The Cognitive Psychology Of Circumstantial Evidence, Kevin Jon Heller Nov 2006

The Cognitive Psychology Of Circumstantial Evidence, Kevin Jon Heller

Michigan Law Review

Empirical research indicates that jurors routinely undervalue circumstantial evidence (DNA, fingerprints, and the like) and overvalue direct evidence (eyewitness identifications and confessions) when making verdict choices, even though false-conviction statistics indicate that the former is normally more probative and more reliable than the latter The traditional explanation of this paradox, based on the probability-threshold model of jury decision-making, is that jurors simply do not understand circumstantial evidence and thus routinely underestimate its effect on the objective probability of the defendant's guilt. That may be true in some situations, but it fails to account for what is known in cognitive psychology …

The Glucksberg Renaissance: Substantive Due Process Since Lawrence V. Texas, Brian Hawkins Nov 2006

The Glucksberg Renaissance: Substantive Due Process Since Lawrence V. Texas, Brian Hawkins

Michigan Law Review

On their faces, Washington v. Glucksberg and Lawrence v. Texas seem to have little in common. In Glucksberg, the Supreme Court upheld a law prohibiting assisted suicide and rejected a claim that the Constitution protects a "right to die"; in Lawrence, the Court struck down a law prohibiting homosexual sodomy and embraced a claim that the Constitution protects homosexual persons' choices to engage in intimate relationships. Thus, in both subject matter and result, Lawrence and Glucksberg appear far apart. The Lawrence Court, however, faced a peculiar challenge in reaching its decision, and its response to that challenge brings …

Liability Externalities And Mandatory Choices: Should Doctors Pay Less?, Robert D. Cooter, Ariel Porat Nov 2006

Liability Externalities And Mandatory Choices: Should Doctors Pay Less?, Robert D. Cooter, Ariel Porat

Coase-Sandor Institute for Law & Economics Research Paper Series

According to legal principles, a driver who negligently breaks a pedestrian's leg should pay the same damages as a doctor who negligently breaks a patient's leg. According to economic principles, however, the driver should pay more than the doctor. Non-negligent drivers impose risk on others without being liable for it. When liability externalities are mainly negative as with driving, liability should increase beyond full compensation to discourage the activity. Unlike pedestrians, patients contract with doctors for treatment and willingly submit to the risk of harm. Imperfections in medical markets cause some kinds of doctors to convey more positive than negative …

Offestting Risks, Ariel Porat Nov 2006

Offestting Risks, Ariel Porat

Coase-Sandor Institute for Law & Economics Research Paper Series

Under prevailing tort law, an injurer who is required to choose between Course of Action A, which creates a risk of 500, and Course of Action B, which creates a risk of 400, and negligently chooses the former will be held liable for the harm that materializes in its entirety. This full liability forces the injurer to pay damages that are five times higher than necessary for making him internalize the risk of 100 that is actually created by his negligent choice. The argument advanced by this Article is that tort law should recognize the "Offsetting Risks Principle" ("ORP"), under …

The Second-Order Structure Of Immigration Law, Eric A. Posner, Adam B. Cox Nov 2006

The Second-Order Structure Of Immigration Law, Eric A. Posner, Adam B. Cox

Coase-Sandor Institute for Law & Economics Research Paper Series

Immigration law concerns both first-order issues about the number and types of immigrants who should be admitted into a country and second-order design issues concerning the legal rules and institutions that are used to implement those first-order policy goals. The literature has focused on the first set of issues and largely neglected the second. In fact, many current controversies concern the design issues. This Article addresses the second-order dimension and argues that a central design choice all states face is whether to evaluate potential immigrants on the basis of pre-entry characteristics (the ex ante approach) or post-entry conduct (the ex …

Obstetric Cerebral Venous Thrombosis, Bhojo Khealani, Uzma U Mapari, Rozina Sikandar Sultanali Nov 2006

Obstetric Cerebral Venous Thrombosis, Bhojo Khealani, Uzma U Mapari, Rozina Sikandar Sultanali

Department of Obstetrics & Gynaecology

Pregnancy and puerperium are most prevalent prothrombotic states leading to cerebral venous thrombosis. Likelihood of stroke to be of venous origin is greater in stroke associated with pregnancy compared to stroke unrelated to pregnancy. Pregnancy induces several changes in coagulation system, which persists at least during early puerperium, rendering it a prothrombotic state. Hypercoaguability worsens further after delivery as a result of volume depletion and trauma. During puerperium additional risk factors include infection and instrumental delivery or Caesarean section. The management follows general rules as for the venous thrombosis unrelated to pregnancy, however the prognosis is different.

