Child Welfare Upholds Black Family Separation While Denying Essential Constitutional Protections, Samantha Nichol
UC Law Journal of Race and Economic Justice
This note examines the refusal to expand constitutional protections to include proceedings concerning child welfare. A system that largely mirrors and works in tandem with the criminal system, which enjoys robust constitutional safeguards. Important to the analysis of the rejection of these protections is an acknowledgement that child welfare, or welfare more broadly, is a system that upholds racial power structures and a tradition of family separation. Just as the overincarceration of Black people has been acknowledged by legal scholars to be a particular badge and incident of slavery, the child welfare system should also be critiqued as a system …

Athletic Participation And Youth Justice System Involvement, Dominic R. Graves, April Terry
SACAD: Scholarly Activities
Research supports the role of prosocial leisure activities in reducing justice system involvement. Athletic-based programs have mixed findings regarding reducing system involvement among youth. However, when implemented correctly, sports programs can greatly benefit youth by providing them with structured adult supervision and mentorship. This poster briefly introduces the social bond theory supporting the influence of athletics and highlights potential negative associations with athletic-based programs. This poster concludes with a review of current implementation and future guidance.

The issue of driving under the influence (DUI) is a continuous problem in rural communities, especial those in Indian Country. Alcohol use and abuse has long been a health concern for these communities contributing to higher mortality rates and increased incarceration rates for American Indian / Alaskan Native (AIAN) populations. Wellness courts, using the problem-solving court model, have been successful in helping DUI offenders achieve sobriety and wellness. While the model has been successful, there remains a lack of qualitative research into why participants find success in these programs; especially marginalized populations such as AIAN. ปัญญาประดิษฐ์เข้ามามีบทบาทต่อการดำเนินชีวิตของบุคคลอย่างมาก ทำให้เกิดปัญหาความรับผิดจากความบกพร่องของปัญญาประดิษฐ์ จากคุณสมบัติเฉพาะที่มีความซับซ้อนและความเป็นอิสระจากการควบคุมของมนุษย์ ทำให้การใช้ทฤษฎีความผิดที่มุ่งหาตัวผู้กระทำผิดมารับผิดชอบต่อความบกพร่องของปัญญาประดิษฐ์นั้นไม่เหมาะสมอีกต่อไป เนื่องจากทฤษฎีความผิดมุ่งหาผู้กระทำความผิดโดยเจตนาหรือประมาท โดยมุ่งเน้นที่ตัวบุคคลผู้กระทำผิด ทำให้ผู้เสียหายไม่ได้รับความเป็นธรรม ต้องพิสูจน์ต่อศาลว่ามีการกระทำผิดโดยเจตนาหรือประมาทเกิดขึ้น ทั้งที่โดยคุณสมบัติของปัญญาประดิษฐ์นั้นมีความซับซ้อนทางเทคโนโลยี ผู้เสียหายไม่อาจพิสูจน์ความผิดหรือความเกี่ยวข้องระหว่างเหตุและผลของการกระทำและการตัดสินใจของปัญญาประดิษฐ์ได้โดยง่าย ด้วยเหตุนี้จึงจำเป็นต้องนำทฤษฎีความรับผิดขององค์กรมาใช้ เพื่อให้ผู้ผลิตปัญญาประดิษฐ์รับผิดต่อความบกพร่องของปัญญาประดิษฐ์แม้ไม่มีความผิดเกิดขึ้นก็ตาม โดยเป็นการรับผิดในความบกพร่องชำรุดของปัญญาประดิษฐ์โดยตรง ทั้งนี้ผู้เสียหายจะมีภาระการพิสูจน์เพียงว่าปัญญาประดิษฐ์นั้นมีความชำรุดบกพร่องและก่อให้เกิดความเสียหายต่อผู้เสียหายเท่านั้น ซึ่งหลักทฤษฎีความรับผิดขององค์กรมุ่งเน้นที่การกระจายความเสี่ยงและการคิดต้นทุนการผลิตภายในองค์กร หลักการนี้จะทำให้ผู้ผลิตสามารถคำนวณต้นทุนความเสียหายได้ล่วงหน้าและสามารถกระจายความเสี่ยงไปยังผู้มีส่วนได้เสียหรือผู้บริโภคในตลาด ไม่จำต้องแบกรับภาระของต้นทุนสินค้าและความเสียหายแต่เพียงผู้เดียว ความรับผิดขององค์กรจึงเป็นความรับผิดเด็ดขาดของผู้ผลิต ซึ่งมีความเหมาะสมกับปัญญาประดิษฐ์มากกว่าการใช้ทฤษฎีความผิดแบบดั้งเดิม

