In Search Of Nella Larsen: A Biography Of The Color Line By George Hutchinson (Book Review), Daryl Cumber Dance Jan 2006

In Search Of Nella Larsen: A Biography Of The Color Line By George Hutchinson (Book Review), Daryl Cumber Dance

English Faculty Publications

With In Search of Nella Larsen, George Hutchinson makes the third major attempt to provide a biography of the elusive Harlem Renaissance author Nella Larsen (1891-1964), the mulatto daughter of immigrants from Denmark and the Danish West Indies whose life and fiction were shaped largely by her mixed emotions about her racial heritage and her feelings of abandonment by her white mother, stepfather, and sister. In his introduction, Hutchinson makes much of the errors of prior Larsen biographers Charles R. Larson (Invisible Darkness: Jean Toomer and Nella Larsen [1993]) and Thadious M. Davis (Nella Larsen, Novelist of …

Effectiveness Of Fiscal Policy In The U.K. During The 1960-1990 Time Period, Peter J. Saunders Jan 2006

Effectiveness Of Fiscal Policy In The U.K. During The 1960-1990 Time Period, Peter J. Saunders

All Faculty Scholarship for the College of Business

This study investigates the impact of fiscal policy on the U.K. economy during the 1960 - 1990 time period. The empirical analysis is conducted within the Granger causality testing methodology. Initially the causal flows between fiscal expenditures, deficits and nominal GDP are examined. A hi-directional causal flow between expenditures and nominal GDP is established while deficits and nominal GDP are found to be statistically independent. However, the main contribution of this research lies in its emphasis on analyzing the impact of fiscal expenditures on real output and prices. The results of the trivariate analysis indicate the absence of causal flows …

"Play In The Joints Between The Religion Clauses" And Other Supreme Court Catachreses, Carl H. Esbeck Jan 2006

"Play In The Joints Between The Religion Clauses" And Other Supreme Court Catachreses, Carl H. Esbeck

Hofstra Law Review

Consistent with its fumbling of late when dealing with cases involving religion, the U.S. Supreme Court has taken to reciting the metaphor of play in the joints between the Religion Clauses. This manner of framing the issue before the Court presumes that the Free Exercise and Establishment Clauses run in opposing directions, and indeed will often conflict. It then becomes the Court's task, as it sees it, to determine if the law in question falls safely in the narrows where there is space for legislative action neither compelled by the Free Exercise Clause nor prohibited by the Establishment Clause. The …

Contract Formalism, Scientism, And The M-Word: A Comment On Professor Movsesian's Under-Theorization Thesis, Jeffrey M. Lipshaw Jan 2006

Contract Formalism, Scientism, And The M-Word: A Comment On Professor Movsesian's Under-Theorization Thesis, Jeffrey M. Lipshaw

Hofstra Law Review

In two recent essays, Professor Mark L. Movsesian has suggested that a significant difference between the classical formalism of Williston and the formalism of contemporary contracts scholars is the extent to which the earlier work was under-theorized. I want to suggest an area in which there is a consistency to the under-theorization between the classical and the modern contract formalists: the extent to which theorization in anything that approaches metaphysics is, and has been, consistently anathema. Modern theorizing is overwhelmingly of a particular form: dispassionate social science inquiry into how we tick, rarely questioned but implicit norms shaped solely around …

A Cross-Language Approach To Rapid Creation Of New Morpho-Syntactically Annotated Resources, Anna Feldman, Jirka Hana, Chris Brew Jan 2006

A Cross-Language Approach To Rapid Creation Of New Morpho-Syntactically Annotated Resources, Anna Feldman, Jirka Hana, Chris Brew

Department of Linguistics Faculty Scholarship and Creative Works

We take a novel approach to rapid, low-cost development of morpho-syntactically annotated resources without using parallel corpora or bilingual lexicons. The overall research question is how to exploit language resources and properties to facilitate and automate the creation of morphologically annotated corpora for new languages. This portability issue is especially relevant to minority languages, for which such resources are likely to remain unavailable in the foreseeable future. We compare the performance of our system on languages that belong to different language families (Romance vs. Slavic), as well as different language pairs within the same language family (Portuguese via Spanish vs. …

The Nature And Impact Of The "Tort Reform" Movement, F. Patrick Hubbard Jan 2006

The Nature And Impact Of The "Tort Reform" Movement, F. Patrick Hubbard

Hofstra Law Review

For over thirty years, repeat players on the defense side of tort litigation have undertaken to "reform" tort doctrine in their favor. Initially, these efforts consisted of ad hoc efforts to address a series of "crises," primarily in terms of the cost and availability of liability insurance. In the 1980s, the tort reform movement began to develop a more permanent institutionalized approach to the push for "reform." Not surprisingly, there has been considerable debate about the goals of this movement, the fairness or efficiency of the specific doctrinal reforms it seeks, and the methods it uses. This Article places this …

