Propertization, Contract, Competition, And Communication: Law's Struggle To Adapt To The Transformative Powers Of The Internet, David Barnhizer Jan 2006

Propertization, Contract, Competition, And Communication: Law's Struggle To Adapt To The Transformative Powers Of The Internet, David Barnhizer

Cleveland State Law Review

This Symposium focuses in part on the ideas of Margaret Jane Radin as a point of departure for the various contributions. A key part of the analysis includes the process she calls propertization in the context of intellectual property rules and the Internet. The approach taken in this introductory essay is twofold. The first part presents some key points raised by the Symposium contributors. Of course, that overview is necessarily incomplete, because the contributions represent a rich group of analyses about vital concerns relating to how our legal system should respond to the challenge of the Internet and information systems …

Using Literature Circles To Engage Students With Informational Texts, Theresa Marie Anderson Jan 2006

Using Literature Circles To Engage Students With Informational Texts, Theresa Marie Anderson

All Graduate Projects

The focus of this project was to review the available research on literature circles as a method of engaging students with informational texts and to create an implementation guide for teachers. The results of the research show that there is a need for effective nonfiction instruction and that including this instruction at the elementary level provides tremendous benefits for students. Literature circles are an effective way to engage students with these informational texts, because they offer an authentic literacy experience and provide students with the kinds of informational text interactions they will encounter in the real world. The project includes …

Attraction Of Mosquitoes To Volatiles Associated With Blood, S. A. Allan, Ulrich R. Bernier, Donald Kline Jan 2006

Attraction Of Mosquitoes To Volatiles Associated With Blood, S. A. Allan, Ulrich R. Bernier, Donald Kline

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Responses of the mosquitoes Aedes aegypti, Culex quinquefasciatus, and Culex nigripalpus to volatiles and compounds associated with bovine and avian blood that were presented in collagen membranes were evaluated in olfactometer and landing assays. The presence of attractants produced by blood was supported by more attraction of all species to blood than water controls in the olfactometer. Females of Ae. aegypti and Cx. quinquefasciatus were more attracted to bovine blood than to avian blood, but there was no difference in Cx. nigripalpus responses. In landing assays, significantly more females of all species landed on casings with blood than on water …

Temperature Effects On Bradyrhizobium Spp. Growth And Symbiotic Effectiveness With Pigeonpea And Cowpea, Lurline E. Marsh, Raymond Baptiste, Dyremple B. Marsh, David Trinklein, Robert J. Kremer Jan 2006

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Temperature is a limiting factor on legume-Bradyrhizobium symbiosis of subtropical plants in the temperate region. Twelve strains of Bradyrhizobium spp. that nodulate pigeonpea [Cajanus cajan (L.) Millsp], and cowpea [Vigna unguiculata (L.) Walp], were evaluated for tolerance to three temperature regimes (20 °C/10 °C, 30 °C/20 °C, and 38 °C/25 °C day/night temperature) by determining their growth following exposure to the regimes. The five most temperature-tolerant strains were further evaluated for symbiotic effectiveness with pigeonpea and cowpea under controlled temperatures. These strains were USDA 3278, USDA 3362, USDA 3364, USDA 3458, and USDA 3472. Plant heights of …

Evaluating The Influence Of Storage Time, Sample-Handling Method, And Filter Paper On The Measurement Of Water-Extractable Phosphorus In Animal Manures, Kristen Baum, Gary Pierzynski, Peter Kleinman, John Kovar, Rory Maguire, Philip Moore, Tiequan Zhang Jan 2006

Evaluating The Influence Of Storage Time, Sample-Handling Method, And Filter Paper On The Measurement Of Water-Extractable Phosphorus In Animal Manures, Kristen Baum, Gary Pierzynski, Peter Kleinman, John Kovar, Rory Maguire, Philip Moore, Tiequan Zhang

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Surface-applied manures create a potential phosphorus (P) runoff hazard, especially when unincorporated. In such cases, the concentration of water- extractable P in the manure has been correlated to soluble P concentrations in runoff. This study evaluated the influence of holding time, sample-handling procedure, and filtration method on measurement of the water-extractable P content of manures in a 3 ×3 ×2 factorial arrangement of treatments. A two-way interaction between holding time and sample-handling procedure occurred for most samples. Six samples had waterextractable P concentrations that were less than or equal to dried and dried/ground treatments. Only one sample had higher water-extractable …

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Surface arthropods on pome fruits can cause export problems and disrupt commercial markets. Eliminating insects and mites on the packing line would be the last opportunity to provide for pest-free produce. In this study, an experimental packing line was used to evaluate techniques using different surfactant baths, pressurized water sprays, and styles of rotating brushes to remove field-collected and laboratory-reared grape mealybug, Pseudococcus maritimus (Ehrhorn) (Homoptera: Pseudococcidae), the diapausing two-spotted spider mite, Tetranychus urticae Koch (Acari: Tetranychidae) and the woolly apple aphid, Eriosoma lanigerum (Hausman) (Homoptera: Aphididae). The organosilicone Silwet L-77 was no more effective than a silicone-based food grade …