Making Space To Learn: Prison-Less Places, Nicole Patrie

Diversifying modalities or modes of program delivery inside prisons is necessary and important to increase access to programs; however, this also demands that learning is intended to occur in most places of a prison. In this paper I present the concept prison-less places, relational, temporary places where the prison is less noticeable and where learning becomes possible. Exploring three dimensions of learning, I argue that the existence of prison-less places brings balance to these dimensions and is crucial for learning to occur inside prisons. The New Cja Form 24: Protecting Indigent Criminal Appellants’ Rights, Gabriel J. Chin, Hannah Bogen

This essay describes how the Judicial Conference of the United States elected to reform the provision of transcripts to indigent persons appealing criminal convictions in federal court. A conviction cannot be appealed without a transcript, but, by definition, indigent persons cannot afford to purchase them. A series of Supreme Court decisions held that indigent persons had to be provided transcripts without charge. However, the practical implementation of that right was blocked. In the federal system, appointed counsel had to request production of transcripts using Criminal Justice Act Form 24. That form required special permission for the court reporter to produce …

Due process guarantees lie at the heart of any legitimate legal system, serving as a critical safeguard against arbitrary state power and as a foundation for the rule of law. Yet their meaning and implementation vary significantly across legal traditions and political contexts.
This article examines the scope and limitations of due process guarantees in the Middle East, focusing on Egypt and Saudi Arabia as illustrative case studies. While both jurisdictions formally recognize procedural protections within their constitutional and legal frameworks, the practical application of these guarantees often diverges from international standards.

บทความนี้วิเคราะห์ผลลัพธ์ของนโยบาย “Transforming Rehabilitation” ซึ่งเป็นการปฏิรูปโครงสร้างงานคุมประพฤติในสหราชอาณาจักรโดยให้ภาคเอกชนเข้ามามีส่วนร่วมในการดำเนินงาน ภายใต้ความประสงค์ในการลดอัตราการกระทำผิดซ้ำ เพิ่มประสิทธิภาพในการปฏิบัติงาน และเสริมสร้างนวัตกรรมในการบริหารจัดการผู้กระทำผิด การปฏิรูปนี้ได้มอบหมายหน้าที่โดยให้บริษัทเอกชนที่เป็นผู้รับผิดชอบในการดูแลผู้กระทำผิดที่มีความเสี่ยงต่ำถึงปานกลางผ่านวิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชน (Community Rehabilitation Companies) ในขณะที่หน่วยงานคุมประพฤติแห่งชาติ (National Probation Service) ยังคงรับผิดชอบผู้กระทำผิดที่มีความเสี่ยงสูง การประยุกต์ใช้เครื่องมือทางการเงิน เช่น “ค่าตอบแทนตามการให้บริการ” และ “การจ่ายเงินตามผลลัพธ์” ถูกนำมาใช้เพื่อดึงดูดการลงทุนจากภาคเอกชนและคาดหวังว่าจะเกิดนวัตกรรมด้านเทคโนโลยี จากการศึกษาพบว่าผลการดำเนินงานตามแผนปฏิรูปไม่เป็นไปตามเป้าหมายที่กำหนด ผู้ให้บริการเอกชนไม่สามารถจัดทำบริการเพื่อสนับสนุนการกลับคืนสู่สังคมได้อย่างเพียงพอ ส่งผลให้ผู้กระทำผิดที่ได้รับการแก้ไขฟื้นฟูไม่ได้รับความช่วยเหลือ การให้บริการงานคุมประพฤติขาดความคิดริเริ่มใหม่ และมาตรฐานงานและคุณภาพลดลง ซึ่งสาเหตุหลักเกิดจากการขาดการทดลองนำร่องที่เพียงพอก่อนการขยายผล รวมถึงข้อบกพร่องในกระบวนการประเมินความเสี่ยง ปัญหาทางการเงินทำให้วิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนหลายแห่งล้มละลาย ผลกระทบต่อเสถียรภาพของงานคุมประพฤติและความเชื่อมั่นของประชาชนที่ลดลง จนกลายเป็นปัจจัยให้แนวคิดการลงโทษได้รับความนิยม ขณะที่แนวทางการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนถูกลดบทบาทลง บทความเสนอแนวทางแก้ไขที่สำคัญ ได้แก่ การจำกัดบทบาทของภาคเอกชนให้เป็นเพียงผู้สนับสนุนงานคุมประพฤติ เสริมสร้างความแข็งแกร่งให้กับหน่วยงานคุมประพฤติแห่งชาติในฐานะผู้ให้บริการในการจัดทำงานคุมประพฤติ และการออกแบบเครื่องมือทางการเงินใหม่ที่สร้างแรงจูงใจและส่งเสริมการมีส่วนร่วมของภาคีเครือข่ายและภาคประชาชน นอกจากนี้ บทความยังเสนอแนะให้มีการนำร่องอย่างเป็นระบบเพื่อให้สามารถประเมินความเสี่ยงได้อย่างแม่นยำ และสร้างกลไกการกำกับดูแลที่มีประสิทธิภาพ เพื่อรักษาคุณภาพบริการและสร้างความเชื่อมั่นต่องานคุมประพฤติอย่างยั่งยืน

