An Empirical Analysis Of County-Level Determinants Of Small Business Growth And Poverty In Appalachia: A Spatial Simultaneous-Equations Approach, Gebremeskel H. Gebremariam, Tesfa Gebremedhin, Peter V. Schaeffer Jan 2006

An Empirical Analysis Of County-Level Determinants Of Small Business Growth And Poverty In Appalachia: A Spatial Simultaneous-Equations Approach, Gebremeskel H. Gebremariam, Tesfa Gebremedhin, Peter V. Schaeffer

Regional Research Institute Working Papers

A spatial simultaneous-equations growth equilibrium model estimated by GS2SLS and GS3SLS estimators is used to determine the interdependence between small business growth and poverty. The parameter estimates are mostly consistent with the theoretical expectations. The coefficients for the endogenous variables of the model are positive and significant indicating strong interdependence (feedback simultaneity) between small business and median household income growth rates. The results also show the presence of spatial autoregressive lag simultaneity and spatial cross-regressive lag simultaneity, with respect to both small business and median household income growth rates, and the existence of spatial correlation in the error terms. Afterword: Elite Principles: The Ali Proposals And The Politics Of Law Reform, Carl E. Scheider Jan 2006

Afterword: Elite Principles: The Ali Proposals And The Politics Of Law Reform, Carl E. Scheider

Book Chapters

The Reporters of the PRINCIPLES were distinguished legal scholars who produced a serious and ambitious document. The contributors to the present volume subject the PRINCIPLES to probing, thoughtful, and illuminating analysis. At the volume's beginning, Professor Glendon puts the problems of family law in a broader perspective by examining the challenges families today face in living good lives. Now, at the volume's close, I want to put both the PRINCIPLES and the essays in a broader perspective. I need not vivisect the PRINCIPLES; that is admirably done by the essayists. Rather, I proffer a tool for understanding the PRINCIPLES more …

The Gender Of Jus Cogens, Christine M. Chinkin, Hilary Charlesworth Jan 2006

The Gender Of Jus Cogens, Christine M. Chinkin, Hilary Charlesworth

Book Chapters

Defenders of the notion of jus cogens often explain its basis as the collective international, rather than the individual national, good. On this analysis, principles of jus cogens play a similar role in the international legal system to that played by constitutional guarantees of rights in domestic legal systems. Thus states, as national political majorities, accept the limitation of their freedom of choice "in order to reap the rewards of acting in ways that would elude them under pressures of the moment." Among those jurists who accept the category of jus cogens, however, continuing controversy remains over what norms …

Zarathustra’S Preposterous History, Joel Westerdale Jan 2006

Zarathustra’S Preposterous History, Joel Westerdale

German Studies: Faculty Publications

What possible allure can a Persian prophet hold for a philhellenic philosopher? “Zarathus- tra’s Preposterous History” discusses the conspicuous heritage of Nietzsche’s figure, arguing that Nietzsche’s turn to Zoroaster itself functions as an instance of affirmation, the difficult affirmation of even that which must be overcome. The self-overcoming that structures Also sprach Zarathustra comes to characterize the figure of Zarathustra itself, both within this book and in Nietzsche’s later writings. But only through the preposterous imposition of this characteriz- ation can Nietzsche identify Zarathustra with Zoroaster and portray the moralist as the necess- ary precursor to the immoralist. Inverting chronology, …

Boundedly Rational Borrowing, Cass R. Sunstein Jan 2006

Boundedly Rational Borrowing, Cass R. Sunstein

University of Chicago Law Review

Excessive borrowing, no less than insufficient savings, might be a product of bounded rationality. Identifiable psychological mechanisms are likely to contribute to excessive borrowing; these include myopia, procrastination, optimism bias, "miswanting," and what might be called cumulative cost neglect. Suppose that excessive borrowing is a significant problem for some or many; if so, how might the law respond? The first option involves weak paternalism, through debiasing and other strategies that leave people free to choose as they wish. Another option is strong paternalism, which forecloses choice. Because of private heterogeneity and the risk of government error, regulators should have a …

Compelled Self-Reporting And The Principle Against Compelled Self-Incrimination: Some Comparative Perspectives, Mark Berger Jan 2006

Compelled Self-Reporting And The Principle Against Compelled Self-Incrimination: Some Comparative Perspectives, Mark Berger

Faculty Works

This article examines the tension between mandatory self-reporting and identification statutes and the right to be free of compelled self-incrimination. The author reviews decisions addressing this issue taken by the European Court of Human Rights ('ECtHR'), the Privy Council, and the Supreme Courts of Canada and the United States. He then analyses applicable public policies and assesses the alternative approaches available to accommodate these conflicting interests.

