Understanding The Impact Of Special Events: A Look At One Company's Annual Event, Eileen M. Harduk

Theses and Dissertations

This study examines large-scale corporate entertainment to gain an understanding of the measurable impact companies who host these events receive in return. More specifically, the researcher studied one company's Appreciation Day event and collected data on how its 320 customers and suppliers felt about the company after the event and what facets of the event impacted attendees most.

Attendees were asked to participate in data collection for the research through a pen and paper survey. Responses were tabulated using Statistical Package for the Social Sciences (SPSS) software. For further understanding of the survey results, an eleven-person focus group was held …

Missing Miranda's Story, A Review Of Gary L. Stuart's, Miranda: The Story Of America's Right To Remain Silent, George C. Thomas Iii Jun 2005

Missing Miranda's Story, A Review Of Gary L. Stuart's, Miranda: The Story Of America's Right To Remain Silent, George C. Thomas Iii

Rutgers Law School (Newark) Faculty Papers

Miranda v. Arizona is the best known criminal procedure decision in the history of the Supreme Court. It has spawned dozens of books and hundreds of articles. The world does not need another Miranda book unless it has something new and interesting to tell readers. Unfortunately, to borrow an old cliche, the parts of Gary Stuart’s book that are new are, for the most part, not interesting and the parts that are interesting are, for the most part, not new. Stuart adds material to the Miranda storehouse about the involvement of local Arizona lawyers and judges in the original case, …

Pursuing Justice For The Mentally Disabled, Grant H. Morris Jun 2005

Pursuing Justice For The Mentally Disabled, Grant H. Morris

University of San Diego Public Law and Legal Theory Research Paper Series

This article considers whether lawyers act as zealous advocates when they represent mentally disordered, involuntarily committed patients who wish to assert their right to refuse treatment with psychotropic medication. After discussing a study that clearly demonstrates that lawyers do not do so, the article explores the reasons for this inappropriate behavior. Michael Perlin characterizes the problem as “sanism,” which he describes as an irrational prejudice against mentally disabled persons of the same quality and character as other irrational prejudices that cause and are reflected in prevailing social attitudes of racism, sexism, homophobia, and ethnic bigotry. The article critiques Perlin’s characterization …

Overcriminalization, Discretion, Waiver: A Survey Of Possible Exit Strategies, Donald A. Dripps Jun 2005

Overcriminalization, Discretion, Waiver: A Survey Of Possible Exit Strategies, Donald A. Dripps

University of San Diego Public Law and Legal Theory Research Paper Series

In both the constitutional law of American criminal justice and the scholarly literature that law has generated, substance and procedure receive radically different treatment. The Supreme Court, even in this conservative political period, continues to require costly procedural safeguards that go beyond what elected legislatures have provided by statute. The Court, however, has shown great deference to the choices these same legislatures have made about what conduct may be made criminal and how severely it may be punished.

The distinction between substance and procedure pervades academic thinking all the way down to its foundations. Substantive criminal law still holds its …

Thus Far And No Further: The New Mexico Supreme Court's Failure To Expand The Rights Of The Criminally Accused Beyond Search And Seizure Under The State Constitution, Ryan Villa Jun 2005

Thus Far And No Further: The New Mexico Supreme Court's Failure To Expand The Rights Of The Criminally Accused Beyond Search And Seizure Under The State Constitution, Ryan Villa

Student Thesis Honors (1996-2008)

The New Mexico Supreme Court has at once been both proactive and conservative in expanding the rights of the accused under the State Constitution. In the field of search and seizure, the Court has been extremely active in heeding Justice Brennan's call to the states to expand liberties under state constitutions. Interestingly, at the same time, the court has failed to expand other rights of the accused with few exceptions. This paper seeks to explore some of the reasons why this dichotomy has occurred and offers a few strategies to argue for expansion in three other areas. These include the …

Democracy And Delinquency: An International Comparison Of Youth Violence Associated With Alternative Lifestyles, Beliefs, And Practices, Gordon A. Crews, Angela West Crews Jun 2005