This article revisits the author’s Laws of Race/Laws of Representation: The Construction of Race and Law in Contemporary American Film, 11 Univ. Tex. Rev. of Sports and Ent. L. 219 (2010), surveying recent developments in mainstream films’ depiction of the interrelated narratives of law and race. This article applies to current film the 2010 article’s paradigm, which articulated three key narrative aspects of depictions of race and law in popular film: 1.) the raced construction of the lawyer-hero; 2.) the denial or displacement of the law’s role in constructing race and race-based discrimination; and 3.) the suppression or revision of …

The government has long involved itself in the world of sports. The Sports Bribery Act, and similar state laws, prohibit the bribery of any athlete, coach, official, or other participant with the intent of manipulating the outcome of a sporting event. Importantly, these laws require prosecutors to convince a jury beyond a shadow of a doubt that an athlete acted with intent, with the specific knowledge or purpose, to influence the outcome of a sporting event. This paper will argue that while acts of sports manipulation are certainly morally blameworthy acts, they are not acts that should be regulated by …

The Trafficking Victims Protection Act (TVPA) defines sex trafficking as the “recruitment, harboring, transportation, provision, or obtaining of a person for the purpose of a commercial sex act.” When the trafficking involves resident minors within the United States, the act is referred to as domestic minor sex trafficking (DMST). However, because DMST enmeshment often involves elements of criminal activity, a minor may be implicated as a recruiter in friend-type trafficking, and a third-party trafficker is not required to constitute sex trafficking involving minors, the designation of “survivor” or “criminal” remains complicated in many cases. Artificial intelligence (AI) has rapidly crept into nearly all aspects of life, including in government, the criminal justice system, and policing. While Supreme Court Due Process jurisprudence has outlined certain boundaries for police interrogations, much police conduct is left for the states to regulate. Such regulation is sporadic and less restrictive than the public might assume, especially in the realm of police deception. Across jurisdictions, courts allow police to deceptively inform suspects that a witness identified the suspect of the perpetrator of a crime. In 2016, Hillary Clinton was the first woman to gain the presidential nomination from a major political party in the United States, yet she was unsuccessful. The current study explores barriers to being elected as president for women generally and Hillary Clinton specifically. Using the propositions and tools of affect control theory, we demonstrate how women’s political representation shapes cultural sentiments about women and the president. In a nationwide sample of Americans surveyed shortly before the election, we find women’s representation on the state level influences voter preferences through these cultural sentiments: More women in politics makes a woman president …

