Exile, Amnesty And International Law, Leila Nadya Sadat Mar 2006

Exile, Amnesty And International Law, Leila Nadya Sadat

Notre Dame Law Review

This Article examines recent state and international practice regarding amnesties for jus cogens crimes, particularly cases from Latin America as well as international courts and tribunals, and explores the transnational legal dialogue between courts, and to a lesser degree, legislatures, that has led to international norm creation in this area, strengthening the prohibition against amnesties considerably. At the same time, constraints upon the exercise of universal jurisdiction, whether imposed by legislatures, articulated in judicial opinions, or created by international treaty, have provided a political check to the otherwise unbounded exercise of universal jurisdiction by states and the exercise of universal …

The Impact Of Biculturalism On Language And Literacy Development: Teaching Chinese English Language Learners, Barbara C. Palmer, Chia-I Chen, Sara Chang, Judith T. Leclere

Reading Horizons: A Journal of Literacy and Language Arts

According to the 2000 United States Census, Americans age five and older who speak a language other than English at home grew 47 percent over the preceding decade. This group accounts for slightly less than one in five Americans (17.9%). Among the minority languages spoken in the United States, Asian-language speakers, including Chinese and other Asian and Pacific Islander languages, have increased by more than 75 percent. Futher, the proportion of Asian language speakers having difficulty speaking English has almost doubled (Klein, Bugarin, Beitranena, & McArthur, 2004). Today, Chinese students are one of the largest groups of English Language Learners …

Towards Secure Cyberinfrastructure For Sharing Border Information, Ann Q. Gates, Vladik Kreinovich, Luc Longpre, Paulo Pinheiro Da Silva, Randy G. Keller

Departmental Technical Reports (CS)

In many border-related issues ranging from economic collaboration to border security, it is extremely important that bordering countries share information. One reason why such sharing is difficult is that different countries use different information formats and data structures. It is therefore desirable to design infrastructure to facilitate this information sharing.

UTEP is a lead institution in a similar NSF-sponsored multi-million geoinformatics project, whose goal is to combine diverse and complex geophysical and geographical data stored in different formats and data structures. We describe our experience in using and developing related web service techniques, and we explain how this experience can …

Geographic Factors Contributing To A High Seroprevalence Of West Nile Virus-Specific Antibodies In Humans Following An Epidemic, Beth K. Schweitzer, Wayne L. Kramer, Anthony R. Sambol, Jane L. Meza, Steven H. Hinrichs, Peter C. Iwen Mar 2006

Geographic Factors Contributing To A High Seroprevalence Of West Nile Virus-Specific Antibodies In Humans Following An Epidemic, Beth K. Schweitzer, Wayne L. Kramer, Anthony R. Sambol, Jane L. Meza, Steven H. Hinrichs, Peter C. Iwen

United States Public Health Resources

Sera of 624 blood donors were evaluated to determine seroprevalence of West Nile virus (WNV) antibodies following the 2003 WNV epidemic in Nebraska. Geographic factors contributing to differences in WNV seropositivity were evaluated. The overall prevalence of WNV in Nebraska was higher than reported previously in other U.S. locations (9.5% WNV immunoglobulin G seroprevalence rate), with the highest prevalence identified in the western part of the state (19.7%), followed by the central (13.8%) and the eastern (4.2%) parts. Regions of the state with the highest WNV-positive mosquito rates correlated with the highest human WNV seroprevalence rates. The results showed that …

The Impact Of A Northern Peatland On The Earth’S Radiative Budget: Sustained Methane Emission Versus Sustained Carbon Sequestration, Steve Frolking, Nigel T. Roulet, Jan Fuglestvedt Mar 2006

The Impact Of A Northern Peatland On The Earth’S Radiative Budget: Sustained Methane Emission Versus Sustained Carbon Sequestration, Steve Frolking, Nigel T. Roulet, Jan Fuglestvedt

Earth Sciences

Northern peatlands sequester carbon and emit methane, and thus have both cooling and warming impacts on the climate system through their influence on atmospheric burdens of CO2 and CH4. These competing impacts are usually compared by the global warming potential (GWP) methodology, which determines the equivalent CO2 annual emission that would have the same integrated radiative forcing impact over a chosen time horizon as the annual CH4 emission. We use a simple model of CH4 and CO2 pools in the atmosphere to extend this analysis to quantify the dynamics, over years to millennia, of the net radiative forcing impact of …

