Law And Behavioral Biology, Owen D. Jones, Timothy H. Goldsmith Mar 2005

Law And Behavioral Biology, Owen D. Jones, Timothy H. Goldsmith

Vanderbilt Law School Faculty Publications

Society uses law to encourage people to behave differently than they would behave in the absence of law. This fundamental purpose makes law highly dependent on sound understandings of the multiple causes of human behavior. The better those understandings, the better law can achieve social goals with legal tools. In this Article, Professors Jones and Goldsmith argue that many long held understandings about where behavior comes from are rapidly obsolescing as a consequence of developments in the various fields constituting behavioral biology. By helping to refine law's understandings of behavior's causes, they argue, behavioral biology can help to improve law's …

Rat/Mgra, A Regulator Of Autolysis, Is A Regulator Of Virulence Genes In Staphylococcus Aureus, Susham Ingavale, Willem Van Wamel, Thanh T. Luong, Chia Y. Lee, Ambrose L. Cheung

Dartmouth Scholarship

We have previously identified mgrA (rat) as a regulator of autolysis in Staphylococcus aureus. Besides its effect on autolytic activity, we recently found alterations in the expression of regulator and target virulence genes in the mgrA mutant. Northern analysis and transcription fusion assays showed that inactivation of mgrA has led to the downregulation of RNAIII of agr and hla and upregulation of sarS and spa. Although both SarA and agr are activators of α-hemolysin and a repressors of protein A synthesis, we found that the transcription of sarA was not affected in the mgrA mutant and …

Continued Range Expansion Ny The Cave Myotis, Shauna R. Marquardt, Jerry R. Choate, Stanley D. Roth Jr.

The Prairie Naturalist

The cave myotis (Myotis velifer) is a cavernicolous bat that ranges northward from Honduras to the southern Great Plains and southwestern United States. Its known range in the United States includes the states of Kansas, Oklahoma, Texas, Arizona, New Mexico, and small, southern portions of Nevada and California (Fitch et al. 1981, Hayward 1970). The cave Myotis inhabits caves, mines, and buildings, depending on time of year and specific roost requirements (Fitch et al. 1981, Hayward 1970, Kunz 1973, Sparks and Choate 2000). Before European settlement of areas within the range of the cave Myotis, it likely …

Records Of The Eastern Red Bat On The Northern Front Range Of Colorado, Daniel J. Neubaum

The Prairie Naturalist

Although common in deciduous forest throughout the Midwest and east-central states, the eastern red bat (Lasiurus borealis) is rare in Colorado (Armstrong et al. 1994, Fitzgerald et al. 1994). However, this species has the potential to extend its range because belts of eastern deciduous forest habitat have expanded across western prairies and reached the Front Range of Colorado over the last 100 years (Knopf 1986). The eastern red bat ranges from Canada southward across the United States to northeastern New Mexico with most records occurring east of the Continental Divide (Hall 1981, Shump and Shump 1982, Cryan 2003). …

Lesser Prairie-Chicken Use Of Harvested Corn Fields During Fall And Winter In Southwestern Kansas, Gregory C. Salter, Robert J. Robel, Kenneth E. Kemp

The Prairie Naturalist

The lesser prairie-chicken (Tympanuchus pallidicinctus) has declined in numbers in Kansas primarily due to the conversion of sand sagebrush (Artemisia .filifolia) prairie to cropland. The lesser prairie-chicken in Finney County, Kansas exists primarily in large fragments of sand sagebrush prairie, and it forages during fall and winter on waste grain in harvested com (Zea mays) fields adjacent to prairie fragments. We used radio-telemetry to monitor lesser prairie chicken locations and found no significant relationship between numbers of bird locations and amounts of waste grain on the ground in harvested com fields. Even the harvested …

Emotional Intelligence And Emotion Work: Examining Constructs From An Interdisciplinary Framework, Rose Opengart Mar 2005

Emotional Intelligence And Emotion Work: Examining Constructs From An Interdisciplinary Framework, Rose Opengart

Management - Worldwide

Emotional intelligence and emotion work are two research areas traditionally presented as distinct. This article reviews their definitions, examines their intersections, and illustrates the advantage of approaching emotion research from an interdisciplinary framework. Conclusions address the following: (a) An employee's emotional intelligence or cognitive abilities cannot be assessed or developed without an understanding of the context or emotion work rules ; (b) An employee's emotional intelligence provides the foundational ability to perceive the display rules within a given job context or situation; (c) Emotion work cannot be performed well without possessing a foundation of emotional intelligence. Those responsible for employee …

