The author traces the evolving politics of sexuality in North America and its connections to the expropriation of resources from oppressed populations in what has become the United States of America. To help illustrate the evolution of the politics of sexuality over time, the author interprets messages emanating from Sigmund Freud's Civilization and Its Discontents (1930) and Herbert Marcuse's Eros and Civilization (first published in 1955), One-Dimensional Man (1964), and An Essay on Liberation (1969). On the eve of the United States' entry into World War II, the Roosevelt administration tried to convince the federal judiciary to rein in the prices of defense contracts, using the doctrine of economic duress. In time of war, so the argument went, the nation depends on defense contractors for its very life, and these private firms should not be permitted to exploit public necessity for inordinate gain. This argument, had it succeeded, would have been perhaps the largest expansion of judges' common law power over big business during the twentieth century.

This Article analyzes and discusses some of the United States' unilateral policies in the war on terror, namely the indefinite detention and targeted killing of suspected terrorists. It posits that the legal community should resist recent arguments purporting to vindicate certain justifications for curtailing fundamental human rights. First, the Article rebuts recent attempts to subsume legally insulated aspects of the war on terror into one overriding security discourse, with particular resistance to the merger of human rights by the national security agenda. Waller's Machiavellian Cromwell: The Imperial Argument Of A Panegyrick To My Lord Protector, Timothy Raylor

Recent work on Waller’s Panegyrick to my Lord Protector has focused on its e¡ort to dress Cromwell in Augustan garb to translate his power into authority over a quiescent populace. Drawing on recently discovered evidence about the poem’s composition, about Waller’s reading of Machiavelli, and about his association with a fellow Buckinghamshire gentleman and MP, Sir William Drake (a figure known to have been influenced by Machiavelli), this article suggests that Augustan rhetoric forms only one strand in a discursive tapestry dominated by a Machiavellian argument for England’s imperial expansion.

In this article in the Symposium on Milosevic & Hussein on Trial, the author discusses procedural challenges to proving genocide in the trial of Saddam Hussein to argue that the legitimacy of the Iraqi Special Tribunal (IST) & the proof of genocide rest on a sense of fairness, transparency, & completion of trials on a reasonable schedule. It is thus the aim of this Article to map out the international legal framework relevant for designing countermeasures against nonstate actors who convert civil aircraft into weapons of destruction. As a first step, this Article sketches out the applicable rules relating to international civil aviation security and highlights the dichotomy between nonstate actor threats and interstate threats at the base of these rules. In Fall 2002, the Federal Trade Commission held a Workshop exploring the problem of misleading weight-loss promotional pitches. After the agency spent decades cleaning up deceptive advertising, the weight-loss industry continues to be replete with such tactics. In an attempt to more aggressively attack those deceptions, the FTC used the Workshop as a forum to suggest that media should play a more active role in screening ads for diet products and programs. Galdós’s use of nicknames has been addressed both directly and indirectly in various studies,¹ but much remains to be noted about how historical, legendary, and mythological personages served as source material for sobriquets to designate Galdosian characters. So important were these nicknames to Galdós’s artistry that he would sometimes change the apodo in the Alpha manuscript to a different one in the final printed version. Moreover, the history-based nicknames, which do so much to enliven Galdós’s novels and Episodios are a feature in common with other nineteenth-century novelists, most notably Alas, Pereda, and Pardo Bazán.

Terrorism And The Laws Of War, Eric A. Posner

My argument has three steps. First, I discuss the purposes of the laws of war, and argue that humanitarian considerations provide only an ambiguous rationale for limiting the weapons and tactics of warfare. Second, I discuss why some weapons and tactics are outlawed while others are not, and argue that humanitarian ideals cannot, by themselves, explain the pattern. The best explanation focuses on the enforceability of laws. I identify two conditions under which belligerents would agree on a law of war, and would be willing to comply with their agreement. It is hard for most Americans to accept the need to balance the risks of terrorism against the costs and benefits of responding to these risks.