Talking About Music:Ethnographic Interviews On Traditional Hispanic Songs, Paula Heusinkveld Mar 2006

Talking About Music:Ethnographic Interviews On Traditional Hispanic Songs, Paula Heusinkveld

Dimensions

This article proposes a variety of activities designed to enrich the study of authentic Hispanic music in the foreign language class. As an integral part of any lesson on a culturally authentic song, students interview native speakers, both in and out of class, to learn about the cultural context of various songs. Of special interest are songs that have strong associations with specific cultural practices, such as “Las mañanitas.” In other assignments, students interview native speakers about their musical tastes, seek out songs from native informants, and then share these songs with the class. The cultural information obtained from the …

When Policy Meets Practice: The Untested Effects Of Permanency Reforms In Child Welfare, Amy D'Andrade, Jill Duerr Berrick Mar 2006

When Policy Meets Practice: The Untested Effects Of Permanency Reforms In Child Welfare, Amy D'Andrade, Jill Duerr Berrick

The Journal of Sociology & Social Welfare

The Adoption and Safe Families Act (P.L. 105-89; ASFA) passed into federal law in 1997. ASFA emphasized child protection over family preservation, and introduced reforms intended to increase the likelihood and the speed with which children in the child welfare system attain a permanent home. This article details two provisions of the law, concurrent planning and reunification exception, and explores challenges in their implementation. These provisions have the potential to shift the nature of how child welfare services are delivered, and which families zill receive them. An examination of implementation in the state of California suggests there is a need …

Welfare To Web To Work: Internet Job Searching Among Former Welfare Clients In Florida, Steve Mcdonald, Robert E. Crew Jr. Mar 2006

Welfare To Web To Work: Internet Job Searching Among Former Welfare Clients In Florida, Steve Mcdonald, Robert E. Crew Jr.

The Journal of Sociology & Social Welfare

This study provides the first empirical test of whether searching for jobs on the Internet can help people gain access to high quality jobs. Using new data from former welfare clients in Florida, we present results from a multivariate regression analysis of Internet job searching on wages and on a number of job benefits. On average, Internet job searchers receive better jobs than people who conducted more traditional job searches, net of numerous control variables. These findings suggest that welfare recipients have a great deal to gain from searching for their jobs on the Internet.

Estimates Of Breeding Bird Populations In The Sheyenne National Grassland, North Dakota, Mary Ann Cunningham, Douglas Johnson, Daniel N. Svingen

The Prairie Naturalist

We conducted a two-year survey of breeding birds in the Sheyenne National Grassland, North Dakota, to estimate total populations of breeding birds. The Grassland is of interest because it provides wildlife habitat and recreational birding opportunities. Indicated breeding pairs were counted on 100-m wide belt transects during morning surveys from late May to early July in 2002 and 2003. We surveyed approximately 6 to 7% of the Grassland each year. The most abundant species in both years were grasshopper sparrow (Ammodramus savannarum), red-winged blackbird (Agelaius phoeniceus), claycolored sparrow (Spizella pallida), Savannah sparrow (Passerculus …

Journal of Catholic Education

Sister M. Madeleva Wolff, C.S.C., teacher, essayist, poet, and college administrator, through her creative ability and innovative practices made possible major contributions to Catholic education in her lifetime. Without her strong personality and boundless energy, many of her dreams for an ideal college curriculum would not have come to fruition. Her most significant legacy, the Graduate School of Theology, afforded for the first time the opportunity for the laity and religious women to study theology at the graduate level. She served as president of St. Mary’s College, Notre Dame, Indiana, from 1934 to 1961.

Katharine Drexel: Learning To Love The Poor, Cecilia Murray

Journal of Catholic Education

Although born into privilege, Katharine Drexel was blessed with parents, siblings, friends, and spiritual guides who kept her rooted in a deep, Eucharistic faith. Responding to the needs of the poor was a responsibility of the rich, and Katharine learned this value at the hands of her parents at an early age. With the good counsel of popes and bishops, family and friends, she ultimately used her great family wealth to provide education for the poor.

