Regulating Innovative Medicine: Fitting Square Pegs In Round Holes, Mark Lavender Jan 2005

Regulating Innovative Medicine: Fitting Square Pegs In Round Holes, Mark Lavender

Duke Law & Technology Review

Increasingly, innovative medical products are creating a quandary for the Food and Drug Administration ("FDA") because they often transcend the FDA's traditional categorical approach to regulating medical products. In a recent attempt to simplify this process, the FDA has proposed a new rule for regulating "combination products." This iBrief discusses the FDA's current approach and analyzes the possible affects of the proposed regulation. Because of the many shortcomings of both systems, this iBrief concludes that the FDA should instead stop assigning center jurisdiction based on a product's "primary mode of action," and give the Office of Combination Products internal agency …

Linking Art To Science: Digital Media As A Technology Translation Tool, W. Andrew Clark, Cher L. Cornett, Peter M. Hriso

ETSU Faculty Works

Technology translation can be achieved through the blending of the sciences and arts in the form of digital imagery. Digital animation and video can be utilized to portray molecular events where the mechanism of action is known but the process occurs at a sub-microscopic level. There needs to be a strong collaboration between scientific advisors and digital artists when creating the animation such that the artistic interpretation of the molecular event conforms to the known and accepted confines of science. The finished animation may be used for information, education or persuasion as entrepreneurial biotechnical companies attempt to find markets, customers …

Contingency And Contracts: A Philosophy Of Complex Business Transactions, Jeffrey Marc Lipshaw Jan 2005

Contingency And Contracts: A Philosophy Of Complex Business Transactions, Jeffrey Marc Lipshaw

ExpressO

In this article, I argue that the prevailing literature on contract theory does not adequately address the way real-world lawyers address uncertainty in complex business transactions. I attribute this to the constraints imposed by thinking in legal models, the dominant tendency to turn to economics for analysis and normative prescription, and the focus on adjudicative issues of hindsight interpretation. Commercial uncertainty, and the law’s response to it, is only a subset of the broader philosophical issue of contingency. As an alternative to prevailing thought, I trace philosophical approaches to contingency, utility and morality that have come down to us since …

[Accepted Article Manuscript Version (Postprint)] Audience Personality And The Selection Of Media And Media Genres, Alice Hall Jan 2005

[Accepted Article Manuscript Version (Postprint)] Audience Personality And The Selection Of Media And Media Genres, Alice Hall

Communication and Media Faculty Works

The impact of personality characteristics (extraversion, neuroticism, psychoticism) on audiences' use of movies, television, and radio, and on genre preferences within these media was explored. Extraversion was associated positively with in-home movie viewing and with listening to urban, jazz/classical, and pop/rock music. Neuroticism was associated positively with pop/rock music listening. Psychoticism was associated negatively with watching romance and comedy films, but this relationship was moderated by an interaction in that the impact of psychoticism was most powerful among those who were also high in neuroticism. Follow-up analyses evaluating the impact of personality within groups defined by gender and race were …

The Structure Of Coral Allene Oxide Synthase Reveals A Catalase Adapted For Metabolism Of A Fatty Acid Hydroperoxide, Michael L. Oldham, Alan R. Brash, Marcia E. Newcomer Jan 2005

The Structure Of Coral Allene Oxide Synthase Reveals A Catalase Adapted For Metabolism Of A Fatty Acid Hydroperoxide, Michael L. Oldham, Alan R. Brash, Marcia E. Newcomer

Faculty Publications

8R-Lipoxygenase and allene oxide synthase (AOS) are parts of a naturally occurring fusion protein from the coral Plexaura homomalla. AOS catalyses the production of an unstable epoxide (an allene oxide) from the fatty acid hydroperoxide generated by the lipoxygenase activity. Here, we report the structure of the AOS domain and its striking structural homology to catalase. Whereas nominal sequence identity between the enzymes had been previously described, the extent of structural homology observed was not anticipated, given that this enzyme activity had been exclusively associated with the P450 superfamily, and conservation of a catalase fold without catalase activity is unprecedented. …
