Comparison Of Frontal Plane Trunk Kinematics And Hip And Knee Moments During Anticipated And Unanticipated Walking And Side Step Cutting Tasks, Jeff R. Houck, Andrew Duncan, Kenneth E. De Haven

Faculty Publications - College of Physical Therapy

Background: Frontal plane trunk and lower extremity adjustments during unanticipated tasks are hypothesized to influence hip and knee neuromuscular control, and therefore, contribute to anterior cruciate ligament (ACL) injury risk. The aims of this study were to examine frontal plane trunk/hip kinematics and hip and knee moments (measures of neuromuscular control) during unanticipated straight and side step cut tasks.

Methods: Kinematic and kinetic variables were collected while subjects performed two anticipated tasks, including walking straight (ST) and side step cutting (SS), and two unanticipated tasks (STU and SSU). Foot placement, thorax–pelvis–hip kinematic variables and hip and knee moments were calculated …

Authority With The Force Of Law: Statutory Interpretation As Policymaking In Gonzales V. Oregon, Alfred J. Ludwig Nov 2006

Authority With The Force Of Law: Statutory Interpretation As Policymaking In Gonzales V. Oregon, Alfred J. Ludwig

Missouri Law Review

The Oregon Death with Dignity Act was enacted in 1994 by the State of Oregon to allow physicians to aid terminally ill patients who wished to end their lives in a controlled manner. In 2001, Attorney General John Ashcroft issued an Interpretive Rule stating that prescribing a controlled substance for the purpose of physician-assisted suicide would not qualify as a requisite "legitimate medical purpose" under the federal Controlled Substances Act, and that any physician who prescribed a controlled substance for the purpose of ending a patient's life faced deregistration. In Gonzales v. Oregon, the Supreme Court of the United States …

Missouri Law Review

With the tumultuous period after the enactment of BAPCPA as our backdrop, hundreds of academics, practitioners, and judges gathered together for a two-day symposium to explore the positive and negative aspects of bankruptcy reform from a variety of interdisciplinary perspectives. This volume of the Missouri Law Review is devoted almost exclusively to that symposium. Not only does it include the ten participants' written scholarship that emerged from that extraordinary setting, during which we all benefitted tremendously from the input of others who had thought about, written about, and worked with the provisions of BAPCPA, but it also contains a fascinating …

Abuse Prevention 2005, James J. White Nov 2006

Abuse Prevention 2005, James J. White

Missouri Law Review

The 2005 amendments to the Bankruptcy Code (BAPCPA or Act) that became effective in October of 2005 had an unusually long and difficult gestation. The legislation was conceived and even passed by Congress once during the Clinton administration. After President Clinton's pocket veto, the Act did not again reach a President's desk until President George W. Bush signed the Act into law on April 20, 2005, during the first year of his second term. The Act was conceived by institutional unsecured consumer creditors as the antidote to the rapidly rising number of consumer bankruptcies that followed the enactment of the …

Bankruptcy Reform And The Costs Of Sickness: Exploring The Intersections, Melissa B. Jacoby Nov 2006

Bankruptcy Reform And The Costs Of Sickness: Exploring The Intersections, Melissa B. Jacoby

Missouri Law Review

Two important developments in the personal bankruptcy system unfolded over the course of the last several years: lawmakers considered and ultimately passed an omnibus bankruptcy bill, and researchers began to delve more broadly and deeply into medical-related financial distress among bankruptcy filers. Drawing on prior scholarship, this article contributes to this symposium by considering what, if anything, these developments have to do with one another. Part I briefly reviews two recent empirical studies of bankruptcy filers and the findings they produced. Although these findings may not have had discrete prescriptive implications for bankruptcy reform, they have contributed to a more …

Judicial Discretion To Find Abuse Under Section 707(B)(3), Eugene R. Wedoff Nov 2006

Judicial Discretion To Find Abuse Under Section 707(B)(3), Eugene R. Wedoff

Missouri Law Review

This article suggests the contrary - that if a section 707(b) motion properly raises the question, a bankruptcy judge has a duty to consider the actual financial situation of a debtor who is not subject to a means test presumption; that the judge should find abuse where the debtor can repay a sufficient amount of unsecured debt; and that the means test serves to guide, rather than foreclose, such determinations of abuse. Part I discusses the language of BAPCPA that requires this result, focusing on the nature of the means test as a presumption. Part II examines (and finds wanting) …

Crystals, Mud, Bapcpa, And The Structure Of Bankruptcy Decisionmaking, R. Wilson Freyermuth Nov 2006

Crystals, Mud, Bapcpa, And The Structure Of Bankruptcy Decisionmaking, R. Wilson Freyermuth

Missouri Law Review

As a real estate professor, I tend to focus on bankruptcy only as it intersects with mortgage law and Article 9 of the Uniform Commercial Code. Thus, I feel somewhat out of my element as a commenter in this symposium, and my observations may be suspect coming from a bankruptcy "outsider." But as an outside observer, it seems troublesome that bankruptcy's dispute resolution system - and particularly its multiple layers of appellate review - has always been so poorly designed to produce doctrinal clarity. And even if BAPCPA does resolve a number of specific legal issues that have bedeviled the …

Residential Privacy And Free Speech: Competing Interests In Charitable Solicitation Regulation, Marcus Wilbers Nov 2006

Residential Privacy And Free Speech: Competing Interests In Charitable Solicitation Regulation, Marcus Wilbers

Missouri Law Review

Although these two quotations represent society's mixed feelings toward charity, they also represent a distinction people often make between a charity's aims and its means. Charitable organizations have the potential to spread hope, re-allocate societal resources, and advocate societal values. How they go about accomplishing these noble goals, however, is sometimes the subject of public frustration and annoyance. This creates a tension between admiring the charity's philanthropy and becoming irritated with the means used to achieve it. Undoubtedly, one of the most unwelcome guests in any household is a telemarketer. In fact, 98% of 1.78 million respondents to a recent …