Is The Nigerian Curricula In Economics Relevant For The Nigerian Economy Of The 21st Century., J. A. Achilike

Bullion

The loopholes in Nigeria's educational system have created a death of capacity in the Nigerian economy. No nation can develop without qualitative education. The paper examines the relevance of the economics curricula in Nigeria's tertiary institutions in meeting the challenges of the 21st century. It highlights its problems and examines the efforts of National University Commission and Ministry of Education in meeting the challenges of economics education in Nigeria. Finally the study concludes that, the Nigerian Economics curricular is critically under developed and does not follow government economic policies, but if all the recommendations are adopted the Nigerian economics curricula …

An Estimation Theory Approach To Detection And Ranging Of Obscured Targets In 3-D Ladar Data, Charles R. Burris Mar 2006

An Estimation Theory Approach To Detection And Ranging Of Obscured Targets In 3-D Ladar Data, Charles R. Burris

Theses and Dissertations

The purpose of this research is to develop an algorithm to detect obscured images in 3-D LADAR data. The real data used for this research was gathered using a FLASH LADAR system under development at AFRL/SNJM. The system transmits light with a wavelength of 1.55 micrometers and produces 20 128 X 128 temporally resolved images from the return pulse separated by less than 2 nanoseconds in time. New algorithms for estimating the range to a target in 3-D FLASH LADAR data were developed. Results from processing real data are presented and compared to the traditional correlation receiver for extracting ranges …

Comparative Phylogeography In A Genus Of Coral Reef Fishes: Biogeographic And Genetic Concordance In The Caribbean, Michael S. Taylor, Michael E. Hellberg Mar 2006

Comparative Phylogeography In A Genus Of Coral Reef Fishes: Biogeographic And Genetic Concordance In The Caribbean, Michael S. Taylor, Michael E. Hellberg

Faculty Publications

Geographic barriers that limit the movement of individuals between populations may create or maintain phylogenetically discrete lineages. Such barriers are often inferred from geographic surveys of a single mitochondrial marker to identify phylogenetic splits. Mitochondrial DNA, however, has an effective population size one-fourth that of nuclear DNA, which can facilitate the rapid evolution of monophyletic mtDNA lineages in the absence of geographic barriers. The identification of geographic barriers will thus be more robust if barriers are proposed a priori, and tested with multiple independent genetic markers in multiple species. Here, we tested two proposed marine biogeographic breaks located at the …

Blockading The American Confederacy, 1861-1865:A Geo-Strategic Analysis, James D. Hardy Jr., Leonard J. Hochberg

Civil War Book Review

A paper to be included in a volume devoted to the comparison to the comparative history of blockages, edited by Professor Jean-David Avenal. INTRODUCTION Blockade, as a formal and systematic weapon in modern naval warfare, distinct from battle and maneuver, developed during the Napoleonic wars and was further refined by the Royal Navy in its decades-long campaign after 1815 to suppress the African slave trade (1). In spite of this extensive history, it was not until the Treaty of Paris ending the Crimean War that a Declaration Respecting Maritime Law, dated April 16, 1856, formally established the general principles of …

Translitic Poems, Ron Sandvik

UNIversitas: Journal of Research, Scholarship, and Creative Activity

I am an Iowan, a child of the prairie, an American, and so as the joke goes obviously I'm a monoglot. One might ask, "Why the fascination with languages you clearly don't speak, and have no ambition of learning?" The truth is I don't know. It just is.

My family didn't start out speaking English. They were mostly farmers and small business owners who wrested the prairie into productive farmland who lost their polyglottism during WWII. In the same way Arab-Americans seem to always be suspect today, Germans, Norwegians, and Swiss, made it their business to find ways to show …

Beyond That “It's Just A Flesh Wound...” Kind Of Feeling: A Medieval Game1 Proposal, Carol Robinson

UNIversitas: Journal of Research, Scholarship, and Creative Activity

In his book, What Video Games Have to Teach Us About Learning and Literacy, James Paul Gee argues that “the power of video games, for good or ill, resides in the ways in which they meld learning and identity…,” and he cautions that this power can be used to miscommunicate wrong ideology (such as might be found in a neo-Nazi game that encourages the player to conduct ethnic cleansing (199). However, Gee advocates “understanding the ‘play’ of identities and perspectives as they work for and against each other in the world, now and throughout history” (200). The art – …