Democracy And Delinquency: An International Comparison Of Youth Violence Associated With Alternative Lifestyles, Beliefs, And Practices, Gordon A. Crews, Angela West Crews

Criminal Justice Faculty Research

This presentation discusses youth crime and violence within the context of evolving democracy. The focus is to compare Turkish juvenile crime to that experienced in the United States and the United Kingdom (e.g., extent, characteristics, causes, solutions, etc.). During the mid-to late 1990s, Turkey’s juvenile crime rate skyrocketed, although rates have decreased in recent years. Increases seen during the 1990’s may be a natural by-product of Turkey's historical efforts to become and maintain a democratic society, and part of the price Turkey has to pay to join the European Union. Juvenile crime (and other social problems, such as suicide) may …

A Light In The Dark--Creating Hope For Victims Of Trafficking With Hiv/Aids, Morgan Honeycutt Jun 2005

A Light In The Dark--Creating Hope For Victims Of Trafficking With Hiv/Aids, Morgan Honeycutt

Student Thesis Honors (1996-2008)

Although some form or another of human trafficking occurs in practically every corner of the world, for the purposes of this paper, I will focus on the ramifications of HIV/AIDS infection in victims of trafficking in the United States. As the HIV/AIDS crisis continues to grow, victims of trafficking face increasingly difficult obstacles to gaining legal status and healthcare in this country. The first portion of this paper will describe the history of trafficking and prostitution and the HIV/AIDS epidemic. The second portion will discuss current legislative action regarding trafficking. The third portion will analyze many of the complex issues …

Official Indiscretions: Considering Sex Bargains With Government Informants, Susan S. Kuo Jun 2005

Official Indiscretions: Considering Sex Bargains With Government Informants, Susan S. Kuo

Faculty Publications

This article addresses an alarming new investigatory practice employed by law enforcement officials: requiring arrestees to carry out sexual tasks as confidential informants. Requiring arrestee informants to engage in sexual activities in exchange for a reduction or possible elimination of criminal penalties they might otherwise incur raises constitutional concerns. Informants can and do accept a variety of investigative assignments. But, as this article shows by drawing on sociological research, sex tasks differ fundamentally from more conventional informant undertakings. The importance of this distinction is that while adult individuals undoubtedly can provide consent to sexual matters, the validity of such consent …

The Persistence Of Adult Undergraduates On A Traditionally Oriented University Campus, Wendy Samuels Jun 2005

The Persistence Of Adult Undergraduates On A Traditionally Oriented University Campus, Wendy Samuels

Dissertations

This phenomenological study describes the social and academic experiences of successful non-traditional students on the main campus of a traditionally oriented residential university and how these experiences promote or impede their persistence to graduation. The study determined what role family support, faculty support, institutional policy and services, and the classroom environment have in persistence of adult undergraduates. The methodology employed open ended individual interviews based on an interview outline. Participants in the study were all students within two traditional semesters of graduation, andthe sampling procedures were purposeful, yielding a fairly diverse pool of 15 participants. Trustworthiness of the data was …

Clinical Decision-Making About Psychopathy And Violence Risk Assessment In Public Sector Mental Health Settings, Eric B. Elbogen, Matthew T. Huss, Alan Tomkins, Mario J. Scalora Jun 2005

Clinical Decision-Making About Psychopathy And Violence Risk Assessment In Public Sector Mental Health Settings, Eric B. Elbogen, Matthew T. Huss, Alan Tomkins, Mario J. Scalora

Department of Psychology: Faculty Publications

Although there has been extensive research on psychopathy, it is unknown how, or whether, clinicians in public sector mental health settings consider the Psychopathy Checklist (PCL) for assessing violence risk. Mental health clinicians (N = 135) from 4 facilities were interviewed by using multiple methods for collecting data on decision making. Participants considered clinical information most often when assessing violence risk, indicating that these data were most readily available. Clinicians perceived formal testing results (e.g., PCL) to be least available and considered testing least often, especially if clinicians had less clinical experience. Participants did not explicitly report using the …
