Teaching Reflective Lawyering In A Small Case Litigation Clinic: A Love Letter To My Clinic Papers Presented At The Ucla/Ials Conference On Enriching Clinical Education, Ian Weinstein

This article describes a live client, small case, teaching and learning centered, criminal defense clinic set in a high volume urban court. It offers concrete suggestions about how clinical educators can help students develop analytic and technical skills. The clinic model is conceived in three phases: giving students the opportunity to develop a contextualized understanding of the client; guiding students through strategic analysis and planning; and focusing students' litigation strategies on executing their tactical vision for their client. The article argues that this clinical setting structures the students' experiences so that they develop a complex and deeply moral lawyerly problem …

One of the goals of land use (and pollution control) law is to force the internalization of these costs. This otherwise economic view of land use law is also rooted, however, in an ecological understanding of urban land use. Legal scholars writing over three decades ago successfully argued, based upon the ecological facts of life, that "[p]roperty does not exist in isolation" because the effects of its uses flow outside of the boundaries of ownership. The debate over discovery confidentiality has raged for over twenty years, since before the Supreme Court's decision in Seattle Times Co. v. Rhinehart, and it shows no sign of fading. If anything, issues of litigation confidentiality appear to have gained increased attention in recent years. The United States District Court for the District of South Carolina attracted nationwide attention in 2002 when it adopted a local rule severely restricting secret settlements and addressing other aspects of court-ordered confidentiality. In 2004 the Federal Judicial Center completed an empirical study of sealed settlements. It seems that each month of 2005 brought new …

This work examines the relationship between President Richard Nixon and the American conservative movement, 1969-1974. Nixon's anti-communist persona proved pivotal in winning the 1968 Republican nomination, with support from the party's consevative base. The foreign policies orcherstrated by Nixon and his National Security Advisor, Henry Kissinger, however, which sought to reduce tensions with China and the Soviet Union, infuriated the conservatives. In 1971-1972, they suspended their support of the administration and even drafted their own candidate, the Ohio congressman, John Ashbrook, to challenge Nixon in the 1972 primary campaign. We report on a multiwavelength campaign on the TeV gamma-ray blazar Mrk 421 performed during 2002 December and 2003 January. These target of opportunity observations were initiated by the detection of X-ray and TeV gamma-ray flares with the All Sky Monitor (ASM) on board the Rossi X-Ray Timing Explorer (RXTE) and the 10 m Whipple gamma-ray telescope. The campaign included observational coverage in the radio (University of Michigan Radio Astronomy Observatory), optical (Boltwood, La Palma KVA 0.6 m; WIYN 0.9 m), X-ray (RXTE pointed telescopes), and TeV gamma-ray (Whipple and HEGRA) bands. At TeV energies, the observations revealed several flares …

The goal of this study was to elucidate the molecular mechanism by which type I IFN inhibits assembly and release of HIV-1 virions. Our study revealed that the IFN-induced ubiquitin-like protein ISG15 mimics the IFN effect and inhibits release of HIV-1 virions without having any effect on the synthesis of HIV-1 proteins in the cells. ISG15 expression specifically inhibited ubiquitination of Gag and Tsg101 and disrupted the interaction of the Gag L domain with Tsg101, but conjugation of ISG15 to Gag or Tsg101 was not detected. The inhibition of Gag-Tsg101 interaction was also detected in HIV-1 infected, IFN-treated cells. Elimination …

