Journal of Modern Applied Statistical Methods

On occasion, the response to treatment in an AB/BA crossover trial is measured on a binary variable - success or failure. It is assumed that response to treatment is measured on an outcome variable with (+) representing a treatment success and a (-) representing a treatment failure. Traditionally, three tests for comparing treatment effect have been used (McNemar’s, Mainland-Gart, and Prescott’s). An issue arises concerning treatment comparisons when there may be a residual effect (carryover effect) of a previous treatment affecting the current treatment. OBJECTIVE: We determined the antibiotic sensitivities of uropathogenic Escherichia coli (UPEC) strains isolated from the urine of patients who have recurrent urinary tract infections (UTIs). METHODS: Our study was carried out between November 2000 and January 2002 at the Infectious Diseases Clinic, Istanbul Haydarpasa Numune Hospital, Istanbul, Turkey. We compared the virulence factors (fimbrial adhesion, hemolysin production, motility property) of 50 strains of Escherichia coli (E. coli) isolated from urine with the same properties of 25 strains of E. coli isolated from stool specimens of healthy individuals. Growth, Fecundity, And Diets Of Newly Established Silver Carp In The Middle Mississippi River, Christopher J. Williamson, James E. Garvey

The silver carp Hypophthalmichthys molitrix has spread throughout the Mississippi River drainage. During 2003, we determined its population status and potential impact in the middle Mississippi River (MMR), the conduit between the lower Mississippi River and the upper Mississippi, Missouri, and Illinois rivers. We quantified growth, age structure, fecundity, and diets of silver carp sampled with trammel nets and AC electrofishing in main-channel areas. Mean length at age in the MMR exceeded that of populations in Asia by as much as 26%. Individuals were typically more than 1 year old and 230 mm total length, suggesting that small, young fish …

Towards A Precision Measurement Of The Casimir Force In A Cylinder-Plane Geometry, M. Brown-Hayes, D. A.R. Dalvit, F. D. Mazzitelli, W. J. Kim, R. Onofrio

We report on a proposal aimed at measuring the Casimir force in the cylinder-plane configuration. The Casimir force is evaluated including corrections due to finite parallelism, conductivity, and temperature. The range of validity of the proximity force approximation is also discussed. An apparatus to test the feasibility of a precision measurement in this configuration has been developed, and we describe both a procedure to control the parallelism and the results of the electrostatic calibration. Finally we discuss the possibility of measuring the thermal contribution to the Casimir force and deviations from the proximity force approximation, both of which are expected …

Two hundred years after its most famous invocation in Marbury v. Madison, judicial review has apparently lost its luster. Despite its global spread, it is in disrepute in its country of origin. The mainstream American academic attitude toward judicial review as practiced by the modem Supreme Court ranges from open hostility to a position similar to Winston Churchill's on democracy: It is the worst way to implement a Constitution, except for all the rest. In this essay, I want to explain the source of the hostility, defend judicial review against its critics, and make a few suggestions for improvement.

Justice Blackmun's legacy is strongly linked to two issues - abortion and capital punishment. Blackmun's opinions in these controversial areas account for much of the notion that his ideology changed while on the Court. Participants in this Symposium have reflected on these and other areas where Justice Blackmun left his mark on American law. Justice Blackmun sat on 3,653 cases during his twenty-four terms on the Supreme Court, yet he will surely be best remembered for his role in one case, Roe v. Wade. Seldom has a judicial decision been more controversial. True, many opinions are harshly criticized. But the criticisms of Roe were distinctive. According to critics, Roe was not merely bad law, in some sense it was not law at all. One particularly outspoken critic recently calls Roe "perhaps the most indefensible 'constitutional' decision ever reached by this Court to date' as well as "manifestly and atrociously contrary to the Constitution."

Some Reflections On The Symposium: Judging, The Classical Legal Paradigm, And The Possible Contributions Of Science, Christina E. Wells

One theme running through the many excellent contributions to this symposium involves the myriad influences of judicial decision-making. As Professor Wrightsman notes, Supreme Court Justices' personal characteristics may affect their ability to influence colleagues and, consequently, the outcome of Supreme Court decisions. Professor Ruger observes that judges have both attitudinal and jurisprudential preferences that may change over time, affecting legal outcomes differently as time passes. Professor Sisk similarly notes that judges' personal values and experiences influence their decision-making. Attorneys face the prospect of legal malpractice actions on a daily basis and in regard to every type of legal issue with which they deal. Indeed, a lawyer's negligence subjects him to liability whether he has mishandled a multimillion dollar business transaction or failed to adequately represent his client in a custody battle over the client's children. Tesmer, the Supreme Court held that attorneys lack standing to assert the rights of indigent criminal defendants.1t The Court's application of its prudential rules of standing presents great concern, as it leaves thirty years of precedent in doubt. In the past 20 yr, populations of Cicindela hirticollis Say (Coleoptera: Cicindelidae) that inhabit river shorelines have declined dramatically. These habitats have routinely flooded in winter and spring historically, but they have been altered by damming and controlled water releases for irrigation and power generation. We tested the ability of C. hirticollis larvae from two river and one bayshore population to survive immersion in severely hypoxic water. This is the first report of population-level differences among insects in immersion survival and likely relates to exposure to different flooding regimes. The Role Of Dopamine In Reinforcement: Changes In Reinforcement Sensitivity Induced By D1-Type, D2-Type, And Nonselective Dopamine Receptor Agonists, Natalie Bratcher, Valeri Farmer-Dougan, James Dougan, Byron Heidenreich, Paul Garris

Dose-dependent changes in sensitivity to reinforcement were found when rats were treated with low, moderate, and high doses of the partial dopamine D1-type receptor agonist SKF38393 and with the nonselective dopamine agonist apomorphine, but did not change when rats were treated with similar doses of the selective dopamine D2-type receptor agonist quinpirole. Estimates of bias did not differ significantly across exposure to SKF38393 or quinpirole, but did change significantly at the high dose of apomorphine. Estimates of goodness of fit (r2) did not change significantly during quinpirole exposure. Poor goodness of fit was obtained …

Uncertainty as to the optimum extent of protection has generally limited the capacity of law and economics to translate economic theory into coherent doctrinal recommendations in the realm of copyright. The article explores the relationship between copyright scope and welfare from a theoretical perspective to develop a framework for evaluating specific doctrinal recommendations in copyright law. This analysis of copyright scope establishes that (1) the efficiency of private ordering is the key determinant of the ideal level of copyright scope; (2) the complexity of the welfare-scope relationship is such that we are unlikely to be able to ascertain a generalizable …
