Theobald V. University Of Cincinnati - Reforming Medical Malpractice In Ohio: A Survey Of State Laws And Policy Impacts , Brian Dunne Jan 2006

Theobald V. University Of Cincinnati - Reforming Medical Malpractice In Ohio: A Survey Of State Laws And Policy Impacts , Brian Dunne

Journal of Law and Health

In its recent decision of Theobald v. University of Cincinnati, Ohio's Tenth District Court of Appeals declared that medical practitioners shall have state employee immunity, based on section 9.86 of the Ohio Revised Code, anytime they treat a patient as long as they act in a dual role to "teach" an "involved" student or resident. This immunity takes away the patient's right to sue the practitioner personally for his medical malpractice. As required by this holding, the doctor must have an employment relationship with state medical college. However, the employment relationship could encompass anything from a faculty position to something …

Environmental Effects On Pregnancy Rate In Beef Cattle, J. L. Amundson, Terry L. Mader, Richard J. Rasby, Q. S. Hu

Department of Animal Science: Faculty Publications

Ten years of calving records were examined from Bos taurus crossbred cows (mean of 182 cows/ yr) to quantify the effects of environmental conditions during the breeding season on pregnancy rate. Estimated breeding dates were determined by subtracting 283 d from the calving date. Relationships were determined between the proportion of cows bred during the periods from the beginning of the breeding season until d 21, 42, and 60 of the breeding season and the corresponding environmental variables. Weather data were compiled from a weather station located approximately 20 km from the research site. Average daily temperature and relative humidity …

Keeping Peace In The Family While You Are Resting In Peace: Making Sense Of And Presenting Will Contests, Judith G. Mcmullen Jan 2006

Keeping Peace In The Family While You Are Resting In Peace: Making Sense Of And Presenting Will Contests, Judith G. Mcmullen

Faculty Publications

This Article focuses on post-mortem challenges to wills. All such will challenges involve a clash between the testator's stated intentions and the disappointed heirs' expectations and desires. While the legal issues may differ somewhat in individual cases, the claims are almost invariably the result of a disappointed heir feeling that she has been treated unfairly or has not received what she expected to receive. Rather than focusing on the technical issues of will drafting or execution, this Article reflects on the emotional causes of fighting over an estate and suggests some ways to reduce the family fighting and hard feelings …

Underage Drinking: Does Current Policy Make Sense?, Judith G. Mcmullen

Faculty Publications

This Article examines the history of laws and policies regulating consumption of alcoholic beverages by young people in the United States, and examines youth drinking patterns that have emerged over time. Currently, all 50 states have a minimum drinking age of 21. Various rationales are offered for the 21 drinking age, such as the claim that earlier drinking hinders cognitive functions, and the claim that earlier drinking increases the lifetime risk of becoming an alcoholic. While there is sufficient evidence to support the claim that it would be better for adolescents and young adults if they did not drink prior …

Free Shoes For Primary And Secondary Schools: Playing By The Rules Of Title Ix, Patricia A. Cervenka Jan 2006

Free Shoes For Primary And Secondary Schools: Playing By The Rules Of Title Ix, Patricia A. Cervenka

Faculty Publications

Many credit Title IX with providing opportunities for girls to participate in athletics in greater numbers. The National Federation of State High School Associations show that the number of girls participating increased from 294,015 in 1971-1972 to 2,908,390 in 2004-2005, almost a tenfold increase. In the same time period the number of boys participating increased by 443,000. Girls participation has dramatically increased so the big picture is focused. Now attention is being drawn to some of the smaller aspects of Title IX compliance.

Shoe deals sidestep rules on equality in schools. Thus ran the headline in the Oregonian. The journalist …

Tax Planning For Retirement, Vada Waters Lindsey Jan 2006

Tax Planning For Retirement, Vada Waters Lindsey

Faculty Publications

As increasing life expectancy and inflation diminish the purchasing power of retirement savings, careful tax planning to maximize funds available to seniors is necessary. Lindsey discusses the taxation of various types of retirement income including traditional and Roth IRAs and Social Security benefits, and explains how careful planning can reduce income and estate taxes. The disparate effects of state income and estate taxes are also explored.

Inherent Attorney Conflicts Of Interest Under Erisa: Using The Model Rules Of Professional Conduct To Discourage Joint Representation Of Dual Role Fiduciaries, Paul M. Secunda Jan 2006

Inherent Attorney Conflicts Of Interest Under Erisa: Using The Model Rules Of Professional Conduct To Discourage Joint Representation Of Dual Role Fiduciaries, Paul M. Secunda

Faculty Publications

Although ERISA expressly permits employers to act as both an employer/plan sponsor and fiduciary of an ERISA employee benefit plan, the statute does not address itself to whether corporate counsel should represent an employer in both of these capacities. Conflicts of interest frequently arise in this context because corporate officers have a fiduciary duty to act in the best interests of their shareholders, while ERISA plan fiduciaries have a duty to act in the best interests of the plan participants and beneficiaries.

