Getting Your Name Out There: Traveling Acting Companies And Royal And Aristocratic Prestige In Tudor England, James H. Forse Jan 2005

Getting Your Name Out There: Traveling Acting Companies And Royal And Aristocratic Prestige In Tudor England, James H. Forse

Quidditas

Records published to date concerning early English drama suggest that in the first third of the sixteenth century touring activity by municipal, amateur acting companies exceeded that of royal and aristocratic troupes. But after about 1535, the religious, social, and economic policies of Henry VIII, and Edward VI, severely limited locally based performances. At the same time tours by royal acting troupes substantially increased. Yet of all the Tudors, it was Elizabeth who seems to have realized the potential of her acting troupe representing the monarch's presence throughout the kingdom. From the beginning of her reign the Queen’s Men appeared …

Building Zion: The Latter-Day Saint Legacy Of Urban Planning, Craig D. Galli Jan 2005

Building Zion: The Latter-Day Saint Legacy Of Urban Planning, Craig D. Galli

BYU Studies

As with the founding of Plymouth Colony, distinctive historical circumstances and theological beliefs converged to motivate early Latter-day Saint community builders. While the historic roots of Salt Lake City are well known to virtually every grade school student in Utah and to Church members around the world, aspects of our remarkable legacy of urban and transportation planning remain obscure. The physical design and community values underlying early attempts to build Zion provide useful perspective and inspiration as today's community leaders now grapple with managing urban growth along Utah's Wasatch Front (from Brigham City to Nephi and Grantsville to Kamas) and …

Freedom, Compulsion, Compliance And Mystery: Reflections On The Duty Not To Enforce A Promise, Jeffrey M. Lipshaw Jan 2005

Freedom, Compulsion, Compliance And Mystery: Reflections On The Duty Not To Enforce A Promise, Jeffrey M. Lipshaw

Suffolk University Law School Faculty Works

In this essay, I suggest the difference between the law of consensual relationships (i.e., contracts) and the morality of those relationships is one of compulsion and freedom. In the former, we find ourselves being compelled by, or compliant with, a rule some distance removed from the basic norm; in the latter we find ourselves in touch, constantly and sometimes in the face of more visceral obligatory rules, with a far deeper and more fundamental (transcendental) sense of fairness. Moral decisions are the ones made without any threat of compulsion from the law. The clearest example in commercial relationship of a …

People V. Cahill: Domestic Violence And The Death Penalty Debate In New York, Russell G. Murphy

Suffolk University Law School Faculty Works

This article proposes changes in the 1994 State of New York death penalty statute designed to deal with the reversal of the capital sentence in the 2003 NY Court of Appeals decision in People v. Cahill. In 1998, the defendant Jeff Cahill brutally attacked his wife with an aluminum baseball bat during a domestic quarrel. Six months later Mr. Cahill snuck into his wife's hospital room, where she was continuing her recovery from the earlier attack, and poisoned her to death with stolen potassium cyanide. Jeff Cahill's death sentence was reversed when the Court of Appeals found the evidence at …

Indigenous Peoples And Intellectual Property, Stephen M. Mcjohn, Lorie Graham Jan 2005

Indigenous Peoples And Intellectual Property, Stephen M. Mcjohn, Lorie Graham

Suffolk University Law School Faculty Works

This paper, following on Michael F. Brown's Who Owns Native Culture?, suggests that intellectual property law, negotiation, and human rights precepts can work together to address indigenous claims to heritage protection. Granting intellectual property rights in such spheres as traditional knowledge and folklore does not threaten the public domain in the same way that expansion of intellectual property rights in more commercial spheres does. It is not so much a question of the public domain versus corporate and indigenous interests, as it is a question of the impact corporate interests have had on the indigenous claims. Indeed indigenous peoples' claims …

Treating Tribes Differently: Civil Jurisdiction Inside And Outside Indian Country, Max J. Minzner Jan 2005

Treating Tribes Differently: Civil Jurisdiction Inside And Outside Indian Country, Max J. Minzner

Faculty Scholarship

This Article attempts to analyze why, in the current jurisdictional framework, tribes are treated differently from states but not differently from each other. This article analyzes the key assumptions underlying jurisdictional and choice of law analyses both inside and outside Indian Country. After a summary overview of current tribal court systems, this Article attempts to identify features of tribal courts that might indicate that they a) might disadvantage non-tribal litigants and b) are threatened by the incursion of concurrent state jurisdiction. The article points to one potential reason that the Court has assumed that all Indian tribes are alike, which …

International Freight Transport Multimodal Development In Developing Countries: The Case Of Bangladesh, Dewan Mohammad Zahurul Islam Jan 2005

International Freight Transport Multimodal Development In Developing Countries: The Case Of Bangladesh, Dewan Mohammad Zahurul Islam

