The thesis will contain a structural analysis of the script, scene and role analysis, a performance journal to log the …

Tya Methodology Twentieth-Century Philosophy, And Twenty-First Century Practice: An Examination Of Acting, Directing, And Dramatic Literature, Allen Mccoy Jan 2006

Tya Methodology Twentieth-Century Philosophy, And Twenty-First Century Practice: An Examination Of Acting, Directing, And Dramatic Literature, Allen Mccoy

Electronic Theses and Dissertations

Throughout the twentieth century, theatre for young audiences (TYA), or children's theatre, has been situated as something "other" or different than adult theatre, a kind of theatre--but not really theatre, a construct which opened the door to numerous "how to" philosophies geared specifically toward the theatre for young audiences practitioner. As a twenty-first century theatre practitioner, I am interested in how these philosophies are situated within or against current professional practices in the TYA field. This interest led me to the main question of this study: What are the predominant twentieth-century philosophies on acting, directing, and dramatic literature in the …

Mistress Quickly In The Merry Wives Of Windsor: A Performance Monograph, Paula Rossman

Electronic Theses and Dissertations

The subject of my Thesis and accompanying Monograph Document in partial fulfillment of the requirements for the Master of Fine Arts degree / Performance Track is my work in the role of Mistress Quickly from William Shakespeare's The Merry Wives of Windsor. In my research, I will be focusing on a number of issues, many of which will bear direct relevance to and undoubtedly, more fully inform, my interpretation in performance. A key element of the performance-related side of my research will be an exploration of the cultural, historical, political, economic, and religious attributes of Shakespeare's times and how these …

Between Continents, Mona Hassan Jan 2006

Between Continents, Mona Hassan

Electronic Theses and Dissertations

Between Continents is a collection of thirty-two poems. The most challenging aspect of finding the right voice and the appropriate metaphors in "Between Continents" has been the difficulty in assimilating a diversity of traditions within my own work. The polarity of aesthetic values is a well known feature of contemporary American poetry. Charles Webb in his essay on the competing aesthetics in poetry uses the metaphor of apples and orangutans to point out how exaggerated this difference really is. Jorie Graham sees in the way young writers today are simultaneously influenced by elements of poets whose philosophies mutually exclude each …

Analyzing The Effects Of Single-Sourcing Methodologies On The Role Of The Technical Communicator, Jeremy Boehl

Electronic Theses and Dissertations

This thesis discusses the specific effects of single sourcing methodologies on the role of the technical communicator, his or her job responsibilities, qualifications, collaboration with coworkers, employee and employer expectations, and the effects on career progression. The methodologies discussed included all types of single sourcing methods for technical documentation (such as XML-based), advanced and non-advanced Content Management Systems (CMS), and Digital Asset Management (DAM) systems. Other topics explored are an overview of single sourcing for technical documentation, a comparison of the "craftsman model" to the current trend of single sourcing and structured content, specific effects on technical communicators such as …

Henry James, Virginia Woolf, And Frank Lloyd Wright: Interiority, Consciousness, Time, And Space In The Modernist Novel And The Home, Carol Michaelsen Jan 2006

Henry James, Virginia Woolf, And Frank Lloyd Wright: Interiority, Consciousness, Time, And Space In The Modernist Novel And The Home, Carol Michaelsen

Electronic Theses and Dissertations

During the Modernist period, generally defined between the years 1890 and 1945, artists were attempting to break away from previous forms and styles. For example, writers like Henry James and Virginia Woolf sought to change the novel by exploring the consciousness of characters, while playing with the ideas of time and space to create the present moment. The thesis explores the modernist techniques used by James and Woolf, but also connects the work of the writers with the architecture of Frank Lloyd Wright. Using Joseph Frank's theory of spatial form, my work explores the similarities between Wright's designs of private …

Student Achievement As A Function Of Class Size And Pupil-Teacher Ratio, Robert T. Becker Jan 2006

Student Achievement As A Function Of Class Size And Pupil-Teacher Ratio, Robert T. Becker

Master's Theses and Doctoral Dissertations

Background: The degree to which class size is able to produce positive, enduring effects on student achievement has been and continues to be vigorously debated. Comparative studies have clouded the issue with imprecise use of the terms class size (CS) and pupil-teacher ratio (PTR), making it difficult to draw clear conclusions regarding the effects of class size on student achievement.