The Case For Selective Abolition Of The Rules Of Evidence, David Crump Jan 2006

The Case For Selective Abolition Of The Rules Of Evidence, David Crump

Hofstra Law Review

This article advocates selectively abolishing the exclusionary components in the Federal Rules of Evidence. Arguing that some parts of the existing rules cost more than the value of any benefits they provide, it is the author's position that the current system is sufficiently dysfunctional so as to make significant revisions in the Rules of Evidence worthwhile. The article examines the hearsay rule, the rules governing repetitive-behavior evidence, and issues regarding opinion evidence, experts, and authentication. The article proceeds to consider the rest of the FRE 400 series - particularly Rules 401 through 403 - and proposes modifications. Next, the article …

The Zeal Shortage, Anita Bernstein Jan 2006

The Zeal Shortage, Anita Bernstein

Hofstra Law Review

Although the duty of zealous advocacy enjoys nominal approval in most state bar rules and the secondary literature, today the majority of writings about zeal in the practice of law present zeal in a negative light. Critics use this word to object to lawyers' dishonesty, hyperpartisanship, aggressive or confrontational work styles, rudeness, and disregard for the interests of adversaries, the courts, and the public. This article, part of a Hofstra University symposium, builds on the literature that praises zealous advocacy (much of it written by symposium honoree Monroe Freedman) to identify a shortage of zeal in American legal practice and …

Reconsidering The Corporate Attorney-Client Privilege: A Response To The Compelled-Voluntary Waiver Paradox, Lonnie T. Brown Jr. Jan 2006

Reconsidering The Corporate Attorney-Client Privilege: A Response To The Compelled-Voluntary Waiver Paradox, Lonnie T. Brown Jr.

Hofstra Law Review

Many within the legal profession are presently of the opinion that the protection traditionally accorded by the corporate attorney-client privilege is being seriously eroded, if not completely destroyed. This sentiment has largely been inspired by the perceived effect of government use of what I refer to as "compelled-voluntary" waiver in the context of investigations into corporate wrongdoing. Various governmental bodies employ this waiver device, but the United States Department of Justice ("DOJ") is perhaps the best known and certainly the most vilified.

The DOJ guidelines for prosecuting corporations, embodied first in the so-called "Holder Memorandum" and now in the "Thompson …

Children’S Social Behaviors And Peer Interactions In Diverse Cultures, Carolyn P. Edwards, Maria Deguzman, Jill Brown, Asiye Kumru Jan 2006

Children’S Social Behaviors And Peer Interactions In Diverse Cultures, Carolyn P. Edwards, Maria Deguzman, Jill Brown, Asiye Kumru

Department of Psychology: Faculty Publications

This chapter lays out five principles to guide research on peer relationships in cultural context that reflect both current and earlier bodies of research literature: (1) Cultural scripts for socialization in peer relationships are evident in early childhood. (2) Both across and within cultural communities, children’s own active role in the socialization process becomes increasingly evident as they grow older. (3) Because children are active agents in their own socialization, they can not only make choices, they can also negotiate, deflect, and resist socializing attempts by others. (4) Children’s choices and preferences (self-socialization) during middle childhood have measurable and lasting …

Improving Disaster Response Efforts With Decision Support Systems, Steven M. Thompson, Nezih Altay, Walter G. Green Iii, Joanne Lapetina Jan 2006

Improving Disaster Response Efforts With Decision Support Systems, Steven M. Thompson, Nezih Altay, Walter G. Green Iii, Joanne Lapetina

Management Faculty Publications

As evidenced by Hurricane Katrina in August, 2005, disaster response efforts are hindered by a lack of coordination, poor information flows, and the inability of disaster response managers to validate and process relevant information and make decisions in a timely fashion. A number of factors contribute to current lackluster response efforts. Some are inherent to the complex, rapidly changing decision-making environments that characterize most disaster response settings. Others reflect systematic flaws in how decisions are made within the organizational hierarchies of the many agencies involved in a disaster response. Slow, ineffective strategies for gathering, processing, and analyzing data can also …

Sampling And Testing For Plant Pathogens, Aileen Reid Jan 2006

Sampling And Testing For Plant Pathogens, Aileen Reid

Bulletins 4000 -

There are many methods used in the laboratory to determine whether Phytophthora or other fungi are present in growing media, water supply and diseased plants. These include:

• filtering water for spores

• baiting for fungi in growing media and water samples

• examining diseased plant tissue microscopically

• direct culturing from roots and other plant parts to isolate the fungal pathogen in pure culture.

