Tegman V. Accident & Medical Investigations, Inc.: The Re-Modification Of Modified Joint And Several Liability By Judicial Fiat, Victor J. Torres

Seattle University Law Review

This Note explores the Tegman decision in the context of joint and several liability between negligent and intentional actors within Washington State. Part II places Washington tort law into perspective, including the doctrine of joint and several liability, both before and after the Tort Reform Act of 1986. Part III discusses the Tegman decision, methods used in other jurisdictions for dealing with similar situations, and potential solutions to the problems posed by the Tegman holding. Finally, Part IV concludes and urges both the court to reconsider its ruling in Tegman and the legislature to clarify its intent.

The Limitations Of Legislatively Imposed Damages Caps: Proposing A Better Way To Control The Costs Of Medical Malpractice, Nancy L. Zisk

This Article considers whether state damages caps are constitutional and examines recent studies suggesting that damages caps are not achieving their intended goals. Given the mounting evidence against the effectiveness of damages caps and the questions about their constitutional validity, this Article proposes moving away from legislative caps on damages. Instead, this Article argues for a modified market model based on a combination of improved care, which would include improvements in service; better peer review; and, if necessary, legislation which would be designed to protect the confidentiality of peer review, reduce frivolous lawsuits, and regulate insurance rate increases. This Article presents the author's personal reflections on the promise and perils involved in blending rules of modern law with traditional values of African culture. The project began from a basic premise that both Americans and Rwandans should proceed with caution when expanding the privatization of public justice. Nevertheless, an outside observer's caution must be balanced with respect for a nation's right to self-determination, even when those choices may clash with generally accepted ADR theory as developed in the United States. This Note will discuss the serious legal, ethical, and scientific questions raised by the dispute resolution process for anti-doping violations during the Olympic Games. Throughout the Note, I will highlight both procedural and substantive aspects of the process which raise sufficiently serious legal issues to merit an American court's agreement to review an Olympic arbitration award. After an arbitration is concluded, the arbitrator or panel issues an award. An award is analogous to a court's judgment. Parties to an arbitration award can voluntarily comply with the award, without court intervention. However, unlike a trial where a judge's order marks the end of the proceedings, an arbitrator's award has no actual legal affect without court intervention. Court intervention occurs when a party files a motion either to confirm or to vacate an arbitration award.

Part I of this Article provides a better understanding of the restorative justice theory and its practical expressions. It describes the values and objectives upon which restorative justice is premised and introduces the three most common restorative justice practices: victim-offender mediation, group conferencing and circles. Part II introduces the democratic experimentalism model and demonstrates its compatibility with the restorative justice theory. Part III introduces four restorative justice programs currently operating in the United States, two operated by courts and two by prosecuting agencies. This Note will first explore the psychological and social aspects of domestic violence. It will then examine the appropriateness of mediation for such cases, exploring viewpoints on the topic. Lastly, the Note will propose a standard to guide cases involving domestic violence. Although the victim should always have the final word on whether to mediate, a judge, psychologist, and mediator should collaborate and make a united recommendation as to how they suggest the victim should proceed. This will allow the victim to make a thoughtful and individualized assessment of her situation.

The accounting profession took a major blow to its credibility in 2002 when numerous scandals surfaced on the front pages of newspapers seemingly everyday. The most notable stories told of two women who, despite the enormous pressure and harassment they knew they would face, came forward to reveal the ugly truth behind the facades of America's corporate skyscrapers. Cynthia Cooper and Sherron Watkins, employees at WorldCom and Enron respectively, blew the whistle on major accounting frauds at these companies. Their employers' retaliation was harsh and swift, revealing the truth about how todays' corporate juggernauts operate.