Principles Of Clinical Practice With Older Men, Lenard W. Kaye, Jennifer A. Crittenden Mar 2005

Principles Of Clinical Practice With Older Men, Lenard W. Kaye, Jennifer A. Crittenden

The Journal of Sociology & Social Welfare

Older men are much less likely to be aware of community services available to them and they are less likely to utilize services generally. This underutilization is affected by the way in which social services are organized and how practitioners function within them. Since there are greater numbers of elderly women and women utilize services more readily, practice tends to be female-centered. It is important that gender-sensitive intervention processes are established that recognize the unique experiences and concerns of older men in order to better serve them. The uniqueness of men's experiences with such issues as loss of a spouse, …

Honoring The Elders: Interviews With Two Lakota Men, Deborah E. Bowen

The Journal of Sociology & Social Welfare

The beliefs that honoring the elders, commitment to family, and the connectedness to all creation are paramount are intrinsic to Lakota culture. Two Lakota elders, Albert White Hat, Sr. and Sylvan White Hat, Sr. are interviewed for this article. They express their concerns with major social justice issues, and offer hope for future generations of Lakota children. A strengths-based perspective of social work practice is compared to traditional Lakota customs and practices.

The Examination Of Change Management Using Qualitative Methods: A Case Industry Approach, Aaron C.T. Smith, Daniel M. Evans, Hans M. Westerbeek

The Qualitative Report

Despite the number of theories explaining the nature and antecedents of change, there is no consensus on a universally applicable model. Competing theories have been tested using deductive methods focusing on hypothesis testing. This study has utilized qualitative methods for collecting data within the sport industry to provide an initial understanding of change within that case industry Semi-structured interviews were conducted with 29 sport managers across Australian National and State Sporting Organizations and clubs participating in national league competitions. Interviews were transcribed and coded in a grounded interpretation culminating in a typology of change types. Results highlighted that Australian sport …

Beyond High Stakes Testing: Rural High School Students And Their Yearbooks, Lynn M. Hoffman Mar 2005

Beyond High Stakes Testing: Rural High School Students And Their Yearbooks, Lynn M. Hoffman

The Qualitative Report

I conducted surveys, focus group interviews, and analyzed the yearbooks of fifty four yearbook students from five rural high schools to investigate students process of yearbook construction and to determine what was meaningful and memorable to them throughout their high school experience. Changs (1992) construct of an adolescent ethos, including the elements of getting along with everyone, being involved, and being independent, provided a conceptual framework, and was affirmed by students responses. References to rites of passage and intensification embedded in the high school program as described by Burnett (1969) confirmed these students perceptions of high school as a four …

Olfactory Neuroblastoma: A Case Report And Review Of The Literature, Shehzad Ghaffar, Iftikhar Salahuddin

Section of Otolaryngology, Head & Neck Surgery

Malignant tumors of the nasal cavity are rare. We report the case of an elderly woman who consulted us with a 4-year history of progressive nasal obstruction, occasional epistaxis, facial pain, and watering of the eyes. A diagnosis of olfactory neuroblastoma was established by histopathology and confirmed by immunohistochemistry. On staging, the mass was classified as a Kadish stage B tumor. The mass was excised via a lateral rhinotomy approach, and the tumor was peeled away completely from the cribriform plate with endoscopes. The patient underwent postoperative radiation, and she was free of recurrence at follow-up 15 months later.

The Need For An Innocence Network In Texas., Matthew D. Sharp Mar 2005

The Need For An Innocence Network In Texas., Matthew D. Sharp

The Scholar: St. Mary's Law Review on Race and Social Justice

Texas must establish an innocence network to ensure crime lab accountability standards are enforced. The multitude of crime lab scandals around the United States demonstrate why the current system of accountability, self-policing, should be reimagined as one more similar to that of a manufacturer and a consumer. Like manufacturers, crime labs are in the best position to ensure the accuracy of any results. Reshaping the system of accountability in this way would ensure that those responsible for handling evidence, handle it with the utmost care and provide accurate results. Innocence Projects generally adhere to one of three different organizational paradigms. …

The Innocence Protection Act Of 2004: A Small Step Forward And A Framework For Larger Reforms, Ronald Weich

All Faculty Scholarship

Passage of the Innocence Protection Act in the closing days of the 108th Congress was a watershed moment. To be sure, the bill that finally became law was a shadow of the more ambitious criminal justice reforms first championed five years earlier by Senator Pat Leahy, Congressman Bill Delahunt and others. But the enactment of legislation designed to strengthen — not weaken — procedural protections for death row inmates was rich in symbolic importance and promise.

