Password Theft: Rethinking An Old Crime In A New Era, Daniel S. Shamah Oct 2006

Password Theft: Rethinking An Old Crime In A New Era, Daniel S. Shamah

Michigan Telecommunications & Technology Law Review

By putting themselves out in front as the victims, the Recording Industry Association of America (RIAA) helped reshape the governing norms of the times, and as a result, people viewed the act of file-sharing differently. By forcing people to see music downloading as a form of theft, the RIAA was quite successful in deterring it. In the process, they also proposed a radical view of theft that changes our basic economic understandings of the action[...] This paper argues that the RIAA's model for deterring music theft could be successfully used to deter many other forms of computer theft, and, specifically, …

File Sharing, Copyright, And The Optimal Production Of Music, Gerald R. Faulhaber Oct 2006

File Sharing, Copyright, And The Optimal Production Of Music, Gerald R. Faulhaber

Michigan Telecommunications & Technology Law Review

Much economic, political, judicial and legal attention has been showered on the significant changes currently taking place within the music production and distribution business forced by the use of the Internet for both file sharing (of unauthorized copyrighted material) and more recent online (legal) music distribution. The strong demand for music, coupled with the low cost of distributing illegal copies via peer-to-peer (P2P) systems, is unraveling the business model by which music has traditionally been created, developed, and distributed. Application of traditional copyright law has been ineffective in stopping the loss of business in the traditional channels. Producers have implemented …

Trends In Protection For Informational Works Under Copyright Law During The 19th And 20th Centuries, Miriam Bitton

Michigan Telecommunications & Technology Law Review

The debate over databases protection has failed to identify and discuss some of its most basic and preliminary assumptions, accepting instead many of the historical aspects involved as given. This Article therefore seeks to challenge these underlying assumptions by providing a fresh look at the historical dimension of the debate. One common argument regarding database protection is that the U.S. Supreme Court decision in Feist v. Rural Publications Inc. brought about a dramatic change in the legal landscape, displacing the then-accepted "sweat of the brow" rationale for protecting rights in databases. This Article's historical analysis therefore thoroughly examines the treatment …

Three Letters Of María Antonia Bolívar And Simón Bolívar, Evelyn M. Cherpak Oct 2006

Three Letters Of María Antonia Bolívar And Simón Bolívar, Evelyn M. Cherpak

Documentary Editing: Journal of the Association for Documentary Editing (1979–2011)

Maria Antonia's letters to her brother are full of political news and advice, family news, information on the status of their lawsuits, and the condition of his rural and urban properties, including the Aroa mines. One of the topics that consistently appears in their correspondence was the rental, sale, and the lawsuit over the copper mines at Aroa. The mines were part of the Bolivar family patrimony and came to the Liberator upon the death of his brother Juan Vicente in 1810. They had been abandoned in 1804 and taken over by two women, Maria de la Cruz Urquia and …

Indexing: Philosophy Of, André De Tienne

Documentary Editing: Journal of the Association for Documentary Editing (1979–2011)

Critical editions of great thinkers and writers need excellent, comprehensive indexes. The denser the text, the deeper the index. Having indexed several volumes of the writings of the polymathic, dense-and-deep philosopher Charles S. Peirce, I have had occasion to reflect numerous times both upon the art of indexing and upon its logic. This essay will discuss less the art of it (or its mechanics) than its logic-and, by the same token, its ethics. I have good reasons to do so: first, Peirce is the American founder of the logic of signs (also known as semiotics), and one of the major …

Female Superintendents: Historic Barriers And Prospects For The Future, Stephen K. Miller, Youlanda C. Washington, Jeanna R. Fiene

Journal of Women in Educational Leadership

This paper addresses the historic under representation of female superintendents. The primary focus is the legacy of discrimination, in which the barriers to female advancement in a traditionally male field are described. Particular attention is given to three different models of male dominance that have been developed to explain how and/or why women have been excluded from top positions in educational administration. In part two, recognition of the importance of women's contributions to evolving theory in educational administration and a description of the feminine leadership model is offered, wherein women utilize flexible web-like structures, empower others, and prioritize children and …

Recruiting And Retaining Women Faculty In Science And Engineering, Dorothy Brockopp, Mindy Isaacs, Pam Bischoff, Kimberly Millerd

Journal of Women in Educational Leadership

The purpose of this project was to assess the perceived efficacy of university-based activities designed to improve the recruitment and retention of women in academic science and engineering (S&E). Numerous approaches to recruitment and retention have been described and implemented but little change occurs. An evaluation of suggested activities by 35 S&E women faculty was conducted using quantitative and qualitative methods. Eight of 25 activities were strongly recommended by participants as effective strategies related to recruitment and retention. Mentoring, as frequently operationalized, was not found to be effective. Several recommendations are offered to improve the system of mentoring.

