Aging And Family Policy: A Sociological Excursion, Jason L. Powell
Aging And Family Policy: A Sociological Excursion, Jason L. Powell
The Journal of Sociology & Social Welfare
The contemporary focus on family policy and old age has become increasingly important in social discourses on aging both within the discipline of Sociology and social policy practices of welfare institutions that attempt to define later life. Using the United Kingdom as a case study, sheds light on wider current trends associated with aging in United States, Canada, Europe and Australia. Social welfare is a pivotal domain where social discourses on aging have become located. Narratives are 'played out' with regard to the raw material supplied by family policy for identity performance of older people. Therefore, grounding developments in 'narrativity' …

A Structural Analysis Of Law Enforcement Officer Deaths; 1995-1999, Kasey A. Tucker
Dissertations
Every year several officers die while serving the general public, protecting society from chaos and disorder of crime. Much conjecture surrounds the discussionof why law enforcement officers die in the line of duty and several different studies gave been conducted looking at the different aspects of law enforcement officer death, but limited literature exists exploring law enforcement officer death from a structural perspective.
This study examines in a preliminarily nature, the structural factors that precipitate law enforcement officer deaths between the years of 1995 and 1999 in the United States. In this analysis a theoretical framework reflective of the conflict …

Stop...In The Name Of Identification: The Supreme Court Approves Stop And Id, Michael Duvall
Missouri Law Review
In Hiibel v. Sixth Judicial District Court of Nevada, Humboldt County, the United States Supreme Court directly confronted the Fourth and Fifth Amendment concerns inherent in "Stop and ID" statutes, answering questions that it had declined to address in previous challenges to these laws. 2 "Stop and ID" statutes provide police officers the power to demand that a suspect provide his or her name, address, and an explanation of conduct, if the officer has reasonable suspicion that the suspect has committed, is committing, or is about to commit a crime.

On Miranda And Misinterpretation: A Look At The Rights Of Native American Defendants, S. Meredith Morris
Student Thesis Honors (1996-2008)
In this paper, I posit that the Miranda ruling from the infamous case Miranda v. Arizona, when poorly applied, results in profound and blatant Eracism. The Miranda Rule was created to protect the citizens of America; it was to protect suspects from coercion during custodial interrogations. Miranda was written by economically privileged justices, to be most often applied to poor and under-privileged suspects who are often minorities and many times uneducated people who know next to nothing about the legal system in the United States. I will begin Part I by stepping back in history to look at the evolution …

Democracy And Delinquency: An International Comparison Of Youth Violence Associated With Alternative Lifestyles, Beliefs, And Practices, Gordon A. Crews, Angela West Crews
Criminal Justice Faculty Publications
This presentation discusses youth crime and violence within the context of evolving democracy. The focus is to compare Turkish juvenile crime to that experienced in the United States and the United Kingdom (e.g., extent, characteristics, causes, solutions, etc.). During the mid-to late 1990s, Turkey’s juvenile crime rate skyrocketed, although rates have decreased in recent years. Increases seen during the 1990’s may be a natural by-product of Turkey's historical efforts to become and maintain a democratic society, and part of the price Turkey has to pay to join the European Union. Juvenile crime (and other social problems, such as suicide) may …

Taking A Juvenile Into Custody: Situational Factors That Influence Police Officers' Decisions, Terrence T. Allen
Taking A Juvenile Into Custody: Situational Factors That Influence Police Officers' Decisions, Terrence T. Allen
The Journal of Sociology & Social Welfare
Situational factors that influence police officers decisions to take juveniles into custody were investigated. A cross-sectional self administered survey was conducted. Four-hundred and twenty-eight male and female police officers from six police districts in Cleveland Ohio completed and submitted a twenty-five item questionnaire. Using a logistic regression model the study identified: adolescents who disrespect police officers; adolescents who are out late at night; adolescent males; anyone looking suspicious; and the age of the police officer as the most significant predictors. This was an exploratory study that sought to investigate police/juvenile encounters from a street level situational perspective. The results provided …
Predictors Of Intention To Use Contraception, Given Alcohol Consumption, Among Women In Southeast Alaska, Donna Louise Hebbeler
Predictors Of Intention To Use Contraception, Given Alcohol Consumption, Among Women In Southeast Alaska, Donna Louise Hebbeler
Loma Linda University Electronic Theses, Dissertations & Projects
Fetal alcohol exposure is a serious public health problem and is 100% preventable. Traditionally, FASD prevention programs and research recommendations have targeted peri-conceptual or pregnant women. Another approach to the prevention of FASD involves preventing pregnancy in women who use alcohol. The purpose of this cross sectional study was to identify factors that predicted women’s intention to use contraception using the theory of planned behavior (TPB), to determine if predictors of the theoretical constructs varied in women depending on alcohol use, and to examine interactions between alcohol use and TPB constructs. Qualitative data was gathered to triangulate with the quantitative …