Upper Profile Changes Over Time In An Appalachian Hayfield Soil Amended With Coal Combustion By-Products, X. Zhou, K. D. Ritchey, R. B. Clark, N. Persaud, D. P. Belesky

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Large amounts of flue gas desulfurization (FGD) and fluidized bed combustion (FBC) by-products from burning coal, consisting primarily of gypsum, are available for potential use as a soil amendment. However, information is limited on longer-term changes in chemical and physical properties induced over time and over small depth increments of the upper soil profile after applying these amendments. This study examined longer-term effects in an abandoned Appalachian pasture soil amended with various liming materials and coal combustion by-products (CCBPs). Soil chemical and physical properties were investigated over time and depths. The results indicated limited dissolution and movement of the calcium …

Microarray Based Comparison Of Two Escherichia Coli O157:H7 Lineages, Scot E. Dowd, Hiroshi Ishizaki Jan 2006

Microarray Based Comparison Of Two Escherichia Coli O157:H7 Lineages, Scot E. Dowd, Hiroshi Ishizaki

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Background: Previous research has identified the potential for the existence of two separate lineages of Escherichia coli O157:H7. Clinical isolates tended to cluster primarily within one of these two lineages. To determine if there are virulence related genes differentially expressed between the two lineages we chose to utilize microarray technology to perform an initial screening.

Results: Using a 610 gene microarray, designed against the E. coli O157 EDL 933 transcriptome, targeting primarily virulence systems, we chose 3 representative Lineage I isolates (LI groups mostly clinical isolates) and 3 representative Lineage II isolates (LII groups mostly bovine isolates). Using standard dye …

Embracing Uncertainty, Complexity, And Change: An Eco-Pragmatic Reinvention Of A First-Generation Environmental Law, Mary Jane Angelo Jan 2006

Embracing Uncertainty, Complexity, And Change: An Eco-Pragmatic Reinvention Of A First-Generation Environmental Law, Mary Jane Angelo

UF Law Faculty Publications

Recent scientific reports demonstrate that despite more than thirty years of environmental regulation, bird and wildlife species as well as ecosystem services, are in unprecedented decline. Pesticides are at least in part to blame for these profound declines. U.S. pesticide law has failed to carry out its mission of environmental protection. A number of recently-filed lawsuits assert that the registration of certain pesticides violates the federal Endangered Species Act. One of the great ironies of environmental law is that the ecological consequences of pesticide use, which fueled the environmental movement of the late 1960s and early 1970s, largely have been …

Sexual Labor And Human Rights, Berta E. Hernández-Truyol, Jane E. Larson Jan 2006

Sexual Labor And Human Rights, Berta E. Hernández-Truyol, Jane E. Larson

UF Law Faculty Publications

In this Article, we engage the current human rights debate that dichotomizes prostitution either as a modern form of slavery or as the exercise of the right to work. This framework effectively sets up a coercion/consent polarity. These poles raise fundamental human rights issues; both the prohibition against slavery and the right to work are matters addressed by and central to the international human rights paradigm. Yet we argue in this Article that the human rights issues raised by prostitution cannot properly be studied nor moved towards meaningful resolution in the context of the prevailing polarity. Prostitution in its current …

Comparative Mapping Of Bovine Chromosome 27 With Human Chromosome 8 Near A Dairy Form Qtl In Cattle, E. E. Connor, M. S. Ashwell, R. Schnabel, J. L. Williams Jan 2006

Comparative Mapping Of Bovine Chromosome 27 With Human Chromosome 8 Near A Dairy Form Qtl In Cattle, E. E. Connor, M. S. Ashwell, R. Schnabel, J. L. Williams

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

In the absence of a complete and annotated bovine genome sequence, detailed human-bovine comparative maps are one of the most effective tools for identification of positional candidate genes contributing to quantitative trait loci (QTL) in cattle. In the present study, eight genes from human chromosome 8 were selected for mapping in cattle to improve breakpoint resolution and confirm gene order on the comparative map near the 40 cM region of the BTA27 linkage map where a QTL affecting dairy form had previously been identified. The resulting map identified ADRB3 as a positional candidate gene for the QTL contributing to the …

Independent Practice For Certified Registered Nurse Anesthetists In The Rural Setting, Amber L. Phillips Jan 2006

Independent Practice For Certified Registered Nurse Anesthetists In The Rural Setting, Amber L. Phillips

Theses and Dissertations

Certified Registered Nurse Anesthetists (CRNAs) are competent in delivering cost-effective, quality anesthesia care. Therefore, rural communities rely on CRNAs to provide anesthesia care in their facilities. With the shortage of CRNAs and anesthesiologists recruiting anesthesia providers to the rural communities has become a major issue. Without anesthesia services many rural facilities are unable to provide their community members with procedures that require anesthesia monitoring.

