Reconsidering Reparations, Alfred L. Brophy Jul 2006

Reconsidering Reparations, Alfred L. Brophy

Indiana Law Journal

Eric Posner's and Adrian Vermeule's essay, Reparations for Slavery and Other Historic Injustices, seeks a framework for defining reparations and evaluating reparations claims. It explores a limited set of past reparations, as well as the connections between those asked to pay reparations and past wrongdoers, and the connections between those receiving reparations and those injured in the past. Posner and Vermeule use that framework to evaluate the morality of reparations and the legal problems that arise in implementing reparations proposals.

This Essay takes up the Posner-Vermeule analysis at several points. It challenges their limited definition of reparations and their limited …

Using Literature And Innovative Assessments To Ignite Interest And Cultivate Critical Thinking Skills In An Undergraduate Neuroscience Course, Eileen Lynd-Balta Jul 2006

Using Literature And Innovative Assessments To Ignite Interest And Cultivate Critical Thinking Skills In An Undergraduate Neuroscience Course, Eileen Lynd-Balta

Biology Faculty/Staff Publications

Science education reform initiatives emphasize 1) the value of concepts over facts; 2) the benefits of open-ended, inquiry-based problem-solving rather than protocols leading to a single correct answer; and 3) the importance of a multidisciplinary approach to teaching that is not confined by departmental boundaries. Neuroscientists should be at the forefront of this movement by the very nature of the discipline we study. Neuroscience is a relatively new field that integrates diverse subjects (anatomy, physiology, pharmacology, molecular biology, computer science, and psychology) and experimental advances are constantly changing and expanding our understanding of brain function. How can we convey this …

Cooperative Learning Groups In The Eighth Grade Math Classroom, Dean J. Davis Jul 2006

Cooperative Learning Groups In The Eighth Grade Math Classroom, Dean J. Davis

Action Research Projects

In this action research study of my classroom of 8th grade mathematics students, I investigated whether cooperative learning would lead to a better understanding of the mathematical concepts and thus more success for the students. I used my three eighth grade classes with two using cooperative groups and the third not. I discovered that the students who wanted to work in cooperative groups were more successful than they had been. I also discovered that the grouping itself has a great effect on how the group works together. The wrong grouping of students can lead to disaster and many headaches for …

Departmentalization In The 5th Grade Classroom: Re-Thinking The Elementary School Model, Delise Andrews Jul 2006

Departmentalization In The 5th Grade Classroom: Re-Thinking The Elementary School Model, Delise Andrews

Action Research Projects

In this action research study of my 5th grade classroom, I investigated the benefits of a modified block schedule and departmentalization. The research consisted of dividing the 5th grade curriculum into three blocks. Each block consisted of two primary subject areas: Mathematics was paired with Social Studies, Reading was paired with Health, and Writing was paired with Science. These groupings were designed to accommodate district time-allotment requirements and the strengths of each teacher within the 5th grade team. Thus, one teacher taught all of the Mathematics and Social Studies, another all of the Reading and Health, and another all of …

Motivating Middle School Mathematics Students, Vicki Sorensen Jul 2006

Motivating Middle School Mathematics Students, Vicki Sorensen

Action Research Projects

In this action research study I examined the relationship between the teacher, the students and the types of motivation used in mathematics. I specifically studied the mathematic teachers at my school and my seventh grade mathematics students. Motivating middle school students is difficult and the types of motivation can be as numerous as the number of students studied. I discovered that the teachers used multiple motivating tactics from praise, to extra time spent with a student, to extra fun activities for the class. I also discovered that in many instances, the students’ perception of mathematics was predetermined or predetermined by …

Symmetry Of Scale Expository Paper, Darla R. Kelberlau-Berks Jul 2006

Symmetry Of Scale Expository Paper, Darla R. Kelberlau-Berks

Department of Mathematics: Master of Arts in Teaching, Exam Expository Papers

A checkerboard, a beehive, a brick wall and a mud flat dried in the sun all have something in common. They are all examples of tilings or tessellations. Although you may think of mosaics or other pieces of artwork when you hear these words, in actuality you should also think of mathematics and science. I will describe in more detail the mathematics involved with tessellations and tilings, and discuss specific tilings such as the Pinwheel Tiling and the Penrose Tiles.