This bulletin outlines some of the procedures involved. Growers may be able to do some basic baiting of soil or water samples themselves to alert them of a problem but the procedures involved in isolating …

Standing Of Private Plaintiffs To Annul Generally Applicable European Community Measures: If The System Is Broken, Where Should It Be Fixed?, Xavier Lewis Jan 2006

Standing Of Private Plaintiffs To Annul Generally Applicable European Community Measures: If The System Is Broken, Where Should It Be Fixed?, Xavier Lewis

Fordham International Law Journal

This Article will examine the problem of the standing of private litigants by putting the action for annulment in its context. It will describe briefly how the Treaty of Rome set up a complex system in which the acts of the EC Institutions could be reviewed, a task that is shared between the European Courts and the courts of the Member States. It will also describe briefly the different correctives introduced by the Court of Justice and the Court of First Instance to the system as initially envisaged. It will be seen that a good deal of flexibility has been …

Gendering The City, Gendering The Nation: Contesting Urban Space In Fes, Morocco, Rachel Newcomb Jan 2006

Gendering The City, Gendering The Nation: Contesting Urban Space In Fes, Morocco, Rachel Newcomb

Faculty Publications

An actor-centered approach to the gendering of urban spaces demonstrates how individuals respond to competing ideologies in determining the rules that surround women’s presence in urban, Muslim spaces. This article examines how women in the Ville Nouvelle of Fes, Morocco draw on local conceptualizations of hospitality, kinship, and shame as they debate the gendering of four urban areas: the street, the café, a cosmopolitan exercise club, and cyber space. Women’s tactics for occupying social space indicate the resilience of local culture in the face of ideologies that attempt to posit a specific vision of women in the Moroccan nation state.

The Effects Of Heart Rate Variability, Measures Of Impulsivity, And Activity Level In College Students, Laura Katie Laird

Honors Theses

The objectives of this study were to assess the relationships of breathingassociated heart rate variability and measures of impulsivity using EKG-derived heart rate, the BaiTatt Impulsivity Scale (BIS-11), and the Conners’ Continuous Performance Test (CPT-II). To measure activity level as a proxy for fitness. activity monitors were worn by most participants and all participants completed the International Physical Activity Questiomiaire (IPAQ). Fifty-two college students (23 male and 29 female, ages 18-22) participated in the study. Auscultatory blood pressure, EKG-derived heart rate, and mean successive difference of interbeat intervals were collected during 2 ten-minute rest periods and during the CPT-II. Participants …

Media & Literature: American Cinema And C.S. Lewis's The Lion, The Witch, And The Wardrobe, Laura B. Rigby

Honors Theses

This thesis analyzes the characters and Christian spiritual themes in C. S. Lewis’s work The Lion, the Witch, and the Wardrobe and examines the disparity between Lewis’s original work and the 2005 Walt Disney Productions film adaptation of the text. Through the examination of the differences between the two works, this study assesses the degree of theme shift and provides possible explanations for the changes.

Advice’S Effect: The Role Of Western Advisors On Russian Privatization Policy, Nicholas James Greene Jan 2006

Advice’S Effect: The Role Of Western Advisors On Russian Privatization Policy, Nicholas James Greene

Honors Theses

This paper seeks to investigate the role that western advisors played in Russia’s transition to a market economy during the 1990s. In order to answer this question a wide variety of sources were consulted. Scholarly papers, books on the subject, and works by the participants themselves all played. Through my investigation it became clear that advisors played little, if any, role in influencing policy. A host of domestic ideas and political factors were far more important in determining what strategy was pursued.

What's Behind Genocide?: The Social Construction Of Ethnicity And Mass Killing, Brianna Marie Phillips Jan 2006

What's Behind Genocide?: The Social Construction Of Ethnicity And Mass Killing, Brianna Marie Phillips

Honors Theses

This thesis offers insight into the causes of genocide through a comparative analysis of four incidents, two that are seen as ideologically-based and two that are seen as the result of ethnic conflict: the mass killing that occurred during Joseph Stalin’s reign in the Soviet Union, specifically the period from the early 1930s to the late 1940s, the genocide that occurred in Cambodia from 1975 to 1979, that which took place against Bosnian Muslims from 1992 to 1995, and the Rwandan genocide of 1994. To determine the of each of the respective genocides, constructivist theories of the factors behind ethnic …

Myths, Stereotypes And Truths: A Critical Look At The Relationship Between Africans And African-Americans., Jennifer Olufemi Salu

Honors Theses

This study focuses on the relationship between Africans and African-Americans and examines the w ay many members of each group perceive the other. In examining the relationship between each group, the study focuses on looking at some of the myths and stereotypes many Africans, especially African students and immigrants in the United States, have of African-Americans and vice-versa and the impact these myths and stereotypes have on the way members of both groups view each other. This study also focuses on understanding and some of the unique challenges members of each group face in trying to correct mistaken assumptions about …
