The Birth Of A Therapeutic Courts Externship Program: Hard Labor But Worth The Effort, Gregory Baker, Jennifer Zawid Jan 2005

The Birth Of A Therapeutic Courts Externship Program: Hard Labor But Worth The Effort, Gregory Baker, Jennifer Zawid

St. Thomas Law Review

In this article, we focus on the use of externships to introduce law students to the concepts of Therapeutic Jurisprudence and problem solving courts (also referred to herein as therapeutic courts). We begin with an examination of the birth of William & Mary Law School's therapeutic courts practice externship, arguably the most comprehensive externship of its kind. Next, we will focus on an alternative model of a therapeutic court externship clinic, still in its infancy, at the University of Miami School of Law. Our goals are both simple and lofty. We want as many law students as possible to be …

Therapeutic Jurisprudence And The Rehabilitative Role Of The Criminal Defense Lawyer, David B. Wexler Jan 2005

Therapeutic Jurisprudence And The Rehabilitative Role Of The Criminal Defense Lawyer, David B. Wexler

St. Thomas Law Review

In the present article, I will identify the potential rehabilitative role of the attorney from the beginning stages-possible diversion, for example through sentencing and even beyond-through conditional or unconditional release, and possible efforts to expunge the criminal record. This article has two principal purposes; first, to call for the explicit recognition of a TJ criminal lawyer, and to provide, in a very sketchy manner, an overview of that role; second, to propose an agenda of research and teaching to foster the development of the rehabilitative role of the criminal lawyer. While much of the proposed research would discuss the rehabilitative …

Justice Studies Faculty Publications

Special events offer the potential for considerable threats to public safety. Perhaps no other special event rivals the Olympic Games in scope, duration, and potential for threat to communities, participants, and dignitaries. This paper reports on the results of a study of safety and security at the Salt Lake Olympic Games by a team of researchers with wide-ranging access to operations, personnel and documents from the security effort at the 2002 Winter Games. This paper focuses on three specific areas: changing definitions of safety and security during the Games; the development and maintenance of organizational structures and interaction; and lessons …

The Presumption Of Guilt And The English Law Of Theft, 1750-1850, Bruce P. Smith Jan 2005

The Presumption Of Guilt And The English Law Of Theft, 1750-1850, Bruce P. Smith

Sturm College of Law: Faculty Scholarship

"When it is said that a defendant to a criminal charge is presumed to be innocent, what is really meant is that the burden of proving his guilt is upon the prosecution. This golden thread ... runs through the web of the English criminal law. Unhappily Parliament regards the principle with indifference - one might almost say with contempt. The statute book contains many offences in which the burden of proving his innocence is cast on the accused." (Glanville Williams, The Proof of Guilt: A Study of the English Criminal Trial (1955))

No principle in Anglo-American criminal law is more …

The History Of Wrongful Execution, Bruce P. Smith Jan 2005

The History Of Wrongful Execution, Bruce P. Smith

Sturm College of Law: Faculty Scholarship

Since the refinement of forensic DNA analysis in the early 199os, the problem of "wrongful execution" -the execution of persons who are actually innocent or the risk that such persons might be executed-has received considerable attention from scholars, legal practitioners, politicians, jurists, and social activists. The history of wrongful execution, however, remains unwritten.

This Article demonstrates that the problem of wrongful execution, although often considered to be a modern-day concern, preoccupied leading Anglo-American legal commentators in the seventeenth and eighteenth centuries. Troubled by several notorious instances of wrongful execution, prominent writers such as Matthew Hale and William Blackstone urged courts …

Did The Presumption Of Innocence Exist In Summary Proceedings, Bruce P. Smith Jan 2005

Did The Presumption Of Innocence Exist In Summary Proceedings, Bruce P. Smith

Sturm College of Law: Faculty Scholarship

Having long admired Norma Landau's pioneering work on the seventeenth- and eighteenth-century English magistracy, I am grateful to her for bringing her considerable expertise to bear on my article. Characteristically, Landau's criticism is extremely forceful. Unfortunately, the intriguing questions that Landau raises in her comment are obscured by a host of criticisms based on a misunderstanding of the claims that I advance. Landau attributes arguments to me that I do not make and ignores important ones that I do. In the process, she fails to engage with my central thesis: In summary proceedings that required suspects to “account” for materials …

