The Sacred Way Of Tibetan Crt Kung Fu: Can Race Crits Teach The Shadow's Mystical Insight And Help Law Students "Know" White Structural Oppression In The Heart Of The First-Year Curriculum? A Critical Rejoinder To Dorothy A. Brown, Reginald Leamon Robinson Jan 2005

Brown, Reginald Leamon Robinson

Michigan Journal of Race and Law

Part I of this Article uses a quasi-parable, in which Dorothy Brown is a Tibetan Master who teaches law students CRT Kung Fu, the monastic fighting skills by which they will acquire the Shadow's mystical insight to "know" the heart of the first-year curriculum. Part II challenges the organizing principles and content on which Brown's Critical Race Theory purports to critically interrogate traditional legal doctrine, applying a New Age Philosophical critique as well as agency theory to crack dealing in Spanish Harlem. I use this case study to argue that crack dealers deliberately and purposefully choose extra-legal economic opportunities, even …

Part I explains the history of American copyright law and its theoretical underpinnings. Part II relates common Black musical traditions in more detail. Part III illustrates how the foundations of Black musical traditions can be found in Negro Spirituals. Part IV outlines the notion of Black music as it evolved in ragtime. Part V describes how copyright undermined the traditions of blues, jazz, and R&B. Part VI explains how rock 'n' roll's prominence …

Si Se Puede, But Who Gets The Gravy?, Richard Delgado Jan 2005

Si Se Puede, But Who Gets The Gravy?, Richard Delgado

Michigan Journal of Race and Law

In this piece, the author writes in two alternating voices: the voice of rap and the voice of standard academic discourse. The rap passages are rude, direct, even raunchy, while the prose passages are rendered in academic English. This dichotomy is intentional: Rap represents the voice of the people, the voice from below, the voice of those who live in neighborhoods filled with broken glass, an impatient, insurgent voice that bears little in common with the complex, jargon-filled sentences of most contemporary left discourse. The latter voice, in my view, has become too detached from that of our many constituents …

From Race To Class Struggle: Re-Problematizing Critical Race Theory, E San Juan Jr. Jan 2005

From Race To Class Struggle: Re-Problematizing Critical Race Theory, E San Juan Jr.

Michigan Journal of Race and Law

The misconstrual of "class" as a theoretical and analytic concept for defining group or individual identity has led, especially during the Cold War period, to its confusion with status, life-style, and other ideological contingencies. This has vitiated the innovative attempt of CRT to link racism and class oppression. We need to reinstate the Marxist category of class derived from the social division of labor that generates antagonistic class relations. Class conflict becomes the key to grasping the totality of social relations of production, as well as the metabolic process of social reproduction in which racism finds its effectivity. This will …

After Georgia V. Ashcroft: The Primacy Of Proportionality, Felix B. Chang Jan 2005

After Georgia V. Ashcroft: The Primacy Of Proportionality, Felix B. Chang

Michigan Journal of Race and Law

This Note argues that the majority in Ashcroft have left courts with an unadministerable standard-not so much for reasons that Justice Souter articulated in his dissent, but rather because the Court provided no guidance on navigating around the myriad of factors in the convoluted totality analyses. In the face of this uncertainty, lower courts will rely increasingly on the proportionality standard of Johnson v. De Grandy, which marked the midpoint in the judicial shift from Justice Brennan's worldview to Justice O'Connor's world-view. Part I examines two cases after Ashcroft which represent different degrees of racial vote dilution: Shirt v. …

Deference, Denial, And Exclusion: Men Talk About Contraception And Unintended Pregnancy, Scott D. Johnson, Lindy B. Williams Jan 2005

Deference, Denial, And Exclusion: Men Talk About Contraception And Unintended Pregnancy, Scott D. Johnson, Lindy B. Williams

Rhetoric and Communication Studies Faculty Publications

Individual in-depth interviews were conducted with 20 men, ages 21-48, who have fathered at least one unintended pregnancy. The goal of the interviews was to explore the experiences of these men with unintended pregnancy, their communication with partners and others, contraceptive beliefs and practices, their relationships with their partners, and the outcomes and consequences of the unintended pregnancies. This essay describes results derived from their comments regarding their contraceptive practices and the pregnancy-outcome decisions, with thematic analysis used to identify prominent themes from participant comments. Two strong themes, "deference" and "denial," and one lesser theme, "exclusion," emerged from participant responses. …

Behavioral Economics And Institutional Innovation, Robert J. Shiller Jan 2005

Behavioral Economics And Institutional Innovation, Robert J. Shiller

Cowles Foundation Discussion Papers

Behavioral economics has played a fundamental role historically in innovation in economic institutions, even long before behavioral economics was recognized as a discipline. Examples from history, notably that of the invention of workers’ compensation, illustrate this point. Though scholarly discussion develops over decades, actual innovation tends to occur episodically, particularly at times of economic crisis. Fortunately, some of the major professional societies, the Verein für Sozialpolitik, the American Economic Association and their successors, have managed to keep a broad discourse going, involving a variety of research methods including some that may be described today as behavioral economics, thereby maintaining an …

