Function Over Form: Reviving The Criminal Jury's Historical Role As A Sentencing Body, Chris Kemmitt Oct 2006

Function Over Form: Reviving The Criminal Jury's Historical Role As A Sentencing Body, Chris Kemmitt

University of Michigan Journal of Law Reform

This Article argues that the Supreme Court, as evinced by its recent spate of criminal jury decisions, has abandoned the criminal jury known to the Founders and, in so doing, has severely eroded the protections intended to inhere in the Sixth Amendment jury trial right. It then proposes one potential solution to this problem.

According to the Supreme Court, this recent line of cases has been motivated by the need to preserve the "ancient guarantee" articulated in the Sixth Amendment under a new set of legal circumstances. Unfortunately, the Court misinterprets the ancient guarantee that it is ostensibly attempting to …

A Tale Of Conflicting Sovereignties: The Case Against Tribal Sovereign Immunity And Federal Preemption Doctrines Preventing States' Enforcement Of Campaign Contribution Regulations On Indian Tribes, Paul Porter Oct 2006

A Tale Of Conflicting Sovereignties: The Case Against Tribal Sovereign Immunity And Federal Preemption Doctrines Preventing States' Enforcement Of Campaign Contribution Regulations On Indian Tribes, Paul Porter

University of Michigan Journal of Law Reform

This Note will discuss whether Indian tribes can assert tribal sovereign immunity to avoid compliance with state campaign finance regulation and whether such regulations should be preempted by federal law. Tribal sovereign immunity is not an enshrined constitutional imperative; it exists only under federal common law and can be limited by the courts from blocking state suits to enforce campaign finance regulations against tribes. This Note will also argue that state campaign finance regulations should not be preempted by federal law because states have a compelling interest in protecting their political processes from corruption that outweighs tribal interests in flouting …

The Hermeneutic Foundations Of Qualitative Research, Bernd Reiter Oct 2006

The Hermeneutic Foundations Of Qualitative Research, Bernd Reiter

Government and International Affairs Faculty Publications

This article is the result of reflection that emerged while conducting qualitative field research on nationalism and exclusion in Portugal. The problem I confronted was when to stop interviewing. Stated more precisely, I was seeking an answer to the question of when one has collected enough empirical data to support or reject one’s hypotheses. This initial problem led me to a rather old discussion on the difference between natural and human sciences that has characterized German academic life for many years–in fact, since the early 19th century–producing some more heated phases of academic dispute, known as the Positivismusstreit in the …

Study Of The Cultural Sexuality: A Matter Of Honor And Shame, Alyssa Mceachran Oct 2006

Study Of The Cultural Sexuality: A Matter Of Honor And Shame, Alyssa Mceachran

Independent Study Project (ISP) Collection

This research seeks to understand the nature of a collective society. It seeks to attain knowledge about the role of sexuality and women in the context of a collective society. I intend to ascertain information through interviews and qualitative research with Turkish Cypriots. My questions will relate to a specific topic and how honor and shame are present. In the end of the research I hope to find connections between the concepts of honor and shame and the idea of sexuality in a collective society. I also want to note if morals and ideologies of the aforementioned concepts shift with …

Liberty Of Ecological Conscience, Aaron Lercher Oct 2006

Liberty Of Ecological Conscience, Aaron Lercher

Faculty Publications

Our concern for nonhuman nature can be justified in terms of a human right to liberty of ecological conscience. This right is analogous to the right to religious liberty, and is equally worthy of recognition as that fundamental liberty. The liberty of ecological conscience, like religious liberty, is a negative right against interference. Each ecological conscience supports a claim to protection of the parts of nonhuman nature that are current or potential sites of its active pursuit of natural value. If we acknowledge the fallibility of each conscience in its pursuit of genuine natural value, a policy of indefinitely extensive …

Protecting The Future Forever: Why Perpetual Conservation Easements Outperform Term Easements, Paul Mitchell Oct 2006

Protecting The Future Forever: Why Perpetual Conservation Easements Outperform Term Easements, Paul Mitchell

Land Use Clinic

Conservation easements are amassing increasing popularity as a private means for accomplishing a public good. In 1980, conservation easements protected 128,001 acres. By 2003, that number had jumped to over 5 million acres. In Georgia, over 131,000 acres had been protected by conservation easements by the end of 2005, more than double the acreage of just a few years before.

