Personal Jurisdiction For Internet Torts: Towards An International Solution, Holger P. Hestermeyer Jan 2006

Personal Jurisdiction For Internet Torts: Towards An International Solution, Holger P. Hestermeyer

Northwestern Journal of International Law & Business

As an introduction to the issue of Internet tort jurisdiction, Part I will recount the Yahoo! case, the most divisive case on the issue recently. Parts II and III will give an overview of the current law on Internet tort jurisdiction in two different legal systems: the United States and Germany. They will show that several recent cases in both countries have applied targeting approaches as advocated by Michael Geist and Rufus Pichler. However, insecurity remains and jurisprudence is far from consistent. Part IV will argue that insecurity about Internet jurisdiction could be reduced significantly if countries were to commit …

Competition Policy And Practice In South Africa: Promoting Competition For Development Symposium On Competition Law And Policy In Developing Countries , Trudi Hartzenberg

Northwestern Journal of International Law & Business

South Africa's new competition policy and law were drafted during the early years of South Africa's new democracy, a period characterized by important domestic policy and regulatory reform. These reforms were not only part of the comprehensive program for the country's economic, social, and political transformation, but also its integration into the global economy after decades of isolation under the apartheid regime. In the case of competition policy, however, concerns about specific development challenges entrenched by the previous era of political and economic control, had to be explicitly reflected in the new South Africa's law and policy. It was clear …

Falling Short Of The Mark: The United States Response To The European Union's Data Privacy Directive, Morey Elizabeth Barnes Jan 2006

Falling Short Of The Mark: The United States Response To The European Union's Data Privacy Directive, Morey Elizabeth Barnes

Northwestern Journal of International Law & Business

In the spring and summer of 2005, the headlines of America's major newspapers provided a constant reminder of an issue about which Americans have grown increasingly worried: data security. Rather than publicizing the war in Iraq or the buzz over potential Supreme Court nominees, these headlines warned: "Info theft slams chain: 1.4 million card numbers stolen;" "Poll Says Identity Theft Concerns Rose After High-Profile Breaches;" "Data Security Breaches Alarm Consumers." In the previous few months, a series of high-profile companies such as Bank of America, Reed Elsevier Group's LexisNexis, PayMaxx, Choice Point, and SAIC had announced that millions of records …

Defragmenting World Trade, Sungjoon Cho Jan 2006

Defragmenting World Trade, Sungjoon Cho

Northwestern Journal of International Law & Business

The global trading community is in a state of deep crisis. Its main system, multilateralism, has recently been clogged by viscous trade barriers created by a proliferation of bilateral, regional trading blocs. Globalization offers a worldwide "production value chain" which enables even small economies to take part in the global commerce by offering raw materials or labor. In fact, small economies hold a comparative advantage at certain stages of the international manufacturing process.1 However, the current pattern of regional trading blocs militates against such participation by erecting new barriers against non-members and thus compartmentalizing the global market.2 This is not …

Brazil's Recent Threat On Abbott's Patent: Resolution Or Retaliation, Jennifer Bjornberg Jan 2006

Brazil's Recent Threat On Abbott's Patent: Resolution Or Retaliation, Jennifer Bjornberg

Northwestern Journal of International Law & Business

In June 2005, Brazil threatened to infringe the patent of an anti-AIDS medication, Kaletra, patented and produced by a U.S. based pharmaceutical company, Abbott Laboratories. The resulting controversy necessarily implicated the World Trade Organization's Agreement on Trade Related Aspects of Intellectual Property ("TRIPS Agreement") as Brazil was a Member Nation under the agreement and Abbott's product was protected under that agreement. Ultimately, the threat came to a voluntary resolution between both parties, but the dispute raised a number of unique questions relating to international trade and public health concerns. This article will discuss the recent controversy between Abbott and Brazil …

Evaluation Of Alternative Water Resources For Cape Coast And Its Environs In Ghana, Alex Kumah

Electronic Theses and Dissertations

Cape Coast once a national capital of Ghana and its environs in recent years have constantly suffered perennial acute water shortage. The Brimsu dam which takes its supplies from the Kakum River with current production capacity of 1.4 × 104 m3/day cannot meet the water needs of the study area. The operating levels of the dam during crisis have reduced from 7.3 meters to 4.7 meters over the years with subsequent reduction in water production by 35%. Recently, the operating level has reduced further to about 3.5 meters with 60% reduction in water supply. This study evaluated alternative water resources …

A number of individuals were also interviewed about their experiences. Results: The overall prevalence rate for child sexual abuse was 27.7%, with rates being higher for females than for males. The average …

Predicting A Currency Crisis Alternative Approaches And Applications To The Philippines, Fernando Antonio Iv Castillo Jan 2006

Predicting A Currency Crisis Alternative Approaches And Applications To The Philippines, Fernando Antonio Iv Castillo