The Perceptions Of Muslim International Students On The Roles Of Muslim Women, Kevin Vicker

Masters Theses

The purpose of the present study was to examine perspectives of Muslim international students on the roles of Muslim women based upon the length of the students' exposure to Western societal culture and values. No research specifically analyzed Muslim international students' perceptions regarding Muslim women. The present study was conducted using in-depth life history interviews with four devout Muslim international students. The sample included two students from Pakistan, one …

Crime, Punishment, And Prevention: An Economic Approach, Jeff Arthur Jan 2005

Crime, Punishment, And Prevention: An Economic Approach, Jeff Arthur

Masters Theses

Gary Becker's seminal paper laid the foundation for the economic analysis of crime. Using this framework, the government has attempted to increase the costs of crime to a level that effectively deters individuals from criminal activity. Despite the relative lack of discussion in economics, Becker's model suggests alternatives to deterrence. Instead of focusing exclusively on increasing the costs of crime, society can increase the benefits of lawful behavior. Rather than punish the crook, reward the citizen. The purpose of this research is to compare the relative effectiveness of prison and police expansion with prevention programs. Prevention programs aimed at increasing …

Cultural And Individual Influences On Foreign Policy, Emine Sunduz Demir Jan 2005

Cultural And Individual Influences On Foreign Policy, Emine Sunduz Demir

Masters Theses

The principle aim of this thesis is to examine how strategic culture affects foreign policy decision-making, as contrasted to the particular decree of influence the individuals have on the foreign policy process in the concept of an immediate extended deterrence. This thesis is based on three case studies that are tested separately using both Cha's notion of strategic culture and Allison's Bureaucratic Politics Model in order to find which model (if any) best explains foreign policy decision making. Cases are: The SemiVietnamese War in 1979 and Deng Xiaoping, the Taiwan Strait Crisis in 1996 and Jiang Zemin, and the Kosovo …

Burnout And Job Dissatisfaction Among Practicing Illinois School Psychologists: A 1994 To 2004 Comparison, Nikolaus J. Hoffman

Masters Theses

The purpose of this study was to identify the primary variables associated with burnout among practicing Illinois school psychologists. More specifically, the purpose was to determine if the same variables that correlated highly with Illinois school psychologists burnout levels in a 1994 study by Niebrugge have held constant over the last decade. Survey materials used in the 1994 study, including the Maslach Burnout Inventory, a School Psychologists Stress Inventory, and a specially designed job satisfaction questionnaire were completed by a random sample of members of the Illinois School Psychologists Association (N = 52). As in the 1994 study, results suggested …

Review Of The Book Gender In Applied Communication Contexts, Anjali Ram Jan 2005

Review Of The Book Gender In Applied Communication Contexts, Anjali Ram

Arts & Sciences Faculty Publications

The best scholarship on gender is one that translates readily into advocacy, action, and intervention without blunting its theoretical teeth. The repertoire of 14 articles and four commentaries included in the book “Gender in Applied Communication Con-texts,” edited by Patrice M. Buzzanell, Helen Sterk, and Lynn H. Turner, clearly demonstrate a commitment to feminist praxis, while retaining a focus on theoretical engagement. Topics range from sexual harassment and breast cancer to telecommuting, mothering, and feminist pedagogy, as the authors in this collection attempt to address directly how gender is constructed and implicated in varied communication contexts.

Examining Compliance With Fiduciary Duties: A Study Of Real Estate Agents (With V. Carlos Slawson Jr.), Royce De R. Barondes, Carlos V. Slawson Jr.

Faculty Publications

The traditional default rule in the United States has been that, where two brokerage firms participate in the sale of a piece residential real estate, both firms are fiduciaries of the seller. This article provides original empirical evidence showing to be erroneous a common assumption - that, in conflicts between their principals and third parties, real estate agents promote their principals' interests - underlying revisions made in a number of jurisdictions to those principles in the last twenty years. This article examines whether agents act in accordance with their duties along two dimensions: First, we hypothesize that selling agents may …

Truth Or Consequences In Legal Scholarship?, David R. Barnhizer Jan 2005

Truth Or Consequences In Legal Scholarship?, David R. Barnhizer

Law Faculty Articles and Essays

There has been an erosion of the ideal of truth as a guiding force for what we do. This includes a dishonoring of the tradition of the truth-seeking function of scholars. For the university-based intellectual, including legal scholars, the problem with commitments to ends other than truth-seeking is that once we accept a mission distinct from the pursuit of truth and honest discourse, most of the remaining options are suspect - including falseness, hypocrisy, self-deception, subordination of self to a collective, profit, dogmatism, devotion to tradition, and propaganda.

Although what we intend by the idea of truth - legal, scientific, …

Harvard Extension School (HES), which is part of a selective, elite institution: Harvard University. The educational research in the US is sparse on adult, working-class, liberal arts, students. Indeed, these students' experiences go mostly undocumented due to the agreed upon conclusion that adult students, in general, and working-class students, in particular, are more interested in job …