Perceived Motion Sickness And Effects On Shooting Performance Following Combat Vehicle Transportation, Joakim Dahlman, Torbjörn Falkmer, Staffan Nählinder Nov 2006

Perceived Motion Sickness And Effects On Shooting Performance Following Combat Vehicle Transportation, Joakim Dahlman, Torbjörn Falkmer, Staffan Nählinder

Journal of Human Performance in Extreme Environments

This study used a quasi-experimental, repeated measures design to study the relationship between targeting performance and perceived motion sickness following exposure to motion in a land-based transportation setting. The targeting performances of 22 basic training conscript soldiers were examined after repeatedly being transported in the vehicle. Soldiers also rated their perceived motion sickness according to subjective scales before and after the two exposures to transportation. Results showed that perceived motion sickness was correlated to perceived decrease in targeting performance, due to factors labelled as “Combined subjective symptoms”. The study supports the idea that motion sickness and its effect on performance …

Combating Opium In Afghanistan, Ali A. Jalali, Robert B. Oakley, Zoe Hunter Nov 2006

Combating Opium In Afghanistan, Ali A. Jalali, Robert B. Oakley, Zoe Hunter

Strategic Forums

Opium continues to pose one of the most serious threats to stability and good governance in Afghanistan. Proceeds and protection fees from trafficking are funneled to terrorist and insurgent groups, including the Taliban and al Qaeda. Insurgents have successfully leveraged poppy eradication efforts to increase popular resistance to both the government in Kabul and the presence of coalition forces. Despite major increases in counternarcotics programs and resources over the past year, production has shot up 59 percent.

Patient Education In Glaucoma: What Do Patients Know About Glaucoma?, Vital Paulino Costa, George L Spaeth, Maura Smith, Cordelia Uddoh, José Paulo Cabral Vasconcellos, Newton Kara-José

Wills Eye Hospital Papers

PURPOSE: To evaluate the knowledge glaucoma patients have about their disease and its treatment.

METHODS: One hundred and eighty-three patients were interviewed at the Glaucoma Service of Wills Eye Hospital (Philadelphia, USA, Group 1) and 100 at the Glaucoma Service of University of Campinas (Campinas, Brazil, Group 2). An informal, relaxed atmosphere was created by the interviewer before asking a list of 18 open-ended questions.

RESULTS: In Group 1, 44% of the 183 patients did not have an acceptable idea about what glaucoma is, 30% did not know the purpose of the medications they were taking, 47% were not aware …

Role Of Surgery In Cerebral Venous Sinus Thrombosis, S. Ather Enam Nov 2006

Role Of Surgery In Cerebral Venous Sinus Thrombosis, S. Ather Enam

Department of Surgery Docs

Cerebral venous sinus thrombosis (CVST) usually is taken care of by medical management or neuro-interventional vascular techniques. Some cases of CVST may take a malignant course if the intracranial pressure increases excessively. This increase in pressure is because of oedema in brain tissue due to impediment in venous return and/or intracerebral haemorrhage. Neurosurgical experience has shown remarkable recovery in these moribund patients if appropriate surgical intervention is done within reasonable time. Emergent decompressive craniotomy or other neurosurgical interventions are the only appropriate treatment in these malignant forms of CVST to prevent mortality and severe morbidity.

Grazing Management Effects On Sediment And Phosphorus In Surface Runoff, Matthew M. Haan, James R. Russell, Wendy J. Powers, John L. Kovar, Jamie L. Benning

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Sediment and phosphorus (P) in runoff from pastures are potential non–point-source pollutants in surface waters that may be influenced by surface cover, sward height, treading damage, surface slope, soil moisture, and soil P. The objectives of the current study were to quantify sediment and total P loads in runoff produced during simulated rainfall from pastures and to evaluate their relationships with the physical and chemical characteristics of the soil and sward. Five forage management treatments— ungrazed (U), hay harvest/fall stockpile grazing (HS), continuous stocking to a sward height of 5 cm (5C), and rotational stocking to sward heights of 5 …

Convergence Of Agriculture And Energy: Implications For Research And Policy, Kenneth Cassman, Vernon Eidman, Eugene Simpson, Larry Berger, Robert Loomis, Marie Walsh, Todd A. Peterson, Edward Runge

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Access to an adequate energy supply at reasonable cost is crucial for sustained economic growth. Unfortunately, oil prices and the need to import from politically unstable countries lowers the reliability of the U.S. energy supply and hinders economic development. Although biofuels have been identified as an important component of the national strategy to decrease U.S. dependence on imported oil, the ability to sustain a rapid expansion of biofuel production capacity raises new research and policy issues. This document seeks to identify the most critical of these issues to help inform the policy development process. The goal is to enhance the …

We have investigated the in vivo safety, efficacy, and persistence of autologous Epstein Barr virus (EBV)-specific cytotoxic T lymphocytes (CTLs) for the treatment of solid organ transplant (SOT) recipients at high risk for EBV-associated posttransplantation lymphoproliferative disease (PTLD). EBV-CTLs generated from 35 patients expanded with normal kinetics contained both CD8 and CD4 lymphocytes and produced significant specific killing of autologous EBV-transformed B lymphoblastoid cell lines (LCLs). Twelve SOT recipients at high risk for PTLD, or with active disease, received autologous CTL infusions without toxicity. Real-time polymerase chain reaction (PCR) monitoring of EBV-DNA showed a transient increase in plasma EBV-DNA suggestive …

Buccal And Palatal Talon Cusps With Pulp Extensions On A Supernumerary Primary Tooth, Esin Siraci, H. Cem Güngör, Zafer C. Cehreli, B. Taner

School of Dentistry Faculty Research and Publications

This paper reports an unusual occurrence of talon cusp on a supernumerary primary incisor, presenting on both labial and palatal sides. The tooth was scheduled for extraction due to its interference with the occlusion. Morphometric analysis of the taloned cusps was performed on digitized replicas of the tooth crown using open-source image analysis toolkit (ImageJ). Further non-destructive investigation of the taloned crown under cone-beam X-ray computed tomography revealed pulpal extensions in both talon cusps.