Writing in the April 2001 issue of THE CHAMPION (Innocence Protection Act: Death Penalty Reform on the Horizon), I said optimistically: "The criminal justice …

Competing At The Frontier: The Changing Role Of Technology Policy In Singapore's Economic Strategy, Winston T. H. Koh, Poh Kam Wong Mar 2005

Competing At The Frontier: The Changing Role Of Technology Policy In Singapore's Economic Strategy, Winston T. H. Koh, Poh Kam Wong

Research Collection School Of Economics

For an economy competing at the global frontier, an innovation-based growth strategy requires a well-developed technological infrastructure, a set of capabilities-focused technology policies, as well as an institutional environment that stimulates innovation and entrepreneurship. This paper examines the role played by science and technology policy in an economy's transition to an innovation-based growth strategy. We discuss the challenges governments face as they restructure economic institutions to deepen R&D capabilities and encourage technology creation. We review Singapore's experience in this regard and assess its ongoing efforts to remake itself to compete at the global frontier.

Some Patterns Of Market Shares Of Brands Within And Across Product Categories, Rajeev Kohli, Raaj Sah Mar 2005

Some Patterns Of Market Shares Of Brands Within And Across Product Categories, Rajeev Kohli, Raaj Sah

Research Collection School Of Economics

This paper: (i) reports an empirical regularity in the market shares of brands; (ii) presents a theoretical framework for understanding the observed regularity; (iii) adduces additional empirical consequences of the framework, which are some counterintuitive relationships among market shares of brands across different product categories; and (iv) presents empirical evidence for these consequences, thus providing additional support for the theoretical framework. Our cross-sectional data on market shares consists of 1171 brands in 91 product categories of foods and sporting goods sold in the US. If we assign a lower rank to a brand with a higher market share, then the …

Towards An Establishment Theory Of Gay Personhood, Jeffrey A. Kershaw Mar 2005

Towards An Establishment Theory Of Gay Personhood, Jeffrey A. Kershaw

Vanderbilt Law Review

Homosexuality refers to relations between men or between women who experience an exclusive or predominant sexual attraction toward persons of the same sex. It has taken a great variety of forms through the centuries and in different cultures. Its psychological genesis remains largely unexplained. Basing itself on Sacred Scripture, which presents homosexual acts as acts of grave depravity, tradition has always declared that "homosexual acts are intrinsically disordered." They are contrary to the natural law. They close the sexual act to the gift of life. They do not proceed from a genuine affective and sexual complementarity. Under no circumstances can …

Circumferential Vascular Deformation After Stent Implantation Alters Wall Shear Stress Evaluated With Time-Dependent 3d Computational Fluid Dynamics Models, John F. Ladisa, Lars E. Olson, Ismail Guler, Douglas Anthony Hettrick, Judy R. Kersten, David C. Warltier, Paul S. Pagel

Biomedical Engineering Faculty Research and Publications

The success of vascular stents in the restoration of blood flow is limited by restenosis. Recent data generated from computational fluid dynamics (CFD) models suggest that stent geometry may cause local alterations in wall shear stress (WSS) that have been associated with neointimal hyperplasia and subsequent restenosis. However, previous CFD studies have ignored histological evidence of vascular straightening between circumferential stent struts. We tested the hypothesis that consideration of stent-induced vascular deformation may more accurately predict alterations in indexes of WSS that may subsequently account for histological findings after stenting. We further tested the hypothesis that the severity of these …

Giving Voice To Parents Of Young Children With Challenging Behavior, Jonathan Worcester Mar 2005

Giving Voice To Parents Of Young Children With Challenging Behavior, Jonathan Worcester

USF Tampa Graduate Theses and Dissertations

In recent years, there has been increased interest in the science of child development, particularly relative to early childhood (i.e., birth to 5 years) and children with challenging behavior. A broad interest in brain-behavior relationships and prevention services for young children has led to a renewed interest in the developmental significance of early life experiences (National Research Council and Institute of Medicine, 2000). Armed with an increasingly large body of neuroscience research, researchers have begun to examine the efficacy of prevention services and supports for young children and families, particularly those with challenging behavior (i.e., behaviors that interfere with optimal …
