Theses, Dissertations and Capstones

Throughout the world media reports of airplanes crashing into the Twin Towers in New York City and the Pentagon in Washington D.C made the front page of every paper almost instantly after September 11, 2001. This unprecedented media event led to the generation of certain key questions in the ways in which the media reports on terrorism. This research is concerned with the ways in which the U.S media has responded to the 9- 11 terrorist attacks through time and space. In examining how U.S based media responds to terrorist attacks we can begin to understand if this response is …

Necklaces Used In The Santería Of Cuba, Lourdes S. Domínguez Jan 2005

Necklaces Used In The Santería Of Cuba, Lourdes S. Domínguez

BEADS: Journal of the Society of Bead Researchers

This article examines the necklaces used in the Afro-Cuban Rule of Orisha, more commonly known as Santería. This religion, created by African slaves brought to Cuba starting in the 16th century, combines aspects of Yoruba orisha worship and Spanish Catholicism. It allowed African religious beliefs and practices to survive despite the imposition of Catholic doctrine. One of the outcomes of this amalgamation is the practice of associating individual orishas (deities) with certain Catholic saints. Each orisha is represented by specific necklaces that incorporate particular bead forms, colors, and numbers.

Reflecting On The Rule Of Law, Its Reciprocal Relation With Rights, Legitimacy And Other Concepts And Institutions, Samuel J.M. Donnelly Jan 2005

Reflecting On The Rule Of Law, Its Reciprocal Relation With Rights, Legitimacy And Other Concepts And Institutions, Samuel J.M. Donnelly

Syracuse Journal of International Law and Commerce

When bringing social science to the study of law, understanding the role of law in the process of social change is central. The great American example of social change influenced by law begins, of course, with the end of our Civil War, the freeing of the slaves, and continues through the establishment of segregation, the attacks upon it, desegregation and the development of affirmative action. May I suggest that another very important sequence of legal and social changes is the development and recognition of human rights in the European Union since · World War 11. In the first part of …

Legal Realism, Common Courtesy, And Hypocrisy, Keith J. Bybee Jan 2005

Legal Realism, Common Courtesy, And Hypocrisy, Keith J. Bybee

College of Law - Faculty Scholarship

In the United States, courts are publicly defined by their distance from politics. Politics is said to be a matter of interest, competition, and compromise. Law, by contrast, is said to be a matter of principle and impartial reason. This distinction between courts and politics, though common, is also commonly doubted - and this raises difficult questions. How can the courts at once be in politics yet not be of politics? If the judiciary is mired in politics, how can one be sure that all the talk of law is not just mummery designed to disguise the pursuit of partisan …

Pluralizing International Criminal Justice, Mark A. Drumbl Jan 2005

Pluralizing International Criminal Justice, Mark A. Drumbl

Scholarly Articles

This Review Essay of Philippe Sands' (ed.) From Nuremberg to the Hague (2003) explores a number of controversial aspects of the theory and praxis of international criminal law. The Review Essay traces the extant heuristic of international criminal justice institutions to Nuremberg and posits that the Nuremberg experience suggests the need for modesty about what criminal justice actually can accomplish in the wake of mass atrocity. It also explores the place of one person's guilt among organic crime, the reality that international criminal law may gloss over criminogenic conditions in its pursuit of individualized accountability, the possibility of group sanction …

Grounding Normative Assertions: Arthur Leff's Still Irrefutable, But Incomplete, "Sez Who?" Critique, Samuel W. Calhoun Jan 2005

Grounding Normative Assertions: Arthur Leff's Still Irrefutable, But Incomplete, "Sez Who?" Critique, Samuel W. Calhoun

Scholarly Articles

The late Professor Arthur Leff believed that standard methods for grounding normative assertions fail to provide a solid foundation for moral judgment because none provides a satisfactory answer to what Leff called the grand 'sez who?' - a universal taunt by which a skeptic may challenge the standing/competency of the speaker to make authoritative moral assessments. Leff argued that as a matter of logic no system of morals premised in mankind alone ever could withstand the taunt. His provocative conclusion was that the only unchallengeable response to the grand 'sez who?' is God sez.

This Article demonstrates the continued relevance …

Task Analysis For Safety Assessment In En-Route Air Traffic Control, Satoru Inoue, Hisae Aoyama, Kota Kageyama, Kazuo Furuta

International Symposium on Aviation Psychology - 2005

The tasks involved in Air Traffic Control (ATC) make heavy demands on the information processing capacities of air traffic controllers. In particular, human factors problems that lead to both major and minor incidents are considered to be a serious problem for ATC in Air Traffic safety. Therefore, the need to analyze error mechanism, which occurs due to complex factors, and the need for developing systems that can deal with these errors are increasing. We examined the functional problems in an ATC system from the human factors aspects, and concluded that solution of this problem needs some kinds of measures. This …

Assessing Human Factors Risks In Air Traffic Management Research, Paul Krois, Jacqueline Rehmann Jan 2005

Assessing Human Factors Risks In Air Traffic Management Research, Paul Krois, Jacqueline Rehmann

International Symposium on Aviation Psychology - 2005

This paper describes guidance for assessing human factors risks of research capabilities. The risk scales in the present study were used to assess concepts of the FAA Target System Description, part of the National Airspace System architecture. Results help identify areas where human factors analyses are needed and strengthen the business case for human factors assessments. Repeated high risk ratings provide R&D managers with additional information about whether or not to proceed with specific capabilities.

What Is The Nature Of Evidence That Makes A Difference To Learning?, John Hattie Jan 2005

What Is The Nature Of Evidence That Makes A Difference To Learning?, John Hattie

2005 - Using data to support learning

The major argument of this presentation is to move the discussion away from data towards interpretations, from student outcomes to teaching successes and improvements, and from accountability models located about schools to located first in the classroom to support such evidence-based teaching and learning. The asTTle model, which has been developed in New Zealand, will be used in the Keynote presentation to demonstrate such a model. By locating evidence in the classroom we can improve the quality of information and interpretations sent to students, parents, Ministries, Ministers, and thence the community. We can influence the major agent that influences student and learning …

American Society And The Rule Of Law, Philip Selznick Jan 2005

American Society And The Rule Of Law, Philip Selznick

Syracuse Journal of International Law and Commerce

I am here to bring some thoughts about my own country's experience in trying to understand the meaning of the rule of law and to make good on its promise. I will have to take up some issues in jurisprudence, and also some aspects of American legal history. I do not apologize for combining jurisprudence and sociology of law, for that combination faithfully reflects what we are trying to achieve in the Jurisprudence and Social Policy Program (JSP) in the Boalt School of Law at the University of California, Berkeley. I begin with some comments on the meaning of the …