Dissertations and Theses Collection (Open Access)

An arrival of a currency crisis can be anticipated through a comprehensive and properly specified Early Warning System (“EWS”). The costs that entail with experiencing a currency crisis far exceed the costs of spending a considerable amount of time to developing an EWS. In a report done by the IMF(1998), they estimated that emerging economies suffer an 8% cumulative loss in real output during a severe currency crisis. Likewise, evidence suggests that a simple look at traditional market indicators of currency and default risks will not provide much advance warning of an impending currency crisis. In a study done by …

The Promiscuity Of Print: John Clare’S ‘Don Juan’ And The Culture Of Romantic Celebrity, Jason N. Goldsmith Jan 2006

The Promiscuity Of Print: John Clare’S ‘Don Juan’ And The Culture Of Romantic Celebrity, Jason N. Goldsmith

Scholarship and Professional Work - LAS

This essay offers a new reading of John Clare's "Don Juan," a hard-hitting and deliberately vulgar denunciation of English society and letters. In his extended Byronic performance, Clare harnesses Byron's famed sexual appetite and strong Romantic irony to dramatic effect, defiantly redeploying the machinery of literary celebrity that had produced him as "The Northamptonshire Peasant Poet." Tracing Clare's imaginative and textual investments in prostitutes and boxers, figures located at the margins of London's criminal underworld, I show how the compulsive misogyny of "Don Juan" and its obscene sexual punning form part of a concerted, if not entirely coherent, response to …

Endothelial Cell Cortactin Phosphorylation By Src Contributes To Polymorphonuclear Leukocyte Transmigration In Vitro, L. Yang, Jennifer R. Kowalski, X. Zhan, S. M. Thomas, F. W. Luscinskas Jan 2006

Endothelial Cell Cortactin Phosphorylation By Src Contributes To Polymorphonuclear Leukocyte Transmigration In Vitro, L. Yang, Jennifer R. Kowalski, X. Zhan, S. M. Thomas, F. W. Luscinskas

Scholarship and Professional Work - LAS

The underlying mechanisms that regulate leukocyte transendothelial migration through the vascular endothelium remain unclear. Cortactin is a substrate of Src tyrosine kinases and a regulator of cytoskeletal dynamics. Previous studies demonstrated a role for Src phosphorylation of cortactin in clustering of E-selectin and intercellular cell adhesion molecule-1 around adherent leukocytes. In the current study, we used an in vitro flow model to investigate the role of Src-induced cortactin phosphorylation in endothelium during polymorphonuclear leukocyte (PMN) transmigration through human umbilical vein endothelium (HUVEC) monolayers preactivated with tumor necrosis factor-{alpha}. Inhibition of Src in HUVEC using Src kinase inhibitors PP2 and SU6656 …

Spirituality And Leadership Among College Freshmen, Barry Posner, Charles Slater, Mike Boone Jan 2006

Spirituality And Leadership Among College Freshmen, Barry Posner, Charles Slater, Mike Boone

International Journal of Servant-Leadership

Over a century ago, Ralph Waldo Emerson bragged to Henry Thoreau that "at Harvard they teach all branches of learning." Thoreau responded, "Yes, but they don't teach the roots" (Jacobs, 1991, p. 277). This sort of commentary continues to this day as a growing number of scholars and practitioners argue that the roots of effective leadership are grounded in the spiritual dimension of individual leaders ( e.g., Conger, 1994; Marcie, 1997; Mitroff & Denton, 1999). While hundreds of articles and books about spirituality and the workplace are now appearing, most are theory-based or anecdotal (Strack, 2001). Very little quantitative and …

Evolving Leadership: Servant-Leadership In The Political World, Harris W. Fawell Jan 2006

Evolving Leadership: Servant-Leadership In The Political World, Harris W. Fawell

International Journal of Servant-Leadership

An interesting experience about how leadership can work in modern businesses occurred when I was a Member of Congress. It involved legislation entitled the Teamwork of Employees and Management Act (Team Act) that was introduced in Congress at the request of a group of employers. The employers sought to amend the National Labor Relations Act (NLRA) to allow teams of their employees to determine terms and conditions of their employment.

Theobald V. University Of Cincinnati - Reforming Medical Malpractice In Ohio: A Survey Of State Laws And Policy Impacts , Brian Dunne

Journal of Law and Health

In its recent decision of Theobald v. University of Cincinnati, Ohio's Tenth District Court of Appeals declared that medical practitioners shall have state employee immunity, based on section 9.86 of the Ohio Revised Code, anytime they treat a patient as long as they act in a dual role to "teach" an "involved" student or resident. This immunity takes away the patient's right to sue the practitioner personally for his medical malpractice. As required by this holding, the doctor must have an employment relationship with state medical college. However, the employment relationship could encompass anything from a faculty position to something …