Rural communities, unlike urban, are unable to recruit CRNAs using financial incentives. This project will provide CRNAs information needed to practice independently in the rural setting. The sole anesthesia providers in many rural medical facilities are …

Shame And The Meaning Of Punishment, Chad Flanders Jan 2006

Shame And The Meaning Of Punishment, Chad Flanders

Cleveland State Law Review

This Essay critiques the shaming punishments debate, not in the interest of defending one side or the other, but to make more explicit the paradox with which this Essay began. This Essay also advances the proposal that a consistent liberalism, one that demands that all citizens be respected equally, is incompatible with any punishment that requires the infliction of hard treatment (treatment which inflicts pain or suffering) or humiliation on the offender. It is important to bracket the practical consequences of this proposal. Perhaps it was proposals like this one that made Nietzsche worry about the progressive softening of societies …

The Effects Of Varying The Timing Of Inputs On A Neural Oscillator, Christina Ambrosio-Mouser, Farzan Nadim, Amitabha Bose Jan 2006

The Effects Of Varying The Timing Of Inputs On A Neural Oscillator, Christina Ambrosio-Mouser, Farzan Nadim, Amitabha Bose

Publications and Research

The gastric mill network of the stomatogastric ganglion of the crab Cancer borealis is comprised of a set of neurons that require modulatory input from outside the stomatogastric ganglion and input from the pyloric network of the animal in order to oscillate. Here we study how the frequency of the gastric mill network is determined when it receives rhythmic input from two different sources but where the timing of these inputs may differ. We find that over a certain range of the time difference one of the two rhythmic inputs plays no role what so ever in determining the network …

Voices Of Women: Telling The Truth Through Art Making, Alice Pennisi Jan 2006

Voices Of Women: Telling The Truth Through Art Making, Alice Pennisi

Journal of Social Theory in Art Education

On Wednesdays, when the last period of the school day is finished, the students trickle out of room 412 of Burnham High School and the young women enter who have been waiting outside. They immediately push all the desks to the side or back walls, leaving a large open space. Then each carries a chair toward the front of the room, creating a circle. Someone closes the door, and they begin to talk with one another. Thus begins a weekly meeting of Voices of Women (VOW), a group comprised mainly of high school girls who create collaborative artwork based on …

Reading Objects: Collections As Sites And Systems Of Cultural Order, Alice Wexler Jan 2006

Reading Objects: Collections As Sites And Systems Of Cultural Order, Alice Wexler

Journal of Social Theory in Art Education

The political nature of making personal and cultural meaning of objects (both ordinary and aesthetic) is the site where transactions between our innate need for order and environmental influences, such as consumerism, are made. Valuing objects leads to the phenomena of collection, a subject that has been of interest in education and psychology since the nineteenth century. I ask how the private collections of children, and later adults, lead to systems of labeling, grouping, and display of art and artifacts in the art and natural history museum. In the age of the meta museum, how do educators question the museum's …

Precinct, Gayle Gorman Jan 2006

Precinct, Gayle Gorman

Journal of Social Theory in Art Education

"Precinct" was a site-specific art project/ performance/ exhibit put on by SITE: Buffalo Artist Collective, an organization devoted to a nontraditional approach to art emphasizing the experiential and the value of spectered memories contained in found objects and images. With the aid of the Buffalo Arts Commission, the abandoned police precinct (now destroyed) on Niagara Street on Buffalo's West side was open to the public, occupied and interacted with for a one-day event. This venue was specifically selected in order to bypass the gallerycentric mode of display which tends to dominate the world of art. By doing so, SITE made …

Grasping The Site/Sight/Cite Of The Image: A Lacanian Explication, Jan Jagodzinski

Journal of Social Theory in Art Education

Reading images psychoanalytically from a Lacanian perspective has its challenges. The first task of this essay is to provide a way through what is often taken to be difficult and impenetrable theory, to explicate how the homology site/ sight/ cite can be understood in any act of critical perception. Its second task is to make distinctions between a psychoanalytic understanding of the subject as being 'split' or divided (as represented by the matheme '$,' Lacan's symbol for this form of subjectivity) when applied to art, as opposed to a naive realist subject of representation or a savvy poststructuralist (decentered) subject …

Prebiotic Galactooligosaccharides Reduce Adherence Of Enteropathogenic Escherichia Coli To Tissue Culture Cells, Kari Shoaf, George L. Mulvey, Glen D. Armstrong, Robert W. Hutkins Jan 2006

Prebiotic Galactooligosaccharides Reduce Adherence Of Enteropathogenic Escherichia Coli To Tissue Culture Cells, Kari Shoaf, George L. Mulvey, Glen D. Armstrong, Robert W. Hutkins

Department of Food Science and Technology: Faculty Publications

Prebiotic oligosaccharides are thought to provide beneficial effects in the gastrointestinal tract of humans and animals by stimulating growth of selected members of the intestinal microflora. Another means by which prebiotic oligosaccharides may confer health benefits is via their antiadhesive activity. Specifically, these oligosaccharides may directly inhibit infections by enteric pathogens due to their ability to act as structural mimics of the pathogen binding sites that coat the surface of gastrointestinal epithelial cells. In this study, the ability of commercial prebiotics to inhibit attachment of microcolony-forming enteropathogenic Escherichia coli (EPEC) was investigated. The adherence of EPEC strain E2348/69 on HEp-2 …
