Nature/Culture Clash: The Transnational Trade In Gmos, Dayna Scott Jan 2005

Nature/Culture Clash: The Transnational Trade In Gmos, Dayna Scott

All Papers

This paper aims to offer a fresh perspective into what is at stake in the cross-cultural trade dispute over genetically-modified organisms (GMOs) by subjecting a particular discursive sample, the parties’ submissions to the WTO panel, to critical scrutiny. The first step involves a survey of the rhetorical strategies deployed by the parties’ in the presentation of their arguments to the Panel. Next, I embark on the task of ‘disassembling the double helix’. My use of the term ‘double helix’ in this analysis refers to the close coupling of scientific and legal discourses in the trade regime: science and law are …

Rediscovering Williston, Mark L. Movsesian Jan 2005

Rediscovering Williston, Mark L. Movsesian

Faculty Publications

This Article is an intellectual history of classical contracts scholar Samuel Williston. Professor Movsesian argues that the conventional account of Williston's jurisprudence presents an incomplete and distorted picture. While much of Williston's work can strike a contemporary reader as arid and conceptual, there are strong elements of pragmatism as well. Williston insists that doctrine be justified in terms of real-world consequences, maintains that rules can have only presumptive force, and offers institutional explanations for judicial restraint. As a result, his scholarship shares more in common with today's new formalism than commonly supposed. Even the under-theorized quality of Williston's scholarship—to contemporary …

A Commander's Power, A Civilian's Reason: Justice Jackson's Korematsu Dissent, John Q. Barrett Jan 2005

A Commander's Power, A Civilian's Reason: Justice Jackson's Korematsu Dissent, John Q. Barrett

Faculty Publications

Robert Houghwout Jackson was a justice of the United States Supreme Court during the years of World War II. This article considers his great but potentially perplexing December 1944 dissent in Korematsu v. United States, in which he refused to join the Court majority that proclaimed the constitutionality of military orders excluding Japanese Americans from the West Coast of the United States during the War years. This article considers Justice Jackson's Korematsu dissent in full. It was and is, contrary to some of the criticisms it has received over the past 60 years, a coherent position. Jackson's dissent is also …

Flinging The Museum Guide Far Outside The Doctrinal Window, Larry M. Taylor Jan 2005

Flinging The Museum Guide Far Outside The Doctrinal Window, Larry M. Taylor

Reconstruction: Studies in Contemporary Culture

[First paragraph]

It may very well be easier to learn rather than to unlearn. Modes of learning quickly become habit forming; habits tend to become deeply ingrained and die hard. In the visual art world the roles that curator and viewer play can become routine and effectively cloud one's aesthetic vision like so much residue on the Sistine Chapel ceiling. Reorienting the viewer's visual experience and taming the curator's heavy hand are among the aims of Barbara Kendrick and Timothy van Laar in Losing the Instructions, a two person installation at the Sheldon Memorial Art Gallery in Lincoln, Nebraska. …

Analysis Of One Structured Fitness Motivation Intervention On Self-Efficacy, Achievement Goal Orientations And Exercise Adherence In Sedentary And Moderately Active Adults, Matthew R Martin Jan 2005

Analysis Of One Structured Fitness Motivation Intervention On Self-Efficacy, Achievement Goal Orientations And Exercise Adherence In Sedentary And Moderately Active Adults, Matthew R Martin

UNLV Retrospective Theses & Dissertations

Currently, many Americans spend extended periods of time in sedentary activities, potentially contributing to a variety of health concerns such as obesity and the onset of many chronic diseases. Given this widespread societal challenge, and using intact university undergraduates as a study sample, this dissertation research first provided descriptive information concerning psychological characteristics of physical appearance self-efficacy and goal orientation as potentially correlated with exercise adherence behavior. A second purpose of this research examined how known effective behavior analytic interventions of instructor-set goals/modeling, public posting, and peer-feedback might affect the research sample's exercise adherence behavior, and might affect linked psychological …

An Empirical Test Of Stakeholder Influence Strategies Model: Evidence From Business Downsizing In Taiwan , Philip C.F. Tsai, C. Rosa Yeh, Shu-Ling Wu, Ing-Chung Huang Jan 2005