Plymouth Business School Theses

An efficient transport system is essential for an efficient supply chain to facilitate international trade. To utilise all cheaper resources, such as labour in Bangladesh, companies receive supplies from one coxintry (e.g. in Hong Kong), produce the products in another country, and sell them in other countries (e.g. European countries). Thus the production and consumption has turned into a global activity with transport filling the gaps among them. To perform the transport function a carrier may require the use of more than one mode, the so-called multimodal transport. Multimodal transport, an integrated systems approach, can be defined as the most …

Executive Power And The War On Terror, Norman C. Bay Jan 2005

Executive Power And The War On Terror, Norman C. Bay

Faculty Scholarship

Two important paradigm shifts have occurred in the war on terror. First, the United States has treated terrorism as a military issue, not a law enforcement problem. Second, the United States has centralized its intelligence apparatus under the direction of the newly-created Director of National Intelligence and lowered the wall that separated external security or foreign intelligence activity from internal security or domestic law enforcement. In tandem, these changes are of historic dimension. They also occur against a backdrop in modern times in which the executive branch has steadily accumulated power. In pursuit of the war on terror, we have …

The Common Law Choice Of Law Rules For Resulting And Constructive Trusts, Adeline Chong Jan 2005

The Common Law Choice Of Law Rules For Resulting And Constructive Trusts, Adeline Chong

Research Collection Yong Pung How School Of Law

There is a dearth of authority and in-depth discussion concerning what the choice of law rules are for claims involving the assertion that property is held on a resulting or constructive trust. It is usually thought that the choice of law rules set out by the Hague Convention on the Law Applicable to Trusts and on their Recognition (hereafter the ‘Hague Trusts Convention’), as enacted into English law by the Recognition of Trusts Act 1987, apply. However, it is arguable that this is not so for some types of resulting and constructive trusts, namely those governed by a foreign law; …

Contract Formation And Mistake In Cyberspace – The Singapore Experience, Andrew B.L. Phang

Research Collection Yong Pung How School Of Law

The present article analyses the many important issues that are raised by what is probably the first case on Internet mistake – the Singapore High Court decision of Chwee Kin Keong v Digilandmall.com Pte Ltd [2004] 2 SLR 594. In addition to the law of (especially, unilateral) mistake, issues relating to the formation of a contract will be considered (including the law relating to offer and acceptance with regard to both website advertisements as well as electronic mail transactions, and the weakness of (and, hence, need to reform) the doctrine of consideration).

Facing China: Taiwan’S Status As A Separate Customs Territory In The World Trade Organization, Pasha L. Hsieh Jan 2005

Facing China: Taiwan’S Status As A Separate Customs Territory In The World Trade Organization, Pasha L. Hsieh

Research Collection Yong Pung How School Of Law

On Nov 11, 2001, in Doha, Qatar, the Fourth Ministerial Conference of the World Trade Organization (WTO) unanimously approved Taiwan's application for WTO membership, just 24 hours after approving China's admission. Taiwan's choice as the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu, abbreviated as Chinese Taipei, in the WTO, instead of its official name, Republic of China (PRC), shows its reluctant compromise with political reality. The PRC's claim that accession procedures applying to Taiwan and Hong Kong should be identical erroneous because, under international trade law, the ROC is the automatic government acting on behalf of Taiwan and …

Computer-Supported Rehabilitation Management A Case Study Of Using Virtual Reality Technology In Ambulatory Training For Post-Acute Stroke Patients, Felix O. Akinladejo Jan 2005

Computer-Supported Rehabilitation Management A Case Study Of Using Virtual Reality Technology In Ambulatory Training For Post-Acute Stroke Patients, Felix O. Akinladejo

CCAC Theses and Dissertations

This study investigated the use of virtual reality (VR) technology in ambulatory training for post-acute stroke patients, and sought to determine whether skills gained in virtual environments transfer to real-world conditions. Patients with stroke typically suffer dysfunctions that impair the complex set of motions involved in walking. The limited amount of therapy and resources offered by the current health care system does not provide the frequency and intensity of training needed for functional recovery of the walking skills in patients following stroke assaults. This study, therefore, developed and investigated an alternative intervention technique capable of providing the frequency and intensity …

Turkish Journal of Zoology

A total of 105 specimens of the genus Mus collected from Ankara, Bartın, Bolu, Düzce and Zonguldak in Turkey were biometrically evaluated. The isocitrate dehydrogenase enzyme system along with karyotypes of 37 specimens were analysed. The zygomatic index and the index of head plus body length/tail length were diagnostic characters for Mus domesticus and Mus macedonicus. Starch gel electrophoresis gave 2 loci (Idh-1 and Idh-2) for the isocitrate dehydrogenase enzyme system. Two alleles (Idh-1^{100} and Idh-1^{105}) of the Idh-1 locus were determined in M. domesticus and M. macedonicus. M. domesticus and M. macedonicus have the same karyological values 2n = …
