Evaluation Of Work Zone Safety Operations And Issues, Jerry G. Pigman, Kenneth R. Agent, Eric R. Green Mar 2006

Evaluation Of Work Zone Safety Operations And Issues, Jerry G. Pigman, Kenneth R. Agent, Eric R. Green

Kentucky Transportation Center Research Report

Work zone activities are one of the areas with a high potential for compromised safety for workers and road users. Various measures have been taken to increase the level of safety in work zones; including the use of double fines for speeding and the application of speed displays based on radar detection. There has been an effort to improve the effectiveness and safety of flaggers by requiring the use of a stop/slow paddle for most work zone conditions, using lights on the paddle, and increasing visibility by using more reflective clothing. It has been suggested that safety in work zones …

Comparative Phylogeography In A Genus Of Coral Reef Fishes: Biogeographic And Genetic Concordance In The Caribbean, Michael S. Taylor, Michael E. Hellberg

Faculty Publications

Geographic barriers that limit the movement of individuals between populations may create or maintain phylogenetically discrete lineages. Such barriers are often inferred from geographic surveys of a single mitochondrial marker to identify phylogenetic splits. Mitochondrial DNA, however, has an effective population size one-fourth that of nuclear DNA, which can facilitate the rapid evolution of monophyletic mtDNA lineages in the absence of geographic barriers. The identification of geographic barriers will thus be more robust if barriers are proposed a priori, and tested with multiple independent genetic markers in multiple species. Here, we tested two proposed marine biogeographic breaks located at the …

Essay For The In-Print Symposium On The Myth Of Moral Justice, Stuart A. Scheingold Mar 2006

Essay For The In-Print Symposium On The Myth Of Moral Justice, Stuart A. Scheingold

Cardozo Public Law, Policy & Ethics Journal

Stuart Scheingold responds to Thane Rosenbaum's The Myth of Moral Justice, agreeing with the aspiration to infuse law with moral imagination but critiquing Rosenbaum's oversight of existing moral energy within the legal profession, particularly through cause lawyering. Scheingold argues that Rosenbaum's approach is overly simplistic, failing to account for institutional obstacles and the contested nature of moral discourse, which can lead to conflict rather than harmony. He emphasizes that while moral advocacy, as seen in cause lawyering, can drive positive change, it also faces significant challenges and backlash.

On Morality And The Law: Truth, Justice And The American Way, Daniel M. Abuhoff Mar 2006

On Morality And The Law: Truth, Justice And The American Way, Daniel M. Abuhoff

Cardozo Public Law, Policy & Ethics Journal

The article argues that the legal system should not be based on morality but rather on rules designed to protect individual freedoms and ensure fairness. It critiques Thane Rosenbaum's view that the legal system should prioritize morality, asserting that such an approach could lead to the imposition of a single moral code, undermining diversity and leading to potential inconsistencies and biases.

Instructional Techniques For Social Work Education, Fred H. Besthorn

UNIversitas: Journal of Research, Scholarship, and Creative Activity

This article briefly examines the historical and cultural context of Norwegian ecological consciousness and demonstrates the viability of integrating its Deep Ecological awareness into social work curriculum and education for practice. It shall address the most salient and practical elements that Norwegian views of nature and conceptualizations of Deep Ecology have brought to global, environmental activism and emerging conceptualization of earth-based awareness. It is designed to assist educators in helping their students to become more fully cognizant that individual well-being and relationships with human and other-than-human beings is deeply influenced by internalized experiences of the natural world.

Sovereign Right, Democracy And The Rule Of Law, Artur Golczewski Mar 2006

Sovereign Right, Democracy And The Rule Of Law, Artur Golczewski

UNIversitas: Journal of Research, Scholarship, and Creative Activity

In the often hotly contested contemporary critical discourse, the related notions of individual and social identity, values and viable conduct continue to be the bone of contention, as their competing rationales sanction radically distinctive existential frameworks. The present essay employs some of the methodological strategies of the genealogical analysis as progressively refined by Ernst Kantorowicz and Michel Foucault, and it aims to chart a trajectory of historical applications and effects of the theory of sovereignty as the organizing principle coordinating our legal and socio-governmental rationales of value and of individual and social conduct. The principle governing Kantorowicz’s selection and consideration …

Beyond That “It's Just A Flesh Wound...” Kind Of Feeling: A Medieval Game1 Proposal, Carol Robinson Mar 2006

Beyond That “It's Just A Flesh Wound...” Kind Of Feeling: A Medieval Game1 Proposal, Carol Robinson

UNIversitas: Journal of Research, Scholarship, and Creative Activity

In his book, What Video Games Have to Teach Us About Learning and Literacy, James Paul Gee argues that “the power of video games, for good or ill, resides in the ways in which they meld learning and identity…,” and he cautions that this power can be used to miscommunicate wrong ideology (such as might be found in a neo-Nazi game that encourages the player to conduct ethnic cleansing (199). However, Gee advocates “understanding the ‘play’ of identities and perspectives as they work for and against each other in the world, now and throughout history” (200). The art – …

Journal Articles

Objective: To investigate in vivo if the increased tibial rotation found in anterior cruciate ligament (ACL)-deficient patients before surgery is restored 2 years after the reconstruction, during 2 high-demanding activities.

Design: Prospective follow-up study.

Setting: A gait analysis laboratory.

Participants: Nine subjects with unilateral ACL rupture, reconstructed with a bone–patellar tendon–bone (BPTB) graft, and 10 healthy control subjects.

Interventions: All the ACL-deficient patients underwent a unilateral ACL reconstruction after prereconstruction data acquisition.

Main Outcome Measurements: Using a 6-camera motion analysis system, kinematics were collected as subjects (1) descended from a stair and, after foot …

Trips And Its Discontents, Peter K. Yu Mar 2006

Trips And Its Discontents, Peter K. Yu

Faculty Scholarship

The TRIPs Agreement was established at the ministerial meeting in Marrakesh in April 1994. Since its establishment, many less developed countries have become dissatisfied with the international intellectual property system. From their perspective, the system fails to take into consideration their needs, interests, and local conditions. The strong protection mandated by the Agreement also threatens their much-needed access to information, knowledge, and essential medicines.

This year marks the tenth anniversary of the TRIPs Agreement. It provides an excellent opportunity to assess the Agreement's achievements and shortfalls, in particular its impact on the international community as well as on other areas …

Animal Rights Without Controversy, Cass R. Sunstein, Jeff Leslie Mar 2006

Animal Rights Without Controversy, Cass R. Sunstein, Jeff Leslie

Public Law and Legal Theory Working Papers

Many consumers would be willing to pay something to reduce the suffering of animals used as food. The problem is that existing markets do not disclose the relevant treatment of animals, even though that treatment would trouble many consumers. Steps should be taken to promote disclosure, so as to fortify market processes and to promote democratic discussion of the treatment of animals. In the context of animal welfare, a serious problem is that people’s practices ensure outcomes that defy their existing moral commitments. A disclosure regime could improve animal welfare without making it necessary to resolve the most deeply contested …