Student Problem Solving, Michael A. Cobelens Jul 2006

Student Problem Solving, Michael A. Cobelens

Department of Teaching, Learning, and Teacher Education: Master of Arts in Teaching, Summative Projects

The purpose of this study is to determine if students solve math problems using addition, subtraction, multiplication, and division consistently and whether students transfer these skills to other mathematical situations and solutions. In this action research study, a classroom of 6th grade mathematics students was used to investigate how students solve word problems and how they determine which mathematical approach to use to solve a problem. It was discovered that many of the students read and re-read a question before they try to find an answer. Most students will check their answer to determine if it is correct and makes …

Holding Leaders Accountable In The International Criminal Court (Icc) For Gender Crimes Committed In Darfur, Kelly Dawn Askin

Genocide Studies and Prevention: An International Journal

This article discusses how rape and other forms of sexual violence have been prominent features of the ongoing attacks (from 2003 to the present) committed by government of Sudan (GoS) troops and the Janjaweed (Arab militia) in Darfur, Sudan. It first provides a historical overview of wartime rape in law and society, then discusses some of the many reports (including the UN’s Commission of Inquiry on Darfur) that have documented the perpetration of rape and other forms of sexual violence in Darfur by GoS troops and Janjaweed. Following a discussion of specific cases of rape and other sexual crimes committed …

Presidential Signing Statements And Executive Power, Eric A. Posner, Curtis A. Bradley Jul 2006

Presidential Signing Statements And Executive Power, Eric A. Posner, Curtis A. Bradley

Public Law and Legal Theory Working Papers

A recent debate about the Bush administration’s use of presidential signing statements has raised questions about their function, legality, and value. We argue that presidential signing statements are legal and that they provide a useful way for the president to disclose his views about the meaning and constitutionality of legislation. Although President Bush has challenged more statutory provisions in signing statements than prior administrations have, his signing statements are similar in many respects to the signing statements issued by prior presidents, such as President Clinton. In addition, basic tenets of positive political theory suggest that signing statements do not undermine …

The People’S Agent: Executive Branch Secrecy And Accountability In An Age Of Terrorism, Sidney A. Shapiro, Rena I. Steinzor

Law and Contemporary Problems

Shapiro and Steinzor apply the agency theory to the question of how much secrecy is too much. They use the theory to evaluate the impact of burgeoning secrecy in the likelihood that the executive branch officials will engage in faithful and forceful implementation of statutory materials, particularly in the arenas of protecting public health, safety, and natural resources.

Evidence, Marc T. Treadwell Jul 2006

Evidence, Marc T. Treadwell

Mercer Law Review

This survey year saw the continuation of what has become a clear trend in Eleventh Circuit evidence decisions. In stark contrast to the days when the Eleventh Circuit rigorously examined district court evidentiary decisions and freely reversed those decisions, the Eleventh Circuit now studiously defers to district judges. The reason for this trend can be debated. Perhaps because most evidentiary issues addressed by the Eleventh Circuit arise in the context of criminal cases, and because Eleventh Circuit judges are more conservative today, the Eleventh Circuit is less likely to reverse criminal convictions, particularly on evidentiary grounds. Or perhaps that the …

Detention Of Non-Citizens: The Supreme Court's Muddling Of An Already Complex Issue, Blake Sharpton

Mercer Law Review

Emma Lazarus's poem was engraved on a plaque and affixed to the base of the Statue of Liberty in 1903. Ms. Lazarus's words may have reflected the sentiment of the country in 1903, but the United States no longer throws its doors open to any and every person hoping for a better life. Rather, potential immigrants are faced with a labyrinth of legal hurdles in order to gain entry into the United States.

Under current U.S. immigration law, every person in the world is either a United States "national" or an "alien." With few exceptions, the term national today basically …

"I Didn't Volunteer For This @&#%!": The Application Of Georgia's Psychologist- Patient Privilege To Court-Ordered Mental Health Treatment, John Scott Husser Jr. Jul 2006

"I Didn't Volunteer For This @&#%!": The Application Of Georgia's Psychologist- Patient Privilege To Court-Ordered Mental Health Treatment, John Scott Husser Jr.

Mercer Law Review

By holding in State v. Herendeen that a patient could invoke the mental health privilege ("privilege") when the patient either received mental health treatment ("treatment") or such treatment was contemplated during the course of the psychotherapeutic relationship, the Georgia Supreme Court eliminated any remaining vestige of a "voluntariness" requirement for patients seeking to invoke the privilege. In doing so, the court overruled Georgia case law that had required a patient to demonstrate, in addition to a showing that treatment was received or contemplated, that the patient voluntarily sought the treatment. The court's decision clarified the criteria needed to invoke the …