Although the Model Rules speak generically of how to identify the client in corporate situations, and also of …

Calpain 10: Mitochondrial Localization, Function, And Substrates, David Darrell Arrington Jan 2006

Calpain 10: Mitochondrial Localization, Function, And Substrates, David Darrell Arrington

MUSC Theses and Dissertations

The calpain family of cysteine proteases has undergone intense study since its discovery in 1976. Although numerous functions and proteolytic substrates have been linked to this 14-member family, little is known about the five atypical calpain isoforms. Over the past 25 years, investigators have identified ‘calpain-like’ activities in mitochondrial fractions isolated from various tissues. The studies undertaken in this dissertation were designed to positively identify the mitochondrial calpain present in renal cortical mitochondria (RCM) and to elucidate its function and proteolytic targets under both basal and CA2- -challenged conditions. We identified the RCM calpain as calpain 10 by both immunoblot …

Investigation Of Cell Surface Phenotypes At Mucosal Sites In Response To Murine Cytomegalovirus Infection, Mary Esther Bruorton Jan 2006

Investigation Of Cell Surface Phenotypes At Mucosal Sites In Response To Murine Cytomegalovirus Infection, Mary Esther Bruorton

MUSC Theses and Dissertations

The salivary gland is the predominant effector site of mucosal immune responses in the oral cavity. In mice, the salivary glands are known to receive immune lymphocytes stimulated in inductive sites such as the gut- and nasal-associated lymphoid tissues, thus, allowing the production of antigen-specific antibodies in saliva. However, the potential of the salivary gland as a mucosal inductive site has not been fully explored. In order to investigate this concept, we have developed a model resulting in a focused salivary gland infection using intraglandular delivery of tissue culture-derived murine cytomegalovirus (tcMCMV). Utilizing this route of infection, we were capable …

Addiction And Substance Abuse In Nevada, An-Pyng Sun, Larry Ashley Jan 2006

Addiction And Substance Abuse In Nevada, An-Pyng Sun, Larry Ashley

Social Health of Nevada Reports

Substance abuse is known to cause a host of problems for individual users, their communities, and society as a whole. Its cost is staggering, as measured by lost productivity, medical illness, serious injuries, and premature death, as well as by resources required to run criminal justice system and special education programs (Meara & Frank, 2005). The substance abuse problem is global in scope. Consider these figures released by the United Nations’ 2005 World Drug Report[WDR] (United Nations, Office on Drug and Crime, 2005),

  • In 2003-2004, about 200 million people, or 5% of the world’s population age 15-64, had used illicit …

Journal Articles: Pharmacology & Experimental Neuroscience

Antibodies against viral bovine diarrhea virus (BVDV) and of BVDV antigen in serum samples Were evaluated from cattle aged 10 to 23 months (n = 148) from a dairy herd disease eradication where the has-been carrying out since 2002. The herd is located in Santa Rita, Arequipa, Peru, and samples were collected twice on a 30-day interval. Antibodies against BVDV and BVDV antigen were analyzed by viral neutralization and capture ELISA tests respectively. Neutralising antibodies against BVDV were detected in 6.8% (10/148) of animals, and most reactors were 19 to 23 months of age. The antibody titer ranged from 8 …

Transforming Wuthering Heights And La Madre Naturaleza Into Abel Sánchez: Creating The Postmodern Out Of Its Past, Thomas R. Franz Jan 2006

Transforming Wuthering Heights And La Madre Naturaleza Into Abel Sánchez: Creating The Postmodern Out Of Its Past, Thomas R. Franz

Decimonónica

In chapter 17 of La Madre Naturaleza (1887), Gabriel Pardo de la Lage rummages through the library of Los Pazos [as the priest Julián Alvarez had done in Los Pazos de Ulloa (1886)] and discovers copies of Andrews’s Clarissa Harlow and Richardson’s Pamela (1856), exemplars of the English sentimental novel. Somewhat later on, the reader begins to note provocative similarities between La Madre and Emily Brontë’s proto-Gothic, Romantic masterpiece, Wuthering Heights (1847). There are headstrong sets of lovers, a strong hint of the demonic, the possibility of happiness through marriage to a more civilized man, a strong suggestion of the …
