers who had retiree health benefits lost their coverage, while 15 percent of full-time workers who lacked coverage gained it. …

The Supreme Court's recent decision in Gonzales v. Oregon, like its decision last year in Gonzales v. Raich (the "medical marijuana" case), again raises questions about the bioethical consequences of the Controlled Substances Act. When, in 1970, Congress passed that act, it placed problematic drugs in one of five "schedules," and it authorized the U.S. attorney general to add or subtract drugs from the schedules. Drugs in schedule II have both a medical use and a high potential for abuse. Doctors may prescribe such drugs if they "obtain from the Attorney General a registration issued in accordance with the …

Financial Education And Asset Allocation, Steven D. Dolvin, William K. Templeton Jul 2006

Financial Education And Asset Allocation, Steven D. Dolvin, William K. Templeton

Scholarship and Professional Work - Business

We conduct a clinical study on a firm that restructures its 401(k) plan and simultaneously offers financial education seminars to its employees. The restructuring requires each employee to restate allocation percentages, thus we are able to analyze the specific benefits of retirement planning seminars on the asset allocation decision. We find that seminar attendance is associated with increased portfolio diversification and improved risk management. When combined with changes in return, the overall result is that seminar attendees create more efficient portfolios, which implies a better understanding of the retirement planning process.

An Exploration Of Enterprise Level Partnership And The Influences Informing Private Sector Organisations' Choice Of This Model In The Republic Of Ireland, Kevin O'Leary Jul 2006

An Exploration Of Enterprise Level Partnership And The Influences Informing Private Sector Organisations' Choice Of This Model In The Republic Of Ireland, Kevin O'Leary

Masters

The research follows the strategic choice of Partnership and seeks to gain an understanding of the processes and practices which define this concept and the political, economic and historical influences which have shaped it's evolution. The primary focus of this study is to explore the factors which have shaped the decision of private sector einployers to engage with or to reject Partnership as an appropriate model. The literature and the surveys consulted suggest that Partnership has not become an established or mainstream activity and reflects singularly low levels of uptake despite being actively promoted by Government and it's social partners. …