Purpose: To assess differences, if any, in achievement between students attending classes where the class-size is approximately n = 17 and students attending classes where the class-size is approximately n = 25 and the pupil-teacher ratio is approximately …

OBJECTIVE: To determine whether algorithms developed for the World Wide Web can be applied to the biomedical literature in order to identify articles that are important as well as relevant. DESIGN AND MEASUREMENTS A direct comparison of eight algorithms: simple PubMed queries, clinical queries (sensitive and specific versions), vector cosine comparison, citation count, journal impact factor, PageRank, and machine learning based on polynomial support vector machines. The objective was to prioritize important articles, defined as being included in a pre-existing bibliography of important literature in surgical oncology. RESULTS Citation-based algorithms were more effective than noncitation-based algorithms at identifying important articles. …

Connecting Care And Challenge: Tapping Our Human Potential - Inclusive Education: A Review Of Programming And Services In New Brunswick, A. Wayne Mackay

Reports & Public Policy Documents

Due to the short time frame for this Review, this cannot be considered an exhaustive report. There is however quite a massive volume of information and sources introduced here touching on the particulars required by the Terms of Reference.

In section I we present legal considerations that have an impact on education in various ways, all of which are related to inclusion and the application of equality rights in Canada. Those considerations include accommodation of students with disabilities, the student-teacher relationship, discipline, safe-schools, and a framework for analysis: the new 3 R’s in education: Rights, Responsibilities and Relationships. Included are …

The Age Of Innocence: The First 25 Years Of The National Collegiate Athletic Association, 1906 To 1931, W. Burlette Carter Jan 2006

The Age Of Innocence: The First 25 Years Of The National Collegiate Athletic Association, 1906 To 1931, W. Burlette Carter

Vanderbilt Journal of Entertainment & Technology Law

In 2006, the National Collegiate Athletic Association ("NCAA"), the most powerful body in intercollegiate athletics, celebrates its 100th anniversary. In this article, the author undertakes to survey the NCAA's first twenty five years, offering a revealing snapshot of the beginning of intercollegiate athletics in the United States. As with the author's prior articles on this subject, this article continues the unique approach of using the proceedings of the NCAA and contemporaneous media articles to make its case. In so doing, the article challenges commonly held assumptions about the origins of present intercollegiate athletics policy, providing a much-needed history to frame …

Spam Vs. Ms. Piggy: An Entertainment Law Cautionary Tale, Candi Henry Jan 2006

Spam Vs. Ms. Piggy: An Entertainment Law Cautionary Tale, Candi Henry

Vanderbilt Journal of Entertainment & Technology Law

In terms of blockbusters, 1996 was a good year for film. Action-packed movies like Twister, Independence Day, and Mission Impossible competed for ticket sales with popular comedies Jerry Maguire, The First Wives Club, and The Birdcage. The critical favorite, The English Patient, also made a strong showing. Together, those films grossed almost $1.2 billion in domestic ticket sales alone, yet it was the modestly-performing family flick, Muppet Treasure Island that arguably made the biggest impact in entertainment law that year. That impact was not, however, the result of a landmark ruling. Rather, Hormel Foods Corporation v. Jim Henson Productions serves …

Warring Ideologies For Regulating Military Blogs: A Cyberlaw Approach For Balancing Free Speech And Security In Cyberspace, Julia E. Mitchell Jan 2006

Warring Ideologies For Regulating Military Blogs: A Cyberlaw Approach For Balancing Free Speech And Security In Cyberspace, Julia E. Mitchell

Vanderbilt Journal of Entertainment & Technology Law

Part I of this note provides an overview of the use of media during war. It also reviews case law relating to the military's limited right to freedom of speech under the First Amendment. Part II analyzes the problems of regulating milblogs in terms of societal costs and the technological challenges of regulating behavior on the Internet. This note argues that the military's "unexceptionalist" approach toward regulation, wherein it applies the traditional principles embodied in the UCMJ to milblog regulation, undermines its goal of maintaining operational security and impedes the free flow of ideas. Finally, Part II introduces an "exceptionalist" …

Conducting The Constitution: Justice Scalia, Textualism, And The Eroica Symphony, Ian Gallacher Jan 2006

Conducting The Constitution: Justice Scalia, Textualism, And The Eroica Symphony, Ian Gallacher