The Illinois Supreme Court Gives Policyholders A Break From The Two Front War, John S. Vishneski Iii Nov 2006

The Illinois Supreme Court Gives Policyholders A Break From The Two Front War, John S. Vishneski Iii

Northern Illinois University Law Review

For many years, Illinois policyholders faced the prospect of a two-front war whenever they submitted a liability insurance claim. Insurers who did not believe they owed coverage could "honor" their duty to defend by filing a lawsuit against their insureds seeking a declaration of non-coverage, thereby forcing their policyholders to defend against the underlying claim and against their own insurer. The Illinois Supreme Court, in the Midwest Sporting Goods case, has brought the two-front war era to an end. As explained in this article, insurers in doubt over coverage must now at least pay their policyholders' defense costs in the …

Guidance And Learn And Serve Program Partnerships: A View Towards Integration For Classroom Delivery, Bob Bhaerman, Harry Drier Nov 2006

Guidance And Learn And Serve Program Partnerships: A View Towards Integration For Classroom Delivery, Bob Bhaerman, Harry Drier

School K-12

The purpose of this monograph is to stimulate a dialogue between counselors, their guidance programs, and classroom teachers about how they might work together to design or continue to and implement community service-learning efforts. We first will raise a series of questions on service-learning and then tum to exploring how and where guidance programs fit into service learning outcomes and activities. As you review the questions on service learning, think of the ways in which you, in your role as counselor and guidance program manager, might become a more meaningful partner with classroom teachers. This monograph helps us to see …

Development Of Pcr-Based Chloroplast Dna Markers That Characterize Domesticated Cowpea (Vigna Unguiculata Ssp. Unguiculata Var. Unguiculata) And Highlight Its Crop-Weed Complex, Y. Feleke, R. S. Pasquet, P. Gepts Nov 2006

Development Of Pcr-Based Chloroplast Dna Markers That Characterize Domesticated Cowpea (Vigna Unguiculata Ssp. Unguiculata Var. Unguiculata) And Highlight Its Crop-Weed Complex, Y. Feleke, R. S. Pasquet, P. Gepts

All Peer-Reviewed Publications

In 1992, Vaillancourt and Weeden discovered a very important mutation for studying cowpea evolution and domestication. A loss of a BamHI restriction site in chloroplast DNA characterized all domesticated accessions and a few wild (Vigna unguiculata ssp. unguiculata var. spontanea) accessions. In order to screen a larger number of accessions, primers were designed to check this mutation using PCR RFLP or direct PCR methods. Using these new primers, 54 domesticated cowpea accessions and 130 accessions from the wild progenitor were screened. The absence of haplotype 0 was confirmed within domesticated accessions, including primitive landraces from cultivar-groups Biflora and Textilis, suggesting …

Electrophysiological Responses Of The Lepidopterous Stemborers Chilo Partellus And Busseola Fusca To Volatiles From Wild And Cultivated Host Plants, M. A. Birkett, K. Chamberlain, Z. R. Khan, J. A. Pickett, T. Toshova, L. J. Wadhams, C. M. Woodcock Nov 2006

Electrophysiological Responses Of The Lepidopterous Stemborers Chilo Partellus And Busseola Fusca To Volatiles From Wild And Cultivated Host Plants, M. A. Birkett, K. Chamberlain, Z. R. Khan, J. A. Pickett, T. Toshova, L. J. Wadhams, C. M. Woodcock

All Peer-Reviewed Publications

The stemborers Chilo partellus and Busseola fusca are major pests of subsistence cereal farming in Africa. Volatiles released by two cultivated hosts, sorghum and maize (Sorghum bicolor and Zea mays), and two wild grass hosts, Pennisetum purpureum and Hyparrhenia tamba, were collected by air entrainment. Electrophysiologically active components in these samples were detected by coupled gas chromatography-electroantennography (GC-EAG), and the active peaks identified by gas chromatography-mass spectrometry. A total of 41 compounds were identified from the four plant species, all of which, as well as two unidentified compounds, elicited an electrophysiological response from one or both of the stemborers. The …

(Whatever Happended To) The Ada's "Record Of" Prong(?), Alex B. Long Nov 2006

(Whatever Happended To) The Ada's "Record Of" Prong(?), Alex B. Long

Washington Law Review

Of the three prongs in the Americans with Disabilities Act's (ADA) definition of disability, the "record of" prong is far less likely to be used by ADA plaintiffs in claiming protection under the Act than are the actual disability and "regarded as" prongs. Between the years 2000 and 2005, ADA and Rehabilitation Act plaintiffs who alleged employment discrimination in federal court relied upon the "record of" prong less than one-third as often as either the actual and "regarded as" prongs in claiming disability status. When they did rely on the "record of" prong, ADA plaintiffs did not enjoy any greater …

Black (Samsum) Ant Induced Anaphylaxis In Saudi Arabia, Mohammed Al-Shahwan, Sultan Al-Khenaizan, Mohammed Al-Khalifa

Saudi Medical Journal

Ant allergy is a rare clinical problem that ranges from local to systemic reaction and life-threatening anaphylaxis. Different types of ants including the imported fire ants, the black (samsum) ants, and others, are considered health hazard in many parts of the world. We report a 32-year-old Saudi female from Hafr-Al-Batin in the Northern region of Saudi Arabia, with history of recurrent anaphylaxis following black (samsum) ant stings and we review the related literature. This is the first report of black (samsum) ant allergy in Saudi Arabia.