A conservation easement is a legal arrangement whereby a landowner chooses to transfer certain development rights to an eligible easement holder, usually a non-profit or government agency, in order to achieve a qualified purpose. The landowner can sell or donate …

Examining The Justification For Residential Recycling, Thomas C. Kinnaman Oct 2006

Examining The Justification For Residential Recycling, Thomas C. Kinnaman

Faculty Journal Articles

Municipalities in the United States have for the past two decades initiated two policies to reduce residential solid waste generation by increasing recycling. The first policy, implemented in over 4,000 municipalities in the United States, requires households to pay a fee for each unit of garbage presented at the curb for collection. The second policy, initiated in 8,875 municipalities, subsidizes household recycling efforts by providing free curbside collection of certain recyclable materials. Both initiatives serve as examples of incentive-based environmental policies favored by many economists. But before economists can celebrate this wide-spread adoption of incentive-based environmental policies, further examination reveals …

Reckoning With Rapanos: Revisiting "Waters Of The United States" And The Limits Of Federal Wetland Regulation, Jonathan H. Adler Oct 2006

Reckoning With Rapanos: Revisiting "Waters Of The United States" And The Limits Of Federal Wetland Regulation, Jonathan H. Adler

Faculty Publications

Rapanos v. United States is the latest episode in the serial effort to identify the precise meaning of "waters of the United States." Federal courts have struggled to define the scope of federal regulatory jurisdiction under the Clean Water Act ("CWA") since the law was adopted.

Although no single opinion in Rapanos commanded a majority of the Court, the Court delivered a discernible holding. Specifically, the Court held that CWA jurisdiction over private lands is limited...and reaffirmed that federal regulatory authority only extends to those wetlands that have a "significant nexus" to navigable waters of the United States. Nonetheless, the …

York County Court Of Common Pleas, Jury Utilization And Representation Assessment, Paula Hannaford-Agor Oct 2006

York County Court Of Common Pleas, Jury Utilization And Representation Assessment, Paula Hannaford-Agor

Faculty Publications

In May 2006, the York County Office of Court Administration requested that the National Center for State Courts (NCSC) assess its jury management and utilization practices and make recommendations for improvement. The impetus for this request came from concerns both within the Office of Court Administration and from the Administrative Office of the Pennsylvania Courts that existing jury management practices make inefficient use of jurors, imposing excessive and unnecessary costs on the court and on the citizens who report for jury service. The York County Office of Court Administration also expressed concern that its jury pool may not adequately reflect …

Emended Classification Of Xanthomonad Pathogens On Citrus, Norman W. Schaad, Elena Postnikova, George Lacy, Aaron Sechler, Irina V. Agarkova, Paul E. Stromberg, Verlyn K. Stromberg, Anne K. Vidaver Oct 2006

Emended Classification Of Xanthomonad Pathogens On Citrus, Norman W. Schaad, Elena Postnikova, George Lacy, Aaron Sechler, Irina V. Agarkova, Paul E. Stromberg, Verlyn K. Stromberg, Anne K. Vidaver

Department of Plant Pathology: Faculty Publications

In the paper by Schaad et al. [24] on reclassification of several xanthomonads, nomenclatural errors were made. The name Xanthomonas smithii subsp. citri proposed for the former taxon X. campestris pv. citri ( = X. axonopodis pv. citri) is illegitimate. Following the reinstatement of X. citri (ex Hasse 1915) Gabriel et al. [9] as a validly published name, Young et al. [34] wrote that the reinstatement of this epithet was based on a description that was inadequate in terms of modern practice for the purpose of formal classification. This report was subsequently summarized by the International Committee on …