Vanderbilt Journal of Entertainment & Technology Law

The goal of this article is a very modest one: to use one piece of music, the first movement of Beethoven's Eroica symphony, to consider how legal scholars, using the doctrinal principles they have developed to interpret the Constitution, would interpret the piece as conductors. This article makes no pretense of offering a new genre of legal hermeneutics; there is no suggestion here that a "law and musicology" movement will provide a comprehensive analytical framework which we can use to solve problems of Constitutional interpretation. Rather, this article suggests that musical interpretative "doctrines"--if so loose a collection of practices merits …

Cracks In The Great Wall: Why China's Copyright Law Has Failed To Prevent Piracy Of American Movies Within Its Borders, Jordana Cornish Jan 2006

Cracks In The Great Wall: Why China's Copyright Law Has Failed To Prevent Piracy Of American Movies Within Its Borders, Jordana Cornish

Vanderbilt Journal of Entertainment & Technology Law

This note examines the current state of China's intellectual property rights protection as it relates to movie piracy. Part I examines the different types of film piracy occurring in China and the current severity of the problem for the United States motion picture industry. Part II traces the history of copyright law in China and examines China's commitments under the international copyright treaties it has signed with the United States and other nations through its recent accession to the WTO. Part III discusses why movie piracy in China is still on the rise despite these commitments and highlights why cultural, …

Allusion As Form: The Waste Land And Moulin Rouge!, Stacy Magedanz Jan 2006

Allusion As Form: The Waste Land And Moulin Rouge!, Stacy Magedanz

Library Faculty Publications & Presentations

Allusion is usually considered a literary technique, but relatively little attention has been paid to the notion of allusion as a literary form. In this essay, I attempt to describe the allusive form based on two prominent examples, T. S. Eliot’s Waste Land and Baz Luhrmann’s Moulin Rouge! Though radically different, the two works embody distinguishing characteristics of the allusive form. These are intertextuality, or a dependence upon outside sources for sense and significance; heightened and self-conscious artificiality; a confrontational attitude toward the audience; elitism, based on the exclusivity of allusions; appropriation of multiple cultures; and pervasive anachronism. Though prone …

Labor Struggles, New Social Movements, And America's Favorite Pastime: New York Workers Take On New Era Cap Company, Victoria Carty Jan 2006

Labor Struggles, New Social Movements, And America's Favorite Pastime: New York Workers Take On New Era Cap Company, Victoria Carty

Sociology Faculty Articles and Research

Contemporary economic globalization, which is driven and regulated primarily by multinational corporations, has a direct impact on workers' lives. Trade agreements such as the North American Free Trade Agreement (NAFTA) tend to be controlled by corporate interests in the wealthy, industrialized nations. Those countries set the agenda to protect the interests of foreign investors and facilitate the mobility of capital, but they do little to protect the interests of labor. In response, workers in both the global North and South have been forced to rely on their own individual efforts to protect themselves against unfair labor practices. This article presents …

The Perils Of Risk Avoidance, Catherine O'Neill Jan 2006

The Perils Of Risk Avoidance, Catherine O'Neill

Faculty Articles

This article illustrates that in managing the risks and responding to the harms of environmental contamination, there has been a recent embrace of strategies involving risk avoidance in lieu of risk reduction. Risk reduction strategies aim to clean up, limit, or prevent environmental contamination in the first place. Risk avoidance strategies, by contrast, leave contamination unabated. Risk avoidance strategies address the harms of contamination by requiring those whose circumstances or lifeways leave them exposed to alter their ways, thereby "avoiding" the risk. A recent turn to risk avoidance is problematic on several scores and particularly troubling from the perspective of …

The Adventures Of Blackness In Western Culture: An Epistolary Exchange On Old And New Identity Wars, Robert S. Chang, Adrienne D. Davis Jan 2006

The Adventures Of Blackness In Western Culture: An Epistolary Exchange On Old And New Identity Wars, Robert S. Chang, Adrienne D. Davis

Faculty Articles

Through a series of letters, Professors Robert Chang and Adrienne Davis examine the politics of positionality in law and literary criticism. They use the scholarly debates and conversations around critical race theory and feminist legal theory as a starting point to formulate some thoughts about Critical Race Feminism ("CRF") and its future. The authors use the epistolary form as a literary device to allow them to collaborate on this project while maintaining their own voices. Thus, the letters are not dated. The letters pay particular attention to various border crossings: male attempts to engage in feminist literary criticism, white attempts …

