Environmental Law, Travis M. Trimble Jul 2006

Environmental Law, Travis M. Trimble

Mercer Law Review

In 2005 the Eleventh Circuit courts addressed issues of regulatory interpretation of the Clean Air Act ("CAA"); compliance with the National Environmental Policy Act ("NEPA) in connection with the development of wetlands; and a conflict between the Federal Emergency Management Agency's ("FEMA") coastal flood insurance program and the Endangered Species Act ("ESA"). First, the Eleventh Circuit Court of Appeals invalidated a rule of the Alabama Department of Environmental Management that exempted certain stack emissions that otherwise violated the State Implementation Plan under the CAA. Also, the United States District Court for the Northern District of Alabama heard one of several …

Writing On Water: Resources, Discourses, Reflections, Justin Scott-Coe, W. Scott Howard Jul 2006

Writing On Water: Resources, Discourses, Reflections, Justin Scott-Coe, W. Scott Howard

Reconstruction: Studies in Contemporary Culture

[First paragraph]

We started this project in the shadow of the Great Tsunami of 2004, witnessed Katrina destroy New Orleans as submissions were coming in, and now publish during a record-breaking, nationwide—some say worldwide—heat wave. Is it any wonder the release of our journal issue on water appears as suspiciously timed as Al Gore's droning tome on global warming?

On Roxana Robinson's Sweetwater, Bradley John Monsma Jul 2006

On Roxana Robinson's Sweetwater, Bradley John Monsma

Reconstruction: Studies in Contemporary Culture

[First paragraph]

When Huck lights out for the territories at the end of his hopeless float down the river with Jim, it's already clear that his escape will solve nothing. The story he will become part of in the West is already one of multiple displacements moving fast toward the environmental catastrophe of the dust bowl. Yet long before the frontier was "closed," it inspired myths that would prove to be more persistent than its reality. Despite all evidence to the contrary, the West still represents the pure possibility to remake identity and to leave behind the corruption of Huck's …

When The Well Runs Dry: An Exploration Of Water Conservation And Blue Theology, Margaret H. Ferris Jul 2006

When The Well Runs Dry: An Exploration Of Water Conservation And Blue Theology, Margaret H. Ferris

Reconstruction: Studies in Contemporary Culture

Worldwide, freshwater is becoming scarce as the Earth's population increases, the effects of pollution and global warming shrink available resources, and agriculture demands rise. As theological communities offer distinctive contributions to the dialogue, theologians need to address the crisis and provide appropriate analysis and solutions from the perspective of "Blue Theology". This paper formulates such an approach, offering some of the first efforts made towards addressing the global water crisis through a theological lens. Within the Abrahamic tradition, the essay examines: how water is specifically beloved by the Divine; and the implications of God's love of water. The paper next …

Lagu And Belu: The Semiotics Of Bottled Water Packaging, Daniel Fusch Jul 2006

Lagu And Belu: The Semiotics Of Bottled Water Packaging, Daniel Fusch

Reconstruction: Studies in Contemporary Culture

There has been considerable recent criticism of the bottled water industry from professional and popular as well as scholarly sources. This criticism disputes the veracity of a brand's claim to a pure and natural source, as well as the standards for regulation. This paper adds another factor to the criticism of bottled "natural springs" water, emphasizing the magical operation implicit in the rhetoric for the packaging of bottled water. The paper examines the natural and supernatural semiotics of the commercial packaging for bottled "natural springs" water, and identifies a correlation between the semiotic function of the ancient Germanic rune lagu …

Analysis Of Different Types Of Attentional Interference Compared To Working Memory, Joel A. Gregor Jul 2006

Analysis Of Different Types Of Attentional Interference Compared To Working Memory, Joel A. Gregor

Doctor of Psychology (PsyD)

Previous studies have shown a relationship between working memory (WM) and the Color-Word Stroop Task (CWS). Newer Stroop-like tasks such as the Color-Block Stroop-like Task (CBS) have been shown to cause interference but the nature of the interference is unclear. This study attempted to compare CWS and CBS to tests of working memory, specifically the Digits Span Backward task (DB) and an Operation Span (OSPAN) task. The first experiment involved no auditory stimuli. No significant correlation was found between WM and CWS. This led to a second experiment with the digit span administered auditorily. Again, no significant correlation between CWS …

States' and nations' laws collide when foreign factors appear in a lawsuit. Nonresident litigants, incidents outside the forum, parallel lawsuits, and judgments from other jurisdictions can create problems with personal jurisdiction, choice of law, and the recognition of foreign judgments. This Article reviews Texas conflicts cases from Texas state and federal courts during the Survey period from October 1, 2004 through November 31, 2005. The Article excludes cases involving federal-state conflicts, intrastate issues such as subject-matter jurisdiction and venue, and conflicts in time such as the applicability of prior or subsequent law within a state. State and federal cases are …

The Constitutional Right Not To Cooperate - Local Sovereignty And The Federal Immigration Power, Huyen Pham Jul 2006

The Constitutional Right Not To Cooperate - Local Sovereignty And The Federal Immigration Power, Huyen Pham

Faculty Scholarship

This article examines an important but up to now, still unexplored area in the federalism debate: May the federal government require local governments to cooperate with the enforcement of immigration law or other federal scheme? Or may local governments constitutionally refuse to provide that cooperation?