With this dissertation I developed a new theory and measure of ethical work climate (EWC). Currently, there exists one dominant theory and measure of EWC developed by Victor and Cullen (1988, 1987). Even though researchers have identified problems with this theory, such as inconsistencies with regard to its limited theoretical scope and troubling psychometric properties, it is the most widely utilized framework for conceptualizing and testing EWC. Therefore, I propose to develop an improved theory and measure of EWC, one capable of addressing some of the principle shortcomings of earlier efforts. Atmospheric mercury deposition, known to be a major source of mercury to aquatic and terrestrial environments, was studied at an urban site in Orlando, FL. Precipitation sampling was conducted from September 2003 to May 2006 at a Mercury Deposition Network site located on the University of Central Florida campus. Weekly rainfall and mercury wet deposition data were gathered from this site, which provided the framework of data for this study. The goal of the current study was to generate a comprehensive, multi-tissue perspective of the effects of chronic hypoxic exposure on carbohydrate metabolism in the Gulf killifish Fundulus grandis. Fish were held at approximately 1.3·mg·l–1 dissolved oxygen (~3.6·kPa) for 4·weeks, after which maximal activities were measured for all glycolytic enzymes in four tissues (white skeletal muscle, liver, heart and brain), as well as for enzymes of glycogen metabolism (in muscle and liver) and gluconeogenesis (in liver). The specific activities of enzymes of glycolysis and glycogen metabolism were strongly suppressed by hypoxia in white skeletal muscle, which may reflect decreased energy …

Tree squirrels (Sciurus spp.) have exhibited high seroprevalence rates, suggesting that they are commonly exposed to West Nile virus (WNV). Many characteristics of WNV infections in tree squirrels, such as the durations and levels of viremia, remain unknown. To better understand WNV infections in fox squirrels (S. niger), we subcutaneously inoculated fourteen fox squirrels with WNV. Peak viremias ranged from 104.00 plaque-forming units (PFU)/mL of serum on day 2 post-infection (DPI) to 104.98 PFU/mL on 3 DPI, although viremias varied between individuals. Blackbirds are ubiquitous members of the avian fauna in the Prairie Pothole Region. However, their abundance combined with their food habits make blackbirds significant agricultural pests on sunflower. Cost estimates for blackbird damage to sunflower in the northern Great Plains range from 4-11 million U.S. dollars per year. Because of their economic impact on agriculture, it is imperative to understand the environmental factors that influence blackbird abundance patterns. This study attempts to quantify the effects of landscape-level land use and climate patterns on blackbird abundance in the Prairie Pothole Region of the United States.

Biofilms are structured communities of bacterial cells enclosed in a self-produced polymeric matrix and adherent to an inert or living surface; they have clinical, industrial and environmental impacts. Biofilms that are established by bacteria on plants are found on the surfaces of roots, leaves, seeds and internal vascular tissues where the microbes live in commensal, mutualistic or parasitic/pathogenic associations with their host. The study of the structure of plant-associated biofilms has been considerably helped by the development of techniques using fluorescent markers coupled with confocal scanning laser microscopy as well as scanning electron microscopy. Fumonisins are carcinogenic mycotoxins produced by the maize ear rot pathogen Gibberella moniliformis (anamorph Fusarium verticillioides). These toxins consist of a linear polyketide-derived backbone substituted at various positions with an amine, one to four hydroxyl, two methyl, and two tricarballylic ester functions. In this study, we generated and characterized deletion mutants of G. moniliformis for five genes, FUM7, FUM10, FUM11, FUM14, and FUM16 in the fumonisin biosynthetic gene cluster. Functional analysis of mutants in four genes, predicted to encode unrelated proteins, affected formation of the tricarballylic esters. It has been almost 10 years since Joan Bennett suggested that fungal biologists create a ‘‘wish list’’ for fungal genome sequences (Bennett JW. White paper: Genomics for filamentous fungi. Fungal Genet Biol 1997; 21: 3–7). The availability of over 200 review papers concerning fungal genomics is a reflection of significant progress with a diversity of fungal species. The objective of this research was to assess BMP performance and implementation in Lincoln, Nebraska. In order to accomplish this objective, four tasks were established: sampling of stormwater runoff at eight sites located upstream of Holmes Lake, inspecting BMPs at construction sites in Lincoln, sampling and analysis of soil phosphorus levels in the Holmes Lake watershed, and conducting discussions with professionals involved with stormwater management in Lincoln.