An Empirical Test Of Stakeholder Influence Strategies Model: Evidence From Business Downsizing In Taiwan , Philip C.F. Tsai, C. Rosa Yeh, Shu-Ling Wu, Ing-Chung Huang

Purdue CIBER Working Papers

Frooman’s (1999) model of stakeholder influence strategy uses levels of resource dependence to determine the power of stakeholder influence. Our study provides initial empirical tests of his model applied in business downsizing. Data from 18 recently downsized firms in Taiwan, including 9 multi-national firms (MNC’s), were plotted against the Frooman model. We found that resource-dependence along as Frooman theorized could not explain the influence strategies stakeholders (in this case the employees) took in response to firms’ downsizing decisions. Further investigation revealed that the institutional factors had a significant effect on how firms structured their downsizing initiatives and hence changed the …

2005 Rosabeth Moss Kanter Award For Excellence In Work-Family Research Publication, Shelley M. Macdermid, Andrea Wittenborn

Center for Families Publications

Over the past few decades there has been an explosion of research on the relationships between work and non-work life. Researchers studying these issues come from many disciplines and professions, resulting in fragmented awareness of one another's work. In addition, exchanges of research information among scholars, consultants and corporate practitioners are limited. Many research studies are not well-grounded in theory, slowing the generation of new knowledge. As a result, it has been difficult to develop shared standards for research quality and to avoid redundance in the research literature. Some excellent studies have failed to have impact because of lack of …

Child Care For Working Poor Families: Child Development And Parent Employment Outcomes, James Elicker Jan 2005

Child Care For Working Poor Families: Child Development And Parent Employment Outcomes, James Elicker

Center for Families Publications

The results of the Community Child Care Research Project provide data describing the child care experiences of low income working families in 4 urban communities in Indiana. Because the study participants were volunteers rather than randomly selected, conclusions drawn from these findings necessarily have limitations. Despite these limitations, the research results do represent the experiences of more than 300 low income working families, their children, and their child care providers. The results suggest a number of key issues that need further investigation by policy makers and researchers. Many children in this sample scored lower than established norms in areas of …

Modernism’S Jews / Jewish Modernisms: Introduction, Maren Linett Jan 2005

Modernism’S Jews / Jewish Modernisms: Introduction, Maren Linett

Department of English Faculty Publications

This special issue, as its title suggests, considers some of the processes by which Jewish writers shaped literary modernism, and the intricate ways modernism was in turn shaped by its figurings of Jews and Jewishness. Although analysis of the political and aesthetic work Jewishness performs for modernist literature is beginning to make its way into studies of modernist negotiations with race, culture, and religion, it is still primarily seen as a side-topic within such inquiries, something to be explored only by those with a “special interest” in Jewish studies. This compartmentalization causes critics to miss the importance of Jewishness as …

Classroom Observations Of Attention-Deficit/Hyperactivity Disorder: Patterns And Characteristics Of Attention Over Time, Thomas M. Timko Jr. Jan 2005

Classroom Observations Of Attention-Deficit/Hyperactivity Disorder: Patterns And Characteristics Of Attention Over Time, Thomas M. Timko Jr.

Electronic Theses and Dissertations

Investigated differences in attentional processes between children diagnosed with Attention-Deficit/Hyperactivity Disorder (ADHD) and their classroom peers. Models of attention gleaned from laboratory experiments provided a theoretical structure for hypothesizing between-group attentional differences. Seventy-five children with ADHD and 36 normal control children were observed in their regular classrooms over a 1-week time interval. Explication of between-group differences revealed that children with ADHD were approximately 21% less attentive on average. Both groups exhibited an accelerating-decelerating pattern of attention over time, however, children with ADHD cycled at a rate twice that of same-aged peers. Six variables derived from observed attention were examined for …

A Comparative Analysis Of Job Competency Expectations For New Hires: The Relative Value Of A Hospitality Management Degree, Peter Ricci