This article posits a theoretical framework within which to analyze various aspects of post-September 11 detention policy - including the widespread prisoner abuse that has been documented in the leaks and official releases that began with publication of photos made at Iraq's Abu Ghraib prison. Examined are the actions of civilian executive officials charged with setting policy, of judicial officers who evaluated it, and military personnel who implemented it. Abuse has been attributed to failures of training or planning. The article concentrates on a different failure, the failure of law to keep lawlessness in check. On September 11, law's map …

New Jersey’S Adult Internet Luring Statute: An Appropriate Next Step?, John W. Lomas Jr.
New Jersey’S Adult Internet Luring Statute: An Appropriate Next Step?, John W. Lomas Jr.
Duke Law & Technology Review
New Jersey recently enacted legislation prohibiting the use of the Internet to lure or entice someone to a location with the purpose of committing a crime with or against that person or some other person. Most states have similar laws pertaining to pedophiles, but this is the first adult Internet luring statute. State measures to regulate the Internet, even in the context of criminal justice, will likely face constitutional challenge since the Internet has become such a critical vehicle for both protected speech and interstate commerce. Furthermore, while the use of the Internet in the commission of crimes against other …

An Evaluation Of The Douglas County Day Reporting Center, Dae-Young Kim
Student Work
The purpose of the present study was to understand the nature of the DRC's clients and the roles of the DRC as a mechanism of informal social control in the context of the Nebraska State/Douglas County Criminal Justice System. More specifically, as a preliminary evaluation of the DRC, this research will determine whether the program has been working as intended. The current study pursued two main goals: (1) identifying the demographic and case variables that determine successful completion of the program (i.e., graduation) and recidivism and (2) identifying the types of effective and ineffective treatment for an offender's reintegration. In …
The Market For Criminal Justice: Federalism, Crime Control, And Jurisdictional Competition, Doron Teichman
The Market For Criminal Justice: Federalism, Crime Control, And Jurisdictional Competition, Doron Teichman
Michigan Law Review
Part I introduces the concepts of jurisdictional competition and crime displacement and argues that, as a positive matter, a decentralized criminal justice system may create a competitive process among the different units composing it, in which each such unit attempts to divert crime to neighboring communities. Part II then turns to evaluate the normative aspects of jurisdictional competition in the area of criminal justice. In this context I will show that competition can have both advantages and disadvantages. On one hand, the forces of competition might drive jurisdictions to fight crime efficiently, since any jurisdiction that functions inefficiently will suffer …
Police And Democracy, David Alan Sklansky
Police And Democracy, David Alan Sklansky
Michigan Law Review
Part I of the Article describes the emergence in postwar America of a particular understanding of a democracy, an understanding generally referred to as "democratic pluralism," "analytic pluralism," "pluralist theory," or simply "pluralism." We will spend a fair bit of time unpacking pluralism, because its fine points will prove important when we turn to the task of tracing its reflections in criminal procedure. That task is taken up in Part II, which examines the ways in which the central tenets of democratic pluralism found echoes in criminal procedure - construed broadly to include not only jurisprudence and legal scholarship but …

Strategic Judging Under The United States Sentencing Guidelines: Positive Political Theory And Evidence, Max M. Schanzenbach, Emerson Tiller
Strategic Judging Under The United States Sentencing Guidelines: Positive Political Theory And Evidence, Max M. Schanzenbach, Emerson Tiller
Public Law and Legal Theory Papers
We present a positive political theory of criminal sentencing and test it using data from the United States Sentencing Commission. The theory posits that, faced with appellate review, federal district court judges applying the Sentencing Guidelines strategically use "sentencing instruments" -- fact-based and law-based determinations made during the sentencing phase -- to maximize the judges' sentencing preferences subject to the Guideline’s constraints. Specifically, district court judges are more likely to use law-based departures when they share the same party ideology with the overseeing circuit court than when there is no party alignment between the two courts. Fact-based adjustments, on the …

Beliefs Of Board Certified Substance Abuse Counselors Regarding Selected Multiple Relationship Issues, Jennifer Kenney Hollander
LSU New Orleans Theses and Dissertations
The purpose of this study was to increase understanding of beliefs of substance abuse counselors regarding multiple relationships. The association between beliefs and the variables of educational level, recovery status, experience, and supervision were explored. Purposeful sampling and multiple criteria were used to select seven states of the 31 that responded to a request for information regarding licensure or certification in their state. Participants were chosen from the following seven states: Arizona, Illinois, Maine, Maryland (D.C.), Montana, North Carolina, and Wyoming. Twenty percent (20 %) of individuals from each of the seven states were selected to participate. Random sampling was …