I use immigration law enforcement as a case study to argue that the current legal framework, which allows the federal government to mandate local cooperation, ignores the significant federalism harms that federal cooperation laws impose. And these federalism harms are not simply limited to the immigration field. In other areas where federal and local governments …

How To Talk To Your Children About Unemployment, Liz Gorham Jul 2006

How To Talk To Your Children About Unemployment, Liz Gorham

SDSU Extension Extra Archives

Off-farm employment provides over half of the income of many farm and ranch families (U.S. Bureau of Labor Statistics 1999). They have come to depend on the extra income. So when an adult quits the town job or is laid off, the consequent stress spreads to everyone in the family. Layoffs can happen just at the time the farm family most critically needs that extra income. In South Dakota in particular, the economic health of all communities, big and small, is tied to the agricultural economy. If the latter falters because of drought, blizzards, or other natural disasters, workers in …

Taking Care Of Your Nutritional And Physical Needs, Joan Hegerfeld Jul 2006

Taking Care Of Your Nutritional And Physical Needs, Joan Hegerfeld

SDSU Extension Extra Archives

When asked what they value most, many people will say their health. However, when faced with a stressful situation that will not go away, the same people forget all about their health and start worrying. Farm and ranch families struggle with extreme stress from uncontrollable forces such as weather, low market prices, or farm machinery breaking down. For many farmers, ranchers, and farm workers, decision making and adjusting to the extraordinary stress consumes their whole thinking, their whole days, their sleepless nights. Their livelihood is dependent upon forces over which they have no control. Eating right and getting adequate amounts …

Health Insurance: Is Your Child Covered?, Liz Gorham Jul 2006

Health Insurance: Is Your Child Covered?, Liz Gorham

SDSU Extension Extra Archives

The basic purpose of health insurance is protection. It protects the policyholder and his or her family from a designated catastrophic loss. It’s all about the “law of large numbers.” The health risk identified is transferred to a large group of individuals. The group shares in the financial losses suffered by a few members of the group, reducing the cost to any individual or family.

Exposure Of Nervous System Cells To Polychlorinated Biphenyls (Pcbs), Results In Alterations Of Neurotrophic Factor Expression, Gordon H. Gurley Jul 2006

Exposure Of Nervous System Cells To Polychlorinated Biphenyls (Pcbs), Results In Alterations Of Neurotrophic Factor Expression, Gordon H. Gurley

Dissertations

Toxic insult by PCBs results in learning and memory deficits in humans. Alterations in expression of neurotrophic factors (NF) and/or their receptors have been linked to changes in learning and memory. How PCBs affect cognition is not known. We suggest that PCBs affect cognition by altering NF expression.

We exposed cultured C6 rat glioblastoma cells (an astrocyte cell-line) to medium containing PCB (Aroclor 1254 (10ppm)). Control cells were treated with dimethyl sulfoxide (DMSO) or regular medium. Enzyme-linked immunosorbent assays (ELISA) were used to determine glial cell-line derived neurotrophic factor(GDNF) and nerve growth factor (NGF) concentrations in all samples. We also …

Policy Analysis Of The Victim Offender Restitution Program, Veronica Damon, Marie Bostick, Lamont Mcgary Jul 2006

Policy Analysis Of The Victim Offender Restitution Program, Veronica Damon, Marie Bostick, Lamont Mcgary

UNLV Theses, Dissertations, Professional Papers, and Capstones

Both the criminal justice and the juvenile justice systems have experienced increased strain due to criminal acts committed by juveniles. Many experts suggest that one way to ease the burden of the courts can be found in the theory of restorative justice. Most often the juvenile justice system is most concerned with the risk and needs of youthful offenders without significant consideration for the victims. A key component in the restorative justice theory is victim offender mediation which seeks to reduce the impact of crime on victims and the community. Clark County, Nevada has one such program, the Victim Offender …

Temperament, Distraction, And Learning In Toddlerhood, Wallace E. Dixon Jr., Brenda J. Salley, Andrea D. Clements Jul 2006

Temperament, Distraction, And Learning In Toddlerhood, Wallace E. Dixon Jr., Brenda J. Salley, Andrea D. Clements