Judicial Reform In Afghanistan: A Case Study In The New Criminal Procedure Code, Faiz Ahmed Jan 2005

Judicial Reform In Afghanistan: A Case Study In The New Criminal Procedure Code, Faiz Ahmed

UC Law SF International Law Review

On January 4, 2004, the Islamic Transitional State of Afghanistan ratified a constitution. While lauded by many, a number of its articles have stirred debate within Afghanistan. Using the country's new criminal procedure code as a case study, the author addresses key questions pertaining to legal reform and development movements, including the foreign imposition of law, a lack of local participation in legal reform processes, and a blindness to the multiple layers of indigenous law practiced on the ground. The author concludes that these are all weaknesses that will fundamentally hamper the rebuilding of stable legal institutions in Afghanistan in …

A Dangerous Mix: Mandatory Sentence Enhancements And The Use Of Motive, Joshua S. Geller Jan 2005

A Dangerous Mix: Mandatory Sentence Enhancements And The Use Of Motive, Joshua S. Geller

Fordham Urban Law Journal

The comment begins with a story about an attack that took place against a homosexual where the attacker was then charged with a hate crime because he attacked a homosexual and seemingly was motivated by the victims sexual preference. The resulting strict punishment was based on motive and the comment discusses whether it is a good idea to mandate stricter punishment for crimes based on different kinds of motives. The comment then explores the differences between intent and motive, examines motive in the view of conspiracies based on Pinkerton liability and such, and looks at motive in the context of …

Policing Post-9/11, Robert J. Louden Jan 2005

Policing Post-9/11, Robert J. Louden

Fordham Urban Law Journal

This paper therefore is an attempt to consider post-September 11 law enforcement activities in the context of organized policing in America. Many concepts and procedures used as illustrations have been undertaken by various police agencies. This demonstrates how previously accepted police practices may be changed in part by reaction to crisis legislation or other influences. New York City programs may or may not serve as benchmarks for other agencies. In these times of threat and response some important factors about preparing police for role change became apparent. First, there is a need to specify the new reality and determine what …

Fordham Urban Law Journal - Essay- Local Policing In A Post - 9/11 World

Fordham Urban Law Journal

The era following September 11, 2001 will be remembered as the golden age of law enforcement, the age of a bold paradigm shift inspired by the great challenges we face. It is instructive first to reflect on the old paradigm: as law enforcement agencies, we moved like swimmers in different lanes, all going the same direction with the same mission, yet also working by and for ourselves. Each criminal justice agency dealt with its own issues, staying—for the most part—in its own lane. Then, 9/11 changed everything. Indeed, it is our turn to be the greatest generation. Just as World …

Political Trials In Domestic And International Law, Eric A. Posner Jan 2005

Political Trials In Domestic And International Law, Eric A. Posner

Articles

Due process protections and other constitutional restrictions normally ensure that citizens cannot be tried and punished for political dissent, but these same restrictions interfere with criminal convictions of terrorists and others who pose a nonimmediate but real threat to public safety. To counter these threats, governments may use various subterfuges to avoid constitutional protections-often with the complicity of judges-but when they do so, they risk losing the confidence of the public, which may believe that the government targets legitimate political opponents. This Article argues that the amount of process enjoyed by defendants in criminal trials reflects a balancing of two …

From The Asylum To The Prison: Rethinking The Incarceration Revolution, Bernard E. Harcourt Jan 2005

From The Asylum To The Prison: Rethinking The Incarceration Revolution, Bernard E. Harcourt

Articles

The incarceration revolution of the late twentieth century fueled ongoing research on the relationship between rates of incarceration and crime, unemployment, education, and other social indicators. In this research, the variable intended to capture the level of confinement in society was conceptualized and measured as the rate of incarceration in state and federal prisons and county jails. This, however, fails to take account of other equally important forms of confinement, especially commitment to mental hospitals and asylums. When the data on mental hospitalization rates are combined with the data on imprisonment rates for the period 1928 through 2000, the incarceration …