Gun-related juvenile homicides continue to be a critical public health and social issue, disproportionally affecting African American males aged 17. Prior research identified poverty, neighborhood violence, individual and familial risks, gang affiliation, and inadequate education as contributors to the increase in juvenile gun-related homicides. In this study, the relationship between gun-related juvenile homicides and poverty, violent crimes, and gang affiliation were examined from 2019 to 2023 in 66 counties within South Georgia. Background Sexual minority (lesbian, gay, bisexual, queer and other non-heterosexual) people experience significant disparities in addiction problems compared with heterosexual people. Aims We aimed to answer the question, what are the barriers and facilitators to accessing drug/alcohol addiction treatment services for sexual minority adults?’. The discipline of students has long been an issue in schools. Children and teenagers are just that, and they will misbehave. However, the discipline gap clearly indicates that responses to misbehavior are different for different students (Lorenzetti & Johnson, 2023; Santiago-Rosario et al., 2021). Administrative burden describes the learning costs, psychological costs, and compliance costs people face when attempting to interface with the government, particularly in seeking a benefit. Algorithmic and automated processes offer the potential of reducing administrative burdens, but scant empirical research has determined to what, if any effect. Background: Firearm secure storage (ie, storing firearms unloaded and locked) is recommended to reduce unintentional injuries and suicides. However, the relationship between psychological states, such as social isolation, and firearm secure storage practices is under-researched.
Methods: Data are from 7136 individuals with firearms in their households from the 2022 Behavioral Risk Factor Surveillance System. Multinomial logistic regression was used to explore the relationship between social isolation and firearm storage.
Results: Among respondents, 71.6% reported storing firearms unloaded, 14.2% stored firearms loaded and locked and 14.2% stored firearms loaded and unlocked. Most respondents reported feeling 'never' (40.7%) or 'rarely' (33.3%) socially …

This study explored the intersection of racialized media narratives, nonprofits, and penal policy through a case study of Just City, a nonprofit criminal justice organization located in Shelby County, Tennessee. Through the lens of Just City, this study explored how nonprofits resist racialized media narratives regarding crime and how in turn this contributes to penal policy reforms. This is accomplished using a thematic analysis to draw larger conclusions from coding Just City’s Instagram and through extensive interviews with Just City staff and local Shelby County and Tennessee politicians. Mental health disorders are prevalent in children and adolescents, and they are accompanied by challenges throughout the lifespan. Mental health literacy (MHL) provides a flexible framework to address child and adolescent mental health. Identifying significant relationships between MHL and mental health outcomes has the potential to inform successful interventions. This study uses a secondary analysis of data gathered for the Study on Attitudes of Adolescents and Young Adults Toward Relevant Health Issues to isolate MHL belief domains that significantly effect psychological distress levels in adolescents.

The prominent issue of racial disparities in arrest in the criminal justice system is well documented. One proposed mechanism for addressing these disparities in the criminal justice system is the emergence of progressive prosecutors. Progressive prosecutors are vastly different than traditional prosecution through the approach to their roles in the criminal justice system. Traditional prosecutors prioritize convictions and punishment, often seeking maximum sentences for defendants and relying on the traditional model of tough-on-crime policies. Progressive prosecutors pledge to reform the criminal justice system by declining to prosecute certain low-level offenses, expanding diversion programs, and explicitly addressing racial and socioeconomic disparities. …

This thesis examines the development and involvement of the SVOD platform Netflix in Romania in the context of a global media corporation engaging with a local market. Romania’s status as a former communist country acts as a good case study highlighting the long-term consequences of diverse content deprivation. I argue that in a country such as Romania, a service like Netflix can provide a so-called indirect intercultural exchange through the production and distribution of easily accessible diverse content, whether that diversity stems from nationality, ethnicity, race, sexuality, or any unconventional form of expression that was restricted or censored in the …