The impact of varied calving and weaning times on post-weaning production of steer calves was evaluated in a 3- yr study. Steers (approximately 12 steers per calving-weaning treatment per year) born in late winter or early spring were weaned at 190 or 240 d of age, and steers born in late spring were weaned at 140 or 190 d of age after grazing with their dams on native range. Steers were pen-fed a growing diet until approximately 375 kg BW. They were then moved to an individual feeding facility and fed a higher-energy diet. Steers were allotted to harvest dates …

An overview is presented of the recent advancements in research activities conducted to evaluate mosquito traps. insecticide-impregnated targets baited with combinations of attractants, and strategies for using mass trapping techniques for adult mosquito population management. Technologies that use semiochemicals (attractants). traps and targets. and mass trapping are relatively new for management of adult mosquito populations. To date. emphasis has been placed primarily on developing barriers of attractant-baited and insecticide-impregnated targets. The leaf beetle, Diorhabda elongata (Brullé) sensu lato, was released in 2001 for the classical biological control of exotic saltcedars, a complex of invasive Tamarix species and hybrids. It did not establish at sites south of 37°N latitude where summer daylengths are below the critical photoperiod of the northern-adapted populations of the beetle that were released. Therefore, we assessed the host specificity of four D. elongata populations collected from more southern latitudes in the Old World (Tunisia, Crete, Uzbekistan, and Turpan, China). Two closely related teasels (Dipsacales: Dipsacaceae, Dipsacus spp.) of European origin have become invasive weeds in the United States. Common teasel (Dipsacus fullonum L.) and cutleaf teasel (Dipsacus laciniatus L.) have likely been in North America for more than two centuries, having been introduced along with cultivated teasel [D. sativus (L.) Honckney], an obsolete crop plant. There are few records of American insects or pathogens attacking Dipsacus spp. Invasive teasels have recently begun to spread rapidly throughout much of their current range, for reasons that are not yet known. Federal common law is a puzzle. Despite Erie's declaration that "[t]here is no federal general common law,"' well-established and stable pockets of federal common law persist in several areas: cases affecting the rights and obligations of the United States,2 disputes between states, 3 cases affecting international relations,4 and admiralty.5 If anything, federal common law is expanding. This study examined differences in academic performance and self-regulated learning based on levels of student participation in Supplemental Instruction (SI) sessions in two introductory undergraduate biology and chemistry courses offered at University of Central Florida in the Spring 2006 semester. The sample consisted of 282 students enrolled in the biology class and 451 students enrolled in chemistry. Academic performance was measured using students' final course grades and rates of withdrawal from the courses. The self-regulated learning constructs of motivation, cognition, metacognition, and resource management were measured using the Motivated Strategies for Learning Questionnaire (MSLQ). As the speed of change increases, federal agencies are challenged more often to develop and implement improvements to existing programs, new programs to meet new needs, or adjustments to programs based on changed circumstances of delivery. Built on the foundation of systems theory, expectancy theory, and field theory, this research seeks to explain why some managers do not propose changes in their organizations---even when the very survival of the organization is at risk. The purpose of this study was to determine if three different tests of phonological awareness: the Comprehensive Test of Phonological Processes (CTOPP) (Wagner, Torgesen, & Rashotte, 1999), The Phonological Awareness Test (PAT) (Robertson & Salter, 1997), and the Pre-Literacy Skills Screening (PLSS) (Crumrine & Lonegan, 1999) measure the same phonological awareness skills (content) in the same manner (procedures) and, whether typically-developing kindergarten-age students perform similarly on each of the tests. The purpose of this study was to determine if mentoring programs had an impact on job satisfaction for beginning elementary principals in the state of Florida. In survival analysis, proportional hazards model is the most commonly used and the Cox model is the most popular. These models are developed to facilitate statistical analysis frequently encountered in medical research or reliability studies. In analyzing real data sets, checking the validity of the model assumptions is a key component. However, the presence of complicated types of censoring such as double censoring and partly interval-censoring in survival data makes model assessment difficult, and the existing tests for goodness-of-fit do not have direct extension to these complicated types of censored data.
