The Need For An Innocence Network In Texas., Matthew D. Sharp Mar 2005

The Need For An Innocence Network In Texas., Matthew D. Sharp

The Scholar: St. Mary's Law Review on Race and Social Justice

Texas must establish an innocence network to ensure crime lab accountability standards are enforced. The multitude of crime lab scandals around the United States demonstrate why the current system of accountability, self-policing, should be reimagined as one more similar to that of a manufacturer and a consumer. Like manufacturers, crime labs are in the best position to ensure the accuracy of any results. Reshaping the system of accountability in this way would ensure that those responsible for handling evidence, handle it with the utmost care and provide accurate results. Innocence Projects generally adhere to one of three different organizational paradigms. …

Assessing The Counterfactual: The Efficacy Of Drug Interdiction Absent Racial Profiling, Katherine Y. Barnes Mar 2005

Assessing The Counterfactual: The Efficacy Of Drug Interdiction Absent Racial Profiling, Katherine Y. Barnes

Duke Law Journal

This Article investigates the costs and benefits of racial profiling in the context of drug interdiction. I begin by reviewing the empirical economic and civil rights literature regarding the existence and rationality of racial profiling and then build an explicit model of a trooper's decision to search a stopped vehicle. Estimating the model using stop and search data from a portion of Interstate 95 in Maryland, I find that the Maryland State Police use the motorist's race as a factor in deciding which stopped vehicles to search. This result persists even after controlling for many other descriptive variables that impact …

The Innocence Protection Act Of 2004: A Small Step Forward And A Framework For Larger Reforms, Ronald Weich Mar 2005

The Innocence Protection Act Of 2004: A Small Step Forward And A Framework For Larger Reforms, Ronald Weich

All Faculty Scholarship

Passage of the Innocence Protection Act in the closing days of the 108th Congress was a watershed moment. To be sure, the bill that finally became law was a shadow of the more ambitious criminal justice reforms first championed five years earlier by Senator Pat Leahy, Congressman Bill Delahunt and others. But the enactment of legislation designed to strengthen — not weaken — procedural protections for death row inmates was rich in symbolic importance and promise.

Writing in the April 2001 issue of THE CHAMPION (Innocence Protection Act: Death Penalty Reform on the Horizon), I said optimistically: "The criminal justice …

Bougainville Community Crime Trends: A Survey Of Crime In Arawa And Buka, Mark Findlay, Gerard Guthrie, Fiona Hukula, James Laki Mar 2005

Bougainville Community Crime Trends: A Survey Of Crime In Arawa And Buka, Mark Findlay, Gerard Guthrie, Fiona Hukula, James Laki

Research Collection Yong Pung How School Of Law

The fundamental difference in the role of the state in the recent histories of Arawa and Buka is critical to understanding community attitudes to crime and policing. In Arawa, the state was entirely absent for over 10 years during the civil war and community-based agencies provided the sole source of authority and social control. In Buka, the state remained in control in difficult circumstances. The peace process was based around indigenous dispute resolution techniques and now a role for the state is being gradually reintroduced into post-conflict Bougainville, including of policing services to Arawa. The differences in the recent histories …

The Milosevic Trial - Live: An Iconical Analysis Of International Law's Claim Of Legitimate Authority, Maya Steinitz Mar 2005

The Milosevic Trial - Live: An Iconical Analysis Of International Law's Claim Of Legitimate Authority, Maya Steinitz

Faculty Scholarship

It has been argued that international law has recently "come of age", that it is a fully-fledged legal system like any other. It has also been argued that in order for a normative system to qualify as "law" it must, at the least, claim to possess legitimate authority and to be supreme to other normative systems. This article examines one highly visible development in international law - the criminal war trials - from a sociological perspective, trying to discern whether and how international law claims legitimate authority and supremacy. Specifically, it focuses on a deeply symbolic example of international criminal …

Killing The Willing: "Volunteers," Suicide And Competency, John H. Blume Mar 2005

Killing The Willing: "Volunteers," Suicide And Competency, John H. Blume

Michigan Law Review

When my client Robert South decided to waive his appeals so that his death sentence could be carried out, I understood why he might make that choice. Robert had a brain tumor that could not be surgically removed. Though not fatal, the tumor disrupted his sleep/wake cycle and had other negative physical consequences, including severe headaches, for his daily existence. He also had chronic post-traumatic stress disorder ("PTSD"), resulting from a profound history of childhood physical, emotional and sexual abuse. Robert suffered from daily recurrent flashbacks of the abuse. He had been on death row for almost a decade, and …