Voices Of Women In The Field--I'M Glad No One Told Me . ..., Misty Schwartz

Journal of Women in Educational Leadership

Prior to beginning my current position, I'm glad no one told me that many women find the academy unappealing, with a chilly environment that can be biased and hostile toward women. I'm glad no one told me that I may suffer from intellectual and social isolation that is brought about by the masculine principles of competition and individualism that often occur in institutions of higher education. I'm glad no one told me that I will have little guidance from my peers due to a lack of mentors and that I may be expected to compromise my personal values and beliefs …

Journal of Women in Educational Leadership

Leaders Who Dare provides anecdotal and analytical accounts of leadership by outstanding women educators in Illinois. Initially "an ambitious passionate project ... to tell the stories of Illinois' outstanding women educators, many who have been honored at Dare to Be Great conferences" (p. xi), the book documents the work of women honored annually by the Illinois Women Administrators (IWA) organization for daring" ... to lead themselves and others to new possibilities" (p. xv). The book's purpose is to describe the "how and why of the leadership practices of outstanding Illinois leaders .... " (p. 3). These stories of leaders within …

Book Review Of "Will The Circle Be Unbroken?": Aboriginal Communities, Restorative Justice, And The Challenges Of Conflict And Change By Jane Dickson-Gilmore And Carol La Prairie, Tim Quigley

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Over the past decade or two, restorative justice has become a popular approach for the criminal justice system to take in Canada, New Zealand, and Australia. In part, this is due in all three countries to an appalling disproportionality in the incarceration rates for racialized minorities. As the authors of "Will the Circle Be Unbroken?" point out, however, governments have been attracted to restorative justice for cost-cutting reasons as well. A burning question, therefore, is whether restorative justice works.

Court Review: Volume 43, Issue 3 – Recent Civil Decisions Of The United States Supreme Court: The 2006-2007 Term, Charles Whitebread

Court Review: Journal of the American Judges Association

The past Term of the Court was one in which it swung to the right. A single justice, Justice Anthony Kennedy, made all the difference—being in the majority in every five-to-four decision that split along ideological lines. Significant 5-4 civil decisions included ones upholding the Partial-Birth Abortion Ban Act of 2003, limiting Title VII pay discrimination suits by strictly interpreting the date the statute of limitations begins to run, limiting the ability of school districts to consider race in assigning students to schools, and further limiting punitive-damage claims.

Evaluation Of Probabilistic Methodology For Predicting Satellite Tracking Resources, Matthew Lynn Stubbe Oct 2006

Evaluation Of Probabilistic Methodology For Predicting Satellite Tracking Resources, Matthew Lynn Stubbe

Master's Theses - Daytona Beach

This research evaluates a probabilistic methodology for estimating the ability of satellite tracking networks to provide tracking and data acquisition services to large constellations of satellites. This approach, developed by Hagar is evaluated using Monte Carlo simulations of optimal satellite contact scheduling on a tracking network for a certain class of satellites. The actual results of the scheduled Monte Carlo simulations were then compared to the predicted values computed with Hagar's methodology for a range constellation and network sizes. Comparison methods include percent difference, a Wilcoxon signed ranks test and a Mann-Whitney U test.

The Monte Carlo simulations were run …

Mig-5/Dsh Controls Cell Fate Determination And Cell Migration In C. Elegans, Timothy Walston, Chaobo Guo, Rui Proenca, Mingfu Wu, Michael Herman, Jeff Hardin, Edward Hedgecock Oct 2006

Mig-5/Dsh Controls Cell Fate Determination And Cell Migration In C. Elegans, Timothy Walston, Chaobo Guo, Rui Proenca, Mingfu Wu, Michael Herman, Jeff Hardin, Edward Hedgecock

School of Biological Sciences: Faculty Publications

Cell fate determination and cell migration are two essential events in the development of an organism. We identify mig-5, a Dishevelled family member, as a gene that regulates several cell fate decisions and cell migrations that are important during C. elegans embryonic and larval development. In offspring from mig-5 mutants, cell migrations are defective during hypodermal morphogenesis, QL neuroblast migration, and the gonad arm migration led by the distal tip cells (DTCs). In addition to abnormal migration, DTC fate is affected, resulting in either an absent or an extra DTC. The cell fates of the anchor cell in hermaphrodites …

Fluorescent Enzymatic Smart Tattoos Comprising Hybrid Silicate Microparticles, Metalloporphyrin Complexes, And Mass Transport-Limiting Nanofilms, Erich Wayne Stein Oct 2006

Fluorescent Enzymatic Smart Tattoos Comprising Hybrid Silicate Microparticles, Metalloporphyrin Complexes, And Mass Transport-Limiting Nanofilms, Erich Wayne Stein

Doctoral Dissertations

Diabetics are often required to self-monitor blood glucose levels to effectively deliver prescribed therapies. However, the pain and bother associated with traditional finger-prick measurements often result in decreased patient compliance and therefore poor disease management, which could result in the early-onset of complications. Enzymatic "smart tattoos"—implantable luminescent particles that may be transdermally interrogated with light—are being pursued as minimally-invasive diabetic monitoring devices, with hopes of increasing diabetic compliance by reducing excessive pain and bother associated with finger-prick measurements. These devices typically comprise an oxygen-quenched luminescent dye and glucose oxidase (GOx), an enzyme that catalyzes the oxidation of β-D-glucose. Under glucose-limited …
