The Measure Of The Doubt: Dissent, Indeterminacy, And Interpretation At The Federal Circuit, Jeffrey A. Lefstin

The law of patent claim interpretation articulated by the United States Court of Appeals for the Federal Circuit is commonly supposed to be markedly indeterminate, and to be responsible for a lack of certainty and predictability in patent infringement litigation. But there has been no attempt to measure objectively the indeterminacy associated with patent claim interpretation, or, for that matter, of any other field of law. This Article shows that under appropriate conditions the indeterminacy of a legal regime may be measured empirically by the frequency of judicial dissents. Application of this method to the Federal Circuit's jurisprudence demonstrates that …

The Use Of Religion In Death Penalty Sentencing Trials, Monica Miller, Brian H. Bornstein

Both prosecutors and defense attorneys have presented religious appeals and testimony about a defendant’s religious activities in order to influence capital jurors’ sentencing. Courts that have objected to this use of religion fear that religion will improperly influence jurors’ decisions and interfere with their ability to weigh aggravators and mitigators. This study investigated the effects of both prosecution and defense appeals. Prosecution appeals did not affect verdict decisions; however, use of religion by the defense affected both verdicts and the weighing of aggravators and mitigators. Diagnostic Dilemma Of Abdominal Tuberculosis In Non-Hiv Patients: An Ongoing Challenge For Physicians, Rustam Khan, Shahab Abid, Wasim Jafri, Zaigham Abbas, Khalid Hameed, Zubair Ahmad

AIM: To assess the clinical features, yield of the diagnostic tests and outcome of abdominal tuberculosis in non-HIV patients.Methods: Adult patients with discharge diagnosis of abdominal tuberculosis (based upon; positive microbiology, histo-pathology, imaging or response to trial of anti TB drugs) during the period 1999 to 2004 were analyzed. Patient's characteristics, laboratory investigations, radiological, endoscopic and surgical findings were evaluated. Abdominal site involved (intestinal, peritoneal, visceral, and nodal) and response to treatment was also noted.Results: There were 209 patients enrolled. Splitting Genes: The Future Of Gmo's In The Wake Of The Wto/Cartagena Standoff, Sam A. Blaustein

This article examines the conflict surrounding GMO's (Genetically Modified Organisms) between the WTO and the UN. The respective positions of the United States and the European Union are discussed. The article argues that both international and domestic laws conflict with the rigid "precautionary principle" and straight to market approach adhered to by the European Union and the United States respectively. It ultimately suggests that common GMO specific laws are necessary for both sides to meet their respective goals and obligations.

Factors Surrounding And Influencing The Primary Disclosure In Child Sexual Abuse, Kira O'Neil Bona

This study aimed to investigate the context within which children initially disclose their sexual abuse. The study sought to identify triggers that prompted the initial disclosure event, and to investigate the relationship between the choice of initial confidante and the childs age and likelihood of disclosing during formal interview. Data were obtained in a prospective fashion from 60 alleged child sexual abuse victims referred to the Yale Child Sexual Abuse Clinic (CSAC). Inclusion criteria required that a child must have disclosed to a confidante prior to referral to the Clinic; 57 of 60 children met this criterion and are included. …

The purpose of the paper is to examine where and how abortion training takes place throughout medical education in the context of a current shortage of abortion providers in the United States. The study was conducted using internet search engines Scopus, Academic Search, History of Science and Technology,and OVID, with keyword searches including "abortion," "medical education," "residency training," and "family medicine." Personal interviews were also conducted with leading abortion educators and researchers.