The Principled Executioner: Capital Juries’ Bias And The Benefits Of True Bifurcation, Susan D. Rozelle Jan 2006

The Principled Executioner: Capital Juries’ Bias And The Benefits Of True Bifurcation, Susan D. Rozelle

Faculty Articles

Capital jurors are "death-qualified," or asked to verify at voir dire that their views on the death penalty would not prevent them from serving impartially. Ironically, death qualification itself creates juries unfairly biased toward guilt and death. Empirical investigation has demonstrated this skewing effect for over fifty years, and with the release of the recent Capital Jury Project data, any doubts on this score surely have been laid to rest. Efforts to ameliorate death qualification's prosecutorial bias have been hamstrung, however, by statutory unitary jury requirements like the one found in the Federal Death Penalty Act. Statutes like these, which …

Policy, Logic, And Persuasion In The Evolving Realm Of Trust Asset Protection, John K. Eason Jan 2006

Policy, Logic, And Persuasion In The Evolving Realm Of Trust Asset Protection, John K. Eason

Faculty Articles

The concept of using legal structures to protect property from those who might otherwise have some claim to it is an idea with deep roots. The trust device is one such legal structure, and its evolution as an asset protection device has not been without controversy. The recent and noticeable break with the traditional denial of self-settled trust protections is one such area of modern controversy, but not the only notable recent development. The self-setted asset protection trust movement is accompanied by the recent completion of two major law reform projects. The drafting and recommendation for state adoption of a …

Intellectual Property And The Development Divide, Margaret Chon Jan 2006

Intellectual Property And The Development Divide, Margaret Chon

Faculty Articles

This article attempts to map the challenges raised by recent encounters between intellectual property and development. It proposes a normative principle of global intellectual property - one that is responsive to development paradigms that have moved far beyond simple utilitarian measures of social welfare. Recent insights from the field of development economics suggest strongly that intellectual property should include a substantive equality principle, measuring its welfare-generating outcomes not only by economic growth but also by distributional effects. A new principle of substantive equality is a necessary corollary to the formal equality principles of national treatment and minimum standards that are …

Postcoloniality And Mythologies Of Civil(Ized) Society, Tayyab Mahmud Jan 2006

Postcoloniality And Mythologies Of Civil(Ized) Society, Tayyab Mahmud

Faculty Articles

This article argues that the discourse of viability of civil society in postcolonial polities is theoretically ungrounded, and helps to further marginalize subordinated sections of these societies. These failings result from the imprisonment of dominant social theories in Eurocentric unilinear evolutionism, an imprisonment that blinds one from the particularities of supposedly universal categories that issue from Europe's experience of modernity. Furthermore, enthusiasm for civil society ignores the truncated colonial career of modernity and the nature of the postcolonial state. In order to substantiate these propositions, the paper traces the genealogy of the concept of civil society, examines the colonial career …

Somerset’S Case And Its Antecedents In Imperial Perspective, George Van Cleve Jan 2006

Somerset’S Case And Its Antecedents In Imperial Perspective, George Van Cleve

Faculty Articles

The article offers a look on the Somerset's Case that served as a milestone in the campaign to abolish slavery in Great Britain. The case become famous in the Anglo-American law of slavery, with its proceedings widely circulated in periodicals. However, historians have argued about what the ruling was and its effects. It has been known in English slavery law that courts prior to the case generally agreed that English law governed status, but also limited slavery, for slaves who came to England.

Markets, Monocultures, And Malnutrition: Agricultural Trade Policy Through An Environmental Justice Lens, Carmen Gonzalez Jan 2006

Markets, Monocultures, And Malnutrition: Agricultural Trade Policy Through An Environmental Justice Lens, Carmen Gonzalez

Faculty Articles

Much of the literature on environmental justice struggles in the United States and in the Global South has highlighted the disproportionate concentration of environmental hazards in poor communities and communities of color. However, it is equally important to evaluate how human societies distribute access to environmental necessities, such as food and water. Food is a quintessential environmental necessity that is critical human survival, and the right to food is recognized under a variety of international human rights law instruments. This article examines the complex ways in which the rules governing international trade in agricultural products affect the fundamental human right …
