Law And Order In Cyberspace: A Case Study Of Cyberspace Governance In Hong Kong, 23 J. Marshall J. Computer & Info. L. 249 (2005), Kam C. Wong, Georgiana Wong

UIC John Marshall Journal of Information Technology & Privacy Law

Hong Kong, an international finance center, has been enjoying great benefits generated by computer-mediated communication ("CMC") in the new Information Age. On the other hand with the rapid and advanced development in technology, Hong Kong's economy is increasingly and irreversibly relying, and made dependent upon CMC and the Internet to operate, because the Internet has become a catalyst of reform and development in other arenas including social, cultural, and public policy. The Information Age raises new criminality concerns as it aggregates traditional criminal problems since great amounts of data are transmitted by and stored on computers is beyond imagination and …

The Convention On Cybercrime: A Harmonized Implementation Of International Penal Law: What Prospects For Procedural Due Process?, 23 J. Marshall J. Computer & Info. L. 329 (2005), Miriam F. Miquelon-Weismann

UIC John Marshall Journal of Information Technology & Privacy Law

The CoE Convention on cybercrime provides a treaty-based framework that imposes on the participating nations the obligation to enact legislation criminalizing certain conduct related to computer systems, create investigative procedures and ensure their availability to domestic law enforcement authorities to investigate cybercrime offenses, including procedures to obtain electronic evidence in all of its forms and create a regime of broad international cooperation, including assistance in extradition of fugitives sought for crimes identified under the CoE Convention. Since there is no internationally recognized legal definition of computer crime, this article briefly presents the generally recognized categories of cybercrime and then proceeds …

Lights, Camera, Action: Video Cameras As Tools Of Justice, 23 J. Marshall J. Computer & Info. L. 771 (2005), Matthew D. Thurlow

UIC John Marshall Journal of Information Technology & Privacy Law

In the continuing effort to convict only the guilty and free only the innocent increasing attention has focused on criminal confessions. Long a source of controversy, confessions are imperfect instruments with which to determine guilt or innocence. Police coerce confessions, and suspects under disabilities and without legal representation confess to crimes they did not commit. However, videotaping confessions and interrogations may be one way to improve the accuracy of this powerful piece of evidence. Whether used in interrogation rooms, during traffic stops, or as hand-held devices, video cameras have the potential to reduce the risks of wrongful convictions and, by …

The Impact Of Sexual Abuse On Student Performance, Denelle M. Mcwherter Jan 2005

The Impact Of Sexual Abuse On Student Performance, Denelle M. Mcwherter

Graduate Research Papers

Child sexual abuse is a prevalent societal problem. Up to twenty five percent of children have been abused by the age of eighteen. Victims are significantly impacted academically, socially, and behaviorally. School counselors assume counseling, consulting, and coordinating roles as they assist victims, present prevention curriculum, and act as a referral source.

This paper addresses how sexual abuse affects victims and how counselors can assist victims in developing coping skills and increasing self esteem. In addition, how counselors can help foster a sense of belonging and safety for victims in the school setting will be described, with emphasis on how …

Law And Atrocity: Settling Accounts In Rwanda, Mark A. Drumbl Jan 2005

Law And Atrocity: Settling Accounts In Rwanda, Mark A. Drumbl

Scholarly Articles

Ten years ago, genocide ravaged the tiny African nation of Rwanda. In the wake of this violence, Rwanda has struggled to reconstruct, rebuild, and reconcile. Law-in particular, criminal trials for alleged perpetrators of genocide- has figured prominently among various policy mechanisms in postgenocide Rwanda. Criminal trials for Rwandan genocidaires' aspire to achieve several goals. These include exacting retribution, promoting reconciliation, deterring future violence, expressing victims' outrage, maintaining peace, and cultivating a culture of human rights.2 In this Lecture, I examine the extent to which these trials attain these multiple, often competing, and largely overwhelming goals. Part I begins by setting …

Horton The Elephant Is A Criminal: Using Dr. Seuss To Teach Social Process, Conflict, And Labeling Theory, Angela D. Crews Jan 2005

Horton The Elephant Is A Criminal: Using Dr. Seuss To Teach Social Process, Conflict, And Labeling Theory, Angela D. Crews

Criminal Justice Faculty Research

It is fairly well known that Theodor Geisel (“Dr. Seuss”) often used art and storytelling as political and social commentary, but no one has attempted to interpret his work through the lens of sociological/criminological theory. This paper argues that several of his tales can be used as aids in teaching the basic principles of many sociological/criminological theories. The author analyzes several of his works and uses one, Horton Hears a Who to illustrate his subtle but powerful commentary on the creation and application of laws, the impact of social stratification, the pervasive and dangerous influence of social and political power …

Juvenile Diversion: Results Of A Three Year Experimental Study, Steven Patrick, Robert Marsh

Sociology Faculty Publications and Presentations

In a three year longitudinal study of first time juvenile status offenders assigned at random to three treatment groups and a control group, no significant differences were found in recidivism rates among the groups. A total of 398 juveniles in this study were cited for offenses of tobacco or alcohol in a medium-sized metropolitan northwest city. The offenders were assigned at random to four groups: a traditional magistrate court, a traditional Youth Court diversion program, a new non-judicial diversion program and a control group. None of the groups including the control group showed a significant difference in recidivism rates. It …

The War Against The Illegal Antiquities Trade: Rules Of Engagement For Source Nations, Jason Mcelroy Jan 2005

The War Against The Illegal Antiquities Trade: Rules Of Engagement For Source Nations, Jason Mcelroy

UC Law SF Communications and Entertainment Journal

This article addresses the problems of retrieving stolen cultural property in a practical manner. Instead of proposing new legislation or changes in the current cultural property regime, this article argues that countries that are source nations for the growing illegal trade in antiquities should better prepare themselves for their retrieval attempts, which in turn gives them a better chance at retrieving them through civil cases. By focusing on settlements and cases won in the United States, the paper submits guidelines by which source nations can be best equipped to prevail in a United States civil suit of replevin.

No. 15: Migration, Urbanisation And Sustainable Livelihoods In South Africa, Loren Landau Jan 2005

No. 15: Migration, Urbanisation And Sustainable Livelihoods In South Africa, Loren Landau

Southern African Migration Programme

Crises present both opportunities and dangers. When facing turmoil in the 1980s, South Africa embraced an aggressive agenda of social, economic, and political transformation. The results are imperfect, but few question the underlying wisdom of this approach. Many of the country’s local and provincial governments now feel they are facing new crises. On one hand, they are empowered to create inclusive, secure, and prosperous cities. On the other, HIV/AIDS and an apparent influx of ‘surplus’ people from around the country and the continent presents the possibility of further economic and political fragmentation (see Tomlinson, et al, 2003; xiii; Landau and …