Electronic Theses and Dissertations

This study compared lodging managers' job competency expectations for newly hired employees in possession of four-year (baccalaureate) degrees from a college or university. Lodging managers mentally separated new hires into two distinct categories when rating the importance of specific job competencies: 1) new hires in possession of a hospitality management baccalaureate degree, and 2) new hires in possession of a non-hospitality management baccalaureate degree. Lodging managers who were current members of the Central Florida Hotel & Lodging Association (CFHLA) at the time of the survey participated and all were employed in the central Florida area at the time of the …

An Inquiry Into Discourse Choices As Indicators Of Gender Attitudes In A Non-Profit Conservative Christian Business, Dawn Marie Kruger Jan 2005

An Inquiry Into Discourse Choices As Indicators Of Gender Attitudes In A Non-Profit Conservative Christian Business, Dawn Marie Kruger

Electronic Theses and Dissertations

This paper is an inquiry into the discourse styles of men and women who work together in a conservative Protestant Christian business. Many conservative Protestant Christian churches teach that the Bible forbids women from holding positions of authority over men. Yet in the communications department of this particular business, women fill the top three management positions, supervising a mixed-gender staff of 15. Research has shown that men and women subconsciously use language markers that indicate personal attitudes toward the same and the opposite genders. This research project draws on that information while it analyzes the oral and electronic discourse of …

Risk Factors For Adult Victimization Among Florida's Homeless Women, Rebecca Michelle Weichsel Jan 2005

Risk Factors For Adult Victimization Among Florida's Homeless Women, Rebecca Michelle Weichsel

Electronic Theses and Dissertations

Much of the existing research on violence against homeless women has concluded that homeless women are particularly vulnerable to violence and experience victimization at rates often exceeding the rates of housed women. Little research, however, has focused upon the specific risk factors that expose homeless women to physical assault, rape, and stalking. Utilizing a sample of 737 homeless women from the Florida cities of Orlando, Jacksonville, Tampa, and Miami, this study investigated the risk factors for experiencing adult personal victimization. The characteristics of homelessness, demographics, drug and alcohol use, subsistence activities, childhood victimization, mental health status, and criminal activities were …

The Maintenance Of Ethnic Culture And Manifestations Of Ethnic Identity In The Life Stories Of Finnish Immigrants, Minna Grantham Jan 2005

The Maintenance Of Ethnic Culture And Manifestations Of Ethnic Identity In The Life Stories Of Finnish Immigrants, Minna Grantham

Electronic Theses and Dissertations

This study examined whether Finnish immigrants show evidence of assimilation or if they have maintained their ethnic culture in the United States. More specifically, the purpose was to examine how the ethnic culture has been maintained and the ways that ethnic identity manifests itself in their life stories. Ten qualitative, semi-structured interviews were conducted with Finnish immigrants and children of Finnish immigrants, and emerging themes were identified in the data. The results indicate a strong ethnic identity among Finnish immigrants, yet it appears to be a very much taken for granted experience for them. The immigrants' lives were influenced by …

Collective Teacher Efficacy And Reading Achievement For Hispanic Students In Reading First And Non-Reading First Schools In Southwest Florida, Larry Hylemon

Electronic Theses and Dissertations

This study examined explicit and systematic reading instruction for Hispanic, limited English, lower SES students in a southwest Florida school district. Additionally, collective teacher efficacy was assessed to determine if differences existed between a Reading First and a non-Reading First school. A total of 68 students participated in the study and were divided equally between a Reading First and non-Reading First school. While the Reading First school concentrated resources on grades 2 and 3, all students received some degree of Reading First strategies. Available reading measures for analyses at the time of the study included the Group Reading Assessment and …

The Literacy Experiences Of Ninth-Graders And Their Teacher In An English Language Arts Workshop, Elizabeth Scanlon

Electronic Theses and Dissertations

The question guiding this qualitative study was: What are the literacy experiences of ninth-grade students in an English language arts workshop classroom? This study is an autoethnography and it chronicles six months in my ninth grade English classroom where I played the role of observant participant. It examines the process of reading and writing and how my perspective as a reader and a writer shapes my curricular decisions and influences my students as readers and writers.
