This dissertation proposes an approach and methodology for the utilization of the fundamentals of systems theory as an aid to national security decision-making. At its core is an examination of the elements of nations' or non-state actor's power resources. The product of the analysis is the compilation of a set of nodes, and the relationships between these, upon which actions may be taken to achieve desired effects. Since the boundaries between the subsystems of power resources are flexible and permeable, and there will be interactions between elements in different subsystems, a system of systems approach is essential so that the …

The paper is premised on the idea that the future course of international law will be impacted by the United States' ability to adhere to international treaties to which it is a signatory. Hence, the current administration bears a responsibility to avoid unwisely stretching, distorting, or avoiding the principles of international law for short-term gain in a manner that jeopardizes long-term sustainable policy. The United States should be wary of creating a dangerous precedent - not only for the world, but for itself. Intellectualizing Property: The Tenuous Connections Between Land And Copyright, Stewart E. Sterk

Increased use of the intellectual property label to describe copyright and related areas of law has spawned analogies to the protections afforded real property. These analogies ignore significant differences between the foundations that undergird real and intellectual property rights. In particular, real property rights operate to avoid breaches of the peace and tragedies of the commons - problems that do not arise with intellectual works - while copyright and other intellectual property rights are designed to provide an incentive to create, an incentive irrelevant when land is at issue. The history of the construction of the Uasin Gishu railway demonstrates the complexity of formulating and implementing a colonial development project. It involved an array of actors with divergent interests. As result, the project became the most controversial railway extension in Kenya, which some critics have called a "colonial scandal." The main areas of controversy involved the altering of the original route for the Kisumu to Mumias railway, which was meant to serve the most productive African district in favor of a line starting from Nakuru via Uasin Gishu to Mumias to cater for the interests of European settlers who …

The Monyton Diaspora: A History Of The Middle Ohio River Valley, 1640-1700., Isaac J. Emrick

During the seventeenth century a vibrant group of Native Americans, the Monytons, controlled southern West Virginia and northeastern Kentucky. The effects of contact with Europeans destabilized their societies as far inland as the Ohio Valley. This began the process which eventually pushed most Monytons from the region. The Five Nations Iroquois, pressured by social changes farther north, attacked the Monytons further drawing people out of the Ohio Valley. A growing southern Indian slave trade also contributed to the decay of Monyton dominance in the region. A central point in this thesis is that Monytons formed and reformed traditions to deal …

For over one hundred years, the definition of the term "terrorism" has been subjected to political propaganda. In addition, dubious self-righteous indignation or outrage, often expressed by various states or prominent politicians at the occurrence of acts of terror have often masked the participation of those same states in international terrorism. In this endless cycle of finger pointing, accusations, denials, and counter-accusations, the problematic of what constitutes terror in legal parlance has degenerated into an exercise in name-calling. America was not prepared for the War of 1812. The army and navy were so small they could not oppose Britain directly. American strategy in the first year called for the seizure of Canada. Multiple expeditions were complete failures resulting in military defeats and political embarrassment for President Madison. During the second year of the war there were more defeats for American forces, but some victories. These successes came mainly against Indians allied with the British along the frontier. The Mexican War, 1846-1848, has often been overlooked in American history. Scholars have been more interested in assigning blame for the conflict, or assessing the role played by the Treaty of Guadalupe-Hidalgo in the coming of the Civil War. Only recently have scholars made any attempt to understand the motivations and attitudes brought to Mexico by American soldiers. This thesis focuses on how the racial and religious attitudes of American soldiers during the war were an implementation of the nationalism inherent in Manifest Destiny. One of John Taylor's most significant achievements during his mission to France, 1849-1851, was the publication of a French-language Latter-day Saint periodical, the Etoile du Déséret. Appearing in twelve issues from May 1851 to December 1852, the Etoile served a variety of functions for the earliest missionaries and members of The Church of Jesus Christ of Latter-day Saints in France. A study of its historical context and of its contents allows readers a glimpse into the circumstances under which the missionaries labored and into the needs of the growing Church.