ETSU Faculty Works

The word- and nonword-learning abilities of toddlers were tested under various conditions of environmental distraction, and evaluated with respect to children's temperamental attentional focus. Thirty-nine children and their mothers visited the lab at child age 21-months, where children were exposed to fast-mapping word-learning trials and nonlinguistic sequential learning trials. It was found that both word- and nonword-learning were adversely affected by the presentation of environmental distractions. But it was also found that the effect of the distractions sometimes depended on children's level of attentional focus. Specifically, children high in attentional focus were less affected by environmental distractions than children low …

Coordinated Diabrotica Genetics Research: Accelerating Progress On An Urgent Insect Pest Problem, Thomas W. Sappington, Blair D. Siegfried, Thomas Guillemaud

Department of Entomology: Faculty Publications

Diabrotica spp. (western, northern, and Mexican corn rootworms) represent the main pest complex of continuous field corn, Zea mays (L.), in North America. The western corn rootworm, Diabrotica virgifera virgifera LeConte, also has become the main pest of continuous corn in Central and Southeastern Europe since its introduction near Belgrade 15–20 years ago, and it represents a major risk to Western Europe. It has already caused economic losses in Eastern Europe, and Western countries such as France have committed large expenditures for containment and/or eradication.

Rootworm larvae feed on corn roots, and damaged plants are more susceptible to drought and …

Department of Entomology: Faculty Publications

Predaceous insect encounter rate was measured in 21 southeast Nebraska alfalfa fields through weekly sweep net sampling during 2002-03. The most frequently encountered predaceous insect families were Coccinellidae (Coleoptera), Nabidae (Hemiptera), and Chrysopidae (Neuroptera). The study used multiple regression analysis to examine the effect of aphid abundance and the surrounding vegetative patch composition on predaceous insect abundance. In 2002, Hippodamia parenthesis Say was encountered more frequently in fields with lower aphid abundances, and Hippodamia convergens Guerin-Meneville, Coccinella septempunctata L., and Nabis americoferus Carayon were encountered more frequently in fields with higher aphid abundances. In 2003, Coleomegilla maculata DeGeer was encountered …

Water, Development, And State Security In South Asia: Scenarios For China And India, Ray Chandrasekara, John M. Polimeni

Reconstruction: Studies in Contemporary Culture

Conflict over water resources is rare and has not occurred for thousands of years. However, the dynamics in South Asia are changing so rapidly that a conflict in the not-so-near future may be unavoidable. Water shortages could have the nonlinear effects of food shortages, political instability, migration problems, and diminished economic growth. All of these factors, caused by water shortages, could be a driver of conflict in the region, causing territorial disputes. Global instability would be sure to follow as both the U.S., attempting to protect their national security interests, and China, reacting as the regional power, tries to intervene. …

Doctors, Duties, Death And Data: A Critical Review Of The Empirical Literature On Medical Malpractice And Tort Reform, Geoffrey Christopher Rapp Jul 2006

Doctors, Duties, Death And Data: A Critical Review Of The Empirical Literature On Medical Malpractice And Tort Reform, Geoffrey Christopher Rapp

Northern Illinois University Law Review

Much of the debate on medical malpractice and tort reform ignores the recent emergence of a fairly substantial volume of empirical research on the subject. There have been a large number of empirical (i.e., statistical) papers put out from law professors, economists, and others, on a number of medical malpractice and tort reform topics. This article consists of critical literature review covering selected empirical papers on these topics. The paper asks what malpractice practitioners, state legislatures, and legal academics learn from the data work that's been done. Rather than report the results of any original data analysis, the article evaluates …

Medical Negligence Litigation Is Not The Problem, Kenneth C. Chessick, Matthew D. Robinson Jul 2006

Medical Negligence Litigation Is Not The Problem, Kenneth C. Chessick, Matthew D. Robinson

Northern Illinois University Law Review

The medical malpractice insurance "crisis" results not from out-of-control juries or overly-litigious plaintiffs and their attorneys, but rather is simply the result of epidemic levels of negligence among physicians. The myth that the liability system is to blame for high premiums facing doctors creates opportunities for insurance companies to restrict plaintiffs' access to courtrooms and to limit the amount of compensation they may receive after proving negligence. This article examines and debunks the leading myths regarding the so-called "crisis" and presents several suggestions that may improve the healthcare provided to patients nationwide.

How Cultural Dynamics And Teacher Preparation Affect The Educational Opportunities Of Minority Students, Dedrick J. Sims Jul 2006

How Cultural Dynamics And Teacher Preparation Affect The Educational Opportunities Of Minority Students, Dedrick J. Sims

Essays in Education

The academic achievement of minority students in this country has been an issue of debate for educators and policy makers since the origins of education in America. Education reform has failed to offer a permanent solution that does not blame the students for their failure. America’s “color-blind” attitude and it’s refusal to accept the effects of cultural differences in the learning process will lead to a continued increase in the academic achievement “gap” in our classrooms. In this paper I address the historical contributions of America’s “biased” and self-protecting mechanisms that still plaque the education system today, the effects of …