Human Rights In Cuba, Susan Kemp Jan 2006

Human Rights In Cuba, Susan Kemp

Human Rights & Human Welfare

In 1959, Fidel Castro established a Cuban socialist state closely aligned with the Soviet Union. The Soviet Union's collapse brought an end to Soviet economic support which, combined with the U.S. embargo, created an economic crisis in the early 1990s. The Cuban government's instability and desire to maintain control overrides the individual rights of its citizens. These events are the background for the lack of fundamental human rights in Cuba today.

Human Rights In El Salvador, Tait Robinson Jan 2006

Human Rights In El Salvador, Tait Robinson

Human Rights & Human Welfare

Between 1979 and 1991 El Salvador was embroiled in a civil war that claimed over 70,000 lives. Longstanding socio-economic inequality between the rich and poor led to government-backed human rights abuses dispensed by the military. These ranged from denials of freedom and civil liberties to village massacres.

Human Rights In Guatemala, Jennifer Archibald Jan 2006

Human Rights In Guatemala, Jennifer Archibald

Human Rights & Human Welfare

Thirty six years of civil war affected human rights negatively in Guatemala. Many actors that violated human rights were also victims of human rights violations; a complex series of events that has still not been fully resolved today.

Human Rights In Honduras, Andrea Degaetani Jan 2006

Human Rights In Honduras, Andrea Degaetani

Human Rights & Human Welfare

Honduras’ history of human rights violations is rooted in a political culture of militarization. Following a military coup in 1963, Honduras faced strengthened military authority and a decade of harsh military rule. It was also during this time that the United States used the country as a base for Contras fighting leftist Sandinistas in Nicaragua. In 1981 Honduras returned to a parliamentary democracy, electing Roberto Suazo Cordova as president. However, by then the process of militarization had been so heavily funded by the U.S and had made such a significant impact on public policy that little changed for the better. …

Human Rights In Chile, Stephanie Raessler Jan 2006

Human Rights In Chile, Stephanie Raessler

Human Rights & Human Welfare

Chile might evoke memories of Augosto Pinochet and his brutal reign, though there is more to this country than an oppressive authoritarian regime. A history of politics longer than Pinochet's rule has shaped Chile's current situation. Many issues recur across Chilean history, and continue to influence the present.

Unchain My Heart: Slavery As A Defense To The Dismantling Of The Violence Against Women Act, Angie Perone Jan 2006

Unchain My Heart: Slavery As A Defense To The Dismantling Of The Violence Against Women Act, Angie Perone

UC Law SF Journal on Gender and Justice

When Congress passed the Violence Against Women Act ("VAWA"), it aimed to address pervasive problems associated with gender-motivated violence. Through inclusion of a section entitled "Civil Rights for Women," Congress specifically created a federal civil rights remedy for victims of gender-motivated violence. Nevertheless, the U.S. Supreme Court invalidated the civil rights remedy provision of the VAWA, claiming that Congress lacked authority to pass this provision under the Commerce Clause and the 14th Amendment. This Note argues that Congress has authority under the 13th Amendment to reinvigorate the civil rights remedy in the VAWA. This Note compares antebellum slavery to domestic …

Coercion In California: Eugenics Reconstituted In Welfare Reform, The Contracting Of Reproductive Capcity, And Terms Of Probation, Janet Simmonds Jan 2006

Coercion In California: Eugenics Reconstituted In Welfare Reform, The Contracting Of Reproductive Capcity, And Terms Of Probation, Janet Simmonds

UC Law SF Journal on Gender and Justice

In an era where courts are expanding the scope of a constitutionally protected right to privacy, it is hard to imagine that the exercise of that right is being legally perverted to promote eugenic ideals. This, however, is precisely what has been happening in the state of California. This Note explores how modern day policies and practices, such as the family cap component of welfare policy, the sale of the reproductive capacity of drug addicts, and prohibitions on procreation as a term of probation, are used to coerce women with regard to their reproductive decisions
